The Judiciary Under The Spotlight: Will Action Now Follow?
A judiciary plenary session last week saw tears flow freely as desperate Kenyans cried in public over how they had suffered in their quest of seeking justice with some taking as long as 33 years in the corridors of justice.
A panel of 14 judges sat and listened to members of the public who accused them of being 'puppets' of the executives. They also mentioned the inaccessibility of the chief justice, Evans Gicheru.
The saddest tale was that of one widow, Margaret Nyakinyua, 63, who broke down while explaining how her case has been pending for the past 16 years and being a land dispute, she can't live a financially stable life.
This stories were not new to the judges who pretended to note the complaints with concern yet many of them were responsible for most of these problems as a result of corruption and laziness among these so called 'distinguished' members of the bench.
The rot and decay in the judiciary is so bad that the plenary session turned into discussions of personal cases instead of tackling broader issues affecting the judiciary like corruption and how it can be dealt with.
Chief Justice Gicheru is already under pressure to resign following his recent orders that all cases against the government can only be filed in the capital city, Nairobi which will make it extremely expensive for upcountry litigants who have issues with the state.
Gicheru also has skeletons in his own closet and many wonder why he has not chosen to pursue those who murdered the late former foreign minister Robert Ouko yet Gicheru himself was among three judges who's sittings in Kisumu to gather information into the mystery was unceremoniously disbanded by former president Moi in 1990.
There were other nagging questions that the plenary session out rightly refused to answer like the recent abortive appointment of three judges yet it is common knowledge that there is an acute shortage of the same in the country.
The so called judicial reforms may have to take a back seat for a while as the minister for justice and constitutional affairs Martha Karua has her hands full at the moment with the contentious issue of whether or not to have minimum reforms before the general elections to be held in December.
They say justice delayed is justice denied and for Stanley Kanona who told the plenary session that his case has been pending for 33 years and he has spent in excess of Sh 1 million or US$ 14,300, he has definitely been denied justice.
However, the saddest part of it is the fact that there are hundreds of others who are in the same predicament as Kanona and will continue to suffer as long as the judiciary remains corrupt and lazy not to mention the influence exerted on it by the executive.

Prostitutes, beggars and the homeless have been cleared from the city streets in a most brutal manner that has provided fodder for the TV stations as images of scantily clad women, men dressed like women and beggars being tossed into council lorries late at night or shortly before dawn.
This move has drawn criticism from many quarters with some arguing that the issues of commercial sex workers and destitutes needs a long term solution and not a short one as they will return to the streets after being convicted in court.
A councilor was on Saturday seen on TV differing with the council security men conducting the swoop and told them the women were simply trying to eke out a living and put a meal on the table and treating them inhumanly like violent criminals was unwarranted.
The calls fell on deaf ears as the security men zealously went about the operation which was degrading and humiliating as women with micro miniskirts sat down with their legs apart in an attempt to resist arrest but were roughed up and tossed into the lorries parked in strategic corners and inter sections of the town.
It is a well known fact that many tourists come to Kenya for sex holidays and use the sun, sand and wildlife as an excuse of visiting the country but sadly some of them also engage in sex with minors as young as 12 years old.
This is part of the reason why Mombasa is always filled with commercial sex workers at night and if the championships were not to be staged there, the authorities would not be conducting the swoops which have increased in frequency as the date of the competition nears.
What happens, the arrested women are paraded in court and charged with loitering with immoral intentions, which is a petty offence punishable by a fine or a few weeks in prison in default. More often than not, the women pay the fines or are bailed out by their colleagues and no sooner are they released, they return to the streets.
The homeless and vagrants could be sent to homes from which they escape after a while and return to the same streets to scavenge which they find more tolerable than staying in those institutions which are usually overcrowded and in dilapidated conditions.
If there are people who wished the international championships should have never been brought to Mombasa, they could be these nocturnal humans but again, they also stand to benefit the most as coaches, trainers and also athletes from the world over who wish to quench their sexual lust in the coastal town which is getting increasingly popular with perverts, could have 'the time of their lives' in Kenya.
But there is another group of honest small scale entrepreneurs and petty traders who were instructed by the authorities to shut down their businesses for the period leading up to the Marathon and a day or two beyond. The Marathon will take place on 24th March this year. The period when they will be shut for business represented over two full months. Now how are these people expected to earn a livelihood? Yet another example of the insensitivity that authorities in Kenya have had for a long time now.

Actually two things have happened at the Nation that have clearly demonstrated that Kenyans will now have to read their daily newspapers with much more cynicism and doubts. Firstly in an unprecedented move, a section of the editorial department has taken on the top management of the newspaper by leaking details of a sexual scandal involving management, to the public through the Internet. Secondly, even as that first controversy raged the senior managers forced the resignation of their star crime reporter Stephen Muiruri, under highly suspicious circumstances. Before leaving Nation Center, or shortly after leaving, Muiruri seems to have felt compelled to explain the details surrounding his resignation and departure to colleagues. His detailed email on that subject which he circulated to colleagues, again leaked out and was posted on the Internet. Its' contents are shocking to say the least. One of the most disturbing things that has emerged from the email is the fact that police commissioner Major General Ali has actively been censoring and seeking to tone down the crime reporting that finds its' way into the Daily Nation newspaper columns.
This behavior by police commissioner Ali put Muiruri and the top management at the most respected media house in East and Central Africa, on a collision course that led to his departure from Nation center.
This development now explains and answers a question that we have been asking in this blog. The question is why is it that matatu carjackings where commuters are robbed and female passengers gang raped are so common in Nairobi these days and yet they are never reported by the media? The answer is that the news and information we read on crime is suppressed and controlled.
The questions that Kenyans will now have to ask themselves are numerous. Questions like, can the public trust senior editors accused of actively seeking sexual favors from female staff including other people's wives? Can they trust characters like these to give them balanced and truthful reporting every time? And if the police have some sort of control over the number of crime reports that find their way into newspapers, who else controls the news we read or have access to in the media? If the police commissioner is regularly seeking to tone down the way crime is reported, who else is doing the same with some other sort of news and for some other reasons? Is this the sort of media that Kenyans can trust as we head into a crucial general elections?

Police Commissioner Ali's Training Places Lots Of Importance on Flow Of Information
Well-trained soldiers are keenly aware of these facts and it is therefore not surprising that police commissioner Maj General Ali, who is a military man, seeks to carefully control what the public reads about crime and security in the country. To him the control of information is part and parcel of the war on crime. But is it?
Is it really a good idea for the public not to know the real crime and security situation in the country? Is the public safer with ignorance? Or is it a better idea for you and me to know exactly what we are up against when we step out of our front doors every morning?
The war on crime is not a military operation and it is wishful thinking to urge the public to share information with a police force that is itself suppressing information. In fact it is highly unlikely that Police commissioner Ali will win the current war on crime with this kind of attitude. Little wonder that even during interviews on national TV, the police commissioner has continuously sidestepped very basic questions and failed to answer simple questions that the public deserves answers to.
This latest development is the strongest argument yet against having a military person running a police force as police commissioner. With the benefit of hindsight, it may have been a better idea to create a special unit manned by military types to confront hard core criminals in gun battles and retain the police commissioner's post amongst police officers who have had many year's training and experience in decision making when it comes to handling crime. As it is, military people hardly receive any training in the law, let alone law enforcement. Admittedly Maj General Ali has learnt fast but it seems other military habits that hinder his ability to function as a police commissioner are a little more tricky to handle.

Woe Unto You If You Are Kikuyu And Agitating For Minimum Reforms
Led by powerful justice minister Martha Karua, the Kikuyu politicians did not mince their words and indirectly told their listeners that those agitating for the reforms were enemies of the community as they did not wish president Kibaki to smoothly sail through in the forthcoming December general elections.
Among the key issues in the reforms that the opposition is keen to see introduced is a new requirement that the winning presidential candidate garners more than 50% of the total amount of votes. This is virtually impossible for Kibaki to achieve, even with a disjointed opposition and will force a two horse race run-off, which the Othaya MP as the incumbent will find difficult to win.
Muite hastily called a press conference the following day and dismissed Hon Karua and her team as shortsighted tribalists who had trivialized the constitution agenda for their own selfish interests.
He was so annoyed that he accused Karua of traveling all the way from Gichugu to talk nonsense to his constituents and warned her that her schemes were bound to fail miserably as Kenyans were not as gullible as she thought. What really got to Muite was the accusation by Karua that he had mismanaged the CDF for Kabete constituency. Muite insisted that the Kabete CDF was one of the best managed in the entire country.
Finding himself also being branded a traitor was the controversial Subukia legislator Koigi wa Wamwere who is in support of reforms before the polls and has even gone further and questioned the way Narc-Kenya are conducting themselves ahead of the general elections.
The vocal assistant minister says that he has been told that Narc-Kenya 'is the party of our tribe' and has challenged it to unveil its manifesto and deal with people like activist Stanley 'moneybags' Livondo who was caught on camera dishing out money in Ikolomani to scores of people at a funeral and hurled more as he took off in the helicopter he had arrived in.
It is common knowledge that Kikuyu's always look out for each other and are known to be the most tribalistic community in Kenya not to mention the wealthiest. On another note, they are also power hungry with most of them assuming that it is their birth right to always rule this country.
During president Moi's 24-year rule, the community were alienated by the Kanu regime and now that they are in power, it is most likely they will cling on to it at whatever cost even if it means shedding blood.
However, majority of Kenyans feel that Kikuyus have had their time and should now step aside and let people from other communities have a go at the highest office in the land. There are about 42 tribes in Kenya.
It is now increasingly clear that this issue of Kikuyu dominance and selfishness is bound to take center-stage in the forthcoming general elections.

ODM is about Raila and Kalonzo, The Other Presidential Hopefuls Are Irrelevant
In a press conference yesterday, Kalonzo told the media that he regularly had breakfast meetings with Odinga when they felt that party affairs were not moving in the desired direction and they often consulted on various issues but these meetings have previously not been made public.
In reality this means that there is no ODM without Kalonzo and Raila and as long as the two remain together and other presidential aspirants leave the movement, the unity required to eject Kibaki from State house will still be intact.
In fact, those in ODM know that the race for the ODM-Kenya nomination is a two-horse race between the big two and that one of them will end up being the party's presidential candidate. Aspirants like Uhuru Kenyatta and William Ruto who also have considerable support among Kenyans have already been dismissed in the minds of many ODM-Kenya die-hards.
Past opinion polls have showed that Kalonzo is more popular than Raila though many have dismissed the opinion poll as a sham.
It is a waste of time that William Ruto is using his ill-gotten wealth to go round the country soliciting for support in his presidential bid under an ODM-Kenya ticket but those in the know say he wants to show Kalonzo and Raila that he is a serious contender for the top seat hence he should be rewarded well if a united ODM-Kenya forms the next government.
The man who is keeping everybody guessing is Uhuru Kenyatta as he does not appear convincing enough as an ODM presidential candidate. For instance he has not been traveling countrywide to sell his presidential bid to the people and chances are that he might not after all contest the presidency this time round.
For Dr Julia Ojiambo, Najib Balala and Ms Nazlin Omar, they are there to show that the presidential nominations in ODM-Kenya is democratic but the advantage they have is that if ODM forms the next government , they will most probably get cabinet posts.

Narc-Kenya Puts Off Elections Yet Again
Sharp differences arose between incumbent MPs and aspirants with the latter accusing the former of using their influence as legislators to manipulate the process in bid to throw democracy out of the window.
It is common knowledge that current MP's aligned to the government are doing everything to ensure that they get the Narc-Kenya nomination as this, they think, will save them a lot of money for campaigning as they look forward to the Kibaki administration to substantially fund their campaigns.
And again, there are those who come from central Kenya and the Mount Kenya region who know that securing the party ticket will mean automatic access to parliament as people who live in this areas will automatically vote for those in Kibaki's party without giving it a second thought—or so it is assumed.
However, those who will attempt to vie on Narc-K ticket in Nyanza and to a large extent, the Rift valley will be committing political suicide. Still this may not be of major concern of greed comes into play, and many contestants will be on a money-making mission.
If the current political situation is anything to go by, over 60% of Kibaki's cabinet ministers will lose their parliamentary seats and he himself could lose the presidency whether he contests under Narc-K or not so he should be busy trying to right the numerous wrongs that his administration has committed in the past four years including entrenching tribalism deeper into the Kenyan society (mainly through appointments made) and condoning high level corruption.

Police Chief Censoring Nation Crime Reports: Crime Reporter Who Resigned Says
According to a leaked email, posted on the web, Nation Newspapers crime reporter Stephen Muiruri has allegedly resigned while under intense pressure from senior managers at the newspaper trying to divert attention from the ongoing sex scandal allegations.
But what is the most shocking thing from the email (if it is genuine) is the revelation that the police have been censoring crime reports in Kenya’s highest circulating daily through senior managers at the paper. At other times they have pleaded for stories on crime and security to be toned down.
This answers a question we posed in this blog last week as to why frequent matatu carjackings that usually end up in rape of all female passengers, have not been reported in the media.
Kenyans will now have to decide if the public is really safer when they do not really know the extent of violent crime. Or if ignorance in fact compromises the security of many city dwellers who assume that all is well.
One of the main reasons for toning down crime reports would for political ends to paint both the government and security forces in good light ahead of the rapidly approaching general elections.

Weekly Citizen Editor Was Bribed To Stop Carrying Sex Scandal Stories: Claim
Yet another letter was posted in this blog in the last few hours which announces that there are now only 14 days before the promised “earth shattering” sex scandal revelations promised by the anonymous letter writers believed to be members of staff at NMG.
In the same anonymous letter posted at this blog, the letter writer claims that a senior manager in charge of security personally went to the Weekly Citizen offices and stopped a series of articles the weekly alternative press newspaper had planned to publish on the unfolding sex scandal at NMG

Nation Crime Reporter Forced Out?
Dear Colleagues,
I wish to inform you that I tendered my resignation yesterday after my reputation was unfairly questioned by Mr Wangethi Mwangi in his desperate attempt to divert attention from the damaging sex scandals that have engulfed him for many years and which are now threatening to tear him apart. This is a false believe because my departure will never undo the scandals and his own mess.
I resigned after Wangethi sent me a scandalous memo making wild accusations that have no basis or foundation. I’ll share the contents in the memo shortly. I replied to his memo and after wide consultations and taking into consideration that I had planned to leave NMG towards the end of this year, I decided to tender my resignation yesterday. I had expressed this desire to quit NMG to some of my colleagues. Unfortunately, it came earlier after Mr Sam Koskei, working in cahoots with Linus Gitahi, and Wangethi, schemed for my downfall for purely personal reasons as I stated in my letter of resignation. See the attached memo in response to Wangethi’s memo and my resignation letter.
In his memo, Mr Mwangi accused me of two things. First, he asked me to respond to an unspecified issue I’m alleged to have done on December 21, 2006, which he claimed contravened my terms of employment with the Nation Media Group. The problem arose because I own a tour firm and Gitahi and Wangethi had earlier told me verbally that NMG rules don’t allow the staff to serve two masters. According to them, a NMG employee should devote all their energies and time on this company. I disagree. Don’t NMG staff have a future? I don’t believe NMG is the beginning and end of life. And my questions to them was; HOW ARE WE THEN SUPPOSED TO SPEND OUR SALARIES? Should we drink all our salary so that by the time they ambush you with a retrenchment letter you go down on their feet begging? If that is what they expected I would do, they are badly mistaken.
Secondly, Wangethi claimed in his memo that the circumstances and “facts surrounding the purchase of a motor vehicle by yourself from the police last year point to a conflict of interest.”
Though details of the first accusation were not explained in Wangethi’s memo, I went through my records and I found out that on December 21, 2006, I placed an advert that appeared in the Daily Nation the next day seeking additional employees for my tour firm. I paid for the advert and the receipt is available. How that contravened my terms of employment remains a puzzle to me.
On the second issue, the said “facts” are a complete distortion of the truth. In 2005 (NOT LAST YEAR), the Kenya Police advertised it was selling by public auction all unclaimed vehicles and all the vehicles on sale were published in the Kenya Times and subsequently advertised in the Daily Nation two times.
I had not seen the first advert but I saw the other two in our newspaper. My first cousin who deals with second-hand vehicles placed a bid for three vehicles and won. After he paid for them, things took a different turn. I first knew that he had tendered for the vehicles when he came to see me at Nation Centre.
He told me that he had been called by the auctioneer and told that several senior police officers and the wife of a top policeman at police headquarters were interested in one of the three vehicles he had paid for. He had two options; either to get a refund of the cash or he accepted an offer of another vehicle. I then called the then CID Director, Joseph Kamau, and he asked me to send my cousin to him. Mr Kamau intervened and the vehicle reverted back to my cousin.
As it’s his tradition, he registered the three vehicles under different names of his wife and relatives. From the first transaction to the last one, the vehicle Wangethi is referring to bears the names of my cousin’s wife. She is also the legally registered owner of the vehicle. As per the law, each of the persons who bought the vehicles which had been sold were issued with an original letter from police headquarters confirming the sale deal was done in accordance with the law and the letters stated
cleared who the buyers of the vehicles were. The letters were on the Kenya Police letterhead and were signed on behalf of the police commissioner, Maj Gen Hussein Ali, by a senior officer. The same letter was sent to KRA, which the buyers used to register the vehicles.
Nowhere does my name appear in the transactions, the sale documents, the receipt for issuing number plates or the log book.
At the time the transactions were going on, Kamau and Maj Gen Ali were at loggerheads. The senior officers who failed to buy one of the three vehicles my
cousin bought found out that I had intervened and they found an opportunity to fix me. The issue came at a time when crime had skyrocketed and various efforts by Maj Gen Ali to prevail upon me to censor major crime stories and to down play the coverage of crime and security matters had flopped. He had called me to his office several times but I refused to tone down. The first time was when we exposed the killings in Ngong and Ongata Rongai. Then came October 2005 when police shot dead four people in Kisumu during the referendum.
Maj Gen Ali was not amused when we exposed they had killed school children and not rioters as he had claimed. He also wanted me to down play stories on murders and bank robberies and the row between him, Kamau and Michuki. His idea was that I should channel out PR stories on his achievements. I started briefing Wangethi about these issues from 2005 and initially, he was on my side. But along the way, he jumped to the other side and matters reached a climax last year when
I wrote a story on three senior officers who had been short-listed for the job of CID Director.
Although the commissioner issues a statement, full of abusive language, and was categorical the story was total lies and my own imagination, my forthrightness and the accuracy of my sources were vindicated two weeks later when one of the three people I had mentioned in my story as having been short-listed for the job was appointed to the post. When Wangethi got Maj Gen Ali’s statement, he wrote some stupid comments on top and accused me of manufacturing stories. He further claimed the reputation of NMG was at stake because of my stories. But when they story turned out to be true, Daily Nation boasted about how the Sunday Nation had broken the story in an exclusive report, when Mr Gatiba Karanja was appointed CID chief!
Neither Wangethi nor his friend Maj Gen Ali offered any apology for the insults they had hurled at me.
Hence, the opportunity to arm-twist me came when Maj Gen Ali stumbled upon the information about the vehicle. He quickly contacted Gitahi through Rose Kimotho just a week after the NMG Board made an announcement that he would take over from Mr Kiboro. By then, Gitahi had more than a month to report to Nation Centre. It’s for this reason that Gitahi called me on the very first day he came to Nation Centre supposedly to pledge his support for me and to commend me for my superb performance. The hypocracy in his statement came to pass when I met him in his office on Thusrday afternoon.
Gitahi and Wangethi used forced information on the vehicle provided to them by Maj Gen Ali and Koskei to plot my downfall for their selfish and personal interests. I would be happy if they came out in the open to declare why they desperately want protection from Maj Gen Ali.
Maj Gen Ali first told Gitahi that I had been given the vehicle by Kamau to influence my coverage of crime stories. He also claimed Kamau gave me a lot of money.
I personally wrote to Maj Gen Ali and challenged him to come out in the open and offer proof of his wild allegations, but he never did. When that failed, he then introduced a new angle to the vehicle and claimed the buyer was my sister.
In order to clear my name and to help Koskei in his investigations, I personally brought the original documents of the vehicle including the newspapers that carried the advertisements for the public auction.

of the vehicle.
Yet, Gitahi, Wangethi and Koskei have opted to twist the facts to suit an intended objective – to portray me as a dishonest person not suitable to hold any position at Nation Media Group.
The facts are there but they choose to sweep them under the carpet. It’s my honest opinion that I did not use my position at NMG in conflict with company rules and regulations.
The events leading to my departure relates to a story I wrote two weeks ago on the sharp rise in extra-judicial killings. Gitahi fumed over the story even before he knew the background behind the story.
He told Wangethi he disliked the story. Out of fearing Wangethi, Odindo instructed Bernard Nderitu to ensure that any analysis I did on crime and police were referred to him (Odindo) and Wangethi. I saw this as a deliberate move to frustrate my work so that I could be rendered non-performing and give Wangethi a reason to fire me.
This is why I went to see Gitahi on Thursday to explain the background of how the story was published in the newspaper. Despite the many assurances Gitahi had given me that he supported me and my work, I found a different Gitahi on this day.
He quickly summoned Aluanga, Hellen Mbugua, Wangethi, Odindo, Nderitu and Koskei to his office and turned the meeting into a lynch forum. The genuine issues I
had raised were bushed aside and the issue of the vehicle and my tout firm took centre stage. A memo was hurriedly crafted and Wangethi was then instructed to
sign it. Now that am out of the way, Gitahi and Wangethi can sit tight and suppress crime stories as they wished to please their master, Maj Gen Ali. I have no regrets for the good work I did.
Which is the worst crime? Muiruri owning a tour company and intervening on behalf of my cousin or the beasts that have been accused of turning Nation Centre into a brothel? As I asked in my resignation letter, I ask again; WHO ARE MY ACCUSERS?
For your own consumption, I wish to inform you that Wangethi and NMG were sued by Kiunjuri, Makwere and Midiwo after they twisted facts in my story and
identified them as the MPs who had been arrested in a swoop on Koinange streets.
During a series of pre-trial meetings, Wangethi, Odindo and myself have been holding with lawyers over the court case, the issue of integrity was raised by the lawyer. The lawyer warned us that our integrity would be thoroughly torn apart if we stood in the dock in court to accuse other people of engaging in prostitution when we knew we had skeletons in our cupboard or a dark past. Although Wangethi had initially accepted to stand in the dock, he developed cold feet and flatly refused to be a witness when the lawyer make the shocking revelation. Despite pleas from the lawyer that the position of NMG would be badly weakened if he refused to testify, Wangethi has completely refused to testify. Instead, he pushed Odindo to take his role. I have no problem to stand in the dock and I’ll do so to save Odindo.
It was amusing to see Wangethi shedding crocodile tears during the Thursday meeting of editorial staff, pleading innocence and making denials. I think he broke down because his conscience was tearing his heart into pieces and not because he was innocent.
Why did he develop [cold feet] to take the dock if he is as CLEAN as he wanted us to know? I dare him to take the dock and defend NMG in the case if he stands by his theatrics on Thursday. The guilty are always afraid.
Colleagues, I’m not bitter for leaving NMG and neither do I have regrets. I’m bitter because lies were used to force me out although I have risked my life for the sake of this great company. Unlike what the likes of Gitahi and his sidekicks thought, am not going into the wilderness. I had prepared well for my future because NMG is not the beginning and end of life. Do they think people should die if they left NMG?
Sadly, the answer is no.

Already, the NMG top leadership has been hit by a high fever resulting from panic. Almost three weeks, the Group Security Manager, Mr Sam Koskei, visited the offices of the weekly Citizen newspaper and offered them a huge bribe to kill a series of articles they had lined up for publication on the unfolding sex opera at Nation Centre. The trick worked since the newspaper has not turned a blind eye on the unfolding drama. Mr Koskei has been boasting to top managers how he managed to cover the lid. For how long are you going to succeed Mr Koskei? You are a trained prison warder and we only wish you can update your skills since you are not in touch with modern technology. The alternative press is only one weapon at our disposal and it’s less consequential. The other weapons we have in store will put to shame the prisoners’ training skills that you boast about. Are you listening? Please continue watching this space. You are so narrow-minded.
NMG prides itself as the leading watch-dog of society and the truth is that the people we rely on to blow the whistle on all the rot that is eating away at our Kenyan society must be beyond suspicion, let alone reproach. Kenyans and the entire world have all the reasons to worry when senior Editors of a leading media house like NMG turn out to be badly rotten than the people they expose in our newspapers every day. We all know that office carpets in Nation Centre have some delicious stories to tell if they could talk. And how we wish Wangethi's carpet (retrenched reporter Claire Gatheru is a living testimony) and his green Mercedez Benz (Adhiambo, are you listening) can talk?
We did not imagine the NMG management can be that scared of the truth. They are the same people who coined slogan Find the Truth in the Nation. But it looks like the truth is only sweet when told about other people who do not work in the Nation Media Group. If the managers can pay hefty bribes to kill stories about them, why should Kenyans continue relying on the NMG publications for the truth? Those of us in the newsroom who cares about their integrity and reputation must stand up to be counted. We must work in solidarity force the managers who have been using our fellow colleagues as sex toys to leave the company. If the stories on their sex lives we have been channeling out to the entire world through the internet are not true, why have they panicked and why should they want to kill stories in other newspapers? THE GUILTY ARE ALWAYS AFRAID.
Afraid and ashamed to face his wife at home and ourselves in the office, Mr Mwangi has resorted to criss-crossing from Kenya , Uganda and Paris in the name of doing company business. It would be his wish for the Ugandan government to keep shutting down NTV Uganda so that he can find an excuse of being far away from his wife and us. After he returned from Paris with Linus, Mr Mwangi could not afford to stay at home. He sneaked into the office last weekend and locked himself inside hoping the heat will cool off. Woe unto you! Mambo bado. Things will get thicker from March 1.
And have you seen the way Mr Odindo has been carrying himself in the newsroom for the past one week? The burden of evil has really weighed down his shoulders and he wishes the world would collapse on him. Mr Mwangi is so cleaver. When the scandal sex scandal was exposed, he found excuses of dashing out of the country at will. And who carries his burden? He leaves behind Mr Odindo to carry his heavy load. The way the gigantic Odindo has been dragging his feet, gnawing his teeth and walking with a drawn face in the newsroom in the past week is enough testimony that he is carrying a heavy load of sins. He, too, has resorted to running away from home and spending his weekends in his office. He found solace in his office the whole of last Saturday.
Ooh poor Joe! How does it feel to share Buzz Editor, Adhiambo Odera, with your friend Wangethi? And how does it feel to share her with junior reporters and watchmen? The story around this woman who swags her huge bottoms around the newsroom and the men who have ever laid her in NMG will be the first to roll out on March 1. Joe and Wangethi, prepare your wives and other concubines for the battles ahead.
Perhaps, Joe and Wangethi should arrange to sneak Adhiambo back to Malindi to wipe out their tears.

Memories of the violence where scores of innocent Kenyans lost their lives in pro-reform demonstrations in the 90s are still very fresh on the minds of many Kenyans. Barring a serious change of attitude on both sides, it would seem inevitable that we are headed in exactly the same direction this time round.
What is playing out now is what the late Michael Kijana Wamalwa used to refer to as politicians playing harmless looking cards on the table while the really dangerous ones are well concealed somewhere under the table.
The opposition has been able to read the planned tactics of the Kibaki campaign team well. The president will clearly be banking on the massive Kikuyu and Mount Kenya vote to give him the simple majority he needs to make it back to State House. Only one thing can stop him—a united opposition. The problem is that opposition unity is not going to be easy. But the opposition can solve the problem of unity with one piece of legislation. The proposed reform law that has sent jitters and violent shivers down spinal chords in the president's camp. This is the proposal that apart from the 25 per cent in every province, to be duly elected, a presidential candidate has to garner 50 per cent of the votes cast plus one. Meaning that virtually all presidential elections in Kenya henceforth will have to move to a round two run-off. In such a scenario the opposition do not need to unite against Kibaki. In fact it will suit them better to stand separately against Kibaki all aiming for the second or runners up slot. And then whoever comes in second moves to the run off where all other opposition candidates are bound to rally behind them against the incumbent. Very simple, very convenient and an easy and smooth way to victory.
The Kibaki camp has correctly read the situation. It is clear that the new piece of legislation (the dangerous card being concealed under the table by the opposition in the clamour for reforms) if passed into law will spell doom for their candidate. So they have hit back with another ace of their own. Justice Minister Martha Karua in a sudden about turn this week said that any reforms must include a referendum. Already the electoral commission chair Samuel Kivuitu has strongly advised against having a referendum and an election within months or even weeks of each other. What this would mean is that the elections will be delayed which will put the opposition at great disadvantage compared to government who not only have an ample war chest, but can also gain access to funds at treasury under various pretexts, if push comes to shove. It is therefore clear that the opposition will be at a great dis-advantage if polls are delayed. Secondly any slight lack of unity amongst the opposition (which is quite likely at this eleventh hour) will easily give victory to the government side in a referendum, meaning that any change to the constitution that would threaten the president will be defeated.
One thing has become very clear, neither of the two "elephants"(opposition and government) will give an inch to the other. This means only one thing—that it is the grass (ordinary mwananchi) who will suffer the brunt. That means any attempts at demonstrations will be marred by violence and the government will use excessive force to ensure that no demonstrations for reforms will take place, let alone the widely taunted mass action.
Ordinary Kenyans have already spilt too much blood and both the opposition and government should do everything in their power to ensure that the call for reforms does not end up being a bloody affair.

Drama In Western Kenya As Money Falls From The Sky At Dr Bonny Khalwale's Meeting
Narc activist, Mr 'Moneybags' Livondo was shamelessly caught on camera in national Television dishing out cash to hundreds of people mainly in the form of Kshs 200 notes and in the process disrupted Khalwale's meeting.
Being a Narc-Kenya activist, Livondo's actions speak volumes including the fact that the government is not putting anything to chance in the forthcoming general elections and in particular, the 1.4 million luhyia vote.
It also clearly shows that the government is ready to use cash to ensure Kibaki retains power along with a legion of MPs who it seems will be heavily funded especially in areas already with strong opposition legislators.
It is no secret that Khalwale is a close confidant of Ford-Kenya chairman Musikari Kombo who has of late started leaning in the direction of Kibaki's critics like Raila Odinga and Paul Muite over the minimum reforms debate.
It is also no secret that Khalwale is among the most popular legislators in Luhya land and is among the few who are expected to retain their seats without much effort as they have firmly entrenched themselves where I matters—amongst the people.
Livondo's escapade has sent a clear message to Kibaki's adversaries that not only does Narc-Kenya have enormous funds for its campaign, but the party also has the ability to
cause sleepless nights to legislators who don’t want to support Kibaki's re-election bid.
My guess is that similar incidents may soon occur in Mwingi North and Langata which are Kalonzo Musyoka's and Raila Odinga's constituencies respectively.
Although there is no denying the fact that with deep pockets and the provincial administration on your side, one can always achieve the impossible, but again there are no guarantees as Kenyans are not as gullible as our arrogant politicians would like to believe.

Unpredictable Ngilu 'Sleeps With The Enemy' Yet Again
This is really no big surprise coming from the unpredictable Kitui central legislator who is known to once in a while discard the collective responsibility that all members of a cabinet have, to criticize and attack the government, which she works for.
Coming this late in the day, it is certain that Ngilu is playing her trump card prior to the elections and her move is widely seen as a way of getting president Kibaki's attention so that he could bow to her whims.
Those in the know say Ngilu is working hard to ensure that she becomes Kibaki's running mate and in effect, the country's vice president in the post election era next year if Kibaki manages to be re-elected.
However, this could prove to be more than a long shot for the iron lady from Ukambani who cannot be trusted by Kibaki's handlers due to her unpredictability and her open criticism to some of Kibaki's decisions, especially those that have proved to be unpopular with the masses.
It is an open secret that Ngilu has always been critical to Kibaki, after he trashed the infamous memorandum of understanding (MOU) soon after taking over the reins of power from former president Moi who had ruled for 24 years.
Kibaki worsened his relationship with the iron lady from Ukambani when he incorporated Kanu MPs into his cabinet yet people like Ngilu wanted nothing to do with the former ruling party. To Ngilu's chagrin she suddenly found herself seated besides them at the Thursday cabinet meetings.
Ngilu is annoyed most by the fact that Kibaki has chosen to establish a cozy relationship with Moi whom Ngilu has always loathed with all her heart and still hates to this day as a result of the harassment she underwent during the Kanu era.
Ngilu's attack on Moi during her days in the opposition were so personal and explicit that even the carefree alternative media dared not print what she had to say about the former president.
In many political meetings she addressed, Ngilu told her attentive audience that president Moi was a dirty, senior bachelor who preyed on secondary school girls whom he lured for sex using money and power.
She further justified her story with the fact that majority of schools, which the president raised money for were girls' schools and not boys' schools—why? She she posed dramatically. She also claimed that the headmistress's of these girls' schools doubled up as Moi's lovers and pimps who brought their students to him in exchange for large amounts of cash to buy their silence.
Most of these ridiculous utterances by Ngilu reached the president's ears through the special branch and intelligence service, which angered him, and he stepped up the pressure on the provincial administration and Kitui Kanu politicians to harass and intimidate Ngilu as much as possible.
To this day, the two cannot meet eye to eye and it is common knowledge that Ngilu has no time for the former head of state and if she arrives at State house and hears that Moi is around, she usually takes off and returns later when he has left.
Ngilu also has a plan 'B' where she could join the ODM-Kenya but again, she cannot add any value to the party as majority of her supporters have already crossed over to Kalonzo Musyoka's side. In other words, she has no gambling chip to dictate for a big slice of the cake if the party comes to power after the polls.

In simple terms, if the past events are anything to go by, Ngilu may find herself floating on the eve of a general election or worse still, find herself between a rock and a hard place.

Students Suspended From School For Being Uncircumcised
The students from Kiriani Secondary School, somewhere in Meru were suspended following pressure on the school's administration by fellow students who protested that they could not coexist with uncircumcised boys as they were a 'disgrace' to the society and cannot sleep in the same room or dormitory since they were 'unclean and toddlers.' The stance taken by the students was fully supported by rural folk living close to the school with one resident saying without batting an eye lid that bringing uncircumcised boys into a dorm of the circumcised is similar to bringing girls into such a dormitory full of boys, which can only lead to chaos.
A decision by the government to have the head teacher transferred has been met by resistance from the students who protested against the move yesterday claiming their head teacher had taken the right decision to suspend the 25 uncircumcised boys.
The education minister has also commented on the issue and has castigated the suspension saying it was wrong and should never have happened in the first place. He promised Kenyans that his ministry would take decisive action.
For starters, circumcision is mandatory for boys of age in Meru and the tradition is taken so seriously that girls are also circumcised though the brutal practise of female genital mutilation (FGM), never mind the fact that female circumcision has now been outlawed.
These practices have been left to thrive there for the simple reason that the Ameru are staunch government supporters and have been behind president Kibaki ever since his first stab at the presidency in 1992.
It is an open fact that all plum jobs in government and parastatal organizations have been divided between members of the presidents Kikuyu tribe and their loyal neighbours, the Meru's.
Parents of the suspended boys argue that their children's admission letters did not stipulate that they had to be circumcised and are surprised that their sons have not been asked to return to the school even in the wake of nationwide outrage over the issue.
Like many important issues that require urgent attention in this country, the matter will most probably be swept under the carpet and soon forgotten to the chagrin of the suspended boys and their parents who will now be compelled to undergo the ritual to gain re-admitted to the school. Or stay as they are and seek education elsewhere.

Bishop Margaret Wanjiru Joins ODM-Kenya
No sooner had Wanjiru declared her interest for the seat early last month and her intention to marry a South African preacher, did her troubles begin. Her supporters are convinced that it is all political. A man claiming to be her husband, one Jimmy Kamangu emerged saying he was married to the evangelist and there was no way she could marry another man prior to ending her marriage with him.
The saga turned into a captiavting soap opera with accusations and counter accusations flying. Inevitably Kamangu ended up in court demanding his conjugal rights back from the Bishop. Kamangu who was suddenly dressed in expensive clothes managed to get an order stopping the much-anticipated Bishop's wedding which was to be held last weekend.
Amid the controversy, Wanjiru turned up yesterday on television looking beautiful and glamorous as always as she sat amongst the "wolves" confidently stating that she was joining ODM-Kenya and managed to get a "welcome kiss" from Raila Odinga as Kalonzo Musyoka watched in bewilderment.
It is no secret that Kenya needs politicians of decorum and flair like Wanjiru who has had a generally incident free public life until the recent Kamangu story. She still enjoys credibility among her flock as the meeting she called for last Saturday at her church had standing room only.
Kenyan politics needs people like Wanjiru to add color and credibility to it and especially Nairobi where most of the current MPs are really just 'thugs' who only know the use of crude and uncouth methods in dealing with their enemies—both real and imagined. David Mwenje and Fred Ngumo not to mention Norman Nyagah are known to have violent gangs under their beck and call.
Wanjiru might not be perfect but she will definitely bring sobriety to Starehe constituency where the current MP was also recently declared the Narc candidate under dubious circumstances even after losing the primary's to businessman Jimnah Mbaru who could definitely have made a better MP than Kamanda.
The Bishop however needs to learn one very important lesson in politics. And that is the fact that you never leap into something just to react to your enemies. This can be fatal in politics. Wanjiru's timing in joining ODM-Kenya, is a direct angry reaction to her wedding being stopped. It is a move designed to send jitters in the enemy camp. The way politics is played is that your enemies should never be able to second-guess you.
There are those who do not believe that there is any hidden hand in the Bishop's troubles, but there is no denying that Kamangu's sharp dressing and court action has got a very wealthy backer, who seems to have some very clear objectives in mind. And mostly they seem to be to finish the inexperienced Bishop politically. The battle for Starehe has started and it promises to be a very bruising one.

Reverend Mutava Musyimi To Take On Joseph Nyagah In Gachoka
Nyagah who says that he will represent those who come from small communities has never had it tough in Gachoka a seat that his brother Norman Nyagah left to him under controversial circumstances as he headed to the city to win the Kamkunji seat in the last general elections. But this time round, the older Nyagah could find his 'waterloo' in Musyimi.
For starters, Musyimi is the so called government candidate and being a close friend of president Kibaki, the highly intelligent and eloquent God fearing man will definitely not have any problems pertaining to finances when the time comes.
Musyimi is said to have been convinced by Kibaki himself to contest the parliamentary seat in the forthcoming elections and chose Gachoka where his roots are not to mention the fact that there are over 10,000 members of his Kamba community who are residents.
The cleric who is also a member of the national anti corruption steering committee has also been busy and has approached both ministers of lands and water, Kivutha Kibwana and Mutua Katuku respectively to assist Gachoka people on matters pertaining to land and water in the constituency.
It is common knowledge that Musyimi and Kibaki are close and the latter is said to have made various visits to State house to discuss his political future with the president who knows only too well that clerics have an advantage over other parliamentary aspirants.
Others speculate that on winning the parliamentary seat, Musyimi will be among the senior most minister's in Kibaki's administration if he gets re-elected later this year in an election which could be marred by pre-polls demonstrations over minimum reforms which the Kibaki government is not willing to go ahead with.
Nyagah should not be underrated as he can call himself an experienced politician who has won elections before while this will be Musyimi's first go at parliamentary elections.
But the greatest danger is if ODM-Kenya manages to remain intact after its presidential nominations and Nyagah happens to join the coalition. In such a scenario, an opposition wave will be in the offing and this has the potential of not only sweeping Musyimi away but also his master, Mwai Kibaki.
