An Unworkable Presidential Nomination System And Serious Political Problems In ODM-Kenya

An extremely complex political situation has now emerged at the main opposition political party in Kenya at the moment, ODM-Kenya. It is a situation sadly brought on mainly by the selfish nature of some of the party's leading presidential candidates and yet is serious enough to cause defeat for this party which is the only hope for many Kenyans today.

The crux of the whole problem stems from ODM-Kenya's presidential nomination process recently agreed on after protracted horse trading that at one time got so heated that the press virtually declared the much-anticipated split in the party had arrived.

According to the mode of selecting the party's presidential candidate, a delegates system will be used in all constituencies in the country where a whopping 2,000 delegates will vote to decide who will face president Kibaki in the forthcoming polls.

The main problem with this agreed on system is requires some mind-boggling leves of financing.

For starters funds will have to be somehow found to get the 420,000 delegates to some central place for voting to take place. Assuming that the average return fare for the whole lot is a mere Kshs 2,000 then, then Kshs 840 million will need to be found just to carry out the elections. We have not even factored in allowances that delegates have come to expect as a right in every political party's delegates conference. On the other hand if the elections are held at the individual constituencies then almost a similar amount will be required to facilitate such an exercise including sending returning officers and setting up the particular points where the elections will happen.

But the more serious problems with this crazy, unprecedented presidential nomination system is the finances required for candidates to campaign successfully. Already the financial pressures are being felt be leading presidential candidates who somehow have to find the money t campaign to win the ODM-Kenya nomination and then after that, they will need to find even mo money to finance their campaign proper against the incumbent and other candidates who will present themselves. What this means is that the ODM candidate will be at a great disadvantage when compared with other presidential candidates from other political parties in that they need to raise funds for two campaigns.

Both Kalonzo Musyoka and Raila Odinga have stepped up their trips to the United States in what many see as a desperate effort to raise funds.

And what has brought about this whole problem? Nothing more than a bunch of opinion polls by the folks at Steadman, which have completely gone into the head of one Stephen Kalonzo Musyoka. Even if the poll is genuine, it means nothing because Kenyans have been known to behave in one way before the polls and then on Election Day have ended up voting predictably for one of their own.

Mr Musyoka has been so blinded that he forgets the example from the 1997 polls where a presidential candidate from his own backyard suffered exactly the same fate. Charity Ngilu generated a lot of excitement when she became the first Kenyan woman to stand for the highest office in the land. At one point, she was welcomed in Kisii (by the worst male chauvinists you will find anywhere in the world) by a huge crowd chanting "Mama tuokoe" (Mother, save us). The crowd was asking would-be President Charity Ngilu to save the country from the mess Moi had gotten it into. Had Steadmann been around then and held an opinion poll, chances are that Ngilu would have emerged as the most popular candidate. But an even more ominous sign for Moi as to how "popular" Ngilu was, was to follow. When she went to present her papers to the Electoral commission, the size of the crowd that escorted her to County Hall and its' enthusiasm would have left you with no doubt that Ngilu and Kenya were set to make history. Political pundits who do not quite understand Kenyan politics chuckled at the prospect of Moi being removed from power by a woman.

It was never to be. Ngilu ended up getting most of her votes from her native Ukambani. The rest of the country including all those adoring crowds voted predictably according to their tribal instincts. Ngilu in fact trailed Moi, Kibaki and Raila in that order.

The consequences of the hunger for power at ODM-Kenya could easily be defeat in the hands of Narc-kenya when in fact the party already has a colossal amount of votes already in the bag.

We have not even analyzed the ugly politics that will surely emerge when the ODM-Kenya candidates start campaigning against each other for nomination. This will greatly weaken whoever is finally chosen to represent the party. The big question is whether Kenyan voters at the constituency level are sophisticated enough to go through a major party nomination process for the presidency and then follow up that with the presidential elections proper without getting terribly confused.

Why ODM-Kenya Presidential Nomination System Greatly Favors Uhuru

If ODM-Kenya goes through with their current proposed sytem for coming with their presidential candidate, then it is safe to assume that one Uhuru Kenyatta will emerge victorious.

Uhuru has three major advantages. Firstly he has the resources to finance an expensive campaign to help him clinch the nomination and then after that will still have enough funds to finance his campaign proper and all without causing any dent on the family fortune, mainly acquired from land grabbed by the first president of Kenya, countrywide.

The second advantage Uhuru has is that he garnered well over a million votes in the presidential polls in 2002 and it will be fairly easy for him to re-establish contact with his 2002 supporters at the constituency level and easily carry the day.

Thirdly there is enough Kikuyu influence in most of the provinces to give Uhuru numerous votes, at least enough for him to clinch the nomination.

If truth be told, the prospect of Uhuru facing Kibaki once again will result in an easy victory for Uhuru this time round, not to mention the fact that tribal tensions will be eliminated from the presidential polls. However there is the massive Kikuyu backlash that has been building up over many years of dominance and arrogant display of tribalstic tendencies by this tribe that has come to the fore again during the Kibaki presidency. What added insult to injury were the voting patterns of the kikuyu in the hotly contested referendum over a new constitution in November 2005. Chances are high this time that many Kenyans will opt to reject any kikuyu candidate in favor of any other tribe for the presidency other than the Kikuyu. No doubt this kikuyu factor will further complicated an already highly complex political scenario that will be the general elections 2007.

And where does all this leave ODM-Kenya? Where does it leave ODM-Kenya founder Raila Odinga? There is yet another even more complex political question; will the nomination produce the most suitable candidate to face Kibaki? Many would quite rightly answer with a loud “no” to that last question. Actually consensus would have been much better because ODM-Kenya kingpins can quietly analyze the Kibaki Awori partnership and come up with the best candidates to bring victory. But then we all know that that is impossible with all the power-hungry folks crowding ODM-Kenya.

Kenyan Women Suspects Now Being Locked Up In Police Officer’s Bedrooms

It has been reported that Mageta island Police officers (Mageta island is in Bondo, Nyanza province) are now using their personal bedrooms to lock up women suspects.

Any Kenyan woman who has been unfortunate enough to land in the hands of police officers will immediately tell you what that means. Women suspects are frequently raped when they are in police cells, so what do you think will happen to them now that they are being locked up in police officer’s bedrooms?

Area DC Fred Mutsami admitted to the press during a recent visit that he was shocked to find that the women’s cells were "right inside the officer’s houses". The policemen at the police post explained that there was a huge shortage of space and that was why the police officers were forced to accommodate women suspects in heir bedrooms.

Sadly in an election year such as the one we are in, all other news that is supposed to attract national attention and outcry like in thus case, is hardly ever noticed.

The truth of the matter is that any woman suspect locked up in these sort of cells should be set free by any court that finds her guilty of any offence, because she will have already suffered more than enough punishment for whatever it is she may have done.

Presidential Aspirants Kalonzo Musyoka And Raila Odinga Return To The US On Yet Another Begging Mission

It seems that the finances of two leading ODM presidential candidates appear to be already stretched beyond limits.

Kalonzo Musyoka yesterday jetted out from Nairobi heading to the United States for the second time in three months as he desperately looks out to the Diaspora to raise funds for his presidential campaign.

Raila Odinga, is no different, and is expected to jet out for the same destination next week and will visit several states hosting US$ 100 per plate dinners all over the place as he also scrambles for State house.

The two have been common faces in the United States where they have launched spirited efforts to convince Kenyans living there to chip in towards their campaign kitty with Odinga being miles ahead of Musyoka as his tours seem to be better organized.

It also goes without saying that majority of Kenyans in the United States hail from the Luo community and with politics of ethnicity having been deeply entrenched in Kenya, Odinga has been receiving much warmer receptions as compared to Musyoka.

What the two have failed to realize is that Kenyans living in the U.S not rich and most are struggling to make ends meet and its not like they always have dollars to spare especially to contribute to politicians just to help make their dreams of power come true.

Majority of Kenyans in the United States are students or went there to study and dropped out before completion only to engage in informal employment and are living there as illegal immigrants.

Not only are they cash strapped for dollars but are living in constant fear of being discovered by immigration officials and being deported back to Kenya. However, there are those who are living the American dream and have made it big in the land of opportunities. Apparently, these are few and far between not to mention the fact that they are too busy to attend dinners of Kenyan politicians begging for funds in a foreign country.

Raila will visit Minnesota, North Carolina, and Florida in the United States. He will then tour a few cities in the United Kingdom. Kalonzo's schedule is yet to be released. These begging missions which are often characterized with stinging attacks on their motherland, have become a source of great irritation and embarrassment to the Kibaki administration.

The Art Of Carrot Dangling In Kenya Politics By Establishing New Districts: Kibaki Goes Overboard Creating 37 New Ones

In a desperate bid to endear himself to voters, president Kibaki has resorted to the same tactics used by his predecessor ahead of elections to woo Kenyans on his side.

During the referendum vote two years ago, the government used similar tactics of pledging to build bridges even where rivers did not exist but they failed miserably and do not seem to have learnt much from the lesson.

Politics in Kenya is deeply based on ethnicity and even if Kibaki delivers heaven to majority of Kenyans, he is still bound to lose the election mainly because of the widespread tribalism which is deeply entrenched in his administration.

The likes of Raila Odinga and Kalonzo Musyoka are tribal chiefs who enjoy fanatical support from their communities which has encouraged them to seek support from other tribes to enable them rule the country one day.

If Kibaki was serious about being re-elected, he should have first addressed the tribal imbalance in the civil service and parastatal organizations where his Kikuyu tribesmen are the majority at the expense of 41 other communities in Kenya.

It is also ironical that the minister who oversaw the creation of the new districts, John Michuki is on record as having gone to court in 2002 in a bid to stop the then president, Daniel Moi from creating new districts.

The imbalances in the provincial administration are so glaring that even the blind can see the favoritism that the Kibaki administration is practicing, for instance, 5 of the 8 provincial commissioners come from the mount Kenya region along with the most powerful cabinet ministers not to mention the head of the public service and secretary to the cabinet.

With the new districts, where most of them have been created in zones perceived to be supporting the government, Kibaki will get considerable amount of political mileage but not enough to enable him woo majority of Kenyans on his side.

The inauguration of the districts now awaits parliamentary approval and this will come to pass considering that most politicians are for the new districts which is a populist move by any standards but Kenyans are not as gullible as president Kibaki would like to believe.

Musalia Mudavadi Reluctantly Campaigns For State House As His Indecisiveness Is Exposed Yet Again

Kenyan Politics: Focus on a 2007 Presidential Candidate

Mudavadi will go down in history as Kenya's shortest serving vice president having held the office for about two months prior to the 2002 general elections.

After leaving Kanu for the opposition in 2002, Mudavadi rushed back to president Moi and was rewarded with the vice presidency position amid signals that Moi's Kanu regime was going to lose as majority of his foot soldiers had already deserted him.

As usual, Mudavadi did not see the signs and mainly due to his indecisiveness, Moi easily convinced him to return to Kanu at a time when the party's future looked bleak and its presidential candidate Uhuru Kenyatta was headed for defeat.

It was a grave mistake which saw Musalia pay so dearly for it as he also lost his Sabatia parliamentary seat to political greenhorn, pastor Moses Akaranga.

Mudavadi is still paying for this mistake to this day, as he has no political platform to speak from and his detractors say if he was unable to secure a parliamentary seat in 2002, how can he manage the presidency this time round?

The 46 year old presidential aspirant also has skeletons in his closet which have also affected him so much that he can't speak too loudly where men are discussing family life and values.

In a dramatic event during his heady days as finance minister, Musalia's wife gave birth to a 'colored' boy, which raised more than concern at the Mudavadi home with his mother instructing him to do away with the wife as her infidelity was unacceptable considering his high profile public position.

The indecisive former minister kept the woman who went ahead and sired more children for him. The Standard Newspaper had the story but Musalia used lots of money and his influence including threats not to have the story published.

However, the alternative media notoriously referred to as the gutter press had a field day with the story to the chagrin of the then minister who chose not to comment about the issue.

Even as he goes around conducting his lukewarm campaign for the ODM presidential nominations, Mudavadi knows well in his mind that he cant make it save for Raila to come out and say 'Mudavadi tosha' which is a very, very, very long shot.

The main reason why Musalia is bothering to go round asking for votes is the simple fact that members of his Luhyia community also expect one of their own to occupy the highest office in the land.

Crime Escalates As Contract Of Police Commissioner Nears Its' End

Police commissioner Mohamed Ali's three-year contract comes to an end next month and the big question among majority of Kenyans is, will the Kibaki government extend it considering his frosty relationship with his superiors?

Ali, a career soldier who rose to the rank of brigadier before being seconded to the police force is known to be a no nonsense man who managed to break cartels involving senior police officers with criminals, a move which made him popular with junior policemen and motivated them at the same time.

Unfortunately, criminal gangs got more sophisticated with increased firepower, to an extent where the police were overwhelmed as crime escalated including murders of police officers.

But that was the least of Ali's problems as he had to do deal with insubordination from senior officers including the fired director of criminal investigations department, John Kamau who openly defied his immediate boss and instead took instructions from internal security minister John Michuki.

Matters came to a head last year when Kamau mobilized an elite unit that seems to have included two Armenian mercenaries to raid the Standard newspaper newsroom without the knowledge of Ali who was abroad at the time. Apparently, the raid was sanctioned by Michuki who when asked to comment about it said 'one must be prepared to be bitten by a snake when you rattle it' he quickly got the nickname 'snake me-chuki'

Kamau was fired later on with the insistence of Ali who is reported to have told the president that he couldn't work with the CID boss due to his arrogance and insubordination.

Since then, Ali has not been in good terms with Michuki who could be his boss but cannot fire him since the police commissioner is a presidential appointee.

If these events are anything to go by, there are very slim reasons for Ali's contract to be extended but again, Kibaki has surprised Kenyans with some of his decisions and this being an election year, wananchi can expect anything from the desperate man who will be at pains to account to Kenyans.

VP Awori Announces That He Is Kibaki's Running Mate In Forthcoming General Elections

For a long time now it has been assumed that current Vice President Moody Awori would go off quietly into retirement and would not run in the forthcoming polls. More so because one of his sons was widely expected to run for the Funyula constituency parliamentary seat.

But all that changed yesterday at the constituency when the aging, but ever smiling VP announced that he was President Kibaki's running mate in the forthcoming general elections. The announcement came just a day after President Kibaki announced for the firs time that he would seek re-election.

The dramatic Awori announcement could have been dismissed as the last kicks of a dying horse except for one thing. There was an extremely heavy presence of MPs from Central province in Funyula when the VP made the announcement. And not just any MPs but a high-powered team led by Justice And Constitutional Affairs cabinet Minister Martha Karua in person.

So what is happening here when we know very well that he Narc-Kenya high command has been pushing very strongly for one Mukhisa Kituyi, the Trade minister to be President Kibaki's running mate and the next VP in the event that president Kibaki is re-elected?

Firstly, if there is one thing that has been consistent about the Kibaki administration, it is the habit of constantly and sometimes unexpectedly shifting positions concerning critical issues. Decisive decesion-making is not one of the president's strong points. There is little doubt that the choice of running mate is important enough to alter the outcome of the forthcoming general elections for any major candidate.

And hat has caused faithful, hardworking and youthful Kituyi to be dropped in favour of aging Awori?

A clue that could help in answering this question are the recent pronouncements by Luhya MPs to the effect that they are no longer interested in the VPs post. In fact the Luhya (which is not really one tribe just like the Kalenjin are not tribe) seem to be defying all odds and predictions (including predictions by this writer) and indications are that the group tribes calling themselves Luhya will for the first time enter a general election more united than they have ever been before. In fact chances are increasingly high that the community will field a presidential candidate if their front-runner, Musalia Mudavadi does not win the ODM nomination.

The Narc-Kenya think tank seems determined that the party should not lose its' strong footing in Funyula and may want to use the constituency as a strong base in which to launch forays into the expansive Luhya communities that are to be found all over Western Kenya and in parts of Rift Valley province.

Admittedly Mukhisa Kituyi was never a strong VP candidate right from the word go when one considers the numbers that he is capable of delivering. For starters he hails from the relatively small Bukusu community, which has been rabidly Ford Kenya right from the launch of multi-party politics in 1992. The Bukusu had a VP candidate in the last elections, one Michael Kijana Wamalwa (now deceased). Wamalwa was a key player in the Kibaki winning team. Kituyi is not quite as popular as Ford Kenya chairman Musikari Kombo, so he would have brought very little of anything to the table.

Make no mistake about it, the people in president Kibaki's re-election team are constantly doing their sums and numbers that will help their candidate end up with the highest number of votes is topmost on their minds. They have already done their arithmetic and concluded that the massive Kikuyu vote will be more or less behind the President who hails from Othaya in Central province. The Kikuyu vote alone is enough to win a presidential election, especially if the opposition fails to unite behind one candidate. In fact the Kikuyu influence countrywide is strong enough to guarantee 25 per cent from at least 5 provinces in the country (the other requirement for a winning presidential candidate). Namely Central, Nairobi, Rift Valley (still with a huge Kikuyu population), Western and Coast.

You may now begin to understand why the Kibaki administration is so determined to resist minimum reforms before the elections at all costs. And why Raila Odinga and company are so determined that reforms are carried out before elections. And the reform that is right at the top of their list is that a presidential candidate must win a least 50 percent of the vote plus one, to be declared winner.

While analysts agree that Awori Arthur A. Moody (the family seems to have a penchant for names with three similar initials. Awori's father was called Canon W.W.W. Awori) is a better choice for a running mate for President Kibaki than Mukhisa Kituyi, there is one factor that will tend to rubbish any positive analysis in this matter. And that is the fact that the political situation in Western Kenya right now is pretty fluid and there is a strong anti-Kikuyu sentiment on the ground. We saw a glimpse of this during the referendum when Funyula constituents overwhelmingly passed a "No" vote against the wishes of their still-popular MP. Chances are high that they will do the same thing in the forthcoming election and send their well-liked MP back to parliament but pass a firm "No" vote against his boss.

Marital Rape In Kenya: New Twist As Woman Goes To Court To Stop Husband Raping Her Again

Marital rape is a subject that most Kenyan men do not take seriously at all. Yet it is a national crisis that will have to be addressed soon even as it continues to spin out of control.

One unprecedented case filed by a Kenyan woman recently, seems to illustrate the gravity of the situation. The woman who is a seller of designer clothes has asked a Kenyan court to restrain her husband of 24 years from coming anywhere near her and should only appear to have sex with her when it is consensual. The woman has had three children with the serial rapist since their marriage at the AG's chambers in 1983.

The woman goes on to say the latest rape occurred only last week when her husband burst into the house on a Friday after the children had gone to school.

In this particular case the woman says that the husband currently lives with another woman and has a relationship with a third.

One of the big emerging issues these days is the possibility of catching HIV-AIDS from a husband who is not faithful and has several other sexual partners while still insisting on continuing to have sex with their wives. The right of the wife to refuse sex on the ground of suspecting one's husband of philandering is more than a good enough reason. One must bear in mind the fact that especially where children are involved, the wife (who is usually the more responsible person in many Kenyan homes) has a right to protect herself if for nothing else, for the sake of her children.

But even where both partners behave responsibly, rape can and does take place frequently in Kenyan bedrooms. Many Kenyans do not believe that rape can take place on a marriage bed and see sex as the right of the husband to be meekly delivered whenever it is demanded. The same Kenyan men are quick to criticize the Kibaki government for any human rights violations taking place in the country when there is absolutely no regard for the dignity and feelings of the woman in their own homes who is the mother of their children.

Kenyan Politics And The Biggest Lie And Betrayal By Candidate Kibaki

There is no doubt that Kenyan politics has changed a lot since 2002 and continues to change. However one thing that cannot be changed are the historical facts and most notably the historical facts behind the successful candidature of one Mwai Kibaki. The big question Kenyan voters will have to ask themselves in the forthcoming general elections is of they can trust their country once again to somebody who short-changed and betrayed his colleagues.

Kenyans who have a memory worth of repute will remember that one of the issues that the initial Kibaki-Kijana Wamalwa-Ngilu group kept on talking about was that the country badly needed one-term presidents to help fight tribalism and other terrible consequences from years of Moi mis-rule. The late Kijana Wamalwa once said in a speech that was widely publicized on TV shortly after his death in a London hospital, that Kibaki would go for one term, leave it to Wamlawa who would leave the presidency for yet another Kenyan.

Today, not only has the Kibaki camp conveniently chosen to forget those noble declarations made which were for the good of the Kenyan people, but anybody who dares bring them to remembrance is labeled a liar. But sincerely who is the liar? The dead Wamalwa Kijana who so eloquently and clearly verbalized the agreement the three=then opposition king pins made?

Some analysts don't even blame Kibaki. Instead the point to the fact that something is bound to happen to any mortal who rises to become president of Kenya that will suddenly cause them to have a serious bout of amnesia over anything they said or promised during their campaign trail. The office of President of Kenya is so powerful that it will not fail to go into any good person's head and turn them from a popular democrat to an evil autocrat in short order.

Other major promises of the Kibaki campaign team were a new constitution within 100 days, zero tolerance to corruption and 500,000 new jobs created annually. Alas today the Kibaki team chooses to ignore and forget "all that mumbo jumbo" and instead concentrates on what they believe are their achievements as they prepare to go all out for the re-election of candidate Mwai Kibaki.

Is this the curse of Kenyan politics, that candidates will forever lie to the Kenyan electorate, telling us one thing and then not bothering to remember, let alone attempting to do what they promised, once they are safely inside the State House compound? Will Kenyan politics continue to be dominated by the ruling class who have no time for the ordinary mwananchi and their every day problems (mostly created by the same politicians)?

Mass Action And Mass Violence Inevitable As No-Reforms-No-Elections-Campaign Picks Momentum

It looks like we are definitely headed for a show down and it is going to be one hell of a show with lots of fireworks. But no excitement, only more suffering for the already stretched ordinary Kenyan.

Opposition parties are all agreed that there will be no general elections in Kenya without minimum reforms, even if it means delaying the polls. The government is saying, "we don't scare that easily and we're not going to be threatened into discussions." It is clear that although Justice Minister Martha Karua says that the government is ready for dialogue at any time, Narc Kenya are not interested in reforms. If anything their strategy has been based on the country going into these elections without any reforms. In other words they do not want to lose the huge incumbent advantage the current constitution gives them.

The wily opposition operatives on the other hand have pushed the kind of reforms that put President Mwai Kibaki at a great disadvantage, right to the top of the reforms agenda. One such proposed law is the 50 per cent rule where the opposition king pins argue that if you are going to give a president powers that come close to those of the almighty, then they might as well insist on their getting over 50 per cent of the popular vote. If this is passed into law, it will put Kibaki's handlers into a mess because working closely with Moi, they seem to have worked out an intricate campaign strategy where by relying on certain assured pockets of support countrywide, their candidate will cruise back into power without breaking into a sweat and Lucy Kibaki will not need to do any packing or house hunting towards the end of this year.

The last time there was a similar showdown between the two sides, the situation was only saved by a last minute decision to post the ODM-Kenya registration certificate. This time all indications are that no side wants to be the first to blink.

There is now a remote possibility but nevertheless a possibility, of certain major political parties sitting out the polls in protest even as Narc Kenya doggedly goes on with them. That can only mean one thing—chaos.

What makes this a possibility is the fact that Narc-Kenya do not seem to have a plan B strategy for winning these elections. It will therefore be suicidal for them to accept minimal reforms before the elections.

It is important to point out that even ODM-Kenya, the darling of many Kenyans has let down the ordinary mwananchi very badly. When tribal clashes broke out in Mathare slums ad other parts f the country, leaving many innocent Kenyans dead, the MPs did not demonstrate in the streets as they did for their precious registration certificate. Now they want to call on the public to demonstrate again, this time so that their match to power is made smoother. In the event of a confrontation with the police, most MPs will have their aides on hand ready for a quick getaway to leave the "cockroaches" to be bludgeoned to death, or even worse, with high medical bills from injuries sustained that they will spend the rest of their lives paying for.

Some of the MPs crusading for mass action will play it the Kalonzo Musyoka way. Incite and inspire a large turn out and then be absent during the actual demonstration (why does this man duck so much in life, he even disappeared into the toilet during an important government vote. If he becomes president, there is no telling what he will duck).

A level playing field is important, but I am persuaded that known lions do not wake up one morning being gazelles. Nor can wolves be turned into sheep. They can only be lions in gazelles clothing or wolves in sheep's clothing for the sole purposes of hunting for food. The sort of characters who currently pollute the ODM-Kenya high command are NOT the kind of people who will lead Kenyans to the promised land. Nor will they prosecute Goldenberg or Anglo Leasing. The tragedy of it all, is that neither will Narc-Kenya (or whatever it is you call the group that has been in power since the end of 2002) deliver the goods—as they have already demonstrated to us in four years of broken promises and the most blunder-prone government in Kenya's history. And that is a fact.

Kenyans can only wait and pray and hope that a third viable alternative will somehow emerge.

Meanwhile prepare yourself for mass action and all the terrible consequences it comes with.

Rift Valley Fever Scare Hits Nairobi

Nyama choma city is in trouble, big trouble. Beef-loving Kenyans have suddenly stopped consuming meat. In a city where meat and especially beef is consumed with much abandon and in huge quantities, the butchers are suddenly very idle.

Following an outbreak of the dreaded rift valley fever, which has claimed humans and livestock since late last year. This fever has spread steadily across the country touching most provinces and claiming over 50 lives countrywide so far.

Still the matter was just another news item in the press until recently when reports indicated that the dreaded flu was in the outskirts of the city. Cases were positively identified in the Maragua area. It now became clear to all that it was only a matter of time before it found its' way into the heart of the city thus threatening the over 3 million Nairobi population. Nairobi's Kenyatta National Hospital reported it's first death from the disease last week, although it was a case that had been referred there from another district.

Initial reports confirmed that the disease had claimed one person in Kirinyaga before spreading to Maragua and later Kajiado district. All these districts are dangerously close to the city in the sun. Most of the meat consumed in Nairobi comes from the Kajiado area which must be the main reason for the panic now gripping the city.

Chicken and vegetable traders are experiencing booming business as majority of Nairobians opt for the two options.

The usually busy Dagoretti livestock slaughtering facility in the outskirts of Nairobi has now become almost a ghost town as beef traders have taken a break from the business until the scare ends. Initially, 100 bulls were being slaughtered daily but now they are struggling to do 50.

Butcheries in Nairobi have been affected badly with many opting to temporarily shut down until the deadly disease is arrested by the concerned authorities.

Adding insult to injury, the disease has chosen a bad time to rear its ugly head as it is only a few months ago that the government revived the Kenya meat commission that was soon to realize its goal of slaughtering 1,000 bulls per day for both local and foreign consumption.

Assurances by the government through its spokesman Dr Alfred Mutua that the fever is under control and has not yet hit Nairobi seems to have fallen on deaf years as the spokesman has a reputation for denying the obvious so as to perpetually paint his masters in good light. A case in point is that a press conference had earlier been planned at Kenyatta National Hospital with medical experts, but was cancelled at the eleventh hour as Mutua addressed the press instead. The idea here seems to have been to prevent panic from spreading in the city. If only the government knew the sort of confidence Kenyans have in official government statements these days. It would have been much more reassuring to give the facts through medical experts.

Crazy Theory: It is still a mystery as to how this deadly Rift Valley Fever entered the country. One source, who is not an expert, tells this writer that it could easily have come in from Somalia. And the fact that that country is a target of US attention because of being a haven for terrorists, could mean that the virus could easily have be man-made and introduced to destroy a major potential source of revenue to finance terrorist activities. No government on earth can ever admit to such a thing, but it is a well known fact that deadly viruses are these days stored and even manufactured in labs. Somehow this crazy theory does not sound too far-fetched and is well worth investigating. Over to you, viral experts.

Kalonzo Musyoka Tells Kenyans Kibaki Is Too Tired To Rule

Presidential aspirant Stephen Kalonzo Musyoka has intensified his countrywide campaign for State House and has openly dismissed the incumbent, Mwai Kibaki as too old to rule and should pack his bags and go home to rest.

This is probably one of the few times that the over-cautious Musyoka has fired a direct salvo at the head of state considering that he is among those who many speculate could join Kibaki's Narc Kenya if defeated in the ODM nominations.

Others are even more surprised by Kalonzo's utterances as they view him as one of the moles in ODM who are spying for former president Moi and by extention president Kibaki as the ex and incumbent have struck a strange friendship in the recent past.

In saying that Kibaki is too old to rule, Kalonzo is endearing himself to millions of youths who have been disillusioned by the current government, which has locked them out from key appointments and decision-making positions.

Musyoka who is in his early 50's is considered young by the youth taking into consideration that those who have occupied the presidency before have been grey haired men who made things even worse by crowding their peers in influential positions.

Many will agree with Kalonzo that Kibaki is too tired to rule considering his indifference towards various issues of national importance where he chooses to bury his head in the sand and not comment, let alone act, even when the issue is causing anxiety among Kenyans.

It could be true that the president is old and senile considering his eccentric behaviour of calling his detractors idiots 'Kumbafu' in public. At other times he has called them chicken droppings.

There are quite a number of younger and dynamic presidential aspirants lining up to replace Kibaki and it will take nothing short of a miracle for him to be re-elected in the much awaited polls expected in December.

Anglo Leasing Cover Up Continues As Kibaki Administration Seeks To Limit Impact Of Latest Githongo Tapes

One of president Kibaki's strongest defenders, Justice Minister Martha Karua played down the latest Githongo tape implicating former finance minister David Mwiraria saying, 'they have no weight in law.'

She even went further and agreed with the Kenya anti corruption commission (KACC) that Githongo was not an investigator and his evidence is subject to scrutiny by an investigator before it becomes admissible as evidence.

Fair enough, but hasn't the justice minister already rubbished the tapes even before experts have scrutinized them? However, it is interesting to note that Karua has asked Githongo to release all tapes in his possession regarding the Sh 50 billion scandal that has turned out to be the biggest nightmare for the Kibaki administration.

Apparently, Karua is among the very few cabinet ministers in the Kibaki government that Kenyans take seriously these days as she has not only proven to be competent but has steered away from financial scandals unlike most of her colleagues who have turned out to be over-night millionaires by engaging in high level corruption.

Kibaki's decision to move her from the water ministry to the justice department is perhaps the best decision he has made to date concerning his aged cabinet where the most powerful positions have been reserved for those over 70 years old.

Karua has tried her best in handling this hot issue that is the Anglo Leasing scandal but her appeal to those with vital information concerning the scam to surrender it to the anti corruption people, has been considered a public relations exercise aimed at hoodwinking Kenyans that top government officials were not involved.

It has now become obvious that the scandal will be a major issue in the forthcoming general elections and chances are that Kibaki will lose on account of allowing the scandal to happen during his watch. Many believe that the dubious deals went ahead with his blessings

Karua has the Herculean task of attempting to tame the monster that has gone out of control to the chagrin of the Kibaki administration which could make history by being the first to serve only a single term before being kicked out for graft and false promises to Kenyans.

Anglo Leasing: Sales Lady Agent And Kamani Family Remain "Untouchable" In Kenya

Kenyans are notorious for two characteristics that have greatly helped the corruption cartels survive with relative ease in the country over the years and even murderers get away with brutal murder. Firstly we have very short memories and secondly we get bored pretty fast.

Nothing wrong with being bored quickly except that if the subject matter is a mega scum that your great grand children will still not quite pay off for, then it is criminal to put it off your mind for one second. Boredom of the Dr-Robert-Ouko-murder-circus that has now been running for over 15 years may arguably be excused, despite the great pain to close relatives, like his widow. But surely Kenyans must pursue tenaciously, mega scandals that have robbed and impoverished millions of Kenyans like Goldenberg and Anglo Leasing.

It is safe to assume that this administration is banking on the habit of the Kenyan public to quickly forget or get bored and are hoping that as the year progresses, the latest Githongo tapes will fade into the background as the excitement and drama of election campaigns hit center stage. They are hoping that in that kind of scenario Kenyans will even find it in themselves to re-elect this corrupt and incompetent government of mostly grand dads, back into power.

Some people in the opposition have other ideas and are hoping to keep the massive Anglo Leasing scandal fresh on the minds of Kenyans right up to polling day. For selfish reasons of course because many of them have also been involved in corruption on a grand scale.

Meanwhile even as the public focuses on Githongo and Justice Minister, Martha Karua who has rapidly emerged as the government's voice in the Githongo issue, there are others who were involved in this mega scandal whose names have completely been forgotten.

For example does the name Sudha Ruparell sound even remotely familiar? No? But that is the Anglo Leasing Sales Agent. The 48-year-old woman is one of the very few visible faces of the mysterious Anglo Leasing Finance, which is right at the center of the entire mess that Githongo has been shouting himself hoarse about. Ms Ruparell is the member of a family whose name no doubt rings a bell amongst many Kenyans. This is the notorious Kamani family. She is actually the daughter of Chamanlal Kamani and sister of Rashmikant Kamani and Deepak Kamani.

Name any major security supplies scandal in Kenya and the Kamani family name is bound to pop up. Remember the Mahindra's supplied to the Kenyan police that were a big joke in car chases with violent criminals? Guess who supplied them? The Kamani family through one of their many companies, this particular one called Kamsons Ltd.

To put it briefly (and not bore Kenyans with the details that they usually get quickly bored with) The Kamani family has made a name for itself for getting involved in deals where they sell stuff to the Kenyan government at greatly inflated prices and many times the stuff is not even delivered, although it is paid for upfront. Which incidentally is what the Anglo Leasing mega scandal is all about.

Although at least one member of the Kamani family is wanted by the Kenya police and Interpol for questioning regarding Anglo Leasing, the family businesses continue to thrive and prosper in Kenya. You probably didn't even think about it when you made that major purchase there only yesterday. The family member wanted by police is Chamanlal Kamani and there is actually a reward of of Kshs 100,000 (US$1,500) for information leading to his capture.

The rest of the Kamanis are not on the run like Githongo is and yet it has become abundantly clear that no discussion of Anglo Leasing can take place without the Kamani name featuring prominently.

Breaking News: Githongo Anglo Leasing Site Suspended

Huge Traffic To Listen To Anglo Leasing Tape, Causes Site To Be Shut Down

What must be the most visited site on the Internet by Kenyans, has been suspended after surpassing bandwidth requirements due to the overwhelmingly huge traffic flocking in to listen to the latest Anglo Leasing audio tape.

This means that the controversial audio tape is no longer available to the whole world to listen to.

However a posting at the site (http://www.eyeonkenya.com/al/al.php) promises that the site will be restored soon and redirects people back to Githongo’s blog http://www.githongo.blogspot.com/ where the same message is repeated.

Githongo will have to do a deal and pay bandwidth costs to get the site back up and running. Kenyans everywhere will be hoping that this is done as soon as possible.

Latest Githongo Tape: Who Is Anglo Leasing?

Why Did Mwiraria Rush Back To Nairobi On Recieiving News Of The New Tape?

One of the questions that have been raised in the minds of many Kenyans in the wake of the dramatic release of the latest John Githongo tape is; who is Anglo Leasing?

Who is the shadowy figure that lawyer Fred Ojiambo was so protective over to the extent where he was prepared to spend time in a filthy Kileleshwa Police cell with common criminals and not divulge the name?

Who is this person who caused former finance minister David Mwiraria to ask Githongo rather anxiously in the latest tape, as they discussed Ojimabo's arrest; "did he give any information?" One can almost sense the relief when Githongo confirms that they were not able to get this key information from the well-known Nairobi lawyer.

Mwiraria even goes on to clearly imply that there was great danger in "harassing Ojiambo" because "you never know what he might say and who else he will pick on.. and who he will go down with Anglo Leasing." So who is this shadowy figure that instructed lawyer Fred Ojiambo to place the ads? This person who Mwiraria was not prepared to have their name "picked on?"

That is the question that Kenyans will have to puzzle over even as the government remained strangely quiet over the latest released tape (many believe that they had been stunned into silence). Even this government's most aggressive defender, foreign minister, Raphael Tuju referred the enquiring press to "the arm of government incharge of investigations." It speaks volumes that Tuju DID NOT say his former cabinet colleague was innocent and that this was a plot to derail Narc Kenya's election campaign, which is the usual predictable statement that one would expect.

The latest tapes arose out of an interesting situation where KACA, under the direction of Githongo decided to go after lawyer Fred Ojiambo for information after he booked a series of ads in the local media that defended the position of the brief-case company called Anglo Leasing. It went without saying that simply revealing the name of the client he was booking the advertisements on behalf of would have revealed who this key Anglo Leasing link was.

Githongo uses the word "belligerent" several times in the tape to describe Ojiambo's behavior towards KACA investigating officers who were seeking the vital information from him. This means the lawyer was spoiling for a fight and was aggressive and quarrelsome. Githongo however points out that after a few hours in police custody, he changed completely.

Here Githongo was clearly sending a message to the two cabinet ministers in using the word repeatedly and probably also trying to get some information from them. It is clear that he would not have recorded his conversation with them had he not been sure that the pair were right at the center of Anglo Leasing. Why would a lawyer be so cocky to Kaca? Unless of course he knew that he had some very powerful protection indeed.

But even more dramatic in the latest tape was Mwiraria invoking the name of the president and informing Githongo that the president was in fact aware. Mwiraria points to a memo and a discussion he had with the president.

Chances are high that one of the reasons why Ojiambo never divulged the name of his client was because that person would have led straight to the highest office in the land. Indeed that is exactly where Mwiraria seems to have rushed to when news of the release of the latest Githongo tape came out. The minister is said to have been out of town but quickly rushed back to Nairobi. It is no secret that Mwiraria remains very close to President Kibaki. The two have in fact been close friends for many years.

In the next day or so we should see some sort of government reaction even as we wait this morning for some more revelations from ODM-Kenya secretary general Prof Nyang Nyong, who was minister of planning in the Kibaki government when Anglo Leasing was happening. Nyongo promised yesterday to "tell Kenyans what I know."

Understand What Anglo Leasing Is All About.

Who Is Lawyer Fred Ojiambo?

The mention in the latest John Githongo tapes, of lawyer Fred Ojiambo has left many Kenyans wondering who he is and what his link to the biggest scandal that has rocked the shaky administration of President Mwai Kibaki could be.

Just to compare lawyers, Mutula Kilonzo was the lawyer who was very close to the inner circles of the Moi administration and if there is such a lawyer in the Kibaki administration, then that lawyer would have to be Fred Ojiambo. He is the one who comes closest to fitting the bill.

Many Kenyans will remember Fred Ojiambo as the Kenyan African lawyer who speaks with a British accent who prominently represented former VP Musalia Mudavadi in the Goldenberg commission of enquiry.

He is also the same lawyer who represented Lord Delamere's grandson, (yes, that complicated tongue twisting name) when he shot a Kenyan on his expansive ranch near Nakuru and got away with it. Mr Chomodley is now facing a murder trial for the second tragic shooting incident and Fred Ojiambo is still representing him. In the first case, the lawyers' contacts and influence were clearly evident when against public outcry Mr Chomodley walked scott free after the first tragic shooting incident on his ranch and all in record time.

Little else is known of this lawyer who seems to hold a very important key to resolving the Anglo Leasing scandal, since he knows the identity of the shadowy figure who was so determined to defend Anglo Leasing and to have the deal go through at all costs.

John Githongo: The Son Of The President’s Bossom Buddy Who Ended Up “Dissapointing”

The main reason why president Kibaki chose John Githongo as his most trusted permanent secretary to be in charge of ethics and governance was for the simple reason that he knew his father very well and they have been bosom friends for years.

In his mind, Kibaki assumed that when push came to shove, he could easily contact John's father and have him talk to his son to take instructions without asking too many questions, and of course, accept to be manipulated by the ruling elite. In brief they would say of Githongo; "he is one of us."

Coupled with the fact that John had a solid reputation for being an anti-corruption crusader having worked for Transparency International, he was the perfect candidate for the job and the appointment pleased everybody including the so called development partners. (It was the sort of appointment made in heaven similar to that of Amos Wako to the post of AG by Moi in the 90s. Wako, once upon a time, had a solid international reputation. Look what Kenyan politics has done to him?).

What Kibaki failed to see in young John was the simple fact that the boy had become his own man and even invoking his fathers name could not cause him to waiver. Kiraitu Murungi was the first to try with disastrous results.

The fact that Githongo was relatively young, approaching his forties, and still single, the aged ruling elite never envisaged that 'the boy' could go against 'his fathers' but little did they know that young John cared less for African tradition and could never let it come between his job which he did with undivided dedication and diligence.

From the transcripts he recently released between him and former finance minister, its evident that the old guards in Kibaki's inner circle treated him the way they treat their teenage kids and one could not help noticing the patronizing tone of David Mwiraria and Kiraitu Murungi.

When the young Githongo became 'difficult' to deal with, the likes of Murungi got impatient with the 'boy' and even opted for blackmail in a bid to have their way which also failed miserably as Githongo recorded the conversations and later made them public.

What Githongo has done to the Kibaki administration has annoyed the ruling elites so much that Githongo's old job, PS in charge of governance and ethics was abolished and the state house office shut down.

The only remaining permanent secretary at state house is Stanley Murage who is in charge of research and policy analysis. He has been named in the Artur scandal where he supposedly introduced two international criminals posing as foreign investors to the president.

Why Would The President's Men Need So Much Cash?

From time immemorial, the top leadership in almost all governments and not only in the third world alone has been looking into ways of raising millions of dollars without dipping their fingers into public coffers.

Unfortunately, African administrations have not been creative enough in their fund raising efforts and have usually found themselves fleecing the country's treasury through dubious schemes like Goldenberg and Anglo Leasing..

This goes back to the question as to why does the country's chief executive and his cronies need so much cash (millions of dollars) especially in a country like Kenya where our politicians are among the best paid in the world?

For starters, Kibaki needed lots of money to woo Kenyans prior to the referendum vote where dozens of delegations visited state house and for the first time since he took over, the visitors were given transport money and cash for lunch, prior to departing.

Then there is the opposition to be dealt with. In Kenya's case , Raila Odinga and his team have been a constant thorn in the flesh of Kibaki and are always strategizing on how best to hit out at the government and malign the name of the president.

Such moves warrant a strong counter attack strategies, which costs lots of money as it is common knowledge that those on the defensive have to spend more money than those on the offensive in Kenyan politics.

The ruling elite have to meet at exclusive retreats far from the eyes of the public to thrash out thorny issues which could last several days not to mention those in attendance, usually MPs have to be given a subsistence allowance to cover their 'fuel costs and 'inconvenience' in attending these meetings.

These are just some of the items which may seem small but need quite substantial amounts of cash which make them good motivations to perpetuate multi million scandals like Goldenberg and Anglo Leasing.

Then there is the fact that in many cases, you will find that the president's closest ministers spend too much time on government matters and lose touch with their constituents hence making them unpopular and unlikely to recapture their parliamentary seats. Since the president finds these men and women indispensable, large amounts of cash have to be raised for these people to ensure they popularize themselves fast and get re-elected so as to continue serving the head of state. This is one of the reasons why Kenya should strongly consider switching to the American system where members of the cabinet are not elected members of parliament.

NARC Kenya has said that its' polls budget is Sh 5 billion while the opposition ODM party said they had reached a figure of Sh 2 billion. Where is all this money going to come from?

NARC Kenya being the ruling party is not very hard to guess how they are going to raise the amount, in fact chances are very high that they could already be in possession of the money. For those who love figures, let me humor you by pointing out the fact that Shs 5 Billion is only 10% of the Shs 50 billion that the Anglo Leasing scandal has cost the Kenyan taxpayer.

It is important to note that although on paper, there are strong reasons justifying the raising of the cash, in reality these kind of deals will always tend to spiral out of control as the greedy people running them will seek to ensure that they personally pocket as much money from the proceeds as possible. This usually starts out with the excuse of costs, but when a deal or two has been done, they have been known to maximize on the funds coming in and then ensure that the hands of the politicians involved are "well greased" so that they turn a blind eye as a few people get fabulously wealthy at the expense of the national treasury.

It makes little sense for one to expect the attorney general, Amos Wako to prosecute those involved in the Anglo Leasing scandal yet he is at the center of the scam.

The ever smiling lawman okayed the Anglo Leasing contracts as being genuine and above board prior to the government committing itself to the dubious contracts and there is no way he can prosecute those involved as this will also mean prosecuting himself.

It was the KACA (Kenya Anti-corruption Commission) boss himself who put it very well to John Githongo when the two met in London. 'The Anglo Leasing case will not be prosecuted before 2007 "if ever" as this will be tantamount to political suicide.

What Aaron Ringera did not complete was that the scandal will never be solved as long as President Kibaki is in power and there are no guarantees that an ODM government will have the political will to see the mega scandal to its logical conclusion.

If there is anybody in government who knows those behind the scandal well, then it is Wako since he also served in the Moi regime when the scandal was born before it was inherited and greatly expanded by the Kibaki administration which was hungry for cash and could not miss such a juicy opportunity of making billions of shillings so easily.

It is also possible that Wako has simply been taking instructions from the minister of justice and constitutional affairs as the creation of the ministry rendered Wako impotent and idle and he simply operated like a rubber stamp. The fact that Wako served many years under the Moi regime, the NARC government could not quickly trust him when they came to power and he simply signed and approved things without reading or questioning the then justice minister Murungi who Wako fears due to his proximity to Kibaki.

Whatever the case, Wako should have been the first top government official to resign and pave way for investigations when the scandal was exposed as sending a high profile thief to catch another high profile thief can never work.

The Radical Surgery Of The Judiciary That Never Was

One of the first things that the Kibaki administration did on taking over power in 2002 was to embark on what was called a "radical surgery of the judiciary". Several high court judges opted for early retirement rather than face a tribunal to investigate their conduct. Some of these were innocent and the country lost some good judges. But a good number also opted to face the tribunal.

It is now clearly evident, especially after the third juidge Justice Daniel Aganyanya was cleared by the tribunal investigating him yesterday, that the whole exercise seems to have achieved very little indeed. The tribunal is yet to find any judge guilty of any wrongdoing. Those who launched the campaign seem to have forgotten that even if you know for sure that somebody is guilty of corruption, you still have to prove the whole thing. And proof was what was lacking in all the cases. That is the sort of proof that can stand up to legal scrutiny.

There is also a feeling among many analysts and observers that enthusiasm to fight corruption quickly fizzled out as many of the previously principled key government figures started enjoying the trappings of power. The result today is that this government has sunk so low that it is viewed to be almost as corrupt as the Moi administration. Little wonder that Moi and Kibaki have warmed up to each other tremendously in recent times.

It is said that power corrupts and absolute power corrupts absolutely.

This is yet another sad chapter of how things went wrong with the Narc dream that was not to be.
