It makes little sense for one to expect the attorney general, Amos Wako to prosecute those involved in the Anglo Leasing scandal yet he is at the center of the scam.
The ever smiling lawman okayed the Anglo Leasing contracts as being genuine and above board prior to the government committing itself to the dubious contracts and there is no way he can prosecute those involved as this will also mean prosecuting himself.
It was the KACA (Kenya Anti-corruption Commission) boss himself who put it very well to John Githongo when the two met in London. 'The Anglo Leasing case will not be prosecuted before 2007 "if ever" as this will be tantamount to political suicide.
What Aaron Ringera did not complete was that the scandal will never be solved as long as President Kibaki is in power and there are no guarantees that an ODM government will have the political will to see the mega scandal to its logical conclusion.
If there is anybody in government who knows those behind the scandal well, then it is Wako since he also served in the Moi regime when the scandal was born before it was inherited and greatly expanded by the Kibaki administration which was hungry for cash and could not miss such a juicy opportunity of making billions of shillings so easily.
It is also possible that Wako has simply been taking instructions from the minister of justice and constitutional affairs as the creation of the ministry rendered Wako impotent and idle and he simply operated like a rubber stamp. The fact that Wako served many years under the Moi regime, the NARC government could not quickly trust him when they came to power and he simply signed and approved things without reading or questioning the then justice minister Murungi who Wako fears due to his proximity to Kibaki.
Whatever the case, Wako should have been the first top government official to resign and pave way for investigations when the scandal was exposed as sending a high profile thief to catch another high profile thief can never work.
