SCHEDULE OF ALLEGED PERPETRATORS

CAUTIONARY STATEMENT

The Kenya National Commission on Human Rights (KNCHR) recognizes the existence of the culture of impunity in Kenya and the need to remove this shield. In the preceding chapters of this report, the KNCHR has made key recommendations including calling upon the Attorney General of the Republic of Kenya and/or the Kenya Police Force to undertake further investigations on various issues that the Report raises. In this section, we provide a list of alleged perpetrators, who were mentioned by interviewees as having played a role in the perpetration of the post election violence. The list is not comprehensive and does not present a complete picture of all who may have been involved. It makes mention of various alleged perpetrators and includes some background information on them, and the allegation(s) and information supporting the allegation(s), which the National Commission believes provides a basis and a good starting point for further investigations.

Every effort has been made to ensure that the information supporting the adverse mentions reaches a threshold that had been agreed to (see Page 20 in Chapter One).

The National Commission is not making any conclusions that the persons mentioned here are guilty; this is presented in the effort to remain faithful to hundreds of Kenyans who provided this information which we expect that the relevant agencies will further

investigate.

On many occasions unsuccessful efforts were made to contact those mentioned. In particular, given that this was election related violence, the Commission sent out letters to all the members of parliament, which however elicited very few responses.

The list was subjected to review by independent persons at the different stages of compiling the report including by the staff and commissioners as well as by national experts contracted by the National Commission to review the report and critique the same.

  1. The late Hon. Lorna Laboso M.P, Sotik Constituency

Planning and incitement to violence

On the third week of January 2008, she attended a purported peace meeting at Manaret Society, and incited the local community after which a vicious attack against the Kisiis was instead intensified.

Together with Franklin Bett they talked to and incited about 700 youths at the Sotik Tea Estate and immediately they left the youths began to burn houses belonging to Kisiis.

Planning, incitement, and financing the violence

During a public meeting in Kiptororo in Kuresoi in December 2007, he reportedly urged the Kalenjins to fight the Kikuyus until they leave Molo area.

Before elections, he and other prominent politicians attended a meeting in the interior Ndoinet forest. After the said meeting, the group that attended attacked and destroyed properties belonging to the non Kalenjins. It is believed that they incited the locals to attack non Kalenjins.

He brought young men (boys) in groups of more than 300 from Bomet who worked with the Luo locals to attack the Kikuyus.

Together with the late Kipkalia Kones and the late

Kimutai Too they financed the Kalenjin youths who

attacked the Kikuyus and Kisiis in Kericho.

He organized youths to attack the Kikuyus and

Kisiis in Kericho. He gave them transport, fuel and

food and held meetings at Kericho Tea Hotel and

other places.

He told supporters that “all the investors in

Kericho and in the estates will be either Kalenjins

or Indians”. This statement is said to have given

the youths motivation to attack all other tribes

especially Kisiis and Kikuyus.

He is said to have been explaining to people who

attended a meeting at Kipkatet that no one can

take what belongs to the Kalenjins, especially land.

In a meeting held in Chopkoibet in Bomet, he is

quoted to have said that “ he will beat up the

Kikuyus till they leave Molo”

Together with the late Kipkalia Kones and the late

David Too, they organized and facilitated the

youths to be transported from Trasmara and

Bomet by lorries through Silibwet to go and chase

Kikuyus from Kuresoi.

He intimidated people at Kericho Police Station

and told them that those that give information to

investigators on post election violence will be

lynched.

Eye witnesses have reported that on the 30th of

December 2007 at around10.00 am, at the Caltex

Petrol Station in Kericho town, he gave

unspecified amount of money to some Kalenjin

and Luo men who immediately after the said

payment started stoning and burning kiosks

perceived to be owned by Kikuyus but were in

actual fact owned by the Kipsigis and the Kisii

people.

3. The Late Hon. David

Kimutai Too

MP, Ainamoi Constituency. Planning, incitement, and

financing the violence

Incitement to violence

On the 23rd November 2009 went to Stagemart in

Kericho and addressed a crowd asking residents to

remove all the stains/spots (madoadoa) from the

region. In January 2008 he asked that all the

stains/spots (Madoadoa) be removed from the

region.

Together with Kipkalia Kones and Franklin Bett

they financed the Kalenjin youths who attacked

the Kikuyus and Kisiis in Kericho.

In January 2008 while addressing youths he is

reported to have told the youths :”When we tell

you to block, make sure you block the road, and

when we tell you to remove, make sure you

remove them.”

Kalenjin raiders were hosted at his residence in

Sirikwa from where they launched attacks against

the Kikuyus and Kisiis.

Too they financed the Kalenjin youths who

attacked the Kikuyus and Kisiis in Kericho

5. Hon William Ruto MP, Eldoret North Constituency,

Minister

Planning, incitement, and

financing the violence

In August 2007 he held a meeting with other

senior ODM leaders in Kipkelion near Kericho

including Sotik MP the late Lorna Laboso , the late

Kipkalia K. Kones (Bomet), Kiprono L. J. Magerer

(Kipkelion) , and Franklin Bett (Bureti) where the

leaders resolved to carry out mass evictions of

non Kalenjins from ‘their’ Rift Valley areas,

particularly the Kikuyu and Abagusii.

During an opening ceremony for the Seventh Day

Adventist Church in a place called Mailing, he is

alleged to have said that they would uproot the

“sangari”, ‘shake off the soil’, ‘gather it together’

and ‘burn it’, in reference to ‘outsider’

communities. .

He is alleged to have addressed the public at

Bisabol shopping centre in Turbo near Burnt

Forest and incited the local Kalenjin and Luhya

communities against the Kikuyu.

At a meeting on 22/12/2007 at his home in Sugoi

said that his headache was Mr Jonathan Bii, his

opponent, who supported Kikuyu on the land

issue and directed that they should be attacked if

they dared campaign in the areas.

6. Hon. Boaz Kaino MP, Marakwet West constituency Inciting vioelence.

At a meeting, he said that he would remove

Kikuyu and Kisiis from the area after elections.

7. Hon Sally Kosgey MP , Aldai constituency and

Cabinet Minister

Planning, incitement, and

With Hon Henry Kosgey, they attended meetings

to organise violence. They are alleged also to have

funded the violence.

8. Hon. Fred Kapondi MP, Mt. Elgon constituency Inciting violence He attended and addressed a

rally / meeting at

Ziwa where violence was planned. Alleged to have

said that Luhyas should be expelled from Trans

Nzoia.

9. Hon. Henry Kosgey MP, Tinderet Constituency and

Cabinet Minister

Planning, incitement, and

financing the violence

He held several meetings with the Nandi Hills area

councilors and other opinion leaders at Septon

Guest House within Septon Estate. The meeting, it

is believed, was for planning and organization of

the violence.

He is also alleged to have funded the violence.

10. William Ole Ntimama MP,

Narok North

MP, Narok North constiteuncy Incitement to violence

During the 2007 election campaigns, William Ole

Ntimama reportedly incited the Maasais in Narok

against the Kikuyus and Kisiis. He told the Maasai’s

to evict the said communities if they did not vote

for him and ODM.

On or about 30 December 2007, the Narok market

was burnt and several people injured after he

allegedly told Kalenjin and Maasai youths that the

Kikuyu women in the market had insulted him.

11. Hon. Omondi Anyanga

MP for Nyatike constituency

He hosted a number of people at his home on the

day violence erupted. He “commanded” the youth

that was looting in Changamwe area.

on the way to the hospital on allegations

that he was in the PNU camp. The body

was taken to Nandi Hills Hospital.

29. Dr. Jacob Bitok A lecturer at Moi University Organising, planning, funding and

participation in the violence.

He ferried Marakwet warriors to attack

and drive Kikuyu out of Rock Centre in

Eldoret and in Kipkaren areas. He was the

custodian of the funds collected to

finance the violence within Mosop area.

30. A Mr Bernard

Acting Assistant Chief of Mubele

Alleged to have been involved in the

violence . The assistant chief is said to

have been arrested and released by

police over the allegations.

31. Thomas Cheruiyot Sirikwa Agricultural/ Veterinary Officer in

Sirikwa

Incitement to violence. He threatened the headmaster of Sirikwa

Primary School (a kikuyu) and asked him

to leave arguing that the school deserved

a Kalenjin headmaster. This was during a

public meeting convened by the Kamara

District Officer held on 27/11/07.

Cheruiyot further reportedly incited the

Kalenjin parents to withdraw their

children from Sirikwa Primary and

Secondary Schools. As a result the

Secondary school was reportedly closed

down.

32. Joseph Rotich a.k.a Survivor. Ass. Chief of Mawingu sublocation

Incitement to violence,

partisanship

He severally threatened the Kikuyu

residents in his area that their time was

running out and that they would be taken

back to central province. On 4/10/07, he

was said to have publicly told the

residents of Murinduko farm that the

Shopping center would be burnt down

soon. After two days, there was an attack

at Murinduko Trading Center by Kalenjin

raiders but they were repulsed by the

Kikuyus. A month later (25/11/07), there

was a major attack in Murinduko during

which two elderly people were killed by

Kalenjin raiders. When Murinduko center

was finally razed down on 16/1/08, Mr.

Rotich was spotted among the raiders

near Set Kobor farm. After the Trading

Center was burnt, Murinduko residents

fled. Mr. Rotich was reportedly heard

bragging that his word that the Kikuyus

were going to move to Central Province

had been fulfilled. He said that he was

going to ensure that all Kikuyus fled to

Kiambu and Nyeri.

33. Steven Ngetich a.k.a Alexander Chief, who lives at Sundu River,

Kuresoi.

killed some five people at Sunu River had

assembled at his home before the attack.

what I have seen, I can’t manage the

situation; everyone should take care of

themselves). He then reportedly drove of

and left the area burning.

35. Sammy Ng’etich Acting chief for Chemaner Location

that they must vacate the area whether

they like it or not. The chief was all along

against the establishment of a police post

in the area and had threatened several

residents who had spearheaded the

establishment of Giticha Police Camp

following recurrent attacks. Sometimes in

September 2007, he reportedly held a

meeting which was attended exclusively

by Kalenjins and the night after the

meetings, a group of youths attacked

Kamwaura shopping center whereby two

people were killed and several houses

burnt.

polling period he was shot by the police at

Mr Enoch Sugut and Solomon Tilawen to

organize the youths into battalions for

the war. Further, he allegedly requested

the youth leaders to enroll more warriors

as they waited for instructions..

A wealthy businessman and elder. Addressed youth and urged them

to attack and evict Kikuyus on

several occasions during the

Youth assembled at his home and later

marched to Maili Moja shopping centre

where he addressed them on 30th

addressed a bigger number of youths in

his home on 1st January 2008.

He supported violence on BBC and tried

to justify the actions in the interview.

He was the custodian of funds that were

used to pay the attackers and generally

carry out the attacks.

During the campaign period, he issued

threats to a Civic aspirant who vied and

worn a civic seat. He told him that he

raided by police after an attack in Giticha

farm sometimes in November 2007.

During the attack, some raiders were

killed by the police. The police then

proceeded to Chumba’s house where

they reportedly found a group of raiders

preparing to take tea which had been

prepared using big sufurias (cooking

pots). It is alleged that the police found a

dead body in the house. Chumba and the

raiders were arrested but were shortly

released reportedly upon the

intervention of Hon Moses Cheboi.

youths gathered outside Tito’s shop. They

later threatened the witness and crossed

over to the neighbouring Murinduko

farm and began attacking Kikuyus who

were attending to their farms, killing two

elderly people.

Vincent Mutai was killed in 2006 during a

cattle rustling incident at Tegea farm. He

accused Murinduko people of being

son. Prior to an attack at Murinduko farm

on 28/11/2007 during which two elderly

people (Daniel Waruhiu and Susan

Wangui) were killed, raiders were

spotted meeting at his residence.

incidences

    I gather this is the Kenya National Commission on Human Rights (KNCHR)alleged list that was released a few months ago.

    Although it does have similarities to the CIPEV list, your list misses some important names that are in the envelope that is in the custody of Kofi Annan.

    The name of one Uhuru Muigai Kenyatta is conspicuously missing on this list. His side kick, Murage is also missing, yet these two are well known Mungiki sympathisers and financiers who have worked closely with Maina Njega, Ndura Waruinge and Gitau Wa Gitau. In January, Uhuru was Kibaki's 'ambassador-at-large'. He was effectively running ALL errands for the big man.

    He was part and parcel of the meeting that took place in State House, alongside Maina Kamanda, Njenga Karume together with Mary Wambui and her puppet Stanley Livondo Livongo.

    What I am saying is this list Chris has published here has since been UPDATED by Waki who was also privy to state intelligence reports and as well as to 'in-camera' testimonies of not just victims but also politicians and heads of state security organs.

    By their own confession, KNCHR relies on whistle-blowers and anonymous tips on ther hotline. This is why you see they were not even able to establish the names of some of the perpetrators. What surprises me is that they only have ONE or TWO names from Kibera which bore the brunt of the violence from police and AP. The Kilimani OCPD can tell you who were those people sent to his territory to ensure that the ODM million man march does not reach Uhuru Park. He will also tell you how many corpses of police officers he fetched from Kibera after the officers were cornered and killed after they were found raping Nubian women near the DCs office in Kibera. In my own estimation, no less than 300 people died in Kibera at the hands of police officers sent from outside the jurisdiction of the Kilimani police division.

    In other words Chris, WAKI's report is much much deeper andmore revealing than this.

    i believe there may be some discrepancies between this list and the waki list

    the knchr list/inquiry was conducted soon after the PEV while Waki inquiry was several months after the peace accord was implemented

    one of frustrations reported in the Waki commission is that they were unable to reach some witnesses due to IDP relocation and therefore it is very likely that there will be different angles to those testimonies. but i think that waki was also able to reach other witnesses and therefore any disparities in the evidence could be amalgamated to zero in on most of the suspects. no doubt some innocent people will be caught up in this but nevertheless the waki and knchr reports even if not perfect should provide foundation for deeper and if it were possible impartial investigations.

    unfortunately the police force being part of the adversely mentioned immediately provides a major obstacle and i hope there is a way round that one. lets see how this unfolds

    What I have a problem with is the missing name of one dangerous man who spent a LOT of time running around inciting (flagging off the hatred as one apt observer put it) people before and further fuelling the hatred once violence erupted. There is good evidence of this.

    By deliberately omitting Raila Agwambo Odinga's (an active participant in the hate)name, all these commissions have committed a GRAVE injustice to those who lost their lives during the anarchy and importantly, have cast a shadow on their objectivity and credibility. WE WILL NOT LET GO OF THIS OMISSION. Take that to whichever bank you wish!

The ball is squarely in state house where the whole thing was first mooted and organised.

    Let us get on with this thing and let these criminals carry their own crosses.

    Seeing that you're discontented with the commissions, name *your* 10 names and cite your reasons. I hope you are not afraid.

    I think there is need for some kind of ranking/categorization of the ills committed and their relative gravity. Waki's report did indicate that pre-election incitement was a critical factor in the occurrence AND intensity of the post election violence.

    Incitement therefore should rank quite highly among the list of ills, just as highly as those that planned and financed the violence. For without incitement, no amount of planning and finances would have led to the violence. After all the pangas, arrows, petroleum (i.e. inanimate objects) cannot on their own volition cause the murder, arson and so on that we witnessed.

    NO inciter should escape unpunished. Youtube and other evidence of this is widely available.

    With all respect, that is what i am fearing allegations. Have you ever heard evidence then when someone is asked to substantiate they say "Hata mimi niliambiwa" I hope you understand my point. After the post election violence there were so many theories of what transpired, dont you think that some people went and floated in their ideas and just what they might have a notion happened.

    We might end up destroying this country with hearsay here and there just because we heard it somewhere. Coz trust me the waki report there are somethings i have read and believe me there are things i used to hear them in a mat, salon, restaurants and even among friends and colleagues.

    Relax like i said...Even Waki commission is formed a million times. Ivy's name will not be anywhere near there unless they are writting down names of spectators who might be just around the corner.

    Even though 10 names of ringleaders (verified or not) are named, that does not blot out crimes by others, which must be addressed as well. Killing, raping, maiming my neighbor and burning his/her house is a major infraction on all fronts.

    It matters little to me whether the names of dead perpetrators come first or last. What counts is they (and all others) are in. The bigger task, which the Waki commission may have done part of already (hence the names in envelopes), is to sort out the alleged crimes and to weight them according to specified criteria.....transparently too...awaiting prosecution by whatever authority.

    Evidence to me is minutes of the meeting that was discussed in statehouse showing what was discussed and who was in attendance (verbatim) and before we go further let us know who allowed the meeting to be held there in the 1st place (coz i mean statehouse is not an NCBDA toilet that you pay and you are allowed access)
    If Ruto, Kones, Bett, Laboso and etc said what has been alledged then can someone substantiate that?

    And like i said these stuff i have heard them in whispers on the streets from whom? Nairobians just as in KK who i believe were not anywhere near those places.

  33. Is it not curious the Kalenjin leaders are now so furious with Raila that they want a meeting with Kibaki after Raila called for the "full implementation" of the report? The following is excerpted from the ODM Newspaper, the EA Standard:

    "....outraged ODM MPs from Rift Valley criticised Raila’s stand, saying it appeared the PM and Deputy PM Mudavadi — who has also spoken strongly on the report’s full implementation — were settling scores with "likely political competitors".

    "We know what is going on and those shouting loudest for the implementation of the report think their competitors have been incriminated," said Eldama Ravine MP Moses Lessonet.

    He said Kenyans fought because of the presidency, which Raila was contesting last year, and "it was wrong for him to sacrifice his foot soldiers after attaining a portion of power".

    "It is sad that Raila is spitting at the people who thrust him where he is now," he said.

    "All the claims bandied around are meant to discredit leaders from the Rift Valley and we are surprised that Raila is supporting it passionately," said Chepalungu MP Isaac Ruto.

    Also speaking out as the Rift Valley MPs retreated into a closed-door meeting last night was Rongai MP Luka Kigen, who said it was ironical that Raila and Mudavadi were turning against the people who heeded their calls for mass action the presidential poll results were "stolen".

    "The protests were called by the two top ODM leaders and must be held responsible. The comments they are making are irresponsible and we believe they are personal," he said.

    Others were Kipkelion’s Dr Magerer Langat, Mr Joshua Kutuny (Cherang’any) and Mr Benjamin Lang’at (Ainamoi).

    "We are supporting President Kibaki on his calls for amnesty. We cannot tolerate more attempts to divide a country that is already fragile. On this matter, Raila and Mudavadi are wrong and we support Kibaki, who we will seek audience with," said Kutuny.."

    This is very interesting indeed. Looks like the Kalenjins are about to break with Raila for good and jump into bed with Kibaki. Is it possible? Maybe. We shall wait and see.
    If it actually happens, then ODM as a party is cooked, and will most likely become a party of Luos, Maragolis, Marachis, Manyalas and Wanyores. This will immediately manifest itself in parliament where Raila's position as PM could be in danger. Ruto could strike a deal with Kibaki to support him in parliament without Raila's say so in exchange for doing away with the Waki report, and possibly the collapse of the GNU with Raila walking out. Very possible as we have seen it all before. Also, don't be surprised if Moi comes out to say i told you so to the Kalenjins.
    What a laugh it would be if the GNU collapsed! We said it here before that tribal alliances for short term goals will get you nowhere.

    Who ordered the killing of the APs is also quite intriguing. Might it be the one dangerous man (yes, THAAT one)who said that he has details of the registration numbers of the vehicles, the time they left nairobi and so on.
    The minutes of the so-called statehouse meeting would make for fascinating reading as well.

    I am not an apologist for Hon Kalonzo, but if you truly want to know on which side he is , well I will tell you. He has no connecion whatsoever with a belief system that advocates for killing of those who do not support your political cause. He is definitely on the side of those on whom violence was unleashed (by lunatics on the payroll of some people you guys like to call leaders).

    Now do I believe he should stand up and be counted? Oh yeah.   39. "70 year old Mzee Joseph Mwangi Macharia (Karobe) watched as seven members of his
    family were hacked to death – his wife, three sons (aged 36, 33 and 23), one daughter
    (aged 25), a grandson (aged 6) and a granddaughter (aged 6). He narrated his ordeal as
    follows:
    On 31st December, 2007 at about 5 p.m., he had a family get-together in his house at
    Chagaiya village in Kesses location, when a group of about forty young people, among
    them his neighbours, struck. They said they wanted five heads from that house – his
    and his four sons’.
    As he pleaded for mercy one of them struck his son on the chest with a club and
    another shot him with an arrow as he tried to escape. Another son was pierced with a
    spear and his throat was cut. The rest of the family tried to hide inside the house but it
    was broken down and they were pulled out. His daughter and her child were pulled out
    and their throats were slit. So was his wife’s throat. That is when Mzee Macharia
    escaped into a nearby bush and watched as his house was set on fire. He stayed in the
    bush until the following morning.
    In the morning he went to a nearby AP camp where he collapsed and became
    unconscious. Three days later he was assisted by the APs and neighbours to dig a
    shallow grave where he buried his family before moving to an IDP camp in Limuru.
    They were only exhumed on 28th April, 2008 and given a decent burial.
    Mzee Macharia knew at least 14 of the assailants and recognized them during the
    attack."

Those wobbly RV MPs are behaving like a cat on a hot tin-roof and rightly so, there is no more Arap Moi for indemnification, only time will tell how long they will continue to escape justice.

    Fact: There were killings in 1992, 1997 and 2007.
    Fact: There were no killings in 2002
    Fact: There is a report about the 1992 and 1997 killings, the so called Kiliku report.
    Fact: Those implicated in the Kiliku report were never prosecuted.

    The RV MPs were acting in the premise that the government will appoint a commission whose report would never see the light of day, just like the Kiliku one. This is what impunity breeds.

    Like i said earlier, me thinks we should have a tribunal similar to the Rwanda one to try these people. We can have it hosted in say... Rwanda or TZ

  44. I have been telling people here that ODM was a mass movement that picked up all kinds of membership last year and indeed some unwelcome characters found its way into the party.

    Hopefully, the forthcoming grassroot elections will act like a sieve and allow those of us who stand for truth and justice to continue the journey.

    Now that the Kwales of this world can see what we have been preaching here since time immemorial, please take time and project how the Kriegler and the Waki reports will become useful to this country.

    The reports and their aftermath have educated the Kenyan voter. Listen to any FM radio call-in program and you will deduce anger, frustration and foul mood from the majority of Kenyans.

    Kalenjins invited themselves to ODM simply because they wanted a short-cut of getting back at Kibaki and Moi. As I am talking to you now, majority of Kenya's middle and lower class have appreciated Raila Odinga's statemanship and would be willing to cast their votes for him at any time. This is a man who is above ethnicity.

    If you do not believe me; just wait and see how REAL POLITIK is played. Watch Raila's steps very closely from now on. Something big is cooking, even as Kofi Annan watches from Geneva - incidentally just a short distance from the Hague.

The only reason he supports the full implementation of the Waki Report is because most, if not all, of his political competition will be decimated, not that he wants to do right by the country.

The Sandinista guerrillas, a coalition of National Patriotic Front crushed the National Guard and forced the president into exile.

    The fascinating part of the Nicaragua revolution was that many of those (government officials) who fled the country seeking asylum in neighboring countries, later turned themselves in to the new authorities after the FSLN took power, on promises of amnesty. They were subsequently tried and many served lengthy jail terms.

    This is what Kenyans should do!

From reading this report it seems to me that the kukuyu and the kalengin were at war and any other tribes got caught in it....The kalengins were mara fighting everyone, mara fighting everyone except indians(ironically) mara only kikuyus, mara kikuyua and luyahs.....the kalengins had a land issue that was not properly dealt with over time......funny thing in mo1's 26yrs he did not resovle it....

    So I wonder where RAO comes in all this? The kukuyu had their fight over missmanaged land allocation by kenyatta. the other wars in other parts of kenya was just long standing hostilities that errupted because the whole country seemed to be at war...I'm sure some guys used the opportunity to kill rivals in business, or even love affairs....



    My ponit is the rather far fetched argument that all this was incited and coordinated by the likes of RAO is bogus propaganda by people who for other dubious reasons did not wish him to ascend to the presidency......


    And for the upteenth time Kibs allowed a feeling of tribal superiority to rise among his tribsmen that created a resentment that boiled into a war. Then the kikuyu are now talking of revenge attacks when they provoked everyone......lets begin this analysis at the proper place and not at the point where the evil actions started......You see the idea is to make it look like the violence was an election tool as opposed to being a reaction to the central bullying of the rest of kenya......

    Central people would like to begin the story at the election period while we all know that this violence has a history that goes back to colonial kenya.

    Mr. Ngunyi this is a very serious allegation indeed.

    As far as I can remember Raila never instructed anyone to go and kill, maim, loot, rape or engage in other acts of felony. But I do remember making serious attempts myself to participate in the ODM mass action rallies in Nairobi. Was that a crime?

    Unless you have concrete proof to back-up your assertions, I think it is only fair we do not politicize this post - if only for the memory of our country men who met violent and needless deaths simply because they cast their votes.

    It basically does not aurgur well for those who died or those who remained to trivialize this report and those individuals who mastered it. Its either you supply authorities with proof and also publish it here or you quit peddling rumours and innuendos just because you have certain political persuasions.

    This issue is already politicized, and for anyone who imagines that it is an attack on the 'integrity' or 'statesmanship' of RAO, then meza wembe!!

    For all I care, supporting and active clamouring for majimbo, his presence in the now infamous rallies where a RV idiot called for removal of 'madoadoa' and his notable quiet in the midst of all the killings going on make him complicit, EVEN IF IT DOES NOT REACH THE THRESHHOLD OF PROOF!!

    Agwambo is the biggest beneficiary of the violence that led to the formation of the GNU. In fact, this is why the Kalenjin are somewhat dissappointed in him. In fact,whether it is good or bad is hard to discern right now as the political situation is very fluid and tension is going to go up a notch very soon. We might even find ourselves in another January scenario. It is the unfinished business of now, as Martin Luther King would say.
    My view is that we need to move away from ALL these politicians and forge a new Nation led by principled politicians. However, we all know what a daunting task that is given the suffocating hold tribalism has over everybody above 5 years old. Reprise to my call to look for a Kenyan Obama right here on KK, the idea was given short shrift in quick order, all because we live and breath tribalism. Perhaps we should just accept it and not fight it.
    So lets sit back, folks, and have a good laugh, we are just mere spectators after all.

  60. Not to take away the seriousness of this list but do any of you find the nicknames of some of these fellows interesting? There’s a chap called ‘Brother Jew’.

    Anyway, what does this list tell us? For one thing, the perpetrators, participators and to some extent financiers are none other than Joe the plumber. These are regular folks, your neighbors and teachers. This confirms that psychological experiment suggesting all of us are capable of inflicting extreme pain to others in the presence of certain conditions. Basically, we can all kill without flinching during war time.

    So what I’m I getting at? Well, the violence in Kenya occurred due to the presence of an optimal environment for war. I mean there were constant variables such as hate, availability of weapons, suspicion, illegitimacy, anger, jealousy etc from all quarters. 99.99% of Kenyans were generally pissed off. So war happened.

    Simple math suggests that war can only be avoided by diffusing its optimal environment; some of the above variables must be removed. So the question is, what has the coalition government done to diminish the atmosphere of war? Nothing. Even Kivuitu is still there. The hate is intensifying. Militias are on an arms race.

    So what exactly will stop the next pre/post election violence?

    All institutions that have conducted investigations into the violence have not come to the same weird conclusion as you.

    You attempting to pass judgment on RAO on the basis of what the demonstrators chanted in the streets, and even that (what they said)is not really admissible as evidence at any legal forum.

    Let us debate facts. eg. Who hired militia? Who transported militia? Who hosted militia? Who met and planned raids? Who financed militia? Who bought crude weapons to arm militia? Who commanded police to shoot and kill? Who declared ODM rallies illegal and barricaded Uhuru park?

    NOT - Who demonstrated? What did they print on placards? Who called for mass action to protest stolen elections?

    I am not peddling hatred. I just want justice. It is unfortunate that, if, for example, I had decided to enjoy a holiday at say Sirikwa Hotel after casting my ballot I would either be dead, maimed or traumatized. It is sad indeed. Therefore, for me, it is personal. I may get carried away from time to time, but reducing me to the category of a hater, no!

    Whether you want to accept it or not, they killed in RAO's name, as Kwale correctly pointed out. His loud silence during those chants is a clear pointer. Furthermore, RAO was already shafted when The Baks swore himself in. As at 30th DEC 2007, the instruments of state power were in his hands. Therefore, the only option Agwambo had was an escalation of the violence so as to form a basis for a ceasefire negotiations AKA The peace accord.

    In fact, were it not for the killings, and not the demonstrations, business would have been as usual in terms of running Government. Heck, even half the cabinet was appointed! Therefore, your assertion that the beneficiary of this violence was The Baks is just but an attempt to advance ODM propaganda.

    It can be alleged, on basis of tribe, that I am in support of The Baks. Actually, I hold him personally responsible for the skirmishes that occured in January, simply because he failed in his primary role as the office holder of the Presidency to unify the country. The Presidency is a symbol of national unity and pride, but during his tenure it became, either as a matter of fact or perception, a cause of strife and disunity.

    I agree with Kimi, we should look for a new leadership as this one has failed us and will continue to in future.

    The Hague awaits for all those idiots who planned this!!!

    I think there is agreement that the KNHR list reflects what is on Waki's list. I also notice that no one has come to the defence of anyone listed here. Again, Chris, that we now know the truth, is it not time for justice?

    Before we go to the Hague i propose some basics.

    1. The cabinet as it sits is a fraud. Kibaki should dissolve the cabinet immediately and constitute a new one with people not mentioned. We need a fresh set of untainted cabinet ministers.

    2. All those mentioned in any report on PEV should resign as minister, mp or civil servant, etc. If they fail to do so they should be forced to leave and banned from occupying public office.

    3.Meanwhile the AG should immediately open criminal cases against these guys. The bench should be composed of judges appointed by the AU and given a time limit within which to dispose all cases, using a mixture of kenyan and international law. As Waki has indicated, he is not at ease with the Kenyan justice system.

    As some commentators have rightly pointed out, amnesty or TRC is NOT the way to go as we will just be burying our heads. We have this unique opportunity to finally solve the problem of impunity.

    Because the truth of the matter is, Raila could have stopped the killings; instead he played them down comparing them with football matches rivalry. (I have a video of him being interviewed by about the violence) If he is the leader you claim he to be, he could have appealed to his supporters to stop the bloodshed!

    Note: I did not lose anyone in that violence and I do not intend to live in Kenya at anytime in my life not even in my old age pension, but I feel obliged to campaign against killing of innocent people in the name of politicians.

    But that’s our predicament. How do we not apportion blame when such a list exists? If you agree with me and being as politically vocal as you are, chances are that if you lived in Mathare North or Kibera during the height of the violence, it is very likely that your very own name would be on the list. Even Cardinal Njue blessed some ‘warriors’. It is not very difficult to feature on such a list. Just ask ‘Mzee Pilot’. He owns a bar in Huruma.

    Now in a country where there’s no justice, how does the list reconcile us? What it surely does is provide us with a death list. So let’s say we kill everybody on that list, will we be appeased? The answer is NO. For one, the argument of whether that list is complete or not will never end. I for one think Martha Karua should be listed in capital letters. I’m sure you want to see Raila there and Vikii will do his best to ensure Kalonzo is never mentioned. Point is, the list will take a life of its own. It will never be completed and will never satisfy our thirst for justice.
    And even if we actually complete the list to everyone’s satisfaction, then comes determining which crime is lesser than the other. Making tea for thirty warriors cannot be compared to buying petrol that burns hundreds in a church…..but they are both financing the violence.

    So yes, we want to frog march these chaps, including ‘Brother Jew’, to The Hague. I for one will see heaven when Kibaki is in the docks. But then what? Will Mungiki voluntarily disband? Will the Kalenjin warriors desist from oathing? Even reading the discourse here shows that Kenyans with access to computers are still drunk with partisan violence. What of the villagers?

    This reconciliation business is not really working.

  78. NO RAILA NO (RUTO) TO HAGUE

    In the battle for ODM supremacy, both Ruto and Gumo initially supported Kalonzo against Raila saying that Raila was un-acceptable by majority of Kenyans. Then suddenly Ruto changed and sided with Raila. Why?

    While Kalonzo was willing to support Ruto's political agenda in the RV, he was unwilling to accept Ruto's idea of ethnic cleansing of Kikuyus out of RV. Aware that Akambas have settled in large numbers in Kajiando and Coast, Kalonzo was adamant that everybody should have the right to own land anywhere in the country regardless of tribe.

    Unlike Kalonzo, Raila (whose tribesmen don't buy land outside their Luoland) was willing and eager to side with Ruto on the Kikuyu issue of owning land in RV. And Ruto was happy to switch his support from Kalonzo and lend his support and that of RV to Raila in his delusional quest for the presidency.

    That is why Raila enthusiastically and ably went about selling his majimbo in RV. By that time, the Kalenjins already new that Majimbo was a code word for Kikuyu (and Kisii) ethnic cleansing. Long before the "sangari" and "madoadoa" were used to label Kikuyus in the RV, Raila had already sang his "kabila adui yetu" song across the breadth and length of RV to wildly cheering mammoth crowds.

    It was a matter of time before the blood of the madoadoa, sangari and kabira adui yetu was shed. And when the elections were bungled, the opportunity the bloodthirsty barbarians were looking for availed itself.

    So if the Hague Express has a seat reserved for Ruto, where is the one for Raila, the captain and patron of ethnic cleansing?

    In retrospect it is fair to say that in 2002 kenyans showed a high degree of maturity in electing kibs. It is also fair to say that tribal animosities and such have always existed in kenya, what was new was that a sitting president appeared to allow one tribe to 'sit' on the rest of kenya.

    So it shuold be fair to say that one man kibaki Emelio should shoulder the blame. He was president with all the unhealthy powers that the the president of the repulic of kenya enjoys and he let things get to where they did....he is the main cuplrit.

    He should be the first to hang then we can have a general amnesty for all.


    He can argue that he was not in control as he was sick....and such but kenyans will realise that electing the wrong person can be very costly......M01 for all his stupity did not turn this into a tribal couldron that kibs did.....

  81. Many of us most likely do not understand the idea of Sir Alex that unless we get to the bottom of what afflicts us Kenyans most of our political problems will continue to take new dimensions.

    Why I am saying this? I don't understand how many people would want us to believe that the word "adui wetu" was the beginning our tribulations. Historical accounts would confirm that there is no community that have shown disdain against the Luos as the Kikuyus. Luos have always lived peacefully with other communities and even the evidence from the last post-election violence confirms this fact. I know the only thing they are known for is being overtly proud, which is not a crime purnishable under Kenya law. But if we start digging in the past we would find that Kikuyu's have said or insinuated things against Luos that would create a serious conflict (I know this from experience). On the contrary Luos have always extended brotherly hand, which sadly has mostly been burned.

    What happened in the RV was purely an affair between the Kikuyu and the Kalenjins which had nothing to do with RAO because it has happened before last year's election. Sadly this time it was aggravated by the fertile negative political environment fomented by none other than Mwai Kibaki. Had the President managed the country with a fair hand we won't have gone through a similar experience as we saw after last year's election. Most of us here have to understand that Kenyans have gone through similar treatments every other election to an extent that they became more disenchanted and thus the ugly outcome early this year.

    I would like to conclude by saying that we need to go back into history to understand the root cause of our problems because they were not caused by RAO even though he may have added more fuel to the already raging fire during the campaigns. Just as someone said here, the Hague will not completely solve our problems or even electing a new brand of leader will either because some of these negativity have already been engraved in to the hearts of five year old kids. It will take generations to change that unless we start right now.

    As Kenyans we are the problem and therefore unless we change our attitudes individually and as communities our problems will never end.

    Caption: Govt. Spokesman Alfred Mutua says the Waki report is misleading.


    Government spokesman Dr. Alfred Mutua has faulted the Waki report, over what he has termed as blatant efforts to implicate President Mwai Kibaki in planning revenge attacks during the post election skirmishes.

    Citing various pages in the report Mutua said the indication that power has been personalized around the president and increased by changes in constitution to suit the president are misleading.

    Mutua introduced yet another twist to the debate citing sections of the report that allude to the president's involvement in planning revenge attacks in Naivasha during the post elections skirmishes.

    In the report on page 121 concerning Naivasha revenge attack the report says:

    "The commission has also evidence that Government and political leaders in Nairobi including key office holders at the highest level of Government may have directly participated in preparation of the attacks. Central to that planning were two meetings held in State House and Nairobi Safari Club in the run up to the election with involvement of senior members of Government and other Prominent Kikuyu personality." Mutua said

    " Also note the report also says, key office holders at the highest level of Government may have directly participated in the preparation of the attack. The report uses the word may to show they are not sure that this actually really occurred. This is in contrast to the rest of the report which is conclusive in its allegations."

    But Mutua said contrary to the report

    The Government wishes to make the following clear:-

    " 1. How can a meeting have been held in state house before the general election, say in September, October, etc, have planned for revenge attacks that had not yet occurred and which were to occur in January 2008. These allegations are not only logically untenable but ridiculous at best.

    2. The President has never at any time held meetings with any person, to plan violence, at State house or anywhere else in the world. This wild allegation is being repeated so as to paint a perception that the President and State House were involved in post election violence.

    3. Media editors and commentators should, in lieu of this, paint the right picture and stop riding on an agenda of casting aspersions at State House and in relation to the Presidency, based on flawed arguments.

    4. We see this trend of assigning blame to President Kibaki, also on page 30 of the report, which says that

    "Power has been personalized around the Presidency and this has been increased by changes in the Constitution under each President since independence"

    This is untrue because in the five years of President Mwai Kibaki's first term, there was NOT single constitutional change." The Government spokesman noted.

    The coalition government leaders have been split on the report as to what extent the report should be implemented amid differences over calls for amnesty for perpetrators.

    Some members of the clergy however supported the report and recommended its implementation.

    Thanks for elaborating using your twisted logic, much of which is reflective of the hate that resulted in the mass slaughter, rape and maiming of helpless Kikuyu women, children and the elderly.

    While I do concede that there MAY be some historical issues to attend to (eg the unlawful allocation of public land), the BIGGER problem for Kenya is how to nurture a spirit of enterprise and innovation among Kenyans in general so that problems of jealousy and hate, especially of the success of others, are pushed into the preiphery where they belong.

    We need to find out what it is that makes some use the same resources available to all others (inspite of adverse conditions) in creative ways that magnify the gains (individual and collective)from those resources, while those around just look at them bemused, salivating and frothing at the same time?

    These are indeed very serious issues, because if you do succeed to exterminate the easy target, the so-called sangari/kabila adui, the green eyes will turn and be trained on the wahindi and wazungu remaining behind.

    I think all Kenyans of good will and intelligence, while focused on looking for our very own Obama from Tseikuru and places, should also expend some energies in trying to understand the origins of enterprise and innovation.

    The problem bedeviling Kenya has nothing to do with resource utilization and the so called enterprise that you are talking about. However, the gist of the problem lies with how we go about utilization resources and exploitation of available opportunities for prosperity.Take for example, if there is an opening to supply goods or services in say company X and say there are ten potential suppliers from ten different communities you would not be surprised that the choice supplier will be based on some level of nepotism. The point I am trying to make is that some of those negative undercurrents do magnify themselves into monsters such as what we experienced because some people feel that their livelihoods are threatened.

    I know people like you still have this warped idea that lack of enterprising spirit is what is causing the inter-tribal conflict in Kenya but it is much deeper than that. You need to ask yourself whether the playing field is uniform and the players are coming from the same background. If I may ask have you ever asked anybody from these so called "non-enterprising" communities about their feelings or why they lack the enterprising spirit? I was expecting that for people like you to form such a strong opinion about other communities then you should have a tangible evidence in form of statistical data to support your sad theories.

    If I am not wrong such statements as "non-enterprising" are just as bad as the hate that you were lecturing Sir Alex on. I would suggest that you search your soul before you make such divisive statements or stereotype others.

One of the lady lecturers can't sleep upto today at night because of nightmares; she sleeps during the day. It is also a fact that less successful people tend to be envious of the more successful ones.   96. You place your money in the bank and the bank goes bust and you loose your money. You find out that certain employees were misusing your money.

    Whom to blame?

    I'd want the employees fired and even jailed but at the end, you have to blame the director(s) and decision makers.

    Hence I place the blame on the Kibaki administration. If ODM took part in the violence, then they should face the music. But Kibaki bears the responsibility of protecting the citizens. In this case he failed miserably. If Kenya was attacked by outsiders, I doubt that anyone here be they ODM,PNU would accept lax security.

    My disappointment with Kibaki is that he takes a laise faire approach to the office of the president. He doesn't get the magnitude of the trust and responsibility placed on him. He treats it like a high school head boy office. The allegation that mungiki were hosted at state house is treason at the very least. And this type of thinking has permeated the entire GK, where the Police chief will call and ask for the release of thugs with no recourse. It is the culture of impunity and arrogance, the "mta do" culture. And that is a very sad fact in my mind.

  98. I think many of us here are missing the point - which is the difference between breaking the law, and just being immoral. Tribunals and courts like hague do not charge people for being immoral, they charge people for breaking the law.

    Saying such and such people are not wanted in our forefathers land, or we want "our people" to have all the good jobs may be immoral, but its not against the law, and is infact protected by freedom of speech. Breaking the law is when you actually plan, finance and lead the violent expulsion of the "outsiders".

    Those are people the law is looking for, but the immoral ones, like all human beings, will face a different judge (God) when their time comes.

    RAO was immoral, but his name is not mentioned because their is no evidence that he broke the law. As for kibaki, he was immoral too - but the report hints that he may have broken the law too - when it mentions the state-house meeting that planned the killing in naivasha.

    We can not force morality upon people, but to grow as a nation we must enforce the law - and all those found guilty of breaking the law by harming or organising the harm of other kenyans should all be punished, no matter who they are.

    You make some very fair points which I would be hardplaced to dispute. I would also be the last to suggest that there is only one problem--it is more complex than that. Also, my tone and choice of language could be better and I am inclined to apologize.

    But let's just focus on one important detail. When you look at the peasants (Kikuyu and Kisii) that were being killed and/or chased away--how did they look like? They seemed just as poor and as uneducated as their neighbors, only that some had begun the rather hard, sweaty path towards some kind of pretty basic accumulation. Ramshackle houses and dukas, tiny farms etc. So where is the privilege? I doubt any of them have ever heard of the words government tender or contract. The Kisii, also under attack, are even harder to explain using you argument.

    Now, I think you should be extremely embarrased at intimating that because government tenders were not dished out to you, then you must kill the kikuyus and kissi because they were the recipients of the tenders. I hope you see the problem with that!

    Baba/mama Moi's 24 years of economic destruction and doom did not see anyone going out hunting for the Kalenjin's heads. Indeed, what I know some peasants did for absence of government--they just simply organized, cooperated and did what they could to produce public goods for themselves eg grading roads or even paying teachers. They neither whined nor waited for a disinterested government.

    Kenyans must move away from the kind of dangerous thinking that you propose--stretching out their begging bowls to whomever may drop something, whatever, into it. We now have CDF funds, Youth funds,and so on. Seize the opportunity, my friend and do take some responsibility for your own lives and destinies. I think I have heard even the Bumpkin say this several times.

    Of course, and I agree with you that there is a role for the state. But I'm afraid it would be expecting too much of the state for it to do everything, including think, for you.

  102. What this report has done is no different from the pattni pick up load of evidence is to buy time and basically creat an unworkable situation just imagine trying to prosecute the cases our courts will be booked for the nxt 10 yrs.

    In other words its a red herring. if we are serious we should get to the root of this.....depending on where you want to start(as in which yr.2002, 1963,) and deal with the key culprits.....

    There are serioius issues in this country that we should face head on..like the taita peopel being largely squatters in their own land while the rest is owned by Criticos and Uhuru....who will fight for the landless taita...their leaders are given ministerial post to look the other way while they renain landless while we waste time on who paid 5bob to someone in the hieght of election fever to scare someonelse away......


    My plea is lets tackle the big issues and the small fry will sort itself.....we run the danger of wasting time in courts on what I will call petty offenses while the real criminals are having a free ride in a fancy car.
