Ministers Should Carry Their Own Crosses

So Jamlek Kamau (MP for Kigumo) feels that Uhuru Kenyatta is the wrong number for Ababu Namwamba to point fingers at. And that he should concentrate his energies on his Budalangi constituency. So who in the eyes of Kamau is the right number? Who is it that can have himself toyed with while others are left alone without investigation I wonder?

Any leader’s responsibility is to his constituents and the country as a whole. If for instance Ababu Namwaba comes across a case that needs clarification in parliament, the repairing of dykes will not stop in Budalangi just because the member looked into national matters. The idea of fellow MPs rallying support for ministers under investigation is sending the wrong message because it’s not a question of friendship here - just a minister who may or may not have broken the law. However complex our laws may be, it all boils to whether Uhuru or Kajwang' or Kimunya rubbished them or not. The case of errant ministers is that simple. Laws are made to be followed however small or negligible they may be in the eyes of the big guys. If Uhuru is guilty of irregular nomination of councilors let him carry his own cross. If he’s not guilty then he has nothing to fear or to be publicly supported about. The government I believe has mechanisms to determine such cases.

I’d not be surprised to see Uhuru going for some constituency love next if the storm gets thicker. And that’s the other point. Constituents too should desist from rallying blind support for MPs who are under investigation. If we are to mend this country, we cannot start by dancing around a corrupt minister just so our constituency can have a flag. We have to start crushing impunity from the constituency level and gladly let our MPs crash to the ground in disgrace if they’re found guilty of corruption or abuse of office.

Elius Mbau of Maragwa also in his defense for Uhuru had the audacity to say that any action taken by a government leader should be respected because the leaders are duly elected. Is he suggesting that we respect ministers’ decisions regardless of whether they’re right of wrong? That is the kind of balderdash that Kenya does not need now or ever. Is that not where abuse of office stems from? Ministers feeling that they can do anything just because?

And those speaking of witch hunting, of what use is the grand coalition if we cannot tackle grand corruption without fear of upsetting the balance?

I was waiting to see how you would come out in defense of one of your own "liberation" comrade Otieno Kajawang' but it was a storm in a tea cup, right? Asians coming to do some welding and "Christians" who believe in slavery of the black "Ham" race are welcome to Kenya and that is ok... whatever!

    And of course, people start complaining about tribalism. This is so poor. Kimunya tried it, Kenyatta will try it and let me tell you something. IT WILL NOT WORK!

    Coming to Kajwang. Maybe Kumekucha should really write an article about the matter in detail. But as the minister has already made clear: Why should you allow some members of a group to enter the country and others not??? Of course, if you have clear evidence and facts you base your decision on, then the minister should listen. But where exactly is this evidence??

    No need to be emotional on this straight forward matter.

    Kajwang has been accused. Instead of a few GEMA MPs calling a press conference to attack Ababu Namwamba, why cant they organise themselves and bring a motion of censure on Kajwang or any other ODM MP they feel acted improperly?

    Ababu has raised valid points against Uhuru. We all know what Uhuru did was illegal and the worst case of abuse of office. Unfortunately, instead of sacking him, Kibaki promoted him to DPM.

    Perhaps we should remember that former CBK Governor, Andrew Mullei, was sacked and eventually charged in court for single sourcing - the same thing that Kimunya is calling "an offer that was too good to turn down." But Kimunya is still roaming freely, perhaps still earning the salary of a cabinet minister who has only but stepped aside! Another example is when the former Director of KNH, Dr. Julius Meme, was sacked and charged for abusing his office for banking hospital funds in Eurobank which collapsed. Never mind the Eurobank was licenced by CBK and Ministry of Finance is the supervisor and manager of the banking sector through the CBK.

    You know what? Both Meme and Kullei were cleared of any wrong doing by the high court.

    It is up to government agencies charged with enforcing the law and charged with monitoring government officials which should act when the laws are disregarded. KACC, EMU, KP, AGs Office, DPP, are all there to ensure law and order is maintained.

    So you guys can accuse Ababu and even mindlessly blame Kumekucha blog, and you conveniently avoid tackling issues that are being raised.

    Its not an issue of whether the shoe fits ababu but rather - did Uhuru break the law? Was Kajwang corrupt? Its as easy as ABC.

Suppose the MPs passed a vote of no confidence and the ministers refused to resign, that is when the parliament who know constitutionally their votes of confidence on cabinet members (with the exception of the president) have no legal basis. And for the first time that is what is going to happen if they touch Uhuru.

    If they were men and women enough they would go for the president.

    Readers of my raw notes will know that I revealed how Kajwang started being corrupt even before the grand coalition cabinet was announced. My view is that he should also resign to pave way for investigations. ODM corrupt ministers must also go. NO EXCEPTIONS. This has nothing to do with tribes or political affiliation's.

  9. An impeachment of Uhuru Kenyatta would be the end of this parliament/government. It is as simple as that. A parliamentary motion of censure against Uhuru, as useless and meaningless as it is, cannot sail through, Mwai Kibaki, the President of Kenya and the only one with the powers to kick a government minister out cannot and shouldn't even dare summon leave alone fire uhuru. And most importantly, uhuru will not resign over nothingness. Next?

The issue with kajwang is very simple the thieves and conmen in immigration department only have power if they are the final authority on matters immigration...the fact that someone can appeal to kajwang just renders them powerless....the so called technocrats...nothing but pen pushing clerks doing a job u can train a clever dog to do over a weekend. There are simple guidelene to determine who gets a work permit but there is also room for descretion and the minister has that. There was no coruption or abuse of office the minister ha the final say and that is that. If youhate it chnage the law. Challenge it in court not payuka all over the place.
    I wish the so called technocrats could instead unearth the deadly corruption taking place at the immigration department.
    Mumunya stole....if the thing was transparent why was hit hush hush? Whay was orengo not told about it?
    Its a deal who can't refuse? Mumunya and co or kenyans?

    The thing is, was he found guilty or innocent by the high court? If what he did was wrong, what makes what Kimunya has done RIGHT? Why cant Kimunya, Uhuru or Kajwang also be hauled by KACC to an anti-corruption court to answer charges like Mulei and Meme?

    In as much as I respect you RAW NOTES, it would be useful - for purposes of this debate - if you could tell us how corrupt Kajwang was even before being a cabinet minister? This is a challenge Kajwang threw at parliament, KACC, Police and I am throwing it at you, table the evidence and we debate it right here!

    On the other hand, this is an issue of public interest for the last two weeks, and isnt it strange that Uhuru has not had a chance to call a press conference to despute what Musalia said in parliament and elsewhere, and defend himself for his short sighted and illegal actions when he was Local government minister.

    As a matter of fact, Uhuru has been Local Government minister twice and on both occassions, he participated in illegal activities. Previously he was deeply implicated in the illegal allocation of the WOODLEY ESTATE in Nairobi. Those allocations led to the violent death of Charles Sosah who was an official of the Woodley Residents Asosciation. Uhuru ako na file mingi sana. Probably because of his background he thinks he is above the law! What nonsense.

    It serves no purpose to engage in empty rhetoric and innuendos - like Vikii who is asking "Who is Ababu Namwamba?" as if he does not know Ababu is the ODM MP for Budalangi who has so far proved much more useful in parliament than the likes of ODM-K's so called Prof. Kaloki whom Vikii loves to adore!

  13. Kajwang's defence on Kiss FM today:

    1. Ethiopian lady had stayed in Kenya, given birth to 8 kids and taught for 20+ yrs. When she went to get Pension, she was told she was not a Kenyan. Her husband appealed. Kajwang agreed with him.

    2. Welder: Is underwater welder of ships. Has been training Kenyans but his company requested that he continues to stay for 2 more years. It is a big company repairing shipsall over Indian ocean and based in Mombasa.

    3. British Investor: Came to Kenya in 1982 and has been running a business. His balance sheet now says his assets are less than 1ook dollars. PS wanted him to inject a further cash to stay. Kajwang thought that was bullshit. Minimal investment is relevent for a new investor not someone who has been here since Kajwang' was in High school!!

    4. Momons: Were denied entry because they were children. Kajwang said 19yr old are not children according to Kenyan laws. Looked at what the church has been doing in Kenya for many years..(they have a church in Uper hill). Granted.

    Let PNU do a censure motion..

    I hear that once the people of Budalangi had a powerful minister Peter Okondo (who had a loose tongue that one day he dared a man of God (Alex Muge) who died immediately after. Was that man able to stop the floods in Budalangi?

I think those who (not the phils of this world) really know kenyan politics understand that a censure move against uhuru will go no where. Nothing to do with guilt or innocence. Just the way things are. Same way no move against rao can succeed.

    How wrong you are ANON! Two things.

    First, even as we debate here, RAO has a court petition case by one Livondo hanging over his head. So clearly, he is not above the law.

    Second, we have seen many big-men in Africa come and go. Perhaps you will need to research on what happened to notorious sons/daughters of leaders like Amin, Mobutu, Abacha, Bokassa, Obasanjo etc. The ill-gotten wealth and grabbing of public property is only good while your folks are at the helm. Kenyatta, Moi and now Kibaki are birds of a feather. I certainly do not fancy the future of people like Gideon Moi, Judy Kibaki and Uhuru Kenyatta. It is obvious that even if they do not face justice, their offspring will live to fight wars they never started. Those three families know full well what they have done to us the rest of Kenyans and it will be repaid, however long it takes.

Those who can't carry the cross should resign not step aside lest they be crucified on the same cross. The problem is not all ministers are carrying cheap "made-in-china/made-in-libya" cross that will break easily-some crosses are more protected with divine power similar to appellate judges or even scions of history

  31. Time has come when we should stop talking about ODM and PNU ministers. If a minister has done wrong he/she be censored whether in ODM or PNU. We dont want a minister like Kimunya censored then Kibaki gives him a cushion. Hata Kajwang' if he is wrong - let him face Music. Hii mambo ya kuangukia tribe ya mtu iishe. Some ministers who should be given yellow cards include Uhuru for over nominations and Haji for allowing the army to kill and rape the innocent in Mt Elgon. It is amazing now that some Kikuyus who saw Kibaki as a betrayer (eg Karume) are now singing his praises because he is Prezzy now. Hata Raila - if he is found wanting - wajaluo wasiseme mtu wao anamalizwa.

  34. I think to some extent save for one or two elements full of recalcitrancy,we are in agreeance.If you are at the very least percieved to have messed with the hen or goat that belongs to the Kenyan people you should step aside until the claims or allegations levelled are proven otherwise.

    Phil i remember a post being made here to the effect that an ODM member had been overheard lobbying on the supply or rather to take part in some supply contract or something to that effect.I will join you in calling for disclosures so we can debate them herein.If they are not tabled by Chris they remain just as much,rumours.If some conduct in public by some minister who holds a public office is wanting,i dont see why it should be confined to the precincts of the raw notes.If we have to be credible in our new title of LYNCH MOB, we should be able to unequivocally scrutinise those we are percieved to carrying out the lynching for.Lack thereof scrutiny of ODM leaders will amount to double standards.

    For the umpteenth time if Kajwang overlooked protocol and procedure and atleast against the advice of the AG, he should step down and not aside but resign altogether and so should Uhuru.In the same breath, the office of the AG needs some revamping right from the top.I think the onus is on the AG to censure Uhuru,Kimunya and Kajwang if he feels crimes of omission and commission have been committed by the respective ministers in the first place before we - lynch mobs - play our thing out.

    So the least said the better,if a public office holder is percieved to have broken the law,let them step down,and spare us the shenanigans of tribe.I listened to this Jamlecks,Mbaus and Cohorts and i wonder why they never came up with much zeal when Kimunya was on the spotlight.As for Ababu,wether he is drwaing his motivation from elsewhere i dont care long as he is serving my intrest as regards proper governance,period.Wether he can't get the right size of shoes for himself or the right numbers let along the wrong ones me am okay.Impunity is an abomination in reflection to good governance.

I wanted Kumekucha to address the issue of Kajwang' because so far there has not been any clear explanations from the media on what really were the reasons for the Asians and Mormons to be granted entry. All I relied on was patchy details and the very rotten past of Kanjwang to suspect the man.

    If the explanations given by Ajwang at 2:05 Am is correct, it sounds all good to me, Kundos Kajwang'. Is there more to it, anyone?

    About UK being beyond the law, jezz, I hate the idea so much that I will not type what am thinking. If Kikuyus continue to be part of the game of defending corrupt ministers and president, they should not complain that others are isolating them. Stand by Kibaki, Kimunya, UK and you will stand alone.

    While am at it, what happened to IDPs? And the Kalenjin boys who were arrested? I thought that there was a law in Kenya on how long one can be detained before being produced in court, something like 24hrs?

    So, why really organised, planned and financed the well coordinated ethnic cleansing in Eldoret, Nakuru and Naivasha? Is it the ODM as clained by the Human Rights watch?

    I remember when Cherie Blair, the wife of UK ex-Premier visted Kenya, they tried to treat her 'special' but she snubbed them. she told them she was only there to highlight about AIDS and teenage sex. She later wrote in a London newspaper that Kenyans are only interested with the important figures than the common citizen.
    All this by a woman (Mrs Blair) who is named as one of the hated figures in UK.

    I think you are a bigger idiot than the rest of us Kenyans. You seem to have no idea that the US have similar appeal channels like Kenya and that Secretary of State has powers to overule immigration officers.

    Kenya has laws that govern their country and you should take sometime off to zip your foul mouth and update yourself with statutes before advertising your ignorance here.

    As Kenyans, we might be poor in comparison to your mighty and mannerless Americano, but we remain extremely proud of our country, culture and heritage.

    It certainly does not take a genius to see Kenya has had to lend you Americans one of our numerous sons to be your next president.   47. Phil - as much as I would like to support you, but fact is that Obama is NOT Kenyan. He compared his family background to all the other Americans whose families come from all around the world, but who feel and always will feel to be true Americans. But as he also once rightly said: The colour of my skin does not make me African, the same as my wife is not one, or Dr. Martin Luther King was not one.   52. I always thought that Ababu Nwamwamba wants to become the official Leader of the Opposition after Raila snubbed him in not appointing him to become a Minister (Portfolio Youth and Gender). As Ababu said in one interview: his second name is AMBITION and therefore not even the sky is his limit. Something else comes to my mind in connection to him: was he not accompanying Marianne Briner when she gave evidence in Nairobi as her lawyer trying to show off to the Committee and made some stupid speeches until he was told by Sunguh to please keep quiet since this is not a Court. Was Ababu not also the one who filed or better tried to file a Defamation Suit against Biwott at the High Court, and lost it because he had based the suit on an Affidavit and did not realize that this document had a priviledged status and therefore the Court had to dismiss the case based on legal grounds? I would say, all this certainly gives him the qualification to become the future President of Kenya.

It doesn't matter whether he represented a crook because even murderers have a constitutional right to representation and I can also opine that it didn't matter whether he lost a case on some legal technicality because some of the best known Kenyan advocates do lose cases in courts on similar legal technicalities.

    Right now what matters to us is whether he is serving the Kenyan public interest or not since that is the reason he was elected as the representative of the people of Budalangi. Every year African Universities have ranked poorly but there seems to be no intention whatsoever among the policy makers to address this important factor.     Nobody is encouraging Kajwang to take over anybody's (even if that person is your uncle) but it is the constitution that provides the minister with the power to exercise discretion in case some aggrieved person appeals to his office. If anybody has a problem with him exercising such powers as provided for in the constitution is call for an amendment to that section or appeal to the President's office to exercise is executive powers to reverse the decision.

    You see that is the amazing wonder of the world; that no matter how wrong a politician is, his constituents will always back him.
    I think what you are talking about here does not in anyway applies to Kajwang because he has never gone back to his constituent to back him or he would "rather die than resign". Do not feed us with your imaginations instead provide us with facts and we will debate them here.

  61. These are the effects of having MPs as ministers. And in Kenya, not only do you have to be an MP but from the right tribe.

    It is unfair that Kikuyu ministers are cited here but considering that all the top ministries are held by MP of the Kikuyu persuation, there is little chance that they MP for gender and sports will be under the microscope!

    Kibaki is unable to trust any other MP from the other tribes with the top ministries. That is just the reality of the fractious nature of his government.

    What needs to happen is for MPs to be law makers and civil servants to be ministers appointed by the president and vetted by parliament as an over sight.

Tobias Nyumba - I felt obliged to provide a response to your observation about our African Universities.Allow to share with you to share with an experience of a friend of mine who recently obtained a Ph.D. and because of his patriotism decided to go back and find away he can make a contribution to our beloved country. The best offer he was given was to volunteer to supervise some masters students. In other words there are no jobs for those who are coming back with there sophisticated training from the West in our local universities. On a similar front he shared with me a situation where another friend of his and his wife (inter-tribal marriage) who both came back with their PhDs applied for jobs in the same Universities but to his amazement only his wife was getting acknowledgments and interview appointments. The interesting part is that the wife was a Kikuyu and the guy was not.

    I believe with these two scenarios you can understand the basis of rot in our public universities. Remember most of the so called Professors have not published in over a decade and do not read the latest publications. To make matters worse you and I know that materials they are using for teaching are outdated. The other gross failure of our universities is that they do not want to employ new people to take up academic and research just as pointed out in the Standard article. How do you expect these institutions to improve?

    My take is that the government needs to come up with a higher education policy document that will guide these universities on how to go about recruiting new academic staff, provide them with incentives so that we can building a base for our own local research targeting local problems that require homegrown solutions. Lastly, universities should apply meritocracy in all their undertakings because that is what is going to open up opportunities for international collaborations that may attract external funding.

    As you rightly observed, the situation is unlikely to improve until some fresh ideas are accepted and adopted. Unfortunately, some of these 'fresh ideas' come with exposure.

    The 1950s professors who only have a title to their names are partly to blame for our sorry state.

I know of this Prof who used to provide those so called notes of the 1950s to a tutorial fellow to dictate to his class until the university council realized what he was doing and started to investigate him. He was later hounded out of the university but I can't help to wonder the magnitude of damage he caused to his students. I also know of some professors who used to take up consultancy jobs with some international organization I used to work for in Nairobi but now I look back and ask myself how these jobs were in anyway benefiting there students. Personally I think that is a gross violation of one's profession and a pointer to the level of rot in our universities. I don't want to get into how science research is almost none existent in our African universities.

  70. The thing with our universities is that in as much as the professors are mediocre, so are the administrators and of course the students. I spent one year in Main campus and thank my lucky stars, other opportunities opened.

    For the professors, I have never seen a group of lazy demoralized pseudo- professionals. I mean, their chancellor was Moi. At that time the complaint was lack of monetary recognition. This for the most part turned many into sex pests and substitute teachers at Universal College among other 'accredited' institutions. Some like Saitoti dashed off campus in Volkswagen beetles and became overnight billionaires. To me a professor must be above ridicule…after all they are guiding future leaders. If Kenya's leaders are deficient today, it is because they mostly went to Kenyan universities.

    As for the administrators, take a walk to the registrars office. Honestly those chaps in there are ex mitumba dealers. It took me about three months to receive official transcripts. Most universities outside of Kenya produce certified copies instantly.

    As for the students, shortcuts is the order of the day. Few indulge in the studious nature of high school finalists. I'm sure some folks from my era are still in junior year.

    That is not to say that all systems have broken down. I'm sure there's been some improvements…but where?

There was this Civil servant who went back to the university as an in-service student to pursue a degree program and I could not help to wonder how rusted she was on many things because I used to do her a favor by coaching her in my free time. I knew how she was performing in most of those courses she was required to take in order to graduate. To cut a long story short, we were shocked to learn that on graduation day she was amongst those top Upper Second Class holders. To this day none of my classmates can be able to explain how this came to happen and we believe that something was provided in exchange for the illegal "upgrade" she received and this must have been done under the knowledge of someone in administration which had nothing to do with the professors.

    The rot comes from all directions.

  77. While it is worth while to recognize the problems bedeveling our universities from top to bottom, I think it is a waste of time to fund them. Let them rot and decay until they can no longer run and then sell them off to the highest bidder.

    More and more Kenyans are opting for private colleges. The difference between a university and a college is that a university has a research department while colleges do not. So in effect, those going to Uganda for college are not missing much but rather getting better bang for their shilling.

    If our universities are unable to compete globally, then we shouldn't waste time funding the same professors and administrators and hope for them to do a better job.

    You think Kalonzo represents the status quo and his most formidable potential rival in 2012, Sibuor Raila A O`dinga, doesn't? Newsflash Mister. Nobody on the horizon is capable of changing the status quo including Sibuor RAO, who hasn't changed anyone's status in Kibera in 16 years. Sibour RAO does not represent change, is in fact a member of the wabenzi class, and change to him is about who sits on the throne, period.
    As for homecoming parties, Sibuor RAO has just come from attending the latest in Mogotio on Sunday where he had to explain himself to the extent that his Authority is recognized in Govt. Who is the porojo exponent now? Did he have to explain himself in such demeaning terms?
    Kikuyus will support Kalonzo because they trust him, far more than they would ever trust Raila. That simple, that clear. In fact, the Kimunya saga merely reminded them of what Raila is capable of when he orchestrated the baying parliamentary mob that hounded Kimunya out without being heard.
    The Julia Ojiambo example is naive and misplaced. Ojiambo wanted a senior position without any commensurate clout. What was she bringing to the ODM-K table? Prestige? Gender? What? If she was shortchanged, she deserved it. Politics is not for nuns.
    With regard to Uhuru the GEMA face and his place in a Kalonzo Govt, there is a saying that goes: Trust, but verify. Kikuyus will not give Kalonzo their votes and then naively rely on his goodwill not to shortchange them, it will be a scratch my back i scratch yours deal, and Uhuru has to be in a position to scratch Kalonzo's back on behalf of GEMA, capisce? That is called realpolitik. The GEMA learnt their lessons well after trusting Moi in 1978 and then bearing the brunt of his oppression for 24 years. This time, they will ensure their interests are taking care of at the high table. Ultimately though, when it comes to preference, Kalonzo is much more attractive to Kikuyus than Raila could ever be. Like i said in another post, if Raila wants Kikuyu votes, he should start by earning their trust, and orchestrating demonisation of their reps in Govt like Kimunya and Uhuru is cetainly the wrong way to go about it. It is the Kikuyu man in the street who will determine where the Kikuyu vote goes, and so far, Raila hardly inspires confidence and has a mountain to climb. Perception is everything in politics. Hounding Uhuru now only makes him a victim in the eyes of GEMA rank and file and raises his stock amongst them. Talk about ODM overreaching.
    Whoever gets the block GEMA vote is a shoo in for President. Your promotion of Mwakwere as PM is therefore quite daft and misplaced from a GEMA perspective. How does Mwakwere take care of their interests?
    Stop trying to defend Raila's dictatorial mien. What was the ODM nomination fiasco all about if not dictatorship and why should i not bring it up? You should argue like a grown up. He did not unite 6 provinces either, but incited tribes in those 6 provinces against one community, the same community he is now in bed with in Govt. That incitement was certainly not in the interests of national unity, it was in fact setting the stage for the breakup of Kenya. That is why ODM MPs led by the Sibuor do not want the Ethnic relations bill to pass as it will make tribal incitement a serious crime.     Regarding Namwamba, why is he calling for Uhuru's head before he can defend himself, yet defends Kajwang who overruled professionals in his Ministry? Since when was Kajwang an expert on immigration decision making that he consistently gives away permits despite contrary advise? You think Namwamba is intelligent? The guy cannot look beyond his nose. He is unwittingly building Uhuru's profile. Politics is not academia and you must look far ahead, not just at your dickhead as you pee on someones reputation.
