Battle Lines Drawn... Again

What do you expect if you go to your local police station and start throwing stones inside? Do you perhaps expect the police officers to invite you inside for a cup of tea while they calm you down and find out what the problem is? Figure it out for yourself my friend.

Yesterday, in what I am very sure was a carefully timed move, PNU MPs known to be mouthpieces of the party’s most rabid hardliners came out with guns blazing and insisted that William Ruto should be left out of the cabinet because of his alleged role in post election violence. Actually this particular utterance came out hot in the heels of another statement from the illegal cabinet to the effect that President Kibaki should scrutinize ODM nominees for cabinet posts.

Clearly there is a very deliberate effort to isolate William Ruto by PNU hardliners. It will be interesting to see what their next move will be.

In a quick rejoinder ODM came out and asked PNU to concentrate on their half of the cabinet and leave that of ODM alone.

Something else significant happened yesterday. The Anan peace talks collapsed. The reason was a lack of interest from the PNU side. Only one representative turned up, namely Mutula Kilonzo. Meaning that the illegal cabinet is pretty busy at the moment. The big question is… doing what?

The answer is… something more important than the “grand coalition nonsense.” Yep. That’s the thinking within PNU at the moment as the hardliners have taken complete control.

Of course they have totally failed to read the writing on the wall even as President Robert Mugabe seems to be on his way out in Zimbabwe. Most Kenyans are hardly interested in foreign news but spare a minute to consider something that directly relates to Kenya...

  6. hello kumekucha i found this posted in your raw notes section and i will just comment- any information passed to you by pnu on any odm member as evidence - is fake!! Koffi Annan was also given some information on Ruto complete with signature - it all checked out fake tasted signature and guess what? a good fake!! that is why Ruto stayed on in the negotiation team even though pnu wanted him off using fake information - if i were in your position as a blog owner i would be very careful taking any paperwork from this people!! unless it is ruto on tape- it is up to you! just simple advice....I'm not even Kenyan- but i was on ground then that is all i can tell you...

    * Why a large chunk of the evidence PNU have against Ruto cannot be used. Impeccable sources deep inside PNU make shocking revelations to Kumekucha that he cannot dare print in the public domain.

    Do not put me in a tribal box or a party box.As i said rutos militia burnt cildren and women in a church and akina michuki,uhuru and other mungiki bigwigs organised the revenge in naivasha.

    Kikuyus have been killing Luos for a very long time.In fact Kikuyus have been killing all the other 41 tribes for a very long time through the system of marginalisation based on ethnicity.

    At least those with pangas and rungus will eventually tire and put those weapons down.The system of marginalisation on the other hand persists relentlessly, it can only be broken through force.The worst is yet to come.

I hope that list includes policemen, especially those who were deployed in Kisumu whom even media houses would testify against with concrete evidence. While at it remember to tackle the chief culprit, the duly rigged in thief, who provocked others into evil acts. Otherwise there is no need because charity (to reform offenders) should begin at home.

    If somebody thinks that they can intimidate Ruto so as to make him worship them (read disown ODM/divide ODM) then they are miscalculating because wananchi's eyes are wide open. As Kajwang puts it "we are the people" who vote.

    And by extension the Thief posing( now at Harambee house) I u/stand Karucy ameleta noma huko statehouse hakukaliki tena... being Meechukis boss needs to also face the law. Hence should not be part of the lean, clean Cabinet.

    Of course, affirming the claims that 'Ruto...is holding the stakes in RV' is not the obvious way of countering the evidence that he was responsible for the violence.

    (1) IMLU report suggests that the majority of deaths were not via police action: most deaths were from injuries by blunt or sharp instruments, and significantly fewer than half were caused by gunfire.
    (2) Don't know that Michuki did give the order.
    (3) The order may have been justified. (cf. the report that there was insurrectionary sentiment and violence in Ksm). It would almost certainly have been justified in RVP at the height of the violence.
    (4) Agents of the state, properly-empowered, may be justified in using lethal force.
    (5) Ruto wasn't an agent of the state in the relevant sense, and non-Kalenjins in RVP are not, in virtue of their ethnicity legitimate targets for violence. So, which seems likely, if he was responsible for planning, directing or funding the violence, he is in a significantly worse legal and moral position than even Michuki (which is saying something). That difference probably justifies differential exclusion from the Cabinet.

    Why can’t we be civilized people here? Why all the threats and emotions I have seen displayed in most of the comments. Why are some bloggers saying so and so is guilty without an iota of evidence? Are they guilty because they don’t belong to the political party you support? Have we become the prosecutor, judge and jury here?

    All MPs at this stage meet the requirement of being appointed Ministers as none has been proved guilty in the court of law. That does not mean they should continue holding the position if found guilty in future. In the Kenyan legal system one is presumed innocent till proved guilty and is also entitled to legal representation.

    We should let the rule of law take it own course. Those involved in the political violence should be prosecuted irrespective of the region they come from or the political party they belong. It does not matter whether one has a whole tribe behind him or not as the court looks at the evidence provided by prosecution as in a criminal case it one versus the state.

    Fair point. But if there were irregularities, then there was a dispute. If there's a legal dispute, then, generally, the status quo ante obtains until the dispute is settled. Even if the election was flawed, Kibbs was justified in exercising the powers of the state pending the resolution of the dispute.

I can bet that if Uhuru and Ruto gang up (which is very possible) they can hold this country at ransom. Do not forget that. I think Raila should be very worried about Ruto. He is lucky right now that these PNU MP's are shouting for him but if they ever have a major disagreement, you can bet the political reallignments will be major. I can easily see it in the works.

Forgotten - they signed the Agreement recognizing each other's position? So how does it come that certain people continue discussing the legality of the elections? This subject is past and forgotten, at least by the mainplayers involved. Building the Cabinet, that's the question right now. And here I agree that most of them have dirted their hands - some before, some during the Elections and some after the Elections. None of them is clean - from the top to the bottom. So calling for a clean Cabinet is a joke since there is nobody around (unless you take some untainted new MP's) - calling for a lean Cabinet should be discussed here and how to solve this problem. Throwing insults at each other is not getting us anywhere. We are only continuing the fights we have all promised never to repeat again. So why are you going back to the question: are you a Kikuyu, so I as a Luo can kill you - and vice versa? Not to forget the Kalenjins and Luhjas. Stop please this ridiculous nonsense and start using your brains to find a positive way how to go together into a better future. All of us together, no matter where we come from. This is the lesson we all should have learned during the past weeks.

Ours is a society with both spoken and unspoken divisions, which continue to impede the progress of our nation. We should all learn from the peace provisions, and work to ensure that our government comes to gain the respect of the international and panAfrican community. Although the means of excluding Honorable Ruto are incorrect, we cannot continue to interpret our laws as they should be, but as they are. The legal minds of our community must educate the populace on the legal requirements for exclusion from government, or the means by which we can ensure that rule of law becomes a the norm and not the exception in our great country. We can stumble but we must not fall.

  49. Somebody here said that the law protects somebody until he is proved guilty. Although this is right - it is not in Kenya at least not upto this very moment. We all know this. People have been implicated for murder, corruption, fraud etc. - but no Court has ever condemned them. On the contrary they walked out as respected men - continuing being 'honourable' MP, Ministers and even President. This is something else which has to change: the legal system. Judges and Prosecutors have to be independent and not 'obeying' to the President and/or Prime Minister. The legal system in Kenya is rotten and only serves the poor whereas the big fishes continue murdering, corrupting and looting. In other countries a MP, Minister and other Official has to step down as soon as he is implicated for a crime - this is how it should be in Kenya too. And if this would be applied, the major part of the current Government would already be out of job (to be fair, also some of the Raila-team) - would this not already solve the problem how to build a lean and clean Cabinet?
    There are some 'learned' lawyers around (some of them even MP's). Get them to work this out: An independent Jurisdiction - and all problems are solved.

  53. This year will be a really long one for Kenya. As a nation, we have seen, heard and experienced what we have never in our lifetimes. Yet, as the peace accord was being signed, I thought we can start afresh. When both the PNU and ODM suddenly reached out to each other. Was I naive to think we can do better as a country and that it's only a matter of time and we shall show Africa the way? Only God knows. I am a very saddened man indeed. As Kenyans continue to suffer in the IDPs, others have suddenly become orphaned, many more have to trek from Muthurwa to town, and yet the majority are suffering from inflation, our leaders are only happy to play games. If this is not a curse being invited on a nation then I don't know what is. But God should forbid, not judge the whole country by the deeds of a few. This world is a very BIG place and every country is fighting to be ahead of the next. China is now scouting the whole os Africa for resources, Europe and U.S too, yet the U.S is also heavily present in the middle East. While these guys are busy doing these, positioning themselves for competitive advantage, Kenya and Zimbabwe are there.......embroiled in self-destructions. God forbid.

    Dictators rule by propaganda and the use of totally obscure, pieces of information encapsulated in a slimy layer of verbose crap, with the intent to provide not an answer but only provide total befuddlement.(The more alert reader might notice that I just did that).
    I am not a Kalenjin, My defense of the gentleman is not based on any tribal affiliation. My defense of William Samoei is based on simple reason. EVIDENCE. When it comes to Ruto, I need one thing, solid evidence. And, if there is evidence of his participation in crime why nearly 4 months later? The demonization of Ruto is part of a strategy of keeping him from one day assuming the leadership of Kenya. Ever wonder why athletes around Eldoret were wrong accused of masterminding violence? well so that anybody is western Kenya who offers challenge to the status quo is quashed.
    So I will say this once more, William Samoei Ruto, remains a hero of mine. I rest easy knowing he is on my side of the divide. Unless proved otherwise, I support him.

    Kenya has always been in the forefront of actions and activities in Africa. During Arpatheid in South Africa we were at the forefront calling for the liberation of our brothers and sisters from the yokes of the Boers. We are a power centre north of Limpopo.
    Our airline - Kenya airways has the logo: Pride of Africa! But I wonder if we are pride of Africa anymore! Events of recent years, months, Weeks and days have knocked all our pride and we should instead be the Shame of Africa!
    I have been ashamed this week when some white British colleagues at work told me that Mugabe was about to do a 'Kibaki' in his country! But they wondered if Zimbabweans would do a Kenya down south!
    I am sorry, this type of association does not make me proud of being Kenyan one bit! It is very shameful that we are nolonger known for our athletic and tourism prowesses but for exporting rigging mulpractices!
    Ngai where shall I hid my shame from my colleagues! We are in deed shame of Africa.

  62. At least I am in agreement with Anon@12.56 that emphasizes my earlier response to Anon@1159 (Njoroge). My piece did not in anyway suggest that Njoroge doesn't have my sympathy. On the contrary I saw Njoroge's case as part of the many painful cases kenyans from all walks of life have gone through in the name of supporting this or that side of politics.

    We need to appreciate the fact that Kenya desperately needs voices of people like a mr. njoroge so that we can bring to a stop this political mischief that has brought suffering to our people. The fact that you still look at my piece as being tribal is not helping Njoroge's cause but you continue to perpetuate his suffering. By the way we need as many 'njoroges' as possible.   64. I would love to sympathise with Njoroge but I can't, this is why, If kenyans were just a bunch of thoughtless haters of kuyos then kebaki would not have gotten elected for the first time. That is the clearest indication that we are a progressive people. Kibaki and unfortunately just about every njoroge I know started behaving as if kenya was exclusively theirs. kenyans then counterd by voting kibs out in a free and fair election,according to the law of the land. When kibs tried to deny them that you must understand their anger 40 plus yrs of waiting to exhale the being cheated that is worse than murder. Take the KCSE for example many Luos kambas kisiis, luyhas kales future have been screwed by the attempt at one tribe to dominate the rest, then jobs, some clans have one principal bread winner imagine that guy denied an opportunity to earn a living cause the job is given to a kuyo the efect is worse than murdering that whole clan. Systematic 'finishing' nyanza,ignoring remote parts of kenya ammounts to crimes against humanity what happened to a few kuyos in one week pales in comparison to what kibaki gov as done to the rest of kenya in the past five yrs.
