Friday saw the arraignment of Vivian Oka Mukoko and Rose Opondo in a Limuru court, where the police requested to hold them for seven days while they were being investigated.
After Limuru Senior Principal Magistrate Jared Magoli stated that the court needed some time to give instructions on the subject, the two suspects were forced to spend the weekend at Tigoni police station.
"The court requires ample time to review the arguments made by both parties regarding whether further time should be given to the police to further examine them. On Monday in the afternoon, the court will issue its decision, Magoli decided.
The two were detained at Brown Cheese Company after it was claimed that they had ordered female employees to undress in order to determine who was menstruating. This came about as a result of a used sanitary pad being discovered in a dustbin rather than a sanitary disposal bin.
The police working the case said that the two ended up making a lot of women undress in front of them so they could determine who might be the culprit.
Felix Mutua, the director of criminal investigations for the Limuru subcounty, reported the incident on July 5 to the Tigoni police station. 34 witnesses had recorded their statements, Mutua informed Magoli.
He said he needed additional advice from his superiors and the director of public prosecutions.
In light of the controversy surrounding the case and the threat to the two's safety, he urged the court to order their detention at Tigoni police station in the event that his 10-day request was granted.
Two defense attorneys disagreed with the police prayers, claiming that their clients had family who relied on them and places where they could live.
They informed the magistrate that the two could not flee because they approached the police rather than waiting to be apprehended.
Magoli stated that after carefully weighing the prosecution's request and the defense's opposition, the court would issue its instructions on Monday at 2:00 p.m.
The women's human rights advocacy group Groots Kenya, which is chaired by MCA Pacifica Ongecha, a Kiambu nominee, has promised to continue till the victims' rights are upheld.
This is a human rights violation committed against female employees by female bosses. This is wicked; it is an act of intimidation, disdain, and hatred. Justice must be served, Ongecha remarked.
Ongecha and other female protestors defaced the company's gate with various types of pads on Thursday.

Azimio leaders in Mombasa have vowed to file a lawsuit against senior police officers in the area for breaking up their peaceful demonstration on Friday. The leaders, who were joined by supporters and human rights advocates, had gathered in the Mapembeni neighborhood along Moi Avenue to protest the high cost of living and the recently passed Finance Bill.
Police fired a number of tear gas canisters at the protesters as they marched to Treasury Square to deliver a petition to the Mombasa county commissioner.
Senator Mohammed Faki of Mombasa stated that Azimio leaders would pursue legal action against individual police officers, including the Officer Commanding Station (OCS Central police), while denouncing police brutality.
He explained, "This was not a demonstration, it was a parade of people coming to the county commissioner to give a memorandum on the high cost of commodities in the country.
No legislation, he said, requires a police officer to obtain a permit for such demonstrations. Instead, safeguard the participants' safety by offering security and making sure they are not hurt.
"I want to let the OCS know that we have his identity and will bring him before the court so he can explain to us why he broke up the orderly parade. To make sure that such a thing doesn't occur in Mombasa again, I will personally take the case to court on Monday, he said.

Pressure continues from Kenyans over the unbearable fuel prices that continue to climb in Kenya while neighbouring countries enjoy much lower prices.
Road travel from Mombasa to Kigali is more than 1,600 kilometers long. However, a litre of super gasoline costs more in the port city of Kenya than it does in the capital of Rwanda.
In Kigali, a litre of super gasoline presently costs around Sh183.58 (1,517 Rwandan Francs). In comparison, the cheapest place in Kenya to buy fuel is in Mombasa, where a litre costs Sh192.48.
While fuel is primarily transported by road from Mombasa to Kigali, there are some marketers who may choose to use the pipeline and pick the products up at Eldoret before continuing their journey by road through Uganda to Kigali. Despite the long hours of travel that truckers must put in to get to Rwanda, pump prices in Kigali are still less expensive.
Rwanda highlighted that lower worldwide oil prices were the cause for the June price declines when analyzing the month's prices. The average price of a barrel of oil on the world market was Sh16,454 ($117.53) in August of last year, but it was just Sh10,700 ($77.66) on Friday. This is a huge decrease over the past and yet in Kenya fuel prices continue to stubbornly point north.
Fuel prices in Kenya are now the highest in the area due to a high tax structure; Rwanda, Uganda, and Tanzania all have petroleum products that are less expensive.
In Dar es Salaam, a litre of gasoline costs around Sh157.40 (TSH2,736), whereas in Arusha, it costs about Sh159.99 (TSH2,781). This is true even though the petrol that is sold in Tanzania is imported in very similar ways to the fuel that is sold in Kenya.
The cost of a litre of super gasoline at the pump in Kampala is Sh190.49. Nearly majority of Uganda's petroleum imports pass through Kenya.
According to tax law specialist Alex Kanyi, "a quick glance at the current prices of petroleum shows that a huge chunk of the pump price goes to the government in form of taxes or levies."
"Petroleum was already heavily taxed, and increasing VAT will push up the tax component significantly, pushing up the price at the pump not by the cost of importing the oil but by the taxes."
Fuel now carries a 16% VAT instead of the previous 8% under the Finance Act of 2023. This has made matters worse for Kenyans because, in addition to driving up fuel prices, it is anticipated that this will raise the price of basic necessities.
And while Epra increased the VAT on fuel in its pricing, the Finance Act's selective application appears to have occurred because the rates that took effect on July 1 did not alter for the Railway Development Levy and the Import Declaration Fees, which were decreased by the Act.
Kenyans already struggled with a high cost of living, and the next round of price increases is projected to make many vital goods and services unaffordable.
Because of the higher gasoline VAT, public service vehicle (PSV) providers have already raised prices.
