The Firearms Licensing Board is now not permitted to revoke the firearm license of Uhuru Kenyatta's son, the High Court has ruled (26th July 2023). In a swift move by the Uhuru Kenyatta family, the former president's first born son moved to the high court seeking protection from some of the drastic moves the state has made against him and the family in recent days.
And he succeeded as the court's Justice Jairus Ngaah issued an injunction prohibiting the agency from requiring Jomo Kenyatta junior to surrender his pistol without first going through the laid down legal process.
How will the Ruto government respond to order?
It will be interesting to see how the government responds to this latest move by the Kenyatta family although the family currently enjoys huge public sympathy over the matter.
On the other hand the Ruto administration already has a reputation for doing the unexpected and it is this unpredictability that has had far-reaching repercussions including impacting on many huge investors in the country who have recently relocated to neighbouring countries. The petroleum industry is probably the worst hit in terms of big businesses relocating out of the country. Hardly surprising because investors the world over are usually terrified of unpredictability.
Admittedly it is this same volatility that has been an advantage to the Ruto administration when it has come to dealing with those that it views as its' enemies.
One possible path that could be taken would be for the authorities to simply ignore any court orders protecting the Kenyattas' and speed ahead with their plans. It will of course not be the first time that the regime has opted to do this. Most recently the new VAT on fuel of 16 per cent has been implemented across the country through EPRA, despite a court order putting it on hold.
Still the Kenyatta family has vast resources and friends around the world, not to mention the huge public sympathy on their side and so it will be interesting to see how this plays out.
Jomo had submitted the petition to oppose the government's plans to revoke his firearms license, a threat that has appeared in the media from the ruling Kenya Kwanza side of the political divide. No direct or formal communication on the matter of withdrawing the gun permit has been made to the family so far, but clearly they are not taking any chances.
In the petition, Jomo had argued that unless the case was heard quickly, his constitutional rights were likely to be violated.
The Firearms Licensing Board, the Attorney General, and the Chief Licensing Officer have all been sued by Jomo in the same petition.
On Friday, July 21, he says that police officers came to his Windy Ridge home in Karen and verbally requested that he hand over his firearms. He explains that the move was made without any adherence to the Firearms Act's procedures for the same.

"The unilateral decision by the 1st and 2nd respondents to arbitrarily withdraw or revoke the applicant's license is illegal and ultra vires since the 1st respondent does not have the authority to unilaterally and arbitrarily withdraw the license without following the set forth procedure," he emphasized in the petition submitted through his lawyer Fred Ngatia.
In his petition, Jomo states that he is concerned that the officers may use excessive and brutal force to force him to give up his firearms and license and that they may "attract media attention while so engaged with the publication that the applicant has been dispossessed of his firearms thus unwittingly inviting criminal elements to target the applicant."
Jomo says in the petition that the government officials violated his right to a fair hearing by neglecting to provide him notice of the intended withdrawal and by denying him the chance to be heard.
He therefore requested authorization from the court to oppose any and all plans to revoke his guns license without following the proper procedures.
