Have You Ever Been A Casualty Of Corruption?

I will never forget that hot sunny day some years back, somewhere in Tharaka Nthi (Meru). I was standing there in the hot sun in one of my warmer suits with tears rather than sweat trickling down my cheeks as I squeezed a Kenya shillings one thousand note into the worn hands of a mother who had cried most of the way from Nairobi.

Mutula "Reforms" Kilonzo: Would you trust a lion to guard your sheep?

A few minutes earlier the tiny coffin that carried the remains of her 9 year old daughter had been lowered from the carriage of our minibus. We were going to bury a friend’s wife and had offered her a free lift in our minibus all the way from Nairobi to Meru.

Her daughter died because of corruption. There was no medicine at Kenyatta National Hospital to save her life because corruption made sure of that and her parents had no money to buy it elsewhere. She told me her daughter’s last words to her which will forever ring in my mind. She had said; “Don’t cry mama, I am going to heaven.”

To many Kenyans corruption is a joke. Something that is not too serious, after all Kenya has more serious problems like road accidents and violent crime. Right? Wrong!! The truth is that it is the ordinary folks (e.g. the Mathareans) who feel the full impact of corruption. While Westgateans enjoy the fruits of it.

A day after being appointed the new Justice Minister, Mutula Kilonzo had the nerve to say that in his many years of practicing the law, he is not aware of any clique out to derail reforms in Kenya. For those who know Mr Kilonzo that statement is hardly surprising. It is easier for a hungry Tana River crocodile to ignore a baby bathing on the banks of the river than it is for Mr Kilonzo to bring reforms.

Many Kenyans are not aware for instance of how rotten the judiciary system in Kenya is. An advocate who recently returned to the country and had to go and file her papers in the high court has been frustrated for the last 2 days because her conscience does not allow her to pay a paltry Kshs 500/- to facilitate the process. Just walk into any legal firm and ask them what "facilitation fees" are.

That is how stinking rotten our dear Kenya is.

Many times when I lose focus in this blog my mind goes back to Tharaka Nthi and to that hot Saturday afternoon and to that young girl who died because of corruption. What would she have been today? A lawyer, a doctor saving lives in some remote hospital? Or maybe some happy Kenyan housewife bringing up the next Barack Obama. Or maybe some cocky blogger posting excellent articles here. We will never know.

My post today is dedicated to her memory and to the memory of all those “insignificant” unknown Kenyans who have been casualties of corruption

You are dead right Mr Kilonzo, there is nobody fighting reforms. Excuse me folks, I need to throw up!!!

I dont know about you Chris, but that girl died because of many of you, yes you. Shame on you for trying to be nice here. Those who did not benefit from corruption are rotting in the village, thanks to your kind. Kenya is a cursed country and you are all cursed because God judges a nation not a person.

  8. Mutula'a sins are lesser than raila's. Atleast KRA caught up with him and he is paying for his unpaid taxes. On the other side , ROA is busy eating up molasses as his son chews all the maize. Who will stop Raila?

  9. Raila the reformer: He staged a bloody coup in 1992 and many innocent Kenyans were killed and maimed and property was lost.

    In 2007, both Raila and Kibaki stole votes but Raila felt so aggrieved and he ordered the slaughter of dozens of innocent Kenyans. The result was that 1, 500 Kenyans died, thousands were left IDPs and the country is still bleeding.

    Raila's best political game has been to break up political parties and then ditch them. He wrecked FORD K and then went on to form NDP, which he finally sold to Kanu. He was rewarded with the Kisumu Mollasses Plant by Moi. He used the mollasses plant to steal money from his poor Luos. Wasnt that graft? Mollasses plant was public property but dished to Raila by Moi.

    Raila and his family was recently involved in the maize scandal. Chris ignored the scandal as if it did not exist.

    All politicians - Mutula, Raila, Kibaki etc etc - are same hyenas and you cant isolate one for redicule while they are all rotten.

    The Grand Coalition Govt has no single reformer or anyone who is clean. All of them are thieves, killers and blood-suckers. Pitty some Kenyans lay so much faith on these idiots just because they are from their tribes.

The Government of Kenya from theif -in-chief Emilio Mwai "Kimbeki" ,to Raila "Zuma" Amollo Odinga ,are all rotten to the core!! there is no-ones that is clean,what we need is a peoples revoultion, we get rid of the entire government, line these guys in Uhuru park for a public firing squad!!period. nothing else will save Kenya.

  11. I am disappointed with bloggers who don't know how to keep within the topic. The topic here is about Mutula, not Raila. Let us talk about Raila in the next topic, but for now let us give our views on the suitability of Mutula as the Minister who will bring reforms and a new constitution in Kenya in the next one year.

    My take is that Mutula fits in well with the description the late Bishop Okullu said of one Aringo, "Court poet and master of platitudes." Mutla cannot be a reformer. He would have reformed Moi when he was his lawyer. Instead he ate the fat of the land even as Moi misruled and dictated Kenya. Ever since he became an MP, Mutula does not come across as a servant of the people. He is more of a Lord over the people. He neither knows nor understands what Wanjiku needs. He prides in talking in front of cameras arrogantly and with an I-know-it-all bravado. He has this aura about him that if he was a lawyer of the president, then he is as good as a president (even the president's driver or cook feels the same).

    My take is that Mutula should sit with Karua and get a dossier on how the ministry runs, the obstacles she faced and the corruption cartels that made her work difficult. Let him not think he will do any better than Karua. Very soon we shall see him crying wolf and blaming everybody for non-performance except himself. He was heard boasting that he will never resign. Watch this space!!!

    Its funny how the assumption is that people who live in mathare are the victims of corruption and people who shop in westgate are the corruptors

    Of course Mutula is not aware of anyone fighting reforms-the same way Dr.Kibaki was not aware why the media spread lies about his having 2 wives. he was in a foul mood that day was he not?

    in Kenya our judiciary is special....it has eyes its not blind it can SEE!it is selective like a cat-that's why to some people justice is delayed and to others it is altogether denied!

My parents were both victims of corruption and it pains me to see kibaki appointing the devils advocate to be in charge of the reform agenda.Kibakis clear message is that 'THERE SHALL BE NO REFORMS".If R did not approve of this appointment like was raised on yesterdays nation why cant he say something?

    I normally use the 'principles' of bible to bring forth my arguements. One is that there is no bigger sin and the other one is from Jesus statement/question of, "He that is without sin among you, let him first cast a stone at her."

    Luckily since 2002, when I bribed policemen around 1 a.m when they tried to wrongfully arrest a lady friend, I have never engaged in any form of corruption.

    I will always insist that our politicians antics are just the mirror of the Kenyan society in general. However there are still people with good behaviour who I feel are the ones who can bring the real change to Kenya. These are the people, irregardless of our own behaviour, which may be contrary to theirs, we should support.

    A corrupt policeman should not point a finger at our politician, because most likely, if given a chance, she/he may be as worse as that politician.

    A corrupt lawyer should not point a finger at our politician, because most likely, if given a chance, she/he may be as worse as that politician.

    A corrupt 'makanga' should not point a finger at our politician, because most likely, if given a chance, she/he may be as worse as that politician.

    This is the reason as Kenyan people we should grow up and make a wise decision instead of replacing a hyena with a leopard to guard our sheeps and goats.

    Ati 'Moi should come back' BULLSHIT! Who among us does not know that there was a time in Kenya where economic growth was -ve 3% and Mwiraria was told to say 1.3% if I'm accurate.

    We know our politicians are corrupt because they steal more than us and the media reports it and the media focus is more on them than us, but we will all be surprised when we realize how corrupt some of our neighbours are, who whine oftenly about our politicians.

    I'm just dissapointed by what I'm seeing around - corruption everywhere, we are now competing with Nigeria.

    Can someone tell me someone with a good history who we can support in year 2012?

    Aaaarrrggghhh why should I even ask when this blog is all about whining and pointing fingers. Can we change and start looking for a solution to all our problems?

    Looting the Budget – Ksh 9.6 Billion Missing, and the fraudulent unjustifiable
    approval of an amount of kshs 26.7Billion from the Supplementary estimates of
    Recurrent Expenditure of the Government of Kenya for the year 2008/2009

    This afternoon Gitobu Imanyara, MP, will request for a statement from the
    Minister of Finance regarding glaring discrepancies in the documents presented
    to Parliament for approval of the Supplementary Budget last week.

    Mars Group Analysis of the Supplementary Budget and comparison of figures
    within the Approved National Budget show systematic differences which caused
    Parliament to vote additional funds to the Government when additional funds were
    not necessary as Parliament had approved the expenditure in June last year.

    There are over 200 such budget line items involved across 35 Ministries and the
    total figure in dispute is just over Ksh 9.6 billion which was removed from the
    Approved Estimates for unknown reasons.

    The following budget line items have
    discrepancies which require explanation:

    - Personal Allowance paid as Part of Salary
    - Training Expenses
    - Hospitality Supplies and Services
    - Domestic Travel and Subsistence and Other Transport Costs
    - Office and General Supplies and Services
    - Research, Feasibility Studies, Project Preparation and Design, Project
    Supervision
    - Purchase of Office Furniture
    - Routine Maintenance
    - Printing, Advertising and Information Supplies and Services
    - Communication, Supplies and Services
    - Utilities Supplies & Services
    - Office and General Supplies and Services
    - Fuel Oil and Lubricants

    The effect is an unexplained loss of kshs 36,347,880,495 being the discrepancy
    and actual loss of kshs 9.6 Billion plus the fraudulent unjustifiable request
    and approval of an amount of kshs 26,670,690,984 on 200 fraud budget line items.
    An amount larger than the entire Supplementary Budget.

    The business of tax money is serious. The report made to Parliament through the
    supplementary estimates is inaccurate. It is criminal to mislead Parliament that
    the figures in the supplementary budget are the same as the approved estimates.

    Who is responsible? Who at treasury authored the Supplementary Budget? Was the
    Minister of Finance Uhuru Kenyatta aware that he tabled falsified documents for
    the approval of Parliament? Parliament passed the budget in one afternoon
    without scrutiny. Can Kenyans claim to have representation in Parliament?

    It is our view that looting the Budget, our tax money by the Executive aided by
    the National Assembly demonstrates that impunity in Kenya is now dictatorial and
    at an all time high. The Kenyan Citizen will have to ultimately seek
    accountability from Parliament and the Executive to end corruption and impunity,
    if Kenya is to survive the problems it has so as to deal with Agenda 4 of the
    National Accord.

  19. It is exactly 30 years ago that Mutula Kilonzo became Moi’s personal lawyer and family friend. At the advice of Baba Moi, the lawyer shaved his goatee and has since maintained a smooth chin to date just as Baba Taifa alisema.

    Baba also advised him not to drink alcohol and so he did make sure Mzee didn’t see or hear any report that he imbibed any liquor-like beverage.

    Mutula Kilonzo epitomizes the phenomenon of loyalty. He is fiercely loyal to the status quo that he has himself immensely benefitted from, and there can be no better defender for the good ol’ rotten system than Mutula.

    We the people are ready for battle because we must reform Kenya if we are to retain it as a peaceful piece of territory.

    Mutula oversaw all of Moi’s vast land acquisitions across the country during the latter’s tenure as President, besides covering up other legal conundrum the President went through. The Kroll report chronicles the good handiwork of Mutula Kilonzo in enabling the Moi family empire to amass from Kenyans, a Sh 500 billion plus fortune.

    In between agenda 4’s land reforms and Mutula Kilonzo for instance lies Mutula’s own gifted piece – one of the biggest individual land holdings in Rift Valley – his huge farm at Rongai, neighbouring Moi’s. His holdings in the Coast, Nairobi and Ukambani are equally amazing.

    In a report I previously posted here in JUKWAA, Mutula declares that (direct quote): “The late president [Mzee Jomo] Kenyatta is the only person who understood the value of land,” he says. It’s no wonder Mutula’s hero Kenyatta holds that much land in Kenya. Will Mutula now facilitate reforms that would challenge that very ownership of land? Your guess is as good as mine.

    Of course as regards the Mau Forest crisis - there should be little doubt as to who shepherded the allocation, transfer and registration of forest land to all those Moi allies, starting with Moi’s own son Gideon Moi and nephew Hosea Kiplagat.

    It was Hosea Kiplagat who in fact first introduced Mutula Kilonzo to Daniel Arap Moi in 1977 through guess what – another land deal.

    Hosea Kiplagat has vowed he will not vacate Mau Forest because he got the land legally (Mutula can attest to this) and that he farms tea in that forest land (yaani it is not idle). Let’s see the kind of spanner Mutula will throw in the Mau Forest works he created with Moi.

    The Mau issue goes beyond the 4,000 peasants holding title deeds. The real big grabbers of Mau forest are the Gideon Mois, Isaac Rutos, and Hosea Kiplagats who are now hiding behind the peasants.

    The task force already insinuated that the peasants will be resettled- I don’t know about the Hoseas. Maybe Mutula Kilonzo is now in a better position to throw more spanners into this on behalf of the Mois and Hosea Kiplagats.

    Let’s also see how Mutula handles the formation of the STK tribunal which his own cousin (real cousin) Justice Phillip Waki proposed – a tribunal which seeks to stand his political allies Uhuru Kenyatta and William Ruto, behind the docket. It will be quite interesting.

    Kilonzo's main claim to fame is that he was Mois lawyer for 24 years and won many cases for him. If you ask Ugandans they will tell you that Idi Amin's lawyer or even Museveni's actually "win" a lot of cases. That is a very easy and cheap career option for a lawyer. The state thugs and compromised judges will always win the cases for you.

    Kilonzo has never been involved in any significant constitutional legal battle. At least legal prostitutes and opportunists like Gibson Kamau Kuria have legitimate claim as having been at the centre of major constitutional battles in the country.

    But you are right that dealing with people like Mutula about issues like the TJRC where he has to defend the status quo is going to be a nightmare but Kenyans are going to take that out of his hands. Already the KNCHR are recruiting the TJRC commissioners and their short list was great. Remember when we proposed that move to let the KNCHR recruit the TJRC commissioners, somebody listened.

    Also the PSC with all its problems have opted to use some form of semi transparent recruitment for the IIEC and the Boundaries Review Commission. That suggestion too originated from you folks. So the battle is on.

    But where Kilonzo will be a pain in the but are the institutional reforms. These guys do not even understand what police reforms. They are going to talk about new uniforms for the cops, better pay. whether to merge the A.Ps with regular police etc. Those are irrelevant things.

    According to the Waki recommendations the issues are police involvement in PEV and police failure to protect citizens. In other words we need a full audit of all police actions and inactions in the pre and post election violence in order to know how to correct the problems. We need to know what went on and who was accountable.

    Secondly we need to address the issue of the OP and the Provincial Administration using and misusing the police to break the laws of the land and to use them for political objectives. That is the root of police violence during political conflicts.

    Third we need to address the issue of civilian oversight when police kill people. The police have proved they cannot investigate themselves. We need structures where every time police kill citizens an investigation not in the hands of the police kicks in. It works very well here in Canada and in the city where I live, Toronto, where we have Special Investigations Unit (SIU) which automatically investigates every single incident where police us deadly force.

    If the police use of deadly force is established to have been justified according to the police code of conduct the matter ends there. Otherwise criminal charges or other remedies can be sought. It works perfectly and the result is that it is a deterrent against careless and criminal abuse of police power. That is what we need.

    I do not think such concepts and insights in human justice and lawful society are in the mindset and political DNA of the likes of Kilonzo. So there we are going to have a war with him.

    When Kilonzo talks about reforms in the judiciary, I just laugh loud. I don't even think he knows what that means. Personally I don't think the Kenyan judiciary can be reformed without reforming the politics of the country. That is not possible. So I pay no attention it. Let them mess it up as much as they want it will be cleaned later.

    Reformer...Mutula Kilonzo is not! has never been and will likely never be.

    My real reservations on the guy reforming anything are based on Mutula's own record and history with yesteryear and current power wielders. You know it very well. His loyalty is to the boss, not to the nation. He will preted that having been briefly in Orange, he is now a reformer. He is not, he is just a skillful sycophant who knows how to get his bread buttered.

    Some folks know how to crawl up and win loyalty of power wielders of the day - it's an art my friend. Sycophantic skills are horned and nurtured by folks like Mutula. These are professional kissers...before you know it - they are whispering right inside the tympanum of the big man.

    Think for a moment about the TJRC Commission soon to be established. This will be a very important ingredient supposed to create national harmony and reconcile our dirty past to nurture closure and peace.

    As the new Minister for Justice - Mutula may have a fairly big and vetting hand in its formation (not that I agree with that wrong premise itself).

    Can you imagine Moi's lawyer Mutula Kilonzo in-charge of (supervising) the formation of a credible and effective TJRC to look into the Moi era transgressions? Will it likely be a genuine and credible team Mutula will unveil? These are the kinds of things I am talking about. Will he even allow the necessary climate to expose Moi's dirt, repression, and tendencies for torture for instance? Isn't Mutula already a spanner in the works of bringing lasting justice?

    Then think about the Kroll report. If the Justice Ministry is responsible for facilitating restitution of looted funds - such as the Sh 500 billion Moi robbed from us. Are you trying to tell me Mutula Kilonzo who literally helped Moi transact the capital flight in the first place will be party to undoing what he did?

    Mutula is there to serve the interests of a few, but not you (Kamale) and me and Kenya. In executing that job - he will automatically deny Kenyans justice. There will be no truth telling of the Moi transgressions, there will be no restitution of kroll detailed loot, and there will be no justice and reconciliation. It is as simple as that - no need to twist anything.

    Any agenda in that Ministry - whether reforming a rotten judiciary that robs Kenyans of timely justice; whether constitution reforms to bring equitable sharing of resources; police reforms to ensure real security of Kenyans;...etc Mutula will not facilitate them. He is doing someone else's bidding.

  22. Yah i have been a casualty of corruption two times ... it hurts like hell and those are the two instances i regretted why i didn't take a gun i had been offered.

    For any vice to thrive there has to be two parties playing ball. There is the one who asks and the one who gives ... or the one who gives and the one who accepts. Its a two way thing.

    We need more people who will refuse to give or accept bribes even when u have been pushed to the edge. And a willingness to conduct our day to day businesses in a clean straight forward way.

    Every institution capable of dealing with this vice, is blind to the corruption in the judiciary. Ama is KACC going to pretend it is not aware of what goes on there?

    Just go to those registries of theirs Chris and you will know the real meaning of 'denied' and 'delayed' justice!

    An Arsenal fan in football-mad Kenya hanged himself wearing his beloved team's shirt after their defeat to Manchester United in the Champions League.

    Like elsewhere across Africa, Kenyans pack bars for Premier League and Champions League matches, especially those involving Arsenal, Manchester United, Chelsea and Liverpool.

    Suleiman Omondi, 29, was found hanged at his home in a middle-class Nairobi estate shortly after leaving distraught from the pub where he had watched Arsenal lose 3-1 in their Champions League semi-final at the Emirates on Tuesday.

    "He took some drinks and broke down in tears within the final minutes of the match," a fellow bar patron, who asked not to be named, told Reuters.

    Police said they were called to Omondi's house on Wednesday morning. "What we are gathering is this suicide is related to the Arsenal and Manchester match," local Embakasi area police chief David Bunei said.

    Bar attendants said they had to intervene after Omondi lunged at a man who suggested Arsenal would not recover from conceding two early goals. They also lost the first leg 1-0.

    Brawls are common in Kenya during football matches and there have been other related suicides reported in the past.

    Professional and ethical investigations leading to speedy trials and conviction or acquittal, with necessary fines and legal fees in place not side payments

    All so that the message is clear that crime does not pay and therefore if you cannot do the time then dont do the crime.

    PARIS, Wednesday

    A French magistrate has launched a probe into whether the presidents of three African oil-producing countries used embezzled public funds to buy luxury homes and cars, the Paris prosecutors' office said on Tuesday.

    The case could strain French diplomatic and business ties with Gabon and Congo Republic, two former colonies and close allies, and with Equatorial Guinea, a growing oil exporter.

    "This is an unprecedented decision because it's the first time a judicial inquiry has been opened concerning suspected embezzlement by sitting presidents," said William Bourdon, a lawyer representing the plaintiffs in the case.

    A 2007 French police probe found the leaders of the three countries and their families owned dozens of bank accounts, homes in rich areas of Paris and on the Riviera, and cars including Bugattis, Ferraris, Maybachs, Maseratis and a Rolls-Royce.

    Omar Bongo of Gabon, Denis Sassou-Nguesso of Congo and Teodoro Obiang Nguema Mbasogo of Equatorial Guinea deny any wrongdoing. They have been embarrassed by the disclosure in French media of their assets worth tens of millions of euros.

    Bongo, Africa's longest-serving ruler who regards Paris as a second home, was so infuriated by a report on the subject on French state television last year that the French ambassador in Libreville was summoned in protest.

    Setting a precedent

    The Paris magistrate, who is independent from government, decided to open the formal investigation at the request of the French arm of anti-graft watchdog, Transparency International.

    It is the first time the organisation has been admitted as a plaintiff in such a case and the precedent is likely to encourage similar actions by anti-graft activists elsewhere.

    A Gabonese citizen, Gregory Ngbwa Mintsa, had requested to be a co-plaintiff with Transparency on the basis that as a taxpayer he was a victim of corruption, but the magistrate rejected the argument so he will not be party to the case.

    The Paris prosecutors' office, which answers to the justice ministry, had asked for Transparency's complaint to be shelved. It is likely to appeal against the magistrate's decision.

    Should the case continue, it could damage France's relations with two of its closest African allies, but if it is halted that would raise suspicions some presidents are protected because of French interests in their countries.

    Bongo and Sassou-Nguesso have both enjoyed friendships with successive French presidents and backing from Paris at testing moments of their careers.

    French oil and gas group Total is the leading producer in Gabon and Congo Republic and many other French firms, public and private, have long-term contracts there.

    The magistrate has opened a preliminary investigation, which in French law is a first step towards establishing whether there may be a case to answer in a criminal court.

    It can lead either to further investigation or to no further action.

    An investigation into allegations that Sh9.2 billion cannot be accounted for in the supplementary budget has been ordered. National Assembly Speaker Kenneth Marende ordered the departmental committee on Finance and Trade to investigate the allegations and report to Parliament not later than next Tuesday.

    Finance minister Uhuru Kenyatta and Imenti Central MP Gitobu Imanyara clashed in Parliament on Wednesday over claims that Sh9 billion could not be accounted for. Mr Kenyatta accused the Imenti Central legislator of relying on information from “doubtful” institutions to mislead the nation.

    “The supposed discrepancy is not real. Let MPs avoid using information from doubtful institutions,” a furious Mr Kenyatta said. In response, Mr Imanyara accused the Finance minister of seeking extra funds on the basis of wrong information.

    “There are 200 inconsistencies in the supplementary budget amounting to Sh9.2 billion and the minister cannot purport to come to this House to seek extra funding based on wrong information,” he said. Mr Kenyatta refuted Mr Imanyara’s claims that he had withdrawn Sh31 billion when Parliament had approved Sh22 billion.

    The minister said that Treasury had cut back expenditure on non-priority areas. “This does not constitute fraud. It is, in fact, prudent management of public resources,” Mr Kenyatta said. But, brandishing some documents, Mr Imanyara insisted that the Sh9.2 billion could not be accounted for.

    His attempt to seek permission to respond to the minister’s statement on Thursday afternoon, saying that he was yet to obtain a copy of the statement, was rejected by Speaker Kenneth Marende, who ruled that ministers did not have an obligation to provide members with ministerial statements.

    “A figure of anything near Sh9.2 billion, let alone Sh1 billion, is mind boggling. Kenyans are entitled to know the truth and I therefore refer the matter to the parliamentary committee on finance to establish if public funds have been misapplied,” the Speaker said.

She got so frustrated and was a jobless top grad doctor in kenya with not enough money -or connections- to open her own clinic.So she went back. Now, she one of the university's and US top neurosurgeons. A kisii girl if that helps.Google her and you will see. Because of your tribal hatreds, when your ma is old and needs thigns done to her brain to correct it, she will have to be flown to the US for quality treatment-from a kenyan no less, than affordable treatment - from the same bright kenyan -right here at home, or will just die from lack of, or substandard treatment from connected" doctors".In fact,this is the kind of neurosurgeon who would have operated free on cases of need, as your ma might be, as she is doing today in the US.

He also got a scholarship and went on to the states and studied astrophysics. He came back bright-eyed and hopeful as many young kenyans abroad tend to do, but kenyans would not give him a job again, cos they did not want "an outsider" in their "connected" places of work.He was required to "pay" wherever he applied especially "since he was a different tribe", or was shown the door.He was jobless,penniless and living with his family in ocha with no food,when he had top education- and had done spectacularly well in it both here and abroad-just because he had no kalenjin/kikuyu/luo "connections" dominant in public service today and yesterday.So he applied for another scholarship,got, went back for his masters and decided to stay. today,he is one of NASA's top people who flies his own cessna plane wherever or whenever he needs to or is needed to,and can very well support his family -who all later joined him in the US. He is married to a ghanaian. Google him and see. So you see, we could have been on the frontier of landing on the moon but "connections" got in the way,and yet another of our brightest brains is somewhere else, fulfilling their dreams, and those of their adopted countries. I understand your resentmment towards the wealthy when there is abject poverty in their midst. We know that the only way to change this system is to have an overhaul of the polical class and institutions. It remaind to be seen if Kilonzo is able to deliver. There are many bright and capable willing and able to lead the way forward.

    We must non-violent pressure at every possible opportunity. That is the only way. Reform can happen in as less than 6 months if the will exists. But the CG for all it's bickeing will not give up their trappings of power easily. It will take ongoing agitation.

    You have no idea how many peoples businesses are stagnating because of corruption, they cant expand, they are struggling to keep it afloat because they refuse to participate in corruption.

    There are many hardworking honest Kenyans, dont take money to mean they do not know hardship. Many of those you talk about probably grew up in more hardship than you can imagine, but back in the day, you could get grants to uni and allowances, which were used to support your family.

    Jobs were plentiful, and the country was just beginning to try and find its feet.

    Fair enough, the poor are feeling it the worst though which is terrible, and must change, but cant change with the current levels of craziness we see. But it is not corruption only that makes medicines at KNH unavailable.

    It is a system of structural adjustment programmes that sought to privatise all our healthcare services to cut the government expenditure and increase economic reform, corruption has perpetuated it, but healthcare is known to have really been affected by structural adjustment programmes in the late 1980's and 1990's.

While we await for the finance committee of parliament to relook at the figures, i have to say i was very alarmed that mps would pass something then ask questions later. and am told the supp budget actually went through the finance committtee who cleared it for approval by parliament! If it is found there is some thing wrong (unlikely since finance committtee would be accusing itself) then you should be very worried. you basically have no representation and you should take steps represent yourself.

    According to the report "Geographic Dimensions of Well -Being in Kenya; Who and Where are the Poor?" – presented by former assistant Planning minister Simeon Lesirma "Nyanza, with poverty levels of 65 per cent is the poorest province, followed by North Eastern with 64 per cent"

    Though poverty is everywhere it is highest in your province. Kasipul Kabondo, Ndhiwa and Rangwe pull the tail in poverty in kenya. How can you explain the fact that Luo Nyanza is poorer than NEP ( Home to the dryest deserts in Kenya? How else can it be that the place where we have the highest number of professors is the poorest yet they have the 'best brains', biggest fresh water lake, numerous rivers, fair rainfall etc?

    Most Kenyans want the President and Prime Minister to share executive authority, a new opinion poll shows. The majority is sceptical that a new constitution can be put in place in a year and support devolution of power to Parliament and regional governments and are against entrenchment of religious courts.

    Some 1,400 respondents were interviewed countrywide between April 19 and April 26 for the Transparency International (Kenya) and the National Council of Churches of Kenya survey.

    Margin of error

    “Despite disaffection with the current performance of the coalition, only 15 per cent of the respondents support a government in which the prime minister exclusively exercises executive power. Similarly, only 32 (per cent) support a government in which the President exclusively exercises executive power,” TI executive director Tom Ogonda said.

    Releasing the findings at Nairobi’s Hilton Hotel on Thursday, Mr Ogonda, in the company of NCCK official Lynette Ndolo, said the majority would like executive powers shared between a president and prime minister. The officials put the margin of error of the findings, in which 56 per cent of respondents were from rural areas, at plus or minus three.

    The poll comes at a time the coalition government is rocked by persistent squabbles between partners ODM and PNU. The wrangles are over power sharing between President Kibaki and Prime Minister Raila Odinga.

    Asked if they expected a new constitution in 12 months as promised by the government, 78 per cent of respondents did not. Sixty two per cent cited political interference as the greatest challenge to a new constitution while others said bickering and tribalism were the main obstacles.

    Mr Ogonda expressed disappointment at new Justice, National Cohesion and Constitutional Affairs minister Mutula Kilonzo’s statement on Monday that he was not aware of vested interests that could block the new constitution. Mr Kilonzo also said a draft constitution would be in place in a year.

    Mr Ogonda said key personalities involved in graft and the political class who control public resources were against a new constitution. “The political class might pretend they want a new constitution to get votes,” the TI chief said. Kenyans, he said, should refuse to be divided on tribal lines and should resort to mass action to push for the new document.

    “We must learn from National Assembly Speaker Kenneth Marende who showed us that you can make independent decisions and the sun will still rise tomorrow,” Mr Ogonda said. Mrs Ndolo said the fight for a new constitution “is as important as the product itself.”

    Election violence

    “The committee of experts must involve everyone,” she said, warning that the situation in the country would be worse than during the 2007 post-election violence if there is no new constitution by 2012. “We expect better political goodwill. If we don’t we are going to demand it,” she said.

    The poll demystified presumptions that Kenyans would not agree to devolution of power and regional governments with 60 per cent saying they supported the system. Mr Ogonda and Mrs Ndolo called on the coalition government to hasten the pace of governance reforms as spelt out in Agenda IV of the National Accord and Reconciliations Act.

    “If the country is to surmount the social economic challenges it faces, focused and meaningful steps to strengthen governance institutions and processes must be initiated,” Mr Ogonda, said.

    The ODM wants to bring the contest to parliament in order to use its majority to try to have its way.

    Mr Musyoka used to be a senior ODM official but split to form his own party - ODM-Kenya - and is now seen as close to the president.

    The prime minister recently complained that the vice-president should not be getting paid more than him.

    Mr Odinga - who has claimed he is being sidelined in the unity government - has said fresh elections may be needed if the rift cannot be solved.

    Over the weekend, President Kibaki's party accused the ODM of "fomenting a coup".

    Earlier this month, Mr Odinga's party said it would boycott cabinet meetings, leading to inconclusive crisis talks.

    The prime minister recently complained at a public rally that no red carpet or toilet were provided for him during an official visit.

    The Finance Minister questioned Mars Group’s integrity. We stand by our
    work. Unfortunately the Minister’s figures do not add up. On the basis of
    his own documents as Minister for Finance, the question is - are Kenyans satisfied
    that the documents of account being prepared by Minister for Finance officials
    are true and further meet proper accounting standards?

    We will know on Tuesday.


    SUBMISSION TO THE JOINT PARLIAMENTARY COMMITTEES ENQUIRING INTO MATTERS ARISING
    FROM A REQUEST FOR A MINISTERIAL STATEMENT BY HON. GITOBU IMANYARA RELATED TO
    THE SUPPLEMENTARY BUDGET ESTIMATES 2008-9

    This submission is on behalf of the Partnership for Change a non-violent
    people’s movement dedicated to ending dictatorial impunity and re-establishing
    democratic accountability in Kenya. To better engage the public with public
    finances we study budgets at central and local levels. When the Supplementary
    Estimates were first made public we formally communicated in writing to the
    Budget Committee our concern about the short time given for scrutiny of the
    Supplementary Budget and suggested that detailed scrutiny would identify any
    inconsistencies or improper provisions ahead of Parliamentary approval.
    Unfortunately the supplementary estimates were approved in one afternoon and no
    member of parliament opposed them.

    As we researched the Supplementary Estimates we asked the following questions:

    Where is the authority for Variation of what Parliament approved last year?

    Where is the authority for the reallocations?

    Even though all variations are supposed to be accompanied by explanatory notes
    why is it that nowhere is there an explanatory note for over 200 items for Ksh
    9.6 billion?

    Hon. Gitobu Imanyara raised this matter in Parliament on May 5th 2009. The
    Finance Minister’s first reaction was to issue a 6 page statement in the
    National Assembly, in which he strenuously defended the integrity of the
    supplementary estimates as laid in the House, and further questioned the motives
    of both Imanyara and other private citizens for airing concern. The Finance
    Minister did not admit to any error before the House and Mr. Imanyara was
    dissatisfied with the statement as were many Kenyans.

    Wisely the Speaker of the National Assembly referred this matter of the Ksh 9.6
    billion to your Joint Committee. When he first asked his question Mr. Imanyara
    tabled 20 questionable budget line items and on Wednesday he tabled a list of
    200 such items worth just over Ksh 9.6 billion. Speaker Kenneth Marende has
    referred this grave matter to both the Budget Committee and the Finance
    Committee ordering them to inquire into the Minister of Finance’s Statement
    and report back to the House on Tuesday May 12th 2009 whether or not there are
    inconsistencies between the estimates of June 2008 and those of April 2009. We
    do not believe that computer error is at play here – it is an afterthought
    having failed to convince Parliament 48 hours ago. We believe that if computer
    error were to blame, the very first response of the Minister would have been to
    check with his officers and thereby prevent the false statement being read in
    Parliament. They would have found the error in a matter of seconds certainly a
    shorter time than it took to draft and print the statement he issued on
    Wednesday May 6th 2009. Because he did not conduct any check the Statement he
    issued needlessly mislead Parliament and the country further. Worse it defamed
    private patriotic persons who were not at fault.

    But to the matter at hand. The Supplementary Appropriations Bill is based on
    contentious documents and Parliament must satisfy itself that it is proceeding
    on the basis of a full and frank disclosure of the facts by the Ministry of
    Finance. We do not believe he is being frank. The recent explanation of last
    night and this morning is a mere after thought after being confronted with
    evidence of a systematic inflation of the total amounts approved by Parliament
    by concealing Ksh 9.6 billion from Parliament while at the same time seeking a
    further Ksh 26,7 billion on the same budget line items. This is a grave matter
    and requires further investigation, and we urge you to consider it imperative to
    the restoration of trust and faith in the management of the public finances of
    the Government and by extension Republic of Kenya.

    The Finance Minister questioned Mars Group’s integrity. The Budget campaign
    is a campaign of the Partnership for Change. MARS Group was commissioned by the
    P4C to conduct the research. The findings were studied and adopted by the
    Partnership for Change and therefore as the P4C, we stand by our work and by the
    reputation of Mars Group. Unfortunately the Minister’s figures do not add up.
    On the basis of his own documents as Minister for Finance, the question is are
    Kenyans satisfied that the documents of account being prepared by Minister for
    Finance officials are true and further meet proper accounting standards?

    There are over 200 such budget line items involved across 35 Ministries and the
    total figure in dispute is just over Ksh 9.6 billion which was removed from the
    Approved Estimates for unknown reasons. The following budget line items have
    discrepancies which require explanation:
    1. Personal Allowance paid as Part of Salary
    2. Training Expenses
    3. Hospitality Supplies and Services
    4. Domestic Travel and Subsistence and Other Transport Costs
    5. Office and General Supplies and Services
    6. Research, Feasibility Studies, Project Preparation and Design, Project
    Supervision
    7. Purchase of Office Furniture
    8. Routine Maintenance
    9. Printing, Advertising and Information Supplies and Services
    10. Communication, Supplies and Services
    11. Utilities Supplies & Services
    12. Office and General Supplies and Services
    13. Fuel Oil and Lubricants

    These are the same budget lines that generally have caused public concern as
    the economic situation in Kenya deteriorated. Unfortunately most of the budget
    line items which are now contentious relate to the allowances of our teachers,
    police officers, administration police officers, prison officers, nurses and
    other decent hard working civil servants. We would like to submit to you the
    list of budget line items in the recurrent supplementary budget that require
    further scrutiny even as we urge you to constitute a further probe into the
    National budget including the estimates tabled in June 2008 and the
    supplementary estimates of April 2009.
    Apart from the Ksh 9.6 billion there are over Ksh 4.89 billion inserted into
    the budget through the device of absolutely new budget line items which were not
    approved by Parliament in June 2008. There are also odious debts such as Ken
    Ren Fertiliser in the National Budget which has been condemned by the Controller
    and Auditor General’s Report which the Minister of Finance tabled in
    Parliament on Wednesday. All these matters require a longer probe than the
    short one you have embarked on and we are sure the public would appreciate your
    solidarity in demanding that Treasury and the Ministry of Finance is fully
    accountable to Parliament.

    Recommendations:

    1. A Forensic Audit of the Budget for 2008-9 is necessary because, on the face
    of it, there are material inconsistencies which perhaps indicate that public
    funds could have been misapplied. The computer/ printing error explanation is
    dubious and probably false - it does not address the doubt inherent in the
    Speaker’s initial order establishing this enquiry. In fact computers and
    printing machines do not make errors – no accounting software exists that
    properly used could produce such error. Treasury must take responsibility for
    this by subjecting itself to a forensic audit if it has nothing to hide.

    2. The Forensic Audit should be conducted independently of Treasury. Perhaps
    the audit could be commissioned by these two committees and an expert Panel of
    the Institute of Certified Public Accountants of Kenya. Even the Treasury has
    hired PWC to conduct special audits of security contracting. The precedent is
    there, and the need is obvious, especially in view of the Treasury’s recent
    U-Turns over the past 4 days.

    3. We would request an apology from the Ministry of Finance in view of their
    climb-down and the damaging statements made against us for merely pointing out
    error in the budget in the public interest.

    4. We would recommend that only urgent critical and priority spending should be
    passed during the next phase of supplementary appropriation – the rest should
    await the National Budget of June 2009.

    5. The Fiscal Management Bill should be assented to and these committees should
    request the President through the Speaker to so assent. This will reduce the
    monopoly over budgeting currently held by Treasury, which has caused this costly
    exercise.

    6. Were this anywhere else in the world, we are sure that Treasury buildings
    resignations would be in order.

  100. I refused to bribe the PRINCIPAL IMMIGRATION OFFICER at the moi international airport and ended up missing my flight and waiting for 2 weeks for the next one. The tour operator understood and gave me a free flight back and I got 2 more free weeks in the sun costing me a few shillings a night at glory guest house and my principles are INTACT. We can all say NO to corruption at all levels and avoid short cuts. Threaten to call a lawyer if you have done nothing wrong and the police leave you alone. The culture of corruption must end NOW and it demise lies with me and you.
