Speaker Marende's Smart Parliamentary Coup


In one fell swoop, Speaker Marende left pretenders to the throne profusely bleeding from political humiliation. And what a masterstroke which neither of the protagonists saw coming. The gatekeepers have been disabused of their murderous venture to auction Kenya and holding her citizens hostage.

All the hubris about seeking constitutional interpretation is just that HUBRIS. Never short of valueless face-saving gimmicks, the scoundrels must be burning the midnight oil scheming to invent another source of political heat. True to SLITHERING IN BETWEEN philosophy, the mouth and backs on hire must fire from all empty cylinders lest they are speedily rendered politically irrelevant.

Speaker Marende’s ruling underscores one truism which politically faint-hearted have been afraid to accept: KENYA IS AND WILL NEVER BE THE SAME AFTER THE BUNGLED 2007. You can chose to live in any FORTRESS OF DENIAL but the reality is all there for all with eyes to see.

No amount of legal posturing ever solved any politically-engineered problem. Marende’s intelligent ruling must have been alive to that fact as evident in his refusal to please either party. Instead he threw the ball back to them by reminding them that both the constitution and the national accord must be read as one and two documents.

With that single stroke of genius, Speaker Marende extinguished all the vents of hot feeding "the constitution is supreme" fallacy.

Speaker Marende has has done Kenya and her people proud in standing by them. He has banished the political smokescreens clothed in deceptive legal gabs. And in the meantime he has inadvertently and fatally bruised political egos of many pretenders who never cease to salivate at every loophole they curve from our tattered constitution to feather their selfish political nests.

Hail Speaker Marende for proving that amidst the political rot remains some sane Kenyans who can come to the rescue of property Kenya under siege from political auctioneers.

  2. This Speaker is a silent genius. Marende's was more than a parliamentary ruling.

    In his hour-long ruling, he adeptly and preemptively made his own interpretation of the constitution vis a vis NARA Accord probably well aware that PNU were soon going to be rushing to courts seeking constitutional interpretation of the same.

    Marende's ruling was of superior legal and political quality - very comprehensive and incorporating the realities of the day in Kenya. A classic ruling that has so far received accolades from top constitutional experts besides widespread public support.

    Now challenge that!!!!!

    This was the greatest move in public relations and advance persuation that I've seen in such a long time in Kenya.

    Marende was giving all and sundry his own top notch constitutional interpretation of the very question Kalonzo Musyoka has announced PNU will be rushing to courts to seek an answer.

    Marende tayari amelijibu hilo swala.

    And in doing so, he has already convinced many that the constitution cannot be read in isolation from NARA. the good 'ol constitution is no more. The days of absolute Imperial Presidency are basically history.

    It's an era of consultations and power sharing - at least in the life of this coalition. Marende amesema, waKenya wamekubali.

    Marende was thrice clever just for the record and precedent - he has explicitly addressed the question of what happens when there's inconsistency between the constitution and NARA - and that is - NARA supersedes.

    People like Michuki and Kalonzo who are blind on NARA need to listen to that wise counsel- all Kalonzo and Michuki see is an imperial presidency which they die to preserve and the old constitution that Kenyans die to reform...these PNU sycophants never see NARA as part of the constitution.

    Then few other interesting observations.

    Karua has welcomed Marende's ruling and she will be sitting in the HBC. Yaani, she doesn't insist that Kalonzo must be the HBC Chair/LGB. Tells me she doesn't really regard Kalonzo worthy of leading her. Haya! remember the reformers vs anti-reformers debate?

    Did anyone read what PNU's Saitoti said? He actually welcomed Marende's ruling! unlike his PNU-mates Kalonzo and few others. Of course Saitoti also bubbled a few other words to the effect that whoever appoints the LGB still needs to be resolved. But at the moment - he's game with Marende, essentially telling Kalonzo to chill out and keep off the HBC Chair/LGB seat.

    Aint that some doggonit something!!!!!

    Someone tells me George Saitoti was seen yesterday at Lunch time with none other than PM Raila Odinga munching steak and ugali at Serena Hotel - this was reported in the papers too. haya!

    Did someone swallow a tinga tinga like KANU jogoo did?

    It is clear Kalonzo is being elbowed by Saitoti and Karua already even as Kibaki continues using him (Kalonzo) as toilet paper to wipe the big 'ol doggonit.

    Let Kalonzo keep making a fool of himself...wiping Kibaki's mess...the same script followed by wakina Nyachae, Kombo, Awori, Mukhisa and other Kibaki sycophants of yesterday.

    By the time they came back to voters, they were stinking nasty..and people were running away from them.

    If you choose to be Kibaki's snake oil salesman, beware Kenyans pay back on you fast and furious.

    I'm also reading today that ODM's Andrew Ligale has been appointed the new boss of the Boundaries Review Commission.

    Anyway back to the crucial issue left pending by Marende.

    He asked the two principals to consult.

    Here is the interesting thing.

    That consultation this time can NEVER EVER AGAIN be at a closed door room in Sagana between two individuals called Raila and Kibaki.

    This time it will be a broad daylight PNU-ODM consultation through the CMC (Coalition Management Committee)....each and everytime any consultation is required.

    Kibaki had better be ready to get busy working and consulting and not just sleeping and eating mutura and slaps at State House.

    We shall only deal with Kibaki this time formally - with a pole called CMC.

    No more informal agreements to be soon discarded by the perennial conman and thief. This belligerent half incapacitated man has held the country hostage for so long. Shenzi kabisa! Ashindwe kabisa!

    ODM has already learnt the hard way talking to Kibaki who then orders Muthaura and kalonzo to contradict the PM. Can the nation go through such nonsense anymore? They have said NO. ENOUGH!

    and the PM himself has said so - no more talk with Kibaki informally, only formal consultations through the CMC.

    And many things will soon be consulted about. Everything literally will be consulted. This is what Kibaki wanted when he trashed goodwill, let the formal consultations now take root.

    I hope Muthaura and Mutua are reading these developments keenly.

    It is not business as usual tena.

    this is the man who wanted to please his own boss raila but at the same time not make an unconstitutional ruling. so since the constitution barred him from naming the 'self appointed' raila as the boss....he had to look for a middle ground. imagine taking 1 hour to explain why you are bending the law??? that was tiring. Marende acknowledged that Kibaki is the boss, hence his letter was law...but..eh eh eh eh..NARA etc...bla bla bla..yada yada yada...i will be the interim.

    then of course raila is jovial like he won an election whereas marende just saved his face. soon kalonzo will be the chair and raile and ODM will do nothing.

    Honestly, its time the PM were accorded his rightful share of power so that he stops complaining. Complaining is a dreadful thing, and nobody likes to do it if they can help it. I doubt the bumpkin enjoys the screaming and shouting. I am in support of him being leader of government business. I am fed up with PNU zero-sum power games, and Kenyans need to move on.

    I now believe most kikuyu's can see through Kibaki's bullshiate,, he and his cronies fight to stay in power to protect their stolen wealth while many Kikuyu's all over central are struggling to survive and many still IDP's..

  11. Taabu, am as non-partisan as can be but i dont think pnu will see this ruling as favouring neither side. I followed the weekend rallies, the press conferences and the proceedings in parliament and my sixth sense is telling me that the ruling was approved by the odm high command before it was read.

    That aside, this is a power struggle between raila and kibaki. Raila has won this round big time. The president's authority to make appointments has been successfully challenged and kalonzo has been stopped from being lgb and chair of hbc. So raila got every thing he wanted. i dont think he wanted to hold the positions in question himself.

    As much as kenyans and jounalists praise the ruling because they want peace, we have to remember that history teaches us that in any power stuggle one of the protagonists has to be defeated. so of course the war will continue until one of the "principals" is brought to his knees.

  12. Let us not LIE to ourselves people; Kenneth Marende has no business appointing himself to a post that he is, constitutionally speaking, powerless to even advise on. He is not any different from raila odinga purporting to 'appoint' himself to government leadership INSIDE or OUTSIDE of Parliament. Look here people, we have to stop this delusion. It doesn't take us anywhere. you cannot possibly constitutonalise your fantasies WITHOUT ammending the constitution.

    This is the truth and you can brandish whatever weapons you have; Raila odinga will NEVER, in this world or the next, lead any government whether inside or outside of parliament. Marende has to stop this little gentleman mien he is trying to posture (he has no choice anyway) and tell him the truth; "Sir, I am sorry but you are better off fighting for the chirmanship of the sub-village cattle dip in bondo than dreaming to lead anyone in the national level. you simply never have and never will!

  13. Anon 10.03: You captured the essence. Honestly, I am partisan and support Raila Odinga in his pursuits. But I am not blind to the political activities in the rounds. Obviously Marende consulted with ODM and his script was approved by its senior brigade. Now that is a smart political move for Tinga.
    Now for the regular pharisees and PNU sycophants, smile or cry but you old thief Kibaki can only understand one language: "being cornered." I'd rather Kenya is ungovernable than co-govern with Kibaki. I'd rather a constitutional crisis of some sorts than a false Kibaki peace just because he is allowed to eat with his boys. I therefore sincerely thank Hon. Olago Aluoch for raising the point of order that has set this new precedent. I pray that more of his likes wake up and push every ODM agenda to its logical conclusion. I am tired of the greedy hyenas in the Kibaki kitchen and the sooner they are classified the better.
    Now, the PNU foot soldiers start the tirades. I know you will throw a few insults here and there but that is ok, I don't eat in your houses, so just go ahead.

Vikii, I said to myself this year that when deserved I would respect and praise differing opinions that had merit, but your latest comments confirm my initial thoughts about you, we all have politicians we support and like for different reasons, and I respect you supporting one kaloozer, pardon me kolonzo musyoka but honestly, marende made the best ruling possible PNU is not in government alone and your friend the kibaki wiper should have just ran on a PNU ticket because ODM-K is a joke, and more so kibaki ass wiper's stature as a man is truly reflected in his physical stature, that being that he is a little man, that has never been able to stand on his own. So in all honestly this peasant from mwingi with his few mps has no business holding either position. Furthermore he has done nothing to fight for democracy in Kenya, unless he was following Raila. This guy even voted against multi-party politics, arguing that he thought that was the party line. So he is no re-former, he is one of the greatest opportunists in Kenyan politics and it is no wonder he now finds himself in the company of the likes of Uhuru and Kibaki the two most recent MPs to lose a national election, at least those two were runners-up, Kibaki wiper was just a loser. I wondering when he will start talking about being saved and all the other bs he talked about during his PNU funded sham of a campaign.     This is not a constitutional matter but a political problem. Did the constitution stop post election violence? If you answer this question then you answer all other problems facing our country. Why are we so forgetful? Have you forgotten how hard it was to drive to an ATM? Only to get there and kosa cash? or find cash and kosa food? how airtime was hard to find & was sold twice the price? How we couldnt get to work? How sad we were boxed in our houses? How our hearts filled with sadness and eyes with tears whenever we opened the telly? How people lost their lives and women got raped as we wached? How it became hard to talk to close friends because they belonged to a different tribe? How desparate we became for a solution? How happy we were when the two goons agreed & shook hands? How happily we filled pubs to celebrate new year?

  19. Marende's ruling was the best of the worst decision he would have made. He was just neutral but quick to emphasis he would be an interim chairman for a short period until the "coalition government" agrees to appoint someone else.

    So what if Raila and Kibaki still can't agree? That's where we should be looking at! Constitutionally, Kibaki still has the upperhand. Consultation is necessary in a coalition government (as a sign of good faith) but since the mood is already too poisoned, Kibaki can still use his executive powers and appoint Kalonzo later on.

    Marende won't be the chairman forever. Kibaki will just wait for political temparatures to die down, then do what he knows best, imposing his sycophants on you!

    The current constitution still stands in many ways. That's why a new constitution is urgently wanted. But if these scumbags can't even agree on a Chairman of HBC, how on earth will they agree on anything regarding a new constitution? Lord have mercy on poor Kenyans.

    On paper, Kibaki and Raila are “equal” partners. But in reality, Kibaki calls the shots. If they are “equal” partners, why did Raila swear an oath to Kibaki and accept a letter of appointment written and signed by Kibaki? Why didn’t Kibaki swear to Raila? Kibaki’s letter says: “I have no doubt that you will do your best to discharge your duties diligently and wholeheartedly for the benefit of the people of Kenya.” Why not other way round where Kibaki’s letter being drafted and signed by Raila or both having their letters signed by a neutral authority?

    Apart from RECOMMENDING ODM ministers to cabinet, how comes all ministers swore to Kibaki as President and no mention of Raila or his PM post? How comes all ministers received letters of appointment signed by Kibaki and not Raila and no mention of PM in their letters? Raila’s role is JUST WATCHING as ministers swear to the dinosaur that is Kibaki. If they are “equal” partners, how comes Raila is only one who RECOMMENDS to Kibaki and not other way round? Why is it only one partner (Kibaki) who can call, chair or dissolve the cabinet?

    In his protocol tussle with the VP, how comes Raila waits alongside Kalonzo and other dignitaries for Kibaki to arrive at every public functions? Why not other way round Kibaki waiting for Raila to arrive in other functions or arriving same time?

    Who between Kibaki and Raila holds key to real power? Can Raila dissolve Cabinet or even sack a minister? What if Raila RECOMMENDS sacking of his own ODM minister and Kibaki rejects it? What if Kibaki fires an ODM minister and use state machinery under his firm control to enforce his move? What can Raila do? Can Raila sack an ODM (leave alone PNU) minister. He can only recommend in respect to ODM only! Can Raila appoint a Chief Justice and judges?

    Can Raila sign any law passed by Parliament? Wasn’t he humiliated by Kibaki the other day when he received a memorandum from media owners protesting about a new law that had been passed in Parliament? Raila was gleaning on TVs assuring them the “Government” would look into their grievances and that he would present their memo to Kibaki for consideration. In an open show of contempt, Kibaki signed the law three days later! It had not dawned on Raila that the law on signing of laws passed by parliament was not amended and the president did not need to consult the PM.

    If Kibaki and Raila are “equal” partners, how comes Kibaki’s salary is clearly set out in the constitution and Raila cannot use his own executive powers to determine his own salary and all he can do is whine in secret leaks to the media and in public that he wants a salary at par with his “equal” partner? How comes we have not heard Kibaki demanding to be paid the PM’s “higher” salary?

    How comes it is only one partner who has the key of the vehicle (Kenya as a country and overall executive powers) and the other “equal” partner cannot drive it and the only thing he can keep doing is to keep RECOMMENDING to the other, “please drive we go”? Kibaki’s letter says: “Neither are you at liberty to announce major policy decisions without having to put the matter in question before the Cabinet.” But Kibaki can make all manner of roadside declarations, like Moi perfected, including making a village a province, if he likes, without consulting PM, Cabinet or PM. Maybe, he can consult Lucy Kibaki to make Othaya Kenya’s ninth province.

    How comes Raila depends on Kibaki to provide him with security and not vice versa? We all see it. Whenever Kibaki is in same function with Raila, Kibaki’s guards are fully in charge and Raila is reduced to level of other dignitaries. Why do the bodyguards of Raila coil their tails and fight for space with the crowd?

    If Kibaki drops dead today, what does the constitution say? Does it even mention the PM in any role after death of President? It says the current VP takes over. Raila’s and Kalonzo’s public gimmicks to be next to Kibaki are a result of bloated ego and signs of inferiority complex. It’s only Raila (not his “equal” partner Kibaki) who struggles to be next to Kibaki. Why that if both “equal”? Shouldn’t we be seeing a drama of Kalonzo jostling with Kibaki to be next to Raila and to invite Raila to speak last?

    If Kibaki dies today, Kalonzo would automatically take charge as a caretaker president for three months before fresh polls are held. Kibaki’s death would bring an automatic death to the Accord he signed with Raila. Hence, Raila needs Kibaki alive to keep his job! But VP who would be in office then would be the sole beneficiary of Kibaki’s death as he would assume power and there would be no deal with a PM. Raila would then find himself jobless and he would most likely stay in the cold for three months trying to endear himself to his disillusioned supporters (if at all he still has their grip today) before a General Election is called by the interim president.

    Bearing in mind Kibaki would not be a candidate, the political landscape we saw in 2007 (which favoured Raila and I believe he deserved it) would shift and Raila would have an uphill task marshalling the frenzied support he got in 2007. In fact, a big majority who voted for Raila were doing so in protest against Kibaki but not their love for Raila. Raila was the only strong DUME capable of flooring Kibaki and that is why we saw all sorts of characters of divergent political (criminals included) and ethnic backgrounds gang up in ODM to defeat Kibaki and his PNU.

    On the other way round, a big majority who voted for Kibaki did not do so because they loved him. They did so due to the Raila Odinga presidency fear phobia that Moi put in Kenyan minds. Raila is regarded by some Kenyans, GEMA in particular, as a big threat to their survival. We saw all sorts of thieves and tribal political chiefs gang up behind Kibaki to secure the unfinished culture of eating and guarantee their seats in Parliament (and possible plum cabinet posts).

    Kibaki out of the way, even in 2012, Raila will have the biggest test of his political career. Unless Kibaki openly backs him in 2012. Can Kibaki for once shelve his selfishness? I doubt.

    But if Raila dies today, Kibaki would hold a state funeral for him and shed crocodile tears of how he had lost a brother! Afterwards, he would appoint a new PM from Raila’s ODM and he remains in office till his term ends in 2012. None of the other ODM heavyweight as Raila’s political muscle and Kibaki would have even an easier ride. If mighty Raila failed to shake Kibaki (apart from “sharing power to save Kenya”, the Mudavadis, Rutos, Henry Kosgeys, Balalas of this world would dance to Kibaki’s tune while wiping Kibaki’s shoes with their tongues.

    The “executive powers” Raila “shared” with Kibaki are just an illusion and Raila was so hungry for power to see the con trap Kibaki had placed on him. In fact, the PM should thank his stars Kibaki wants to have title of president and cares little about running Kenya. If Kibaki and Moi were to swap places in the current arrangement, Raila would find himself dancing to a different tune. Moi would frustrate him and make his work a nightmare. This thing works because Kibaki wants it to work. Raila is Kibaki’s hostage.

    It is, therefore, too late and pointless for Raila and his aides to keep whining over spilt milk. Raila has two choices – move out of Govt to force it collapse and or stay inside, shut up and fly in the same smelly oil with his “equal” partner.

  21. Apart from the war with kibaki, of course odm is also fighting a war with kalonzo. I think as much as odmers like to show contempt for kalonzo, they fear him. at the kibera rally one of the speakers told him he is being used and he will not be the pnu presidential candidate. in letters to the editor and posts in other blogs you see people basically telling him to leave the political scene. odm does not want to risk some of the votes from its "strongholds" going elsewhere. this risk is certainly there if kalonzo is the pnu cnandidate. To be certain of victory odm has to ensure pnu's candidate is either uhuru or saitoti, with karua running around somewhere. so there is definitely a "get rid of kalonzo" aspect in the raila-kibaki war.

    Marende is probably partisan but made the the best ruling under the circumstances. He puts it clearly that the appointment of LGB is the duty of the executive arm of the government.

    He also clearly put it that the head of state and the government and CIC is the president.
    My simple understanding is that we have a coalition the president remains the head, on the other hand NARA talks of real power sharing. The big question is how and to what extent is the power to be shared equally if the president is the wielder executive powers.

    He said received two letters of appointment from the same government. The first one from the head of gov' appointing Kalonzo to LGB, which he initially accepted and Kalonzo started the job on the day the parliament was opened. The second from PM(self-appointment. However, he did not receive any revoking the first appointment for the second one to be effective.

    I think as non partisan speaker he would have stated he needed a revocation for the first appointment before accepting or even considering the second.

    I myself (forgive my Kenyan english) do not expect miracles as a result of the ruling. It would be delusional for me to do that.

    I am very aware that the war between the Reformers who want real change (Raila, Ngilu and co.) and the usual defenders of the pumbavu status quo (Mwai "pumbavu" Kibaki, Kalonzo "Msaliti" Musyoka, Uhuru "millions of acres of grabbed land" Kenyatta, George "Goldenberg" Saitoti, Daniel "Kleptocrat" arap Moi and co.) is still on, it has not abated.

    What matters to me is that for the first time in a long time a decision has been made by someone important in Kenya that is "moving in the right direction." This is very refreshing considering the fact that Mwai "pumbavu" Kibaki has been consistently and stubbornly "spoiling the Kenyan air" with his indecision, poor leadership, contempt and malice... generally he has been sleeping on the job and that is why our lovely country is in a continuous state of one crisis after another. You mark my words, Mwai "pumbavu" Kibaki will soon precipitate another crisis very soon. Pumbavu yeye!!

This should tell PNU that the time for unilateral decisions is long gone. I regret we had to wait to get this far when mere consultations would have sorted out the matter a very, very long time ago.

  34. Momentarily, it is a big win for ODM. There are several optional scenerios for Kibaki:

    He may agree to consult the PM on the new appointment for LBG. This could mean he has lost battle to ODM and his constitutional powers undermined

    Second PNU could go to court for interpretation of NARA and the constitution. This is a long route and they may get a ruling in 2012

    The third at disposal his to pull out the NARA and forming a new government as he did after referendum.

    This could be his best option but has great risks as no one can predict what is going to happen. Riots could erupt again, but could be a better option to having a dysfunctional coalition. He could appoint moderate ODM MPs to the cabinet.

    Thats not an option for Kibaki. Kibaki is president, not because he won the elections as required by the Kenyan Constitution, but, courtesy of the National Accord.

    The above conclusion is obvious because, the Krieger Commission, came back with a verdict that, it was impossible to determine the 2007 presidential elections.

    The implication is that, the declaration of Kibaki as the winer was fraudulent. That report which was the final arbiter of the 2007 elections, was accepted by Kibaki, Raila, and eventually adopted by the Parliament.

    If the Accord is declared dead,then, he has no legal basis, nor political legitimacy to govern the country. Simply, Raila would also claim to be the president, and we will be back to the 2007 - 08 chaos.

    I agree with you that Kibaki may not have the 'political legitimacy' to govern alone but we have had a minority government before. On legal standpoint he was declared the winner and it was never challenged in court

    Yes, it is true he was sworn before the Accord. However, it is equally true that, after the investigation by Krieger Commission, it was not possible to show that he had won.

    Kibaki, did accept the Krieger report. That means, he accepted he did not win the elections, and the consequence is that, he was not validly elected.

    Yes, it is true that, his election was not challenged in the Courts. However, it is true that, they accepted to have Kriege Commission as the FINAL ARBITER of the Presidential elections of the 2007. Thus, the idea of challenging in the Court is moot.

    For argument sake, the fact that he said he did not know who won does not mean Kibaki lost. It was ECK's responsibility to announce the winner

    Our response:

    As concerns the objective of Krieger Commission, you need to read the founding document. It seems to us that, you are yet to read it.

    As concerns the second issue, he said, given the way the elections were conducted and organised, not just at KICC, it was IMPOSSIBLE to determine the winner.

    So, to the extent that, Krieger could not determine the winner, how did the ECK determine the winner? If they ( ECK) had determined the winner correctly, they would have furnished Krieger with those facts. We also know that, Kivuitu did say, he was not sure whether Kibaki had won. What other evidence do you want?
