Drowning Ruto Opts for the Samson Option

Update: Empty political showboating
Ruto's spin doctors have defrauded him big time and he must demand a full refund. The political showboating that was cleverly crafted to deflect public attention has succeeded in doing the exact opposite. First Ruto did not meet ICC chief prosecutor Luis Moreno-Ocampo who was in London when Ruto visited The Hague and his evasive and contemptuous answer to the press (Taxi operator reference) was proof enough.

The Eldoret North MP would have saved his money by meeting the ICC team already in Kenya. The propaganda coup has backfired and Ruto has lent more credence to his impeding indictment after unwittingly showing his hand out of naivety and self-guilt.He derided ICC to be toothless until 2090 and his outburst on Waki Commission's report and KNHRC is the sturdy rope his neck desperately needed.
There is nothing more powerful than the voices of the dead crying to the almighty from the ground. Remember the Cane and Abel saga in the good book? The truth of the matter in Kenya is that there are tons of Kenyans crying for justice. The post election troubles of 2008 claimed close to 5000 souls (Kumekucha figures) although official figures claim slightly above 600. The vast majority of these souls were innocent. And that is not counting all the innocent Kenyans before that who were sent to an early grave courtesy of one Jomo Kenyatta and Daniel arap Moi. Or the ones who were denied being brought up by a father.

God also says in his good book that vengeance is his. Not that the down-trodden of Kenya would have any means of exacting their own revenge.
This is the only way I can begin to understand what seems to be unfolding before our very eyes on the Kenyan political scene. It is all too shocking to fanthom. And yet it is happening.

Firstly the political class in broad daylight enthusiastically passed a constitution that would put them in serious trouble (as is already beginning to happen). It is important to note that those in our political class are many things BUT they are NOT fools. Indeed some of the most intelligent, smart and best educated Kenyans are in politics today. It still beats me how nobody in this bunch of smarts saw that passing the new constitution would come back to haunt them big time. I honestly couldn’t believe my eyes when the likes of George Saitoti so enthusiastically drummed up support for the new katiba. Just watch what happens next to the good old professor. HINT:- plenty of skeletons will emerge from the man’s closet.

Now even before we can analyze all the drama unfolding in Kenya at the moment with big shots falling like dominoes as their colleagues shake uncontrollably in their boots wondering where the axe is going to fall next, a totally unexpected twist has been thrown into the mix. Eldoret North legislator who was right inside the engine room of trouble when the post election violence of early 2008 broke, has chosen to bare all to the ICC. Effectively Ruto (with the help of his lawyers) spent the marathon sessions recently with the chief prosecutor Luiz Moreno Ocampo delivering damning evidence against the two principals. In effect Ruto’s defense is that he was only reluctantly following instructions from his superiors who are guiltier than he is.

If you are sitting there thinking that the two principals will sit and let events take their own course then you have another think coming. One of the very valuable pieces of evidence in the possession of one of the principals are recordings of cell phone conversations Ruto made with others on the ground during the violence. These kind of recordings are not admissible in a court of law in Kenya, however the ICC is something else and these are the kind of recordings that Ocampo would love to get his hands on.

Then there are the court cases now rapidly catching up with Ruto. Indeed the way things are going Ruto could be behind bars long before we hear from the ICC. Which would imply that Ruto knowing that he was going down opted not to go down alone but bring down everybody else with him, especially the high and mighty (namely the two principals who seem to have given instructions that his court cases now proceed with speed).

Fascinating stuff guys. Terribly fascinating stuff.

    I think ruto's strategy, if you can call it that, is twofold. 1. Create some doubt in some of the evidence that ICC has therefore forcing ICC to extend the scope of the investigations. This effectively means delaying the indictments and therefore more time for him. 2. The issue of dragging Raila and Kibaki is effectively to make sure he is not the only one having cold sweat at night. This will force the two principals to come up with some government position that puts brakes on the whole thing.

    He may not succeed, but i give him kudos for his cunning ways. No wonder he was able to curve his way from the jobless corner at Hilton all the way to Moi's statehouse complete with a proposal on how Kanu was going to win. Moi bought the proposal and gave him the keys to the government coffers.....

What am sure is that Ocampo and the people of Kenya may not prosecute these people today - but surely one day soon, all those culpable will carry their own close and will be punished. Most i suspect will commit suicide before before the Dday.They are already living a very miserable life - they are really very tormented.

    In our view, this matter falls under covertly obtained evidence and is admissible in our courts.

    From the case law in England, we come to the view that, such evidence is admissible.

    To the extent this seems to be the case in England where we get many of our precedents, we hold the opinion that, intercepted mobile conversations are admissible in the Kenyan courts.

    As once judge asked:

    "The situation [IS] in essence the same as it would have been if the conversations had been heard by a policeman, say, hiding in the boot or standing on the pavement."

    Aha Euphemism for self praise. "The gate keeper" who frequently exploits and highlights the shortcomings of others. When NOT sure "I" becomes "ours".

    You are misleading us - Perhaps you are taking cue from - The general rule of every "higher" ( read British)court binds lower courts ( read Kenyan).

    Please note that decisions of English courts as per case law are NOT strictly binding, the maxim of "stare decisis" does NOT apply in our courts in relation to communication act.

    Remember case law or common law is "Judge-made" law and not formally enacted by our parliament as relates to the communications act.

    As per our constitutiom statute law takes supremacy over case law.

    Firstly, we have not seen the financing details of this project. Thus, we cannot say much about its merits or demerits.

    Importantly, however, when you proudly talk of our "foreign currency reserves," you make a terrible mistake.

    Foreign currency accumulations today is an unmitigated disaster.

    To accumulate a large foreign exchange requires a persistent surplus of goods being exported to the country issuing the reserve currency.

    This results in a LOWER standard of living for the citizens of the country producing the goods for export, as they do not enjoy the fruits of their labour.

    This would not necessarily be such a problem if the money received for these goods represented REAL WEALTH which could be used to purchase different goods at a later date.

    However, in today's world of fiat currencies, where paper money can be printed without limit, it seems we have two awful choices here:

    (a) we exchange our sweat, blood and tears with USA USELESS PAPER, which they depreciate, i.e. TAX US at will when they print endless dollars or

    (b) we allow Kiraitu to steal from us.

    Seen from this perspective, it would seem "better" if our local thieves got it and not the Americans who are masters of ex nihilo creation of money.

    We take thee, if you are interested in truth to the USA economic policies of 1940's:

    (a) Under the Emergence Plant Facilities Contract, the USA government guaranteed plant expansion expenditure and purchases from abroad.

    (b) Under the Defence Plant Corporation which was a branch of the Reconstruction Finance Corporation, they BUILT new plants and then LEASED them to PRIVATE companies who later bought them.

    At this time, USA under FDR, had de facto NATIONALISED the FED which forced it to act in the interest of the USA and not increasing the wealth of the few.

    (c) Under the Defence Production Act of 1950, the USA FED was required to generate CREDIT for defence industry under the "V - loan program."

    Under this programme, the FED was required to assist competent contractors who lacked SUFFICIENT WORKING CAPITAL to undertake defence contracts for the production of ESSENTIAL GOODS and MATERIALS.

    NB: These policies are now prohibited by "independent" central banks and hence, our assertion that, they are nothing, but, financial oligarchy bent on grinding humanity's face on sand.

    On a serious note, it being stated that Omar Bashir will be a free man and the sanctions against Sudan will be lifted with immediate effect if he - and his government from the north - accepts the outcome of the referendum on Southern Sudan.

    I wonder what will become of the Darfurians living on the other side of Sudan? Will they ever have the chance to hold a referendum any time soon?

  29. Is Ruto the scapegoat being led to slaughter on the ICC altar? Is he the patsy who will go down for PEV excesses in the former RVP? It's plausible. He's now accusing KNCHR's Omar Hassan of coaching & paying witnesses against him. Could this all be a case of old money conspiring to destroy the new kid on the block who dared to dream big & partake in their power games? Ofcourse he can easily go down for the economic crimes that he is to account for but the sudden surge of court cases against him smacks of a well orchestrated set up.

    It's unfortunate that you don't know the politics being played at the moment. You need to go back to your reliable sources and make more enquiries.

    Most of our Ministers have been involved in corruption. The time you'll see Mudavadi and/or Ngilu stepping down is the time you can make a conclusion.

    Wetangula does not have support apart from support of some few Bukusu MPs who are also not interested in running for presidency. Wetangula cannot bring votes to those in charge.
    Once upon a time I said the constitution has shifted powers from the President to the Mps, and not the people. You never know what was discussed in Naivasha during ODM retreat but I won't be surprised that ODM MPs were told to support Mudavadi and Ngilu in this corruption fight, that's the reason expect to see both of them in cabinet till 2012.

    On Ruto
    Ruto made a mistake of insisting he'll run for Presidency, and I think this can also be because Kalenjins are not ready to support anyone else apart from him such that they'll easily go for another option if Ruto decides to back up anyone else. Issues of land and Kibaki replacing Kalenjins with Kikuyus in government have never been resolved. In other words Ruto at the moment is not of any help to the people in charge and the rumours that he wants to go down to the pit with the two principles will even make matters worse for him, they'll fight him, and probably expect the issue of his hotel next to Wilson Airport being brought to court to intimidate him further.

    In conclusion I'll tell you to know two things:

    1) The constitution shifted powers to MPs (and not to the people of Kenya) from the President, so that even though Ruto did wrong there is also a bit of politics being played and that's why you'll never see Kimunya, Mudavadi, Kiraitu e.t.c being fought in parliament,

    2) ICC is not independent, those in charge will only need to promise and give some tenders to some multinational companies and you won't see the likes of Michuki and Saitoti e.t.c going to Hague. If it was independent then you could have seen the likes of Museveni and Kagame going to Hague.

    If you understand these two then you'll know how to give clear arguement without making a quick and excited conclusions.

  31. In the same way whoever says Kibaki and Raila will go to Hague with Ruto should think deeply. There are many factors that can ensure they don't go that way. You can apply the same arguement on why Ruto should go to Hague on Kagame, George Bush and Museveni, but why aren't they in Hague.

    Yes, Ruto can go to Hague, but they are many factors that can ensure he doesn't go. That's why nobody should start celebrating soon.

  32. Phil, your MP's showing their true colours. Check the Nation online. Our next election will not take place on the second tuesday in august 2012 as per the new constitution. The earliest it will happen is december 2012. Some are even advocating for march 2013! From an imperial presidency to a dictatorial 10th parliament. They must be stopped.

    When He declared his presidential bid no Mps backed it up, Infact it didnt even make it to the Headlines. I wonder why Kiraitu - he of the Mbus Ndriver fame didnt shout out loud and declare himself as passenger number one.

    I am no Ruto fun, but the man surely has guts, and I wouldn't be shocked if he takes over the pillar of Kenya's politics from Rao.
