Very Trying Moments for ODM, DPM Mudavadi

Corruption Ghost Stalks ODM ministers.

The Deputy PM and ODM’s Minister for Local Government Wycliffe Musalia Mudavadi was the whistleblower of the Nairobi City Commission cemetery scandal. He purposefully wrote to the Head of Civil Service Francis Muthaura to take action on some officers in his ministry implicated in the scam which he claims was engineered without his knowledge. Mudavadi has also been grilled by the Parliamentary Committee of Local Government, which interestingly made a recommendation that he be investigated for not bothering to visit the cemetery site!

Prime Minister Raila Odinga was last night reported to have asked both Mudavadi and Mayor Geofrey Majiwa to take political responsibility of the scam and step aside to allow KACC to undertake forensic investigations. Rumours have been flying around Nairobi this morning that Mudavadi will be handing over his request to temporarily step aside at any time if only to show his party ODM means business in tackling high level graft.

Many will recall that although President Kibaki suspended key officials of the Office of the Prime Minister over the maize scandal, the suspension came hours after the PM had already received resignation letters from Mohammed Isahakhia and Caroli Omondi. Therefore it will not be entirely a surprise if Mudavadi and Majiwa also hand in their resignation going by the commendable trend already shown by ODM.

While addressing the an International Monetary Fund forum on Africa’s Economic Transformation Prime Minister Raila Odinga maintained that politicians and leaders implicated in corruption must be held to account for the government’s war against graft to succeed. Raila told the forum that corruption had been the biggest impediment to development and that the war against corruption must be personalised by identifying individuals concerned and making them carry their own cross. Wise words indeed. But will ODM walk the talk?

Only yesterday, and more than a month after Mudavadi’s pleas for action to be taken on MoLG officials, the President reluctantly interdicted several government officials. President Kibaki who has been under intense pressure from his coalition partner and donors to crack down on high level corruption went to say that the Kshs. 259 million that was overpaid for purchase of the cemetery land must be recovered from the beneficiaries and “collaborators including lawyers and agents, should be prosecuted for the serious fraud which they have committed against the Kenyan public”. Music to my ears, I must admit.

However, keen observers will have not failed to notice that this is action of interdicting government officials was taken the same day the President was meeting the IMF Managing Director Dominique Strauss-Kahn. Interestingly, the directive by the president to demand that the stolen money be refunded is a historic and a first for Kibaki’s eight year old presidency. The Kenyan public are wondering if the thieves of Anglo-Leasing, Triton, Maize, FPE, Kroll and even Goldenberg will also be charged and asked to refund the hundreds of billions of public money stolen to line the pockets of a few individuals. At long last the public will appreciate the positive side of ever forming the grand coalition.

If Mudavadi and Majiwa do indeed step aside, the pressure will only be increased on Kibaki and his corruption laden PNU side. If they do not step aside, ODM will be seen to have lost credibility in the eyes of the public. The ODM Party Leader will also be placed in an awkward situation.

We shall then have to wait and see if the KACC will indeed find Mudavadi and Majiwa culpable and charge them in an anti-corruption court. Not much hope in that direction though.

  1. Yes, it is the land question again. In the DN, it is written:

    "The officials have been interdicted in connection with the fraudulent purchase of 120 acres for a cemetery in Mavoko Township at a cost of Sh283 million when the true value of the plot was Sh30 million."

    Once again, we insist that, this way of "fighting corruption" is a waste of time and mockery to the poor.

    We say this because, we have completely failed to define our troubles in terms of historical change and INSTITUTIONAL CONTRADICTIONS. As thus, we fail to grasp the interplay of man and society.

    Having said this, a proper appreciation of our troubles must be understood by asking 3 basic questions:

    (a) What is the structure of our society as a whole?

    (b) Where does our society stand in human history?

    (c) What varieties of men and women prevail in this period. More so, how are they selected, formed etc.

    In the article posted here: "The First Principles in Drafting a Constitution," we wrote this:

    "By appropriating our soil, they effectively reduced Africans into slaves because whoever appropriates the soil, must as the night follows the day, pocket the surplus produced by those who must labour in agriculture and manufacturing in accordance with law of rent. In other words, to appropriate land means to claim everything that must be made using its help. In simple words, those who sweat can only pocket only a small piece of the bread that is just necessary to ensure bare survival. The bigger part of the bread they bake with their blood and sweat is thereby, pocketed by those who appropriated land, but, who do not sweat. Hereby, we now see that, this LEGAL/ARTIFICIAL RIGHT TO PROPERTY which grows not from natural causes, but, by the law of fraud or what men in wigs call the law of the land is founded on the negation of the first principle of a just and peaceful society, i.e. the NATURAL RIGHT TO PROPERTY."

    In essence, the sale of this plot of land is the exact example of ARTIFICIAL RIGHT TO PROPERTY. And, we can see clearly that, it is a negation of the NATURAL RIGHT TO PROPERTY.

    Therefore, the way to address this matter is very simple. Abolish artificial right to property which is based on fraud. There IS NO OTHER WAY.

    KACC is busy obtaining coart injuctions against Oburu while he continues to serve at the Finance Ministry. Over to you Phil, am sure Oburu would not want to embarass his brother or would he???

    The High Court has issued an order stopping an MP from transferring some property in Kisumu he is alleged to have acquired illegally.

    The temporary orders restraining Bondo MP Oburu Oginga were issued by the Kisumu High Court judge, Lady Justice Abida Ali Aroni, following an application by the Kenya Anti-Corruption Commission (KACC).

    KACC sued Dr Oginga, together with Baringo Central MP Sammy Mwaita.

    Seeking the orders against Dr Oginga, KACC said investigations had revealed that he fraudulently obtained the registration of the suit property, which belongs to Kenya Railways Corporation.

    The land was surveyed in 1935 and set aside as part of the railway reserve and duly registered. Subsequently, the property was vested in the defunct East African Railways Corporation.

    However, in 2001, Dr Oginga is said to have wrongfully procured a lease over the suit property from Mr Mwaita. The lease was registered at the district land registry in Kisumu on February 12, 2001.

So the good old prezzo finally wakes up one day after over 2,000 days in power and shows the door to some small fish in city hall, he surely does deserve an Oscar. Why can't he do the same when it comes to Ongeri and Ruto...ama they represent millions of votes from their tribes?

    Raila maybe outspoken when it comes to fighting corruption but he must also ask Mudavadi and Majiwa to shove off and show some sense of responsibility. But the PM should not expect Kenyans to pat him on the back for that because that's precisely why we pay him millions in salary and give him a long motorcade.

    I was driving along Limuru Road the other day and past Runda there's a small town which is developing very fast with lots of posh flats coming up daily. It's called Ruaka and the northern bypass will be ending there. Aga Khan university will also be set up there later on. I understand a plot, 50x100, which used to cost 500k five years ago is now going for 5M, take it or leave.

    And guess who recently bought a huge tract of land there and is erecting dozens of posh apartments (Kileleshwa style) worth hundreds of millions? Well, step forward Bwana Gakuo who is also deeply implicated in this cemetery scandal. Maybe KACC should step in and investigate.

    You just couldn't make it up! These crooks in city hall have seen top guns getting away with huge economic crimes whose cases drag on for decades until files vanish in thin air from our pathetic courts which only convicts chicken thieves. I can't really blame them thugs for thieving coz that's what everyone else seem to be doing these days!

    ....Come on really, this is Kenya! What are the chances of getting convicted and ending up in Kamiti when you can buy your way out or get cleared by a sham commission and sneaked back in power when everyone has forgotten?

    This is the HEART of our problems which we have insisted should have been the main issue in constitution drafting.

    Where did this value of over 4 million KES that a few idlers are pocketing come from?

    (a) population increase and,

    (b) efficiency of our economy, i.e. infrastructure paid by ALL.

    Or, did the "owners" of these plots spend any labour or capital so as to increase their value? NO.

    Thus, we have taxed Wanjiku to increase the value of land to be pocketed by a few. Talk of modern slavery.

    And, instead of our religious leaders being the voice of voiceless as the Bible/Qoran requires of them, we just hear them talking a lot of rubbish in press conferences.

    In words of Jesus, Woe to you, teachers of the law and Pharisees, you hypocrites! You are like whitewashed tombs, which look beautiful on the outside but on the inside are full of dead men's bones and everything unclean.

    This is UNEARNED INCOME and is what should EXCLUSIVELY be taken to fund the common activities, e.g. the police, roads etc and not EARNED INCOMES of Wanjiku who walks from Korogocho to work while starving.

    We shall quote from the same article as above what all this means to Kenyans:

  7. I am definitely not a fan of Raila Odinga, but if he takes action on Mudavadi i will give him his props, populism or not. Then pressure definitely has to be put on Kibaki.

    Whatever you think of Raila...he may have upped the ante on corruption fight. But KACC also needs to be strengthened to prosecute Raila should push on that too.

    who knows Raila just MAY redeem himself if he fights the good fight.

    Yes, you are right. Without reaching the masses, it is all in vain. More so, things are challenging because we live in an age when the media, schools, religion, politicians tells that:

    - that peace is to be found in war,

    - that freedom is to be found in slavery,

    - that wealth is to be found in indebtedness, and,

    - that truth is to be found in lies.

    All this is pulling us away from our fragile inheritance of reason, rationality, and enlightened discourse on the REAL menaces we face.

    In the fullness of time, these truths will be self evident even to the babies.

    It is very hard to believe that what went on during the 1980s is still going around in 2010. The older Mudavadi like many politicians of his ilk, appropriated for themselves a lot of plots in Nairobi and large parcels of land and parks around the country.

    Weak Leaf Muzalia Mudavadi inheritated some of what was left behind* by his father in Westlands, Kabete, Muthaiga, Parklands, Kileleshwa, Lang'ata, Karen, Ng'ong, Sukari, Mugoya and Runda, not to mention the south coast and north coast of Mombasa and Malindi.

    The real question is how far back should the collaborators including lawyers and agents (greedy insiders, hyenas, vultures, rats, spiders, reptilian bankers) be prosecuted for the serious fraud which they have committed against the people of the Kenyan republic?

    Why should efforts be wasted on cleaning out the current stench of corruption while looking the other way (turning a blind eye) when it comes to dealing with the old stench from the recent past and its overwhelming side effects?

    Why not clean whole the stench and clear the whole historical culture that still breeds it?

    The band-aid effect will never work.

    *No human ever brings forward their earthly belongings when the expiry date is due or when their mortgaged souls are repossessed for interplanetary relocation.

  13. What's Mudavadi been good at in Kenyan politics?

    May someone correct me if I am wrong. He's only been good at playing second or third fiddle, like many of his people from Maragoli, Kakamega, Busia and some parts of Bungoma.

    They never lead a charge but love to cruise behind on other people's social pathways and political waves. They have never stood ground in any wars of old nor in battles of today.

    Mudavadi must face the music and taste the same fate as Kimunya's when and if culpable traces of his Mululu wa Kalulu hands are found to have played any role in the land for cemetery saga.

    The Kenya Parliament has passed a motion of no confidence on Amos Kimunya for the corrupt sale of the Grand Regency Hotel.

    Presently, several nations, some
    'developed' are undergoing severe economic turmoil and are being pressured by agents of western imperialism to accept restructuring measures to get out of debt. Debts that were caused by an economy catering to the export sector or to being a party to skewed international trade agreements. We are heading the same way. Instead of crying for big brother Koffi at every hiccup in our economic and political odyssey, we need to formulate local solutions to our problems.   15. The draft constitution is the main challenge in Kenya today:

    -Kenyans want anew constitution
    -ODM wants a new constitution
    -PNU wants a new constitution

    facts:

    ODM wants Kibaki to have a last term
    PNU (PDM0 wants Kibaki for a 3rd term!

    Reality:

    -current constitution will not allow Kibaki's 3rd term. maybe the new constitution, with some amends will allow him a third part

    These amendments are the real challenge!

    Amend the draft and it fails in the referendum.
    Even Ruto understands this situation and he supports ODmM on this, out no choice.

    Are we not back to 2005?

    If the draft fails, do we have any person ( of course Kibaki out) to beat RAO?

    Intersting times ahead in the next 30-40 days

  16. WHY MUDAVADI WANTED PS SAMMY KIRUI FIRED.

    Both Mudavadi and Kirui had appointed their pointman, Newton Osiemo, to receive their share of the loot in the Cemetery Scandal. Informed sources say that Osiemo took more than his authorized share and handed Kirui the rest to go share with Mudavadi. Unfortunately, there is no honor among hyenas and Kirui took off with the whole package. As a result Mudavadi was madder than hell and swore revenge - Kirui had to go.

    Things are even getting hotter because Osiemo has disappeared and his folks are worried that he may have met his demise allegedly to shield Mudavadi from political and criminal consequences. Osiemo is the only person who can tell what instructions he got from Kirui and Mudavadi as their agent in the mega scandal. The prayers of all good people is that Osiemo is found safe; at least, his family deserves to know where he is.

  17. Osiemo's life is not any danger at all. The little coward may have decided to go underground for a while until the hit is off Kenyan style. In the meantime, all he is trying to do is deflect shame from what he and his "band of grave (cemetery) robbers" did in the hope that it would never come to light.

    By the way, since land has become the real issue in Kenya, why doesn't the Nairobi area public health officials and residents opt for the construction of solar powered crematorium?

    After all, most of the 90% of the graves are never marked nor do they have tombstones sticking out for identification once the burial is done.

  24. This is a very simple matter. Corruption and Musalia Mudavadi are twin brothers. If you do not believe me, ask Raila Odinga. He knows something about Mudavadi's involvement in that scandal we call the Goldenberg.

    Now, I blame President Kibaki more than anyone else as these corruption revelations continue to emerge. Firing Permanent Secretaries alone is not enough. The repective ministers have to go.

    I will repeat it for those who want to puke, if PS's in the Office of the Prime Minster and the ministries of Agriculture, Loval Government, Education and Special Programmes had to go, then the respective ministers need to go as well. And these ministers are Raila Odinga, William Ruto, Musalia Mudavadi, Prof. Sam Ongeri and Dr. Naomi Shabban. There should be no sacred cows.

    Wait a minute, I just noticed the three top "leaders" in the ODM already have mega-scandals hanging on their necks barely two years into government! Talk about change, talk about gluttony!

    Using your own warped argument to admonish ODM and conveniently ignoring PNU top guns; would President Kibaki be serving as head of state given the humongous scandals that continue to lace the Office of the President? Would Uhuru Kenyatta be finance minister?

    We cannot talk about change if comprehensive reforms plus free and fair elections continue to give sleepless nights to Kibaki, Kalonzo and company.

    Since you are talking of warped logics, what's more warped than the argument by your muttonhead of a Prime Minister that William Ruto should be sent packing because one of the people who work for him wrote a letter soliciting for the allocation of maize to an individual and he himself (I am talking of Raila Odinga) should be spared when his own officers do exactly that except on a much larger scale and for their own PERSONAL bebefit as opposed to that of some disabled peasant?). What is more stupid than that argument?

    We are not mischievous, we are only prescribing to Mr. Raila Odinga what he himself claims should be the way to go. Don't put that back on me, take it straight to Mr. Raila and ask him to explain the difference between the indirect involvement in graft of his Deputy in the party William Ruto and his own and Musalia's.     That my dear readers is enough to know that the KACC man did not actually know why they had to grill Mudavadi further, but that they had to carry out the orders.

    As for Raila, whether he would want to cleanse ODM or not, why would he ask Mudavadi to step-aside. For failing to visit the grave site which he claims he was not informed of?

    Mudavadi will get out of this. After all it is common knowledge that Ruto agreed to dismantle ODM from within so that the charges of corruption trailing him can be dropped, oops, (held in obeyance until the next time). Ruto ame shikwa on the balls.

    Mudavadi, have to dismantle ODM now, he is the only one spoiling the party.

  30. I've got a friend of mine who decided to investigate on some corruption in college, a student leader had been given Kshs 500,000, which he had used only Kshs 5,000. When he went deeper to find out where the rest of the money had gone he realised that the university accountant had given the student leader only Kshs 50,000.

    That means the student leader had eaten only Kshs 45,000, and not Kshs 595,000. The accountant had not released Kshs 450,000, though the books shows that. On going further he saw evidence was pointing to the Vice Chanceller. That's how he gave up investigating since he knew going deeper will lead him into trouble, in which he'll loose. He realised that the biggest thief after all was not the student leader but..... you can guess.

    Now to the Ministry. Following my doing internship at the Ministry I realised that for all major scandals at Ministries the Ministers are normally involved through their agents. For mega scandals like Goldenberg and Anglo leasing know that the President is likely to be involved. However for the ministers and maybe President, they are involved indirectly through them being given the money in form of gifts. In this way if you follow the law, which is what the court does, they are not guilty, though in most cases they have taken the lions share.

    This is how our law is and we should forget about prosecuting any Minister because of corruption, they have simply taken advantage of the loophole in law.

    Check an example of Ruto in Maize scandal. Ruto sent his agents, but there is no kept evidence that he sent the agents since they were done orally. At the same time he might have got his share in form of Christmas gifts, but then there is nowhere that indicates that these gifts came out of the proceeds of maize scandal. In other words our law cannot prosecute Ruto. He's simply innocent according to law. This applies to Ongeri, Mudavadi, Uhuru, Kibaki, Moi, Kimunya e.t.c. They are all innocent according to law.

    Corruption can only be stopped using our current law if humanity ceased to be greedy and selfish, but as long as this current law exist then whoever gets power will use the same loophole to steal public money.

    With due respect, we beg to differ. Human beings are not inherently greedy and inhuman as we are taught today. It is the way they are governed which corrupts man.

    In this perspective, when fundamental laws of a nation entrench robbery, it is difficult and rather stupid to expect a just society to emerge from such rotten foundations. It cannot.

    Let us look at USA as an example of "democracy" which it is not.

    From 1778 to the adoption of the U.S. Constitution in 1789, the United States was governed by the Articles of Conferederation. Article VII stated that the expenses of the Confederation:

    "shall be defrayed out of a common treasury, which shall be supplied by the several states, in proportion to the value of all land within each state, granted to or surveyed for any person, as such land and the buildings and improvements thereon shall be estimated according to such mode as the United States in Congress assembled, shall from time to time direct and appoint."

    Clearly, the USA founding fathers like Jefferson intended running of the USA govt. to be met from LAND VALUES.

  41. Osiemo has given a statement with a sworn affidavit that he was not in hiding neither was he representing the DPM nor the PS and that...KACC has not even sought him for questioning yet they are busy stating that he is in hiding!!

    the DPM has pointed out in his personal statement in parliament that he was the one who requested the investigation. KACC chose to leak an incomplete investigation report to the media even before they delivered the letter to the PM and Muthaura to whom the said letter was addressed to and copied!

    Ordinarily and according to the law KACC should finish their investigation and hand over the report to the AG seeking consent to prosecute (not to PM, as was the case)

    part of the report quoting Mary Ngethe and alluding to the link to DPM is innuendo..... that they think whoever received the 59M may have bought a plot in Karen!!! Dont they have documents to show who bought the land??

    There clearly was outright theft in the whole saga, but there is also a great effort to drag in ( rightly or wrongly ) the DPM into the saga and make maximum political capital out of it.

    If Mudavadi ate he should face the music like the rest of them, however, what KACC or the hand that controls them did was to botch a good case for political expediency!!

    All it needs is a good lawyer to point out that KACC did not follow the law that set it out in purporting to leak the report, and kenyans would be the losers in the matter in court. What a shame for PNU machinations.

Raila told ongeri to step aside because his ministry (not him) is in the dock. The same with ruto. So now pnu says mudavadi should step aside because his ministry (not him) is in the dock. Raila comes out to, as standard puts, gallantly defend mudavadi and says the war on graft should not be politicised. Exactly the same thing kibs had said. Of course pnu knew raila cannot let mudavadi go. But their point has been made.

  55. I have just been doing some simple arithmetic on the Kshs. 24m value the press has been quoting the cemetery land to be worth. For 120 acres this translates to 200,000/= per acre. 50 by 100 ft (1/8 acre) plots in that area go for at least 300,000/= per plot. The Government Valuer claims he is still waiting for NCC to facilitate inspection of the property for valuation purposes, meaning they have not carried out the valuation. Where did the Kshs. 24m value originate from?

After rao talked of political responsibility, pnu must have said: let's expose odm ministers' scams to help the pm in his fight against graft! Raila was forced to defend mudavadi.     A question to KACC. Are Ministers not human beings who are related to, friends to, neighbours to, cousins to and are they not former associates of, school mates of, neighbours of some ordinary person somewhere?

    Another question. Can anyone of the above not do business with any organization, company, corporate, ministry because the persons heading those organizations are or were known to them?

That is the degree they give to those who shouldnt have gone to uni but were just invited to see how a uni looks like. After he fled to canada, they allowed him to study law on the basis of social promotion (they do this with a lot of third worlders). Now that's raila's adviser for you. All he knows is hurling insults at others, which as makau mutua said is a sign of insecurity. He is intellectually insecure but thinks his insults and goliath size will intimidate others. Allowed to call himself a barrister and to practise refugee law then ends up forcing himself on the refugee women. How come he has never addressed in a kenyan paper the rape charges, and he likes to respond to everything.
