Predictable Leadership from the Rear

The king of impunity is back at his element best. In his characteristic style of utter contempt to national mood and public opinion he has fallen back to the tried and tested COMMISSION OF INQUIRY. The outcome is already drafted. But before that good old Justice Majid Cocker reputation can be handy in sanitizing a rot even if the stench won’t be contained. And just for good measure homeboy Kathurima will keep watch incase the good old judge becomes nosy.

Kibaki’s serial acts of impunity make Kenyans desperate for a new constitution. But the insensitive bloke uses the same tattered set of law to rub it on our face. Give it to Emilio; the guy epitomizes the minimalist mind frame as exhibited by his loyalists. When confronted by a crisis he predictably switches into reactive mode albeit mutely only to emerge with the tired line of action that was perfected by previous scoundrels before him. It is not only the height of incompetence but also shameless damage control antic to when wait for cronies to exploit a loophole in the constitution to enable you stay a float in the face of every crisis.

Kibaki’s act is bravado in disguise albeit couched in legalese. The message: Grand Regency scam is my baby and I have the leeway to cover it up. Well, we are back to seizing moments - whose dad is bigger than the other. Instead of strengthening the three lines of probe already in place Kibaki is trashing all the committees and resources spent on them to give himself an upper hand toward showing who has more muscles. Political revenge has never been served so insensitively and cheaply.

The Cocker commission is cleverly designed to kill many birds with no stone. The press is cleverly gagged and the subjudice nonsense comes in handy. By the time it presents the already known verdict in a month’s time the THIEF won’t have appeared before it and the blue-eyed Kimunya would be wearing rose-scented deodorant. No wonder the king of impunity shamelessly brands his subjects pumbavus. He is actually telling us to go hang a thousand times. He has the luxury of sleeping and waiting for a whole month for matters to come to a boil only to surface and splash CONTEMPT on our collective face. Mta do?

Give it to Kibaki, he never betrays his school and train of thought that is stuck at the 1960s rails. Besides contempt all his actions are so predictably boring so much so that you cannot waste your tears on them. With looters lurking in all his corners property Kenya is destined to bleed to the last drop of blood as the DINOSAUR and marionette plot the next item to be ticked to Libyans. And why note extend the goodies to few homeboys by enriching them through meaningless commissions of inquiry. Gibson Kamau Kuria must be cursing why he was overlooked this time round after successfully appearing for the son-in-laws in disguise with the report gathering dust as usual. Kazi iendelee.

    Okemo further stunned Parliament when he claimed that the former Minister undertook to repay the monies to the NBK through the Central Bank of Kenya. However, a cheque written to CBK by Treasury never reached NBK.

    He claimed his committee had information and documentary evidence that NBK had loans amounting to Sh20 billion borrowed by some unnamed private individuals and companies from NBK.

    The Nambale MP, himself a former Finance Minister, claimed Wako had advised Kimunya against guaranteeing the loans to the private individuals and companies. According to Okemo, Wako gave his opinion after the Ministry of Finance sought for it.

    He said minister Kimunya last year undertook to repay the loans and wrote a cheque of Sh20 billion to Central Bank of Kenya. But the CBK cheque, Okemo added, went back to the government, meaning that NBK could have lost the money. He said the National Bank of Kenya went ahead to float a 20-year bond that is not guaranteed by anything.

    He asked the Ministry of Finance to clarify how the government brought itself to foot debts borrowed by private companies and individuals who should be forced to repay the money.

    The Nambale MP asked Finance assistant minister Oburu Oginga to explain when and how the government started re-paying loans on behalf of private companies and individuals purported to be guaranteed by it. Dr Oburu undertook to issue a comprehensive statement on the matter next Wednesday afternoon.

    National Bank of Kenya has had a long history of bad debts, dating back to 1980s. At one time, Simeon Nyachae ran into trouble when he publicly published names of high profile individuals that owed the bank billions of shillings that they were unwilling to repay. This culminated into his sacking as Finance minister.

    If substantiated, Okemo’s claims are likely to complicate Kimunya’s political fortunes, coming barely two days after he bowed to pressure to step aside to pave way for investigations into his role in the controversial sale of the five star Grand Regency hotel.

    US-funded exit poll says Raila won elections

    ODM leader Raila Odinga won the December polls by a 6-point margin over President Kibaki, according to a US-sponsored election-day survey of voters that was released in Washington on Tuesday.

    The 5,495 Kenyans surveyed leaving voting stations in 67 of 71 districts showed Mr Odinga got 46.07 per cent of the vote, compared to 40.17 per cent for Mr Kibaki and 10.22 per cent for Kalonzo Musyoka.

    The poll has a margin of error of 1.32 percentage points, meaning its finding of a six-point victory for Mr Odinga should be considered statistically reliable.

    Commenting on the survey, political scientist and Kenya election expert Joel Barkan said the poll’s design and execution ensure that its findings are trustworthy.

    He spoke at a forum held at the non-governmental Centre for Strategic and International Studies. Presentations on the exit poll findings were made by Prof Clark Gibson of the University of California at San Diego and by James Long, a research associate at the Institute of Development Studies at the University of Nairobi.

    Prof Gibson and Mr Long designed the exit poll under contract with the International Republican Institute (IRI), a Washington-based democracy-promotion group. USAid, a government entity, paid for the poll, which Prof Gibson said cost between $30,000 and $50,000 (Sh2 million and Sh3.2 million).

    Strategic Research, a Nairobi-based firm, assisted in supervising the survey.

    IRI had stipulated that the findings could not be divulged for at least six months following the election.

    In addition to doubting the official outcome of the presidential vote, the survey also questions whether Mr Kibaki actually met the requirement of winning at least 25 per cent of the ballots in five provinces.

    The exit poll’s findings suggest that Mr Odinga will be “the person to beat in 2012,” Prof Barkan observed.

    Police killed majority of victims after poll

    NAIROBI, July 10 - Nearly half of all deaths during post election violence were caused by police according to a report tabled on Thursday before the Justice Phillip Waki-led commission.

    The report, prepared by a local NGO - the Independent Medico Legal Unit (IMLU), indicates that 43 percent of the post poll victims were found with bullet wounds.

    “The 57 percent others were either severed to death or burnt,” said IMLU’s Programmes Manager Dr Joan Wanjiru during the second day of public hearings.

    “None of these people died from natural causes. All of them died from one form of violence or another. 43 percent of those sampled had gun shot injuries while 57 percent had died from injuries inflicted by sharp or blunt objects,” she said.

    The organisation’s Executive Director Samuel Mohochi said they conducted post mortems on some 80 bodies randomly sampled from public mortuaries across the country.

    Mohochi, who became the second witness to appear at the public inquiry after Police Commissioner Major General Mohammed Hussein Ali, said they were unable to conduct post mortems on all the bodies of people killed during the skirmishes, due to their limited capacity.

    He said the organisation collaborated with the Ministry of Health and the police department in sampling the 80 bodies at various mortuaries.

    The operation was conducted in Kisumu, Nairobi, Kakamega, Nakuru and Eldoret, which were the worst hit parts of the country.

    Human rights and charity organisations placed the death toll from the skirmishes at 1,500 but the figure was disputed on Wednesday by the Commissioner of Police, who said only 616 fatalities were reported to them.

    “Many bodies of people killed during the post election violence were piled up in mortuaries but we could not conduct post mortems on all of them,” he said.

    Mohochi said the transport crisis at the time hampered their movements, making it difficult for them to access other parts of the country.

    He also cited the inadequate number of Pathologists in the country as the main reason why they were unable to examine all the bodies preserved in mortuaries.

    Lawyer Evans Monari, who is representing the Police, challenged him to explain why IMLU concluded that 43 percent of the victims were shot dead by the police without conducting ballistic examinations.

    “We made the conclusion because we had cases where family members claimed they saw police shoot at their relatives,” he said.

    The commission has lined up several senior security officials, who would testify on the actions they took to suppress the violence.

    On Thursday afternoon, Internal Security and Provincial Administration Permanent Secretary Francis Kimemia presented a report, suggesting that electoral violence crimes and political incitement be made capital offences.

    Kimemia said that introducing stiffer penalties is the only way the country could deter perpetrators, to avoid what was witnessed in the country after the disputed Presidential elections.

    Among some of the government recommendations, was a proposal to establish at least one national school in all districts in the country, to promote national cohesion and fight tribalism.

    NAIROBI, July 8 – The bodies of three people suspected to be Mungiki sect members, who went missing a week ago, were found dumped in Nairobi’s City Mortuary on Tuesday.

    They include that of a matatu driver, his tout and another matatu crew member.

    Family members of the deceased said their kin were last seen on June 30 while being arrested by police.

    A local newspaper published a photograph on July 1 showing a police officer roughing up the matatu driver, who was identified by his wife Margaret as Peter Maina Wachira.

    “I was informed that my husband had been arrested but when I searched all the police stations, I did not find him,” she told Capital News at the City Mortuary.

    “A day after my husband’s arrest, I saw a photograph on a local daily showing a police officer arresting and handcuffing him,” she added.

    Margaret displayed a copy of The Standard Newspaper of July 1, 2008, showing a police officer struggling to handcuff Wachira.

    It is not clear where the man was taken after the arrest.

    When contacted, Police Spokesman Erick Kiraithe said he would not comment on the matter because he had not gathered sufficient information.

    “I will comment on the matter once I get full details about it,” he said on telephone.

    Records at the City Mortuary indicated that Wachira was taken there by a police officer, who only identified himself as Kirwa.

    It was booked in at 5.40 am under registration number PP 2091/08 as an unidentified male adult.

    The records showed that the body was picked up by police from Ngong Forest alongside that of another man, identified as a tout who worked with Wachira.

    A post-mortem conducted on Wachira’s body by Government Pathologist Dr Peter Ndegwa revealed that the man had died as a result of manual strangulation and torture.

    “He had been so badly beaten. I couldn’t identify him from his face, or most of his body. What I did recognise were his legs,” Margaret narrated.

    By the time the Capital News crew visited the mortuary, relatives of the tout had not shown up at the morgue.

    The body of the third man, who was also booked in as an unidentified male adult, lay unclaimed.

    A mortuary attendant, who pleaded to remain anonymous, said there were 10 other bodies there that had not been identified.

    “They were brought here by the police, many of them with bullet wounds but they have never been claimed,” he said.

    Wachira’s wife Margaret said she suspects her husband may have been tortured and later executed by the police.

    “I suspect they were killed by the police because they (police) were photographed as they hand-cuffed my husband,” she added.

    In May, two other officials of the banned Mungiki sect who went missing in February were found dead and their bodies dumped at the Machakos hospital mortuary.

    The bodies of Joseph Kariuki Njenga and Eliud Gatundu Maina were found dumped at the mortuary bearing bullet wounds, and family members and other sect officials blamed the police for the killings.

    The sect’s Spokesman Njuguna Gitau said they were alarmed by what he termed increased ‘execution-style’ murders by the police.

    “What the police are doing is wrong. If they suspect any one of any wrongdoing, they should follow the due process of the law instead of resorting to execute them,” he said.

    Police Commissioner Major General Mohammed Hussein Ali has previously maintained his that officers were not involved in the murders.

  11. I will try stick to the post as much as possible....Since 2003 as recorded by the Daily nation over 16 task forces and commission of inquiries have been setup to investigate several misdeeds. Out of the 16 i am yet to see the reports of any. So will i be waiting for the outcome of the Majid Cocker one...Hell no unless i am a big fool!!!!
    Can anyone among the commissioners appointed have a conscious and reject this daylight robbery of the people of Kenya and just refuse to take up the position. Kimunya had the audacity of lying in parliament and you are telling me to hear him out that the truth shall set him free...I ask what truth? ....Kibaki "the duly elected president of Kenya" i have no kind words for him so let me take the 5th ammendment.

    I will address my concerns to one Vikii.Firstly Vikii you come across as a well read individual and fairly well informed.You accuse Phil and Taabu of the same crime that you yourself committs every now and then.I have never had a chance yet to get into a media house and see how writers react to each other when they have differences in opinion.I have been watching your comments for a while now and discovered you have nothing you STAND for in person and character.Its very absurd when you keep defending the indefinsible.

    In another words when say X exudes their liking for Y whom you hate, you foam around your mouth and impose your liking for say B even when B is very obviously unpopular.What am saying is, you dont seem to agree with anyone who doesn't buy your line of thought.

  17. I hope there are MPs working behind the scenes redrafting the Bomas draft constitution. This duly elected thief needs to be cut down to size. In other countries like TZ, commissions of enquiry are set up by Parliament and the report is tabled in the House in its entirety - live on national TV! I hope that the Committee set up by the Speaker and that set up by the PM will table their findings in Parliament. That should teach the thief and his supporters a lesson!

  18. Knoppix, I am not here to attack the character of anyone. You have all the right in the world to pass your judgement on whether or not I have a stand.

    For your information, I am not the kind that feels threatened by other people's opinions. I do not believe that your political stand defines what kind of person you are. What I attack is the quality of what you write. I have no apologies to anyone. Taabu has written hundreds of comments on this blog that border on actual insults to people who write much more sense than he does. He feels the likes of Derek and Kwale have no right of existence and that is why I will keep reminding him to come up with something that passes the mark.

    Like one anon fellow has said, what has Kathurima's tribe got to do with his appointment? Does it mean the Kikuyus, Kenya's most populous community, has no rights like the other communities? When you read the writings of a grown-ass man that never sees anything beyond tribe, what classification, besides 'ivish' would you attach to their comments? Kathurima is not even the chairman but his mere membership is being questioned on the basis of his ethnicity. And you call that objectivity? I cannot have respect for a bigot, I never have.

    Knoppix, you have mentioned Phil. For your information I do not agree with Phil's political opinions (and I never will) but I have tremendous respect for what he writes. I have respect for not just his style of writing but also for his arguements in defense of his political inclination. I have not seen him form opinions of people based on their ethnicity. You can say the same on people like Urlnx who are clearly objective despite being ODM (a party I hate with a passion) enthusiasts.
