Grand Regency Scandal Was Aimed at Sabotaging Kimunya’s Presidential Ambitions

Folks, the Race to 2012 has shifted to overdrive! And it is as vicious as they come.

When Kumekucha recently published an article about the flight of one blindside winger in reference to Amos kimunya’s presidential ambitions, it was prematurely dismissed by many bloggers here as pure dreams.

It now emerges that Kumekucha’s post on Kimunya was spot-on and a superbly thought out piece of political analogy. Consider that in a game of rugby union, the opposing team hardly rely on their own blindside winger to stop an attacking blindside winger unless he manages to go past the defending blindside flanker (at the scrum-down backrow) who is the first line of defence. Confused? Read on, because the Grand Regency saga has exposed a GEMA power scheme and find out why Kumekucha called it ‘the Quiet Rise And Rise of Amos Kimunya that Kenyans still ignore – and why I think this latest scandal could just be a minor hick-up for Kimunya as he emerges the GEMA leading light and a serious contender for presidency in 2012.

Although the Grand Regency sale took place in 2007, all has been relatively calm until last week. We can authoritatively reveal the scandal was carefully timed to be deliberately unearthed last week so as to decisively destroy Amos Kimunya’s unchallenged grand march towards the Kibaki succession in Central province. Events surrounding the scandal have taken place in quick succession ALL of which were timed to ‘explode’ when the president was out of country attending an AU summit in Egypt and consequently leave Kimunya completely exposed with very little room for defence, maneuver or recovery.

Although it was ODM’s Orengo who first blew the whistle at an unusual and highly suspect 6.30pm news conference, the actual movers who engineered activities at Ardhi House earlier in the day were errand boys working at the behest of powerful forces from Central Province. These cunning operatives then went ahead to use an informer within the Lands ministry to leak the story to Orengo knowing the minister would not waste time in exposing the scandal. Soon after, ODM ‘saw a gap’ and decided capitalize by sponsoring a motion to censure the finance minister, but not wanting to be seen as directly antagonizing a coalition partner, it decided to use New FORD-K’s Khalwale to give the speaker notice of the motion. As soon as parliament passed the no-confidence motion, the Prime Minister, who had been chairing a cabinet committee meeting on Grand Regency, immediately formed a probe sub-committee and gave them a 24 hour ultimatum to submit ‘its findings and recommendations’.

The momentum towards Kimunya’s political demise was moving at breath-neck speed only to be brought to a screeching halt by the President who also called off a scheduled cabinet meeting and then asked Civil Service boss Francis Muthaura to instruct Spokesman Alfred Mutua to release a terse statement insinuating that the cabinet probe sub-committee report "has not reached cabinet and neither has the report received cabinet attention!" Wow.

It goes without saying that if Francis Ole Kaparo had been Speaker of the National Assembly, Khalwale’s motion would not have seen light of day. Consequently, the apparent success of the Kimunya no-confidence motion is now being seen within ODM circles as a precursor to a possible Kibaki no-confidence motion should the GCG collapse or should any of the pending Annan agenda’s be blocked before completion, especially now that Martha Karua has effectively defected from PNU and the men in that party will have no skirt to hide in like they did in early part of this year.

It turns out the grand regency saga is in reality a water stop break for Kimunya in our pulsating game of rugby and the finance minister is going nowhere! Kimunya actually had the audacity to say he is still serving the nation and that Raila should resign for being aware and doing nothing about the Grand Regency sale! Not only has Kimunya been assured of political back-up, his godfathers have vowed to break the bank in an elaborate plan to ensure that the Presidency stays with the community for as long as it takes.

In recent times, it is not lost on political observers that among all cabinet ministers, Kimunya is known to be the closest to the president and his recent budget speech (dubbed 2012 campaign speech) clearly impressed the president. Kimunya understands Kibaki’s lifelong love affair with economics and his budget speech was targeted at the boss when he announced, amongst other things, that “the 2008-09 financial year forecasted revenues of Kshs. 512.8 billion up from Kshs. 448.8 billion last year, and equivalent to 21.4 percent of the GDP” – all very sweet music to his mentors ears, only that the reality is that the economic growth is negative as we all learnt from Planning Minister Wycliffe Oparanya during the launch of vision 2030.

Kibaki is now being encouraged by his council of elders, among them god fathers who handpicked Kimunya from the corporate world and dumped him into politics, to start construction of project Kimunya for 2012 – similar to what Moi conceived with his own abortive succession through what was known as Project Uhuru. The elders (who are also known as the athuri group) although desirous of Martha Karua in their camp for now, have scant respect for her as a leading presidential light from Central province and are said to be worried that if left unchallenged, both Martha Karua and the Kalonzo/Uhuru axis might develop into larger political monsters and eventually eat into what could otherwise be ‘President’ Amos Kimunya’s GEMA vote basket.

No permanent enemies in Politics

Shortly before the explosion of the Kimunya Grand Regency scandal, a significant event took place in the political arena, whereby Martha Karua was appointed the NARC-K party leader. To the chagrin of the athuri elders, she immediately went ahead to announce that her party NARC-K had de-linked from PNU and that her name will definitely be on the ballot paper come 2012. This announcement was overshadowed by Orengo’s earth shaking whistle blow, but behind the scenes it had effectively thrown the Grand coalition government into a spin with cabinet ministers who habour presidential ambitions being forced back to the drawing board. There is no denying that the current political boxing ring contain grand coalition players who are smart, super-rich, ambitious and highly talented politicians who have their eyes singularly trained on 2012 and beyond.

While Kimunya is fighting the battle of his life to remain in cabinet and in frame to succeed Kibaki, quiet upheavals are building in ODM. Soon after her installation as NARC-K Chairperson, Karua has seemingly embarked on building alliances with possible suitors beyond Central province. Unconfirmed reports say she has already sent emissaries to ODM via Lands Minister James Orengo. Orengo is a long-time comrade of Karua during the 2nd liberation struggle as well as a colleague in the legal profession.

A sure sign that PNU loyalties have completely shifted came when parliament was debating the sensitive Kimunya censure motion and Assistant Minister Danston Mungatana, who is also a staunch Karua supporter and interim NARC-K Secretary General, became the first member of cabinet to stand up in parliament to strongly condemn corruption and unequivocally support the Khalwale motion against his own cabinet colleague Kimunya. In contrast to her strong defence of Kibaki during the early sessions of parliament, Karua sat pensively in the house and unusually kept away from the censure debate. Mungatana’s support for the motion and Karua’s laid back attitude in parliament was in effect a coded message to the Kibaki’s Council of Elders who are propping up Kimunya and also an open invitation to the higher echelons of ODM that she was ready to do business.

Not to be left behind, FORD-K’s Musikari Kombo in an attempt to catch the eye of ODM captain also acclaimed in support of the Kimunya no-confidence motion. Kombo is struggling to remain relevant after being vanquished by the ODM wave in 2007.

Whereas the ODM captain Raila Odinga is sure of going for a second and final stab at the presidency in 2012 or before, Raila is also faced with a simmering power struggle within his own pentagon cabinet as well as in his own Nyanza backyard.

A quiet but steady Raila succession battle in the Nyanza region is in the offing pitting Ayang Nyongo versus James Orengo versus Dalmas Otieno vs James Magara. The first two are front runners to being Raila's deputy in Nyanza politics.

In the all powerful ODM pentagon, there have been calls to expand it a little and also create two deputy captain slots. A soft spoken and moderate Mudavadi is already occupying one deputy captain slot while the firebrand William Ruto and the no- nonsense Charity Ngilu are said to be keen on the other slot. Even before this, the ODM captain must make appointments to cabinet to replace the late Laboso and Kones. There have strong been calls within ODM that the replacements should be done immediately while other party moderates feel the captain should wait until after the by-elections to replace the ODM legislators.

On the front line eyeing the powerful Roads docket are: James Omingo Magara, Christhanus Okemo on one hand while Kipsigis MPs Isaac Ruto and Franklin Bett are on the other hand. The latter actually started canvassing for the seats during the funeral organizing committee meetings, long before the deceased were buried! Apart from reminding the captain that their community was short-changed in the initial cabinet appointments, Ruto and Bett are not hiding their demands for the seat which they say should be a mere replacement exercise by Raila appointing Kipsigis ministers. The influential Orange Women Democrats are pushing for one of their own to replace Laboso.

In the meantime, while weighing-in on the long-term political effects of Karua ’s move in GEMA zones, Raila Odinga knows that he must keep ODM united in his quest to be the next president of Kenya and he also has to keep an eye trained on his erstwhile ODM-K rivals Klonzo Musyoka and Uhuru Kenyatta. Raila must also court surplus votes from central province by all means possible or alternatively divide GEMA into as many splinter groups as possible. This undertaking is already underway considering he has effectively neutralized Mungiki and has their leadership dancing to his tunes while the GEMA elders are now fighting among themselves as to who will induct the ODM captain into their ranks as a Kikuyu Elder. But this is a story for another day!

Clearly, the blindside winger (read Kimunya) has been tackled neck-high and has not made it to the corner-flag try line (score) and it remains to be seen if the favoured PNU player will recover to continue with the game then outmaneuver his opponents and score the much needed try.

So far, PNU are trailing ODM in this exciting rugby union game of high voltage politics.

    That is a superb preface for a nice book. But would you please confirm whether the book is fact of fiction.

Again, I hate to throw spanners at your analogy but come 2012, the Presidency will be watered down significantly and to assume that the the Executive will remain as is, given our experience & history not to mention the impending Constitutional review, I doubt it's contenders would be that significant as opposed to the Prime Ministers docket.

    The flip side is, if the Presidency remains intact come 2012, you and I will have to barricade our homes or simply take flight because the violence we witnessed on earlier in the year would be considered child's play.

    The electorate has had it and that is variable your argument ignores albeit impeccably articulated.

    Libya beats out India’s Essar in struggle for Kenya refinery

    The government has finally given Libya Oil Holdings Ltd the go-ahead to purchase 50 per cent shares of Kenya Petroleum Refineries Ltd — introducing a new twist to a battle for control of the refinery that has pitted the Libyans against Indian conglomerate Essar Group.

    The Libyans will be purchasing shares hitherto owned by three European multinationals — Shell International Petroleum Ltd, BP Africa Ltd and Chevron Global Energy Inc.

    On paper, the arrangement is that the Indians will be accommodated by being offered shares in the company once the Libyans seal the deal with the three multinationals.

    As a matter of fact, the government has held discussions with both the Libyans and the Indians and agreed on an arrangement where the Indians will be accommodated.

    But whichever way one looks at it, the Indians have been snookered over the deal. Once the Libyans sign a deal with the European multinationals, the Indians will have to rely on the benevolence of the former to accommodate them.

    Sources told The EastAfrican that the Treasury was last week trying to persuade the parties to sign a written document committing them to agree to the accommodation arrangement.

    In a sense, the deal has once again exposed the growing clout and influence the Libyans are acquiring within the corridors of power in Kenya.

    The transaction has been conducted against the background of intense lobbying by influential agents representing the two investors.

    At one point, it appeared that the Indians would clinch the deal, especially after they emerged tops in the tender floated by Shell, Chevron and BP paving the way for the signing of a sale and purchase agreement between the parties.

    As the Indians waited for the government to waive its pre-emption rights and consummate the deal with the multinationals, the government asked for time to seek an alternative offer from the Libyans.

    But on January 29, the Libyans wrote to the Ministry of Energy, declining to respond to the offer on the grounds that the offer the ministry was giving them was a breach of a memorandum of understating signed between the governments of Kenya and Libya in June last year.

    It is then that intense lobbying by the Libyans and their well-connected agents started. The multinationals found themselves unable to consummate the deal with Essar group.

    On February 2, they wrote a letter to Finance Minister Amos Kimunya, protesting the delay in getting the waiver of pre-emption rights by the government.

    “We find difficult to understand the reason for the government needing a further extension of time. We will reluctantly agree to a further extension only until March 14,” said Martin Dickinson on behalf of the multinationals.

    At that stage, the excuse by the government was that they needed to do a due diligence on the Essar Group.

    Kenya to pay Ugandan traders over poll losses

    The Kenyan government has asked Uganda to submit the monetary value of merchandise destroyed during the post-election violence for compensation, The EastAfrican has learnt.

    Senior government officials in Kampala told this newspaper last week that Nairobi had sent a diplomatic notice through its high commission in Uganda on April 4 indicating that it was “going to pay all those who lost their goods.”

    Patrick Guma, a spokesman for Uganda’s Foreign Affairs Ministry, said: “We are aware of the message from Kenya. We have a lot of interest but for now it is still sensitive, and therefore I cannot comment on the subject.”

    Rift Valley Railways, the joint concessionaire managing the Kenya-Uganda railway, also reported losses as a result of the post-election violence. Bobby Louw, head of operations at RVR-Kenya, estimated an average loss of Ksh15 million ($231,000) per day during the violence. Sections of the railway line between western Kenya and neighbouring Uganda were damaged, interrupting the flow of goods. The RVR official claimed total loss of business stood at about Ksh375 million ($5.8 million) by the end of January.

    Although it is anticipated that RVR can offset its losses from its insurance policy, Roy Puffet, the firm’s managing director, said: “We have heard about the compensation, but we are still making a study to compute the losses.”

    He said there has been extensive correspondence between his firm and the two neighbouring governments.

    More than a dozen Ugandan traders lost merchandise and vehicles during the violence that erupted in Kenya at the end of last year and early this year between supporters of Raila Odinga and Mwai Kibaki, the two main presidential candidates in the race.

    Kenya offers landlocked Uganda its only direct land route to the sea but weeks of violence disrupted trade and saw vehicles as well as tracks on the Kenya-Uganda railway line vandalised.

    A lot of the violence occurred in the western Kenyan towns of Kisumu and Eldoret, both opposition strongholds and transit points for trade between the two countries.

    After President Yoweri Museveni congratulated President Kibaki on his re-election, angry opposition supporters who were still protesting against the election results started attacking goods vehicles and traders going to Uganda. Several fuel trucks were burnt and the trade blockade resulted in a severe shortage of fuel that sent pump prices soaring in Kampala.

    The EastAfrican has learnt that although no figure has been discussed in terms of compensation, Kampala has started verifying claims by Ugandan traders who say they lost goods.

    Officials from the Kampala City Traders Association lobby group said they have already identified six of their colleagues with claims worth over $835,958. Kacita said they were informed the claims would eventually be submitted to Uganda’s Solicitor General for approval.

    However, Issa Sekito, the traders’ spokesman, said they anticipate the number of claimants would increase after the government announces the exercise.

    Said Mr Sekito: “There are many traders upcountry who do not yet know what is going on; we expect that after the government has announced the intended compensation publicly, they will submit their claims.”

    He said the monetary figures of the claims were computed based on invoices valued and costs of transport for the goods. For the vehicles burnt, he added, the owners can easily establish the value.

    “We are very grateful that this [compensation] is happening. Such things will strengthen the spirit of East African Community,” Mr Sekito added.

    The EastAfrican has learnt that Kenya has been receiving individual claims through its mission in Kampala but has asked the Ugandan government to co-ordinate the process so that the claims can be settled through one lump-sum payment.

    The head of finance and administration at the Kenyan High Commission in Kampala, Samuel Gitongi, told The EastAfrican he was unaware of the compensation process.

  15. reading the comments here, I am getting more and more convinced that Kenyans or at least those here on this blog, have left the jungle according to Darwin not centuries ago, but have tried to join the intellects only after the General Elections realizing that all the others may leave them behind. There are so many stupid posts and comments here on this blog that one starts understanding why those at the top of this country (the Kikuyus) regard those struggling to eat at least a small piece of the cake (led by Raila) as total idiots.

    You mention rebellion in the ranks of PNU (Narcs Mungatana and Karua).Are these part of the scheme

    I am lost-Athuris are suppoting the youngsters in NARC-k? or is it short term to test if Kimunya can handle it?

    It is my firm belief that the Duly elected has no effect come 2012.I doubt that he can win the Othaya vote if there was to be one.
    Did you consider that Kimunya is from Kiambu?.The most effective wage in central at the moment is the anti-kiambu disposition.This alone is what killed Mois project,Uhuru in 2002,Ithink.

  17. Those who think or better dream here on this blog about the next General Elections elevating them to the point of sharing the cake called Kenya, are pure illusionists and daydreamers. Those who count know this and let them continue dreaming or better sleeping. They know they will continue doing so in 2012, 2017 and so on. Kenya is not up for grabs. It is up to the one who counts, the one who knows how to deal with international diplomacy and business. The only Kenyans who know how to play the game are the Kikuyus, the elite of Kenyans - past and present. Accept this - or die. It's either this or that - you have no other choice.

A stand out analysis. amid all the blogs on the GR issue, none has really approached it's analysis the way this article does, and it sure makes the most sense of all of them. i see a game of musical chairs where rather than resign, Kimunya just moves to a relatively weaker ministry as the minister.

  21. I hear the GEMA/PNU folks mention Kalonzo mara Uhuru,mara Kimunya - seriously what have any of these people done to warrant the post of the top CEO. Other than not eing Luos and having been on the ballot, can anyone mention anything inspiring that these people have done. Please don't mention 'party leadership'. Uhuru was nowhere to be seen when real men/women were standing up to oppose or defend the Kimunya motion. Other than the name, I shall not even waste my time contemplating. Kalonzo naye has a history of ducking to the 'loo' whenever a hot issue is put to the vote. Plus, he seems to be courting the MKM votes and will likely not be his own man, but will instead help in hiding the loote like he did with the elections. what was that nonsense of setting up a 'commitee/commision to sort out the prison warder's strike? That is so...Moish...Kibakish - bure kabisa. I fully understand the fears of a leadership vacuum once/if Kibaki retires, better the Mungiki boss than Kimunya or any of the names being bandied around. Seriously PANUISTS- think.

Even your halfgod Raila has realized that after his South-African major shareholders in Spectre have told him to better shut up if he wants to continue business with them and to fulfill his promises to get them some lucrative deals in the Kenyan Energy Sector something he finds himself now more and more diffifult after having to realize that the Kikuyus have already taken the major part of the cake and have given it to the Libyans. Poor Phil and all the other daydreamers here. You can shout yourself hoarse, but you will not and you will never be able to revise the fact that you have been cheated or better outsmarted once again by the ones who rule Kenya, at least when it comes to business. Just accept the defeat, not only in regard to the Grand Regency but to many more deals to come. Just sit, watch with amaze and learn. The otherwise more than outspoken Phil - the ODM spokesman of this blog - must have dropped dead after having learned that this honourable Minister Ruto had the necessity to buy sex with a Kenyan woman in Oslo promising her 1 Million Shilling if she agrees not to use a condom. How desperate this man must have been. One could even feel sorry for him, if only he would have kept the promise to pay her the money, which of course he didn't. Now he has run to Oslo accompanied by Mutula Kilonzo to try to save his face. Too late though because the woman has sold the story to the local and international media after the 7 days 'grace-period' she gave to Ruto had elapsed. But of course, our own Phil, Chris and all the other ODM-worshippers try to skip this subject. Why? Maybe the answer is quite simple: ODM Ministers are saints no matter what and where - PNU Ministers are all guilty, no matter for what and how. It's as simple as that, ins't it?

  27. with all due respect to the deep and at times provocative analysis above, with witty conspiracy theories and rebuttals.

    the analogy of rugby blind-winger or even soccer in politics is one of the reasons we are not moving ahead. it implies, swiftness or speed, agility and brute force and luck (catching the opponent flatfooted) in order to score. its highly glamorous but if you look at the events preceding the elections and the outcome, you see a different picture.

    this is a game of chess at grandmaster level. where each little move is made in such a way to limit free movement of the opponent. its deep thinking and each move intends to expose and/or trap and/or weaken the opponent.

    but enough of analogy and conspiracy theories, here on planet earth at my pedestrian level, its not about the "real reason" behind. what counts is that was there fraudulent deal, (money, process, etc), if yes, punish the perpetrators, all of them.

    its difficult enough to even just show proof of the fraud, how do we expect to prove the insider theories and conspiracies. that would be a near impossible task unless we can get people (whistle blowers) brave enough to provide the information (as obviously they do here at kk) but to take it a step further and table the facts with irrefutable evidence in an open forum where they can be assured and accorded the safety/security but also subject to at least some in-depth questioning to defend or shed more light on the evidence.

    Right now whereas I appreciate the deep reasoning, i must admit it feels like a cat or dog chasing its tail or shadow , i.e we come up with a theory then proceed to bash and support it

    We need to step back and deal with what is evidenced, certainly think about the theory behind it, but it should not engulf our space

That's why he is so desperate to become a Kikuyu Elder. He knows that this is the only tribe counting and therefore his only chance to ever become President is to become one of them.     Few people in Kenya have taken that route — they include Jaramogi Oginga Odinga, Maina Wanjigi, Kenneth Matiba and Charles Rubia. Mr Matiba and Mr Rubia served as ministers during the Kanu administration. After the 1988 discredited elections, the two politicians began in earnest a crusade for the re-introduction of multiparty democracy, earning detention without trial for their effort.

    The Kibaki Government also had Finance minister David Mwiraria voluntarily stepping aside for investigations, while Mr Kiraitu Murungi and Prof George Saitoti had to be pushed out.

    But even with the widest stretch of imagination, no one can use that word to accurately refer to Mr Kimunya and most of the occupants of the House. To be honourable is to be upright, admirable, worthy, respectable and not arrogant.

    That Mr Kimunya is a big disappointment is an understatement. Ann Lauterbach, in A History Lesson, says that to suffer a diminished faith in others is an experience of disappointment. That in “the very syllables of the word — on its very surface — the plain register of its meaning appears: dis-appointed, removed from appointment”.

    So as he packs up so should the next biggest disappointment — another Amos, the attorney-general, Wako.

    This is a man who insists on staying irrelevant for over 17 years. How can the chief government legal adviser keep saying that he was not informed when serious considerations were being made? This is the lamest of excuses and one wonders then who advises the Government in such instances.

    How can you comfortably continue living in a house where you don’t play your role because no one tells you anything? And when they ask you, you comfortably raise your hat and proudly proclaim that you were never informed?

    There comes a time when new leadership and fresh inspiration are called for. On November 9, 2004, US attorney-general John Ashcroft resigned from the Bush cabinet.
