The Amnesty Monster


Despite being a terminological inexactitude (no amnesty without conviction/confession), the amnesty debate for those involved in last year’s post-election violence refuses to die. With the two PRINCIPALS taking diametrically opposing stands on the matter, amnesty may as well stand out as the single issue that will determine the gestation period of the Government of Grand Coalition.

Daggers are drawn and both parties are spoiling for a fight. All the good statements of intent are mere diplospeak as tension heightens among the coalition partners. The unpleasant truth remains the fact that the international community forced PNU and ODM into political marriage which the two parties have done little to consummate. At the heart of this amnesty monster lies the protagonists’ core voting blocks. While Kibaki wants to show his Central and its diaspora’s voting base who is in charge, Raila has to disabuse his foot soldiers of the notion that ODM is nothing but a flower girl in the political union.

Pulling in opposite direction never resulted into harmony of neither ideas nor force. Both Kibaki and Raila are simply playing psychological wars to advance their party lines. Such theatrics would be alright were it not for the fact that their action amounts to playing Russian roulette with Kenyans’ lives. IDPs form the nucleus of this theatre of absurd. Our politicians have insensitively transformed the fate of these Kenyans to those of prisoners of war. On one hand PNU talks tough on enforcing the law while on the other ‘toothless’ ODM stakes meaningful reconciliation of on their release.

No selective justice
No civilized society entertains the culture of impunity. Similarly it amounts to the pot calling the kettle black when a paragon of IMPUNITY shouts fire in a crowded hall by admonishing the same vice oblivious of the fact that he initiated the same. Justice only serves its purpose when applied impartially. Selective application of justice cannot remedy any crisis save for soothing individual egos. Those who killed and raped other Kenyans must promptly face the full force of the law regardless of their first language. Similarly the many Kenyan youths locked up for simply demonstrating with placards protesting a STOLEN ELECTION must be freed.

It is foolish to criminalize dissent and even shamelessly attempt to legislate peace. It is typical Kenyan way of doing things when we avoid making hard decisions and opt for quick fixes whose cheap results will predictably bounce back to disfigure our face. Until we acknowledge that we are in a crisis and face it head on, we are only fooling ourselves as a country whose leadership is best defined by the three pillars of DECEPTION, FRAUD and TRICKERY. Honesty is one rare commodity within our borders. No wonder we are the only country in the world that hires out military choppers for political errands.

  1. All right-thinking people hopefully realize that the issue of whether or not to grant amnesty is a time bomb waiting to explode. It is an issue that requires sobriety and a step back from the revenge seeking stance adopted by the PNU wing of the government. I think everyone is in agreement that the law should take its course as long as there is sufficient evidence that one participated in criminal acts, other than demonstrating against a flawed election process. It's common knowledge that the law is being applied selectively, and this is perhaps the final straw that will break the camel's back. I shudder to imagine the implications of this to our fragile state as a country.

  3. what amnesty?? when prisoners from a certain tribe from central province are being released in the dead of the night and when the prison guards ask where they are being taken ?? they are threatened with their life's!!!

    what amnesty when kibaki and his minister of justice"martha karua" minister of security "saitoti" and police commissioner "Ali" are busy releasing all the kikuyu youths that were jailed during the post election fraca's while on the other hand they pretend and scream loudest no amnesty for the other tribes!!
    what Amnesty when we all know the some kikuyu youths that the prison guard has reported were released from the Eldoret prison did not take long to behead a priest and skin and innocent kenyan!!

    what Amnesty when sources confirm a deal was strike with the munguki leader Njenga and kibaki pnu cronies that they would stop the prayer meeting which was to be held at uhuru park in exchange of the release of many of their youths in nairobi nyeri,thika, nakuru, naivasha and Eldoret prisons which after sources checked with some of the prison guards who were not scared to talk that in fact most of this youths were removed and transported out of prison with police escort during the night before the mungiki prayer meeting was canceled - and the orders come from above the guards were told "yours truly kalonzo musyoka"

    now what can kibaki and his PNU cronies tell kenyans and odm supporters about Amnesty???
    0 nothing- the next thing kenyans should do is to get the prison guards to release all those young men in prison!! kibaki and kalonzo have ferried away to safty their mungiki foot soldiers that they used during election to commit genocide in kibera, nakuru. naivasha and some dressed in police uniforms who went on a rampage in Kisumu!!
    time out why wait for amnesty?? out innocent youth do not need amnesty from the same people who paid their families to be slaughtered by the mungiki gang!! the gates should be opened for our children to work out to freedom!!period

    if the all the youths in jail can't get amnesty then

    1. kibaki should be jail- for giving the police orders to shoot innocent Kenyans.

    2. saitoti and Ali should be in jail for the mungiki organized death in Nakuru and Naivasha among others like mt, Elgon(they transported the mungiki gangs to this town and in the case of Kisumu- some members of mungiki have now confirmed on camera- how they had a meeting at kibaki's residents on two occasions

    3. Uhuru
    4. Saitoti
    5.kiruitu murungi
    6.Njenga and kabondo wa kabondo
    7. Beth Mugo
    8 Njenga Karume

    10. Rafael Tuju(this was shocking to hear)
    and other PNU members of parliament
    they agreed on funds and being in police uniform to camouflage their identities- other police forces were told this were the new recruits from kiganjo police training school-embedded with them to help stop the unrest- all lies
    and that is why the other police offers did not question their actions(Mungiki in uniform) the had no idea.
    all over kenyans complained being slaughtered in Nakuru, Naivasha, kisumu and other town but police were just watching or shooting them dead.
    a police officer has come up and said that he tried to check the police roster of all the police transfered to Nakuru, Naivasha, Kisumu and he can't find any records on who was send to this towns during the post elections except the usual policemen and women that were already there- when he tried to ask and follow up until today no record and he is getting death threats!!

    think Kenyans should understand this marriage of convenience will not last unless kibaki releases the odm youth and explain the genocide in Nakuru. Kisumu. Naivasha and Eldoret(Eldoret same thing a source has come out and said it was planned by Moi and Kibaki to derail the election defeat and blame opposition on ethnic cleansing- the truth will be out soon and nothing but the whole truth- when people are paid to murder!! they become greedy and keep coming for more money and if you don't pay up!! they peak out!! a secret of a thief or a murderer is never a secret unless they are dead!! they normally end up talking!!
    who ever planned the Kenya genocide had a motive and the only motive was to stay in power at whatever cost even if it meant Kenyans loosing life's- to me this person is the most evil being in the history of kenya and he should not be allowed to keep on slaughtering innocent kenyans and releasing murderers to cause more deaths!!(what a stupid excuse the judges had for releasing murderers if one of those murderers was a killer of this judges family members?? would this same judges release them so happily with a stroke of a pen - making excuses for police incompetent while knowing very well they killed their children and releasing them would mean - chances of them killing again!!! You allowed many much more offensive ones in the past or did running away from Kenya for greener pastures change your opinion about free speech? If so, I am sorry to tell you that Kumekucha will have lost its attraction. Censorship is the last we expect to get on this blog and should only be done if some porno stars come out of hiding and start their nonsense here again. Otherwise, let us express our thoughts and opinion without your prior judgement if we deserve to be here. Most of us live in countries where the freedom of speech is part of the Constitution and we do not allow anybody - not even you - to take this away from us. Got me?

  15. dissent and murder are two different things. Were you there when those protesters were sharpening panga's and stopping cars asking people which tribes they belonged to? criminal acts are criminal, and Kenya has had a history of dissent, when section 2a was repealed for example and people didnt get multipartysm by taking panga's to cut people to death. Who ever did criminal acts must face the law that as a citizen he or she has subscribed to, otherwise he or she can go find somewhere else to live.

Anon 7.43 & Anon 8.13...I have just learnt from a very well placed source in Europe that at the height of Kenya post election, between the month of January and March this year, about 400 Kenyans sought refugee in 4 different European countries. Only those identified and proven to be Kikuyus were allowed to stay. They were the only ones considered as the high risk group fleeing persecution in their own country.
    Since the signing of peace agreement, no one is considered at a risk from persecution.

But, when combined together, it is still a crime, taking away someone's life, or destroying what is rightfully their's. Whilst we cannot necessarily criminalize dissent, it cannot be a scape goat for murderers and rapists with no remorse for what they did. Those who died and families who faced injustice deserve their justice. if thats what you call village stupidity an primary ignorance then good for you! I dont care

    Your point is well taken - the culprits should go to court, from there once adjudged guilty they seek amnesty. Thats how it goes. Fortunately thats what your post is saying. This is differnt from what Raila and Kenyans are saying. Even the guilty should be released. Period.

  23. Let's assume Kibaki and Raila now understand the consequences of stealing an election- the other party/tribe will go on a forceful circumsicion spree, the 'govt' will issue shoot to kill orders, there will be mass beheading, burning, and killing.

    Shouldn't there be consequences for the forced circumcision, rape, and killing? You break the law, any law, and then start acting like helpless victim of the same.

    Here we go again- peace with justice! Don't stop short of including the forcefully circumcised, beheaded, displaced and dead in that justice.

    It appears that one set of culprits(PNU) are being set free secretly while another ODM may just get in some hot soup...'justice'

    Once again amoung both groups some members broke the law and should be punished.

  25. PKW that story about RAO rigging was an elaborate plot by PNU Just incase RAO won by a landslide and just incase their rigging efforts did not succeed...so just drop it. I have evidence provided to me by a PNU insider one full month to the election....while he was drunk and happy ....when the polls were showing RAO a head. The guy said that they had planned that if RAO won they would have 'evidence' to prove he rigged....thats a whole full month before the election.......
    As the polls kept showing RAO a head all the guy kept saying like a mantra was that according to him the elections are alredy rigged to favour RAO...he repated it like a guy rehearsing to incite a crowd...
    obviously i was shocked cause why would ROA want to rigg when opinion pols where showing that he was a head.....
    ...so just drop the ponitless crap idea that seems to drag RAO to kifukie's level....tafadhali ji heshimu.....

    I guess the same mantra was repeated to you till it has become 'truth' in your mind.

  28. ODM problem is about domo. Their facts are so flawed on juja constituency having been advised by kabogo - that they should shun to say they were rigged in juja. A constituency of 160,000 voters. Kabogo 32,000 and thuo 53000 and another lady over 10,000 yet they say kibaki got 48,000. siasa tupu. they rigged themslves into government.

Maybe this might be helpful to know that following a request to Amnesty International to take up the case of those people who it is claimed are being held illegally after protesting a stolen election the organisation refused and explained that it is its policy never to represent or advocate on behalf of any individual who has chossen to advocate violence to persue a political goal, they further explained and gave the example of the Ukraine where following a disputed election people came out peacefully and protested peacefully. If a similar thing had happened in Kenya and women and children, old men and women had all come out to protest the flawed election, maybe the argument that it was a political demonstration could hold water, why is it only young male youths that felt they had been disenfranchised. Why were they burning and looting instead of protesting peacefully. It is sad that people would wish to advocate for release criminal youths for hire, the argument should not be for amnesty but accountability accross the board, if two people commit a crime since you only catch one suspect should you argue that he should be set free because the other is not in custody, I am sorry no you should arguing that all those involved should be held accountable. If you are the one caught stealing fruit from the tree it is no defence to say that others have stolen therefore you should not be held culpable, sorry you were caught and have to face the music, so that next time it will not happen. So in the search of accountability it would be better if those people that claim to have evidence of this and that wrong doing to table it so that those responsible can be held to account John Githongo never had to go to a court of law but he presented his case through other methods and all those with information that can hold and is not pure rumour should do the same in fact it is your duty to do so if not then it would be best to keep quite and move on, and join the ranks of all those other cowards that have gone before hand. Therefore the onus is on all of you out there that claim to have irrefutable evidence that this and that happened to make it availble even if you do not trust the kenyan system go to a journalist, your congress man or post it on the web but it should be factual that can hold up in court much like the Githongo dossier and not mere bar room rumour

  30. Kenya has two sets of laws: One for the rich (elite?) and one for the man on the street.

    Ok, if for argument sake these youths now languishing in jails are guilty, then they must be produced in court within a fortnight. And the prosecution must have all evidence for their crimes. Thats the law. But is this the case?

    Secondly, the Police are culpable as anyone cares to know. The law to use live bulltes is very clear. How many women and children died from bullet wounds? Dont even bother about the youths who succumbed to annhilation that whole world witnessed. So the question is: how many police officers have been arrested for breaking the law by killing both innocent and 'guilty' wanainchi? I only know one!

    And did you see Kalooser do chest thumping that ECK officials will never face a magistrate for so long as he is the veep? What stupidity is this?

    May ask him, is the hiring option available to me as common citizen if I wanted to? Or for an opposition MP for that matter?

  32. Anon 547, of course Airforce, Kenya Wildlife and Police choppers have been available for hire for as long as I can remember.

    Last year, there was a near stand-off between Martha Karua and the Maina Kiai-led commission about a Pipeline plane. The Kenya Pipeline had to later clarify, actually explain Maina the hire policy by which time he had forwarded the case to the AG.
    The best thing to do is is for people like you, Kaluki Ngilu and anybody else who feels Kalonzo is not telling the truth is to go to the kenya Airforce and ascertain the authenticity of Kalonzo's claims. But obviously being so used to a culture of heckling without facts, I do not expect you to do it.
