So The Kenya Police Has An Execution Squad...

"...And most Kenyans don't think it is a big deal. Hehehehe ...but not for long, mark my words... not for long"

When Kumekucha last week exclusively revealed how the wife of jailed Mungiki leader was raped and executed and those behind it, some readers who commented on the story reacted in the characteristic Kenyan style of dismissing things at the face value without weighing the underlying facts.

Just before the dust settled on the grisly killing of Virginia Nyakio, the wife of the outlawed sect’s jailed spiritual leader Maina Njenga, and her driver, Mr George Njoroge, Maj Gen Mohamed Hussein Ali’s killing machine struck again just yesterday (Monday) afternoon.

The latest victims, Mr Charles Ndungu Wagaca, the chairman of the Kenya National Youth Alliance (KNYA), and his driver, Mr Naftali Irungu, died in a hail of police bullets on the Nairobi-Naivasha highway near Uplands.

Mr Wagaca was a brother of Nyakio, the wife of the outlawed sect’s jailed spiritual leader Maina Njenga, whose execution, plotted by Maj Gen Ali’s newly-formed Eagle Squad, early this month sparked riots by Mungiki adherents in Nairobi, Central and Rift Valley provinces.

Kumekucha wishes to reiterate here that it does not condone or support in any way the activities of the dreaded Mungiki sect or its political wing, the Kenya National Youth Alliance (KNYA), or any other person bent in breaking the laws of our beloved country – be it criminals, the political establishment, security agencies or any other individual. The Law of the Land makes all of us equal and those who bend it should be severely punished as per that law.

Our concern, hinged on sanctity of human life regardless on who is involved, is the primitive way the Kenyan police, under the stewardship of Maj Gen Mohamed Hussein Ali, have chosen to transact official business in the recent years under the guise of fighting run-away crime.

The Kenya Police is part of the disciplined forces and its officers, right from their commissioner down to the constable, are supposed to uphold the rule of law and not to resort to the rule of the jungle. Under Maj Gen Ali, the Kenya Police has killed more Kenyans – whether criminals or innocent – than the combined tenures of post-independent police commissioners.

The way the Kenya Police has been conducting its business since Maj Gen Ali was appointed commissioner begs serious fundamental human rights questions - What is the difference between the police now and the criminal gangs they are mandated by law to apprehend?

For readers who might not be in the picture, the only way Maj Gen Ali seems to have perfected under the guise of fighting crime is rounding up suspects – both real and imaginary – and executing them in gangland-style. The police are only one wing of the criminal justice system. What’s the use of having courts, the AG’s office, prisons, lawyers, the prosecution etc if Maj Gen Ali’s kind of policing was to be tolerated in our civilised society? It means the police can declare you a criminal and execute you with impunity!

The police declined to take responsibility after Monday’s killing of Mr Wagaca and his driver. If Maj Gen Ali thinks that his actions and those of his officers are within the law, why doesn’t he take responsibility to such executions? Why wouldn’t he take responsibility for the killing of more than 4,000 youths who were rounded up from their homes by his officers and executed without a trace of their bodies last year? Why can’t he take responsibility for the primitive killing of Nyakio and her driver if he believes he was operating within the law? Aren’t these acts of extreme cowardice from a man entrusted in the security of 33 million Kenyans?

Kumekucha has established beyond any reasonable doubt that Monday’s executions in full public view were carried out by the Eagle Squad, an elite unit that was recently formed by Maj Gen Ali to replace the Kwekwe Squad. In keeping with their tradition of covering up the evils and acts of gross abuse human rights by Maj Gen Ali, the mainstream media – TV stations, radio stations and newspapers – opted not to directly tell their views, listeners and readers that the executions were carried out by the police. Why? Because Maj Gen Ali is in bed with a cross-section of top media managers – which was facilitated by his girlfriend and proprietor of Kameme FM, Ms Rose Kimotho.

A man who witnessed the executions could not describe it better: He told journalists the killers identified themselves as police and that ‘‘they looked like thugs.’’ Why should a disciplined security agency want to disguise itself like criminal gangs?

There is no doubt that Maj Gen Ali has a firm grip on the media in Kenya and he has a free hand to dictate the crime and security news, most of which are distorted, Kenyans and the world get from the Kenyan press.

On the executions, crime journalists have happily reported the lies from Police Headquarters suggesting that the killings were carried out by rival Mungiki gangs as a result of a leadership split in the sect. What nonsense is that!

Responsible journalists all over the world owe their loyalty to their readers, listeners and viewers and not to the news-makers and interested groups. Responsible journalists don’t just publish or air any lies just because it has been said by a news-maker. They owe their readers and listeners the truth and not cheap lies aimed at diverting public attention.

Before Monday’s killings, people close to the slain victims told journalists that they were being trailed by police vehicles. So, why have journalists let the police off the hook?

A farmer who witnessed the killings from his farm said he approached the crime scene and the killers identified themselves as the police. When a journalist asked him how they looked like, he said: “They looked like ordinary thugs but were confident ... they seemed very happy after accomplishing the mission.”

Why should a disciplined force stoop so low and behave like highway robbers? Kumekucha has previously reported how members of the Eagle Squad camouflage themselves like Mungiki. They kill Mungiki-style and they use car hire vehicles instead of police cars.

The earlier it dawns on Kibaki’s Administration that Maj Gen Ali was a liability to his Government the better. Security agencies worldwide invest heavily in intelligence gathering to pre-empt crimes before they are committed. But Maj Gen Ali’s poor leadership has killed vital agencies like the CID, which was once rated second in Africa, and the police have been left to do the chasing after criminals have done their act and taken off.

In a desperate move to appease his political godfathers and to be seen to be working very hard, Maj Gen Ali has perfected what he knows best – the power of the gun. Thanks to Maj Gen Ali, morgues and the entire funeral industry across Nairobi, Central and Rift Valley provinces have been doing a booming business while wild animals in Ngong Forest and Tana River crocodiles have never had a shortage of nyama za binadamu!

Guns alone will never end crimes from our streets, highways and homes. The police in Kenya have been killing robbery suspects for more than a decade and this has not driven criminals off the streets or deterred new ones. In the same argument, if last year’s executions of more than 4,000 youths was effective to wipe out Mungiki, we would not have seen any of their members blockading roads the other day.

The elimination of mungiki and other organised criminal gangs from Kenya requires a more intelligent approach rather than the chest-thumping tactics employed by the military-minded Maj Gen Ali.

Instead of perfecting the art of gangland executions and killing the institutions he found in the Kenya Police in a desperate attempt to undermine his would-be successors, Maj Gen Ali should use the top brains in the force to come up with a long-term strategy to gather intelligence and pre-empt crimes.

Where else in the world would the police be caught napping like what happened early this month when Mungiki criminal gangs staged a massive protest in Nairobi, Central and Rift Valley province paralysing road transport and other businesses for a whole week? Had that happened in countries with visionary political leadership, Maj Gen Ali, NSIS Director General Brig Michael Gichangi, AP Commandant Kinuthia Mbugua and other heads of key security agencies would have been sent packing that very morning.

As long as we have a visionless president and who is in office on the account of stolen presidency, Maj Gen can sit pretty tight in his posh office and carry on with his evil acts of painting Kenya red with human blood of real and imaginary enemies. Maj Gen Ali can take solace in the face that we have a president who runs the country on an auto-cue leadership similar to the art pilots use to fly planes. Kibaki hears and sees no evils. He just wanted to be president of the Republic of Kenya and he achieved his life-time political dreams.

Maj Gen Ali should lead a civilised police force not a band of serial killers under the guise of fighting crime. It’s time human rights groups applied pressure on the international community to have Maj Gen Ali charged at the International Court with Crimes Against Humanity.

Now, if you have read some of ma comments, u would know where I stand in many issues u have raised here.

Firstly, let me state this, criminal law is not for criminals. That being said, we are all potential guests of State at any time before we die. Flowing from this observation, our criminal law and procedural aspects of it, must be humane so that if any of us finds himself as a State guest, we will be able to live with that system.

Unfortunately, in Kenya, we have for too long assumed that criminal law is for criminals. As a result, we have devised criminal laws both in substantive and procedural aspects that we cannot live with. There lies the tragedy of Kenya.

Secondly, as concerns ua article on the killing of Mungiki leader, I commented and said ua theory is easy to prove. Simple, we can examine that lady's body to find out if there are any semen in her. Thereafter, we can examine her drivers's DNA and see if they match. Once that is done, we can now investigate whether it was consensual sex or not. That is not dismissing ua theory, it is shining some light on it.

Thirdly, in the last murder u have written about, I have no facts to argue on ua side or the side of the police. However, for u to claim that u have PROVEN BEYOND REASONABLE DOUBT that the police killed him betrays ua lack of knowledge on the meaning of that term as used in courts. For instance, the fact that someone claimed to be a policeman, does not in any way prove he was.

Could it be that Mungiki infighting that has resulted in cultlike murders are indeed responsible and simply claimed to be the police in order to deviate attention from an upcoming insurrection?

The eye witness could be an accomplice and the fact that the Police seem to have failed to establish facts of most crimes committed by this gang, it would be premature, in my opinion to simply heap blame on the Police.

Now, I'm not one to condone Police malfeasance, but it is apparent the the security apparatus in the Country is in need of some major overhaul.

Scotland Yard ought to be seconded to revamp this medieval outfit of 'prefects' because true failures will be the bane of a balkanized society and business, tourism and general commerce will grind to a halt.

It is imperative that facts are established. It is imperative the the current police spokesman is replaced. It is imperative that the office of the President acts to establish a force that is indeed out to serve. It is also therefore imperative that Maj.Ali is replaced and the role of the commissioner changed to that of Commissioner General, subject to Parliaments authority hook, line & sinker.

The law, at least in Kenya, is biased. Wanton disregard for the court system is an act the 9th Parliament Perfected. We are simply reaping the fruits of ignorance and our inability to derive more from an open society.

We must demand accountability and it better start with the continued and effortless agitation of a New Constitution.

Correction; Rose Kimotho is not only the owner of Kameme FM, but also together with Jeff Koinange the owner of the K24 channel, both of them Kikuyus. Interesting team between Maj. Gen. Ali, Rose Kimotho and Jeff Koinange (newphew of the infamous Mbiyu Koinange implicated for the killing of Tom Mboya, JM Kariuku and others, and grandson of Senior Chief Koinange, implicated for the killing of Chief Waruhiu). Kenya is really facing an interesting future.

When you combine fact and fiction it becomes very hard for me and any other reasonable poster on the blog to avoid dismissing you article in totality without regarding an absolutely spot on finale.
The allegations you make are very serious. However, there are no facts in you story that can stand the test of reasonable doubt. No plausible shred of evidence to support them. That our police are brutal, daft, in bed with criminals is nothing new. After all statehouse is occupied by a murderer. We live in a criminal society.
But, as I pointed out in your last sensationalist article.(When Nyakio was murdered) Your claims of police compliance are just as spurious as spurious can ever be.
Lets take the claim of 4000 youths dead. With some claims of over 10000 dead or missing. I pointed out that such a large number of people can not go missing without some one noticing. Provide a list of this people, who are their family members? My assignment to you and all those human rights organizations making the claim is this; Please put names and faces behind the numbers.
I further questioned how you can dispose off that number of people, the claim that wild animals ate them are so ridiculous that only a child can believe them. There are not enough scavengers in Nairobi National Park to eat such a large number of people. After my last challenge I see you have added the crocodiles in Tana River. I tell you this; The animals are innocent, because the numbers are fake'. I guess next you will add the sharks in the Indian Ocean. Have police killed Mungiki members, yes, they have, but not in the numbers you claim.
Claims that police killed the last Mungiki criminal are not true. It is mungiki infighting over money and nothing more. The downfall of Mungiki will be money.

However, if the two people killed are true abiding Mungiki fellas, then the ten bullets pumped in their bodies was not enough. The way I see it, any captured Mungiki should be forced to swallow a live grenade…with a timer to explode only when it settles in the stomach.

Chris, the police, just like the other the 'arms of law', is broken. Taking Mungiki to court is a waste of time. Taking then to Kamiti is simply providing them with state security and tax payer funded lunch and dinner. Maina Njenga is still issuing orders to kill and maim while behind bars.

The only solution, it seems to me, is executing these idiots….gangland style that is. You see, you must never forget that we are dealing with a bunch of sophisticated extortionists, murderers, rapists, tribalists and female circumcisers.

Your are too quick to see a police shadow behind every bush. You are also fond of kicking around legal terms without any due regard to their meanings. Do you know "beyond any reasonable doubt" is the highest level of proof humanly possible in any legal system? So far, there is nothing in the public domain to suggest who was involved in taking justice to these mobsters. Nonetheless, I hope that whoever was involved can also pay a visit soonest to the Murang'a Mungiki regional coordinators who were responsible for mayhem two weeks ago.

Anyway, legality of your claims aside, it beats any logic why you are quick to defend any criminal who terrorises the Kikuyu people. I vividly remember in January you celebrating the so called brave Kalenjin thugs who were terrorising innocent peasant Kikuyus in the RV. Now, you are busy championing the cause of the Mungiki imatating the example Raila set recently. If you care so much about human life, where were you two weeks ago when the same thugs were terrorising huge sections of Central Province. For us who have lived under the mercy of their machetes, our concern is not that some Mungiki kingpins and their wives are dead, but that too many of them are still around and Gen Ali has not smoked them out yet. Yes, we should condemn Gen Ali for being too slow in extinguishing the lights of these gangsters. That criminal gangs can give interviews on TV and go and sleep in bed with their wives in peace is trully an affront to a modern day society.

Before you start pointing your finger at the police, Chris, you ask youself why after ODM start getting involved with Mungiki all of a sudden top Mungiki leaders start being rubbed out.

listen if a had a child and that child got into bad company and started stealing?? I would expect the police to catch him and jail him - but not execute him!! because there is the law for all kenyans
as a parent who loves my children no matter what- if i found out that the president had ordered an execution of my child! i would dedicate my life to do the same to his- eye for an eye- that is my believe- i would not turn over and mourn and forget- never !!i would go for where it hurts him most his kids plus grand children- 6foot under just like my child!!

Either you are lying about the numbers or these were true thugs the Kikuyus would have liked done away with much earlier. When it comes to Mungiki, I am sorry to say that Chris you have become like any other down-town NGO in Nairobi soliciting for funds from foreigners in the name of alleged dead Mungikis. I think Chris has stated that "kumekucha has established beyond reasonable doubt" who killed these mungiki leaders. Evidently some lawyers (and wannabes) are distressed by the holy term "beyond reasonable doubt" used only by the very best when closing an argument. however none has asked what evidence this is or cared to see what that evidence is. and then again who is the judge of what qualifies as irrefutable evidence.

I think Chris, Phil, Taabu and many other Kumekucha bloggers, are not here to gloat over murder or crime, but to raise and expose issues that are wrong and hopefully spur all of us to work together to strengthen institutions that should provide for our security and well being, and not promote these cheap 40's Chicago mobs and Al Capone gangster episodes whether by criminal mafia or screwed up police efforts. Let it be clear that we expect full process of law to be followed or else provide arms to every Kenyan and it becomes a free for all society

I also find it odd that there are people who come back here time after time to discredit the reports provided here, it totally defies logic for someone to repeatedly visit a forum where they do not agree with the content unless of course there are other ulterior motives. Its much better the appraoch by Mwarang'ethe, Fave and a few others where specific questions are raised for the author to table proof on vague aspects or clarify specific parts of a story.

One question raised is that of the number or mungiki/youth actually put away by this squad, lets say its not 4000, lets say its 400 or maybe 40 or even 4, does that make it any less of a problem. How about the number of people killed by mungiki is it 2 or 20 or 3000, does it make it less of a problem i.e if the numbers are small enough then its ok to cull a human population? This is as sickening as it is absurd.

Thanks for my understanding my questions. Chris, appears to be pissed. But, that will not deter me from examining the facts presented and asking questions. I do not think the blog is inaccurate but rather untrue.

But, my questions and concerns remain reasonable. i.e. how can over 5000 people disappear without trace? all me and others have asked is show as the names and faces behind this youths. Everyone has an identity. Saying that wild animals ate the bodies is spurious at best.

Until the day when a Kenyan motorist can confidently go to court to dispute a speeding ticket, I say, kill all Mungiki in sight. Those who callously desecrate the sanctity of human life do not deserve the right to waste tax payer money through lengthy court trials.

Kenyans should be glad to have our very own version of 'chemical Ali' in the form of our police commissioner.

i agree the one big problem in kenya today is the failed institutions, and every day that passes by more institutions are joining that graveyard. what can we do to stop the few remaining (you really need to look for a needle in a haystack) from heading to the grave yard and then work on resuscitating those already too far gone.

clearly our grand plans to bring in RAO to sweep clean have been hit time and again by kibaki-ists. we are now mark-timing yet more institutions are going down the toilet. For every failed/failing institution, at least 500 Kenyans get hurt one way or another and KES 5 billion goes down the drain.

(I threw some numbers in since we seem to have issues with quantities but they somehow get more attention)

Clearly the method from the top is not working and has not worked for 45 years since independence. We have to start from other angles and I suggest the citizens who in turn should impress on the public officers and so on. I long for the day when a simple clerk refuses to hand over or process a certain document to the governer of central bank or even minister of finance (lets say Amos Kimunya) because due process has not been adhered to (corruption), and does not get fired or fried but the big man gets reprimanded. Oh dear my space craft has landed from the moon and right here in front of me is kvu2 wolfing a steak and asking why he should resign when he hasn't killed anyone

i know where you are coming from- but have you forgotten how many people have disappeared from their homes are loved ones since 2002-2008 without bodies being found- or some parts of bodies have been found - the ngo`s and independent search engines in kenya have been going to most of the mortuaries before the bodies are damped in mass graves- yes you have heard right kenya has mass graves- the many un identified bodies laying in most of the mortuaries and nairobi!! I believe they should exhume all the mass graves and bring in the forensic experts but yet again- how many of our people go to the dentist- how do we identify this bodies!! blood or tissue testing i think- but does kenya have that!

the people who have been committing all this crimes namely the police and their bosses knew they could get away with all this executions and murders- but i hope now things have changed and we will not see more than 10,000 kenyans die in vain!!
