Protocol Fiasco: VP Should Stay Away

For far too long now, this country has been treated to the tired old line. Constitution says this, constitution says that, blah blah blah. It is so ironic because the same constitution, everyone agrees, is responsible for a myriad of problems facing the country and is actually overdue for a major overhaul.Because of the same constitution, the electoral process has always been tipped to favour the incumbent and in 2007, ECK's Kivuitu took full advantage of a constitutional vacuum to declare Mwai Kibaki as president.

It is my considered opinion that Raila Odinga and ODM are not in anyway obligated to participate in peace rallies organized by President Kibaki. But by graciously accepting to do so, some PNU politicians are already mistaken in assuming that ODM must see to it that IDPs are re-settled. To make matters worse, the minor protocol incident between the Prime Minister and the Vice President has already resulted in the IDPs saying that they will not return home. In these peace missions, it is now apparent that the VP is a heavy liability rather than an unifying asset and his attempts at gaining relevance is producing reverse consequences.

Perhaps we ought to listen to Rift Valley MPs who are opposed to this hurried resettlement missions. The fact is that IDPs were present in Kenya even before the post elections violence broke-out; but it never received presidential attention. That’s right folks. The period between the 2005 referendum and the 2007 general elections saw Kenya become home to an unprecedented one million IDPs spread all over the country. This is the highest number of internal refugees anywhere in the world for a country not at war. I did not for once hear the Kiunjuris of this world insist on immediate resettlement of these hapless Kenyans. As presidential candidates, Kalonzo or Kibaki never bothered to highlight the plight of these forgotten citizens the current ODM MP for Mt. Elgon was nominated to run for the seat while in police custody on trumped-up charges. As head of state, and commander in chief, the president himself has never concerned himself with the state-sponsored insecurity that existed in some of the violence hotspots like Mt. Elgon, Kuresoi and Molo. It has not escaped anyone’s attention that because the majority of these so called IDPs in Rift Valley are from a certain ancestry, it has suddenly caught the attention of the powers that be we actually have Kenyans who are living like refugees in their own country. As we speak, the government is at war with its own citizens in Mt. Elgon through a massive military operation. Do you see where Hon Kapondi, Hon Ruto and Hon Bett are coming from?

Back to the current peace mission in Rift Valley, it is an open secret that DULY ERECTED Kibaki would never have attempted to embark on a peace tour without the POLITICAL SHIELD that is Raila Odinga. After being forced to a agree to share power with ODM, the PNU coalition partner is using the discredited constitution to once again politically undermine the ODM by purporting to rank the Prime Minister as a junior to the Vice President. As the PM rightly told the President, these sort of juvenile games are what is creating problems kule mashinani (at the grass roots). The people know that the VP happens to be a miserable presidential candidate who was resoundingly rejected at the polls. The two leading contenders amassed votes that were more than TEN TIMES what the VP got. Now, now, the constitution says that this is the individual who will automatically take over power should our current president become incapacitated. God forbid!

Regardless of what the constitution says, the facts arising out of the unique circumstances of early this year are;
  • The 2007 presidential vote was heavily discredited and even the ECK cannot ascertain who the winner was. (One political party known as ODM-K, unashamedly supported the release of disputed presidential results).
  • Two political parties (ODM/PNU) signed a peace accord to create a grand coalition as equal partners in order to make this country governable.
  • The VP and PNU ’half loaf’ cabinet remain answerable to the President and serve at his pleasure, while ODM ‘half loaf’ cabinet serve at the pleasure of the PM who is only answerable to parliament. How then Raila as PM be subordinate to Kibaki's 'servant' so to speak? My understanding is that Raila’s ODM and Kibaki’s PNU are EQUAL partners.
  • The accord says that the PM shall be the leader of the party with a majority of MPs in parliament. Unfortunately, some civil servants who should have retired when Moi and KANU were ousted from power, want us to believe that the VP is above the PM. The VP himself can hardly say he commands loyalty from his 15 ODM-K MPs.
  • The recently released CAPF report on political parties election funding indicates that although the VP’s party was the lowest in terms of expenditure….its sources of cash were from former president Moi, Uhuru Kenyatta and George Saitoti amongst other 'ghost donors' – all of whom endorsed and strongly supported the candidature of PNU’s Mwai Kibaki. The ODM-K and its candidate never had any intentions of being elected to rule this country but rather to withhold votes that would have naturally ended up in favour PNU’s opponents. A further proof of this was the party’s disgusting behavior in the election despute and its hastiness in jumping into bed with PNU for purposes of blackmailing the president to part with the vice presidency and cabinet positions in order to obtain legitimacy. Puuuulease!
I wonder which brew intoxicates some of these PNU geezers. As the country tries to undo the sad consequences of Kivuitu’s irresponsible actions, the President must forthwith stop politicking with the resettlement of IDPs. In any case, the two grand coalition partners are EQUAL and should be the ones to make these peace missions on the ground. The VP’s presence and antics only helps to re-open old wounds and prolong the agony of IDPs. The IDPs quagmire requires political statesmanship, comprehensive land reforms as well as sustainable homeland security. I personally do not see Vice President Kalonzo Musyoka making delivery or even having a role to play in any of these! And this is not just me, the IDPs themselves have booed and jeered him severally at separate venues. Is anyone listening?

ODM's Rift Valley MPs have said the return of IDPs is conditional - it is unclear whether these demands apply jointly or severally - on the release of participants in the electoral violence; the re-installation of the DCs and other civil servants who failed to anticipate or stop the violence; a general amnesty for participants in the post-election violence; the appointment, siting, and publication of the findings of the TJRC; extra Ministerial positions for favoured sons of RVP; the sorting out of a comprehensive national land policy; and the sorting out of a comprehensive national resettlement programme. Meantime, cholera has broken out in some of the camps.

    Is Kalonzo responsible for politicising the IDP issue? No. Go and do something useful with your Sunday.

    You see the peace rallies have just started this week. Already, even before we have a chance to see what positive effects the rallies would bring, the Kalonzo rank-above-PM-fiasco is overshadowing the main mission of the principals. The immediate repercussions of this is that IDPs have rejected calls to go back to their homes. I dont blame them. If unity is still a mirage at national level, then it cannot be a reality at the grassroots.

    What about the IDPs who existed before the elections, are they not Kenyans? Or to you Mr. Waweru, IDPs ni wale wa Eldoret na Naivasha na Molo? There arew IDPs everywhere and I sincerely hope the president will make time to visit them.

    I suggest you drop the think ethnic suit and the KANU/mungiki coloured flag, then you will see that other Kenyans have also a right to land and equal opportunity in this country - stolen elections or not.

    Is Kalonzo responsible? YES and a very big YES. If only he had led his party to reject or speak against Kivuitu's fake results, more than 1400 Kenyans would still be alive and hundreads of thousans would be in their homes tilling their farms in this rainy season.

    I agree with everything you have said in your post but most of all i gotta tell you i really enjoyed reading it, the writing skills i mean...very nice for a sunday morning.

    what purpose does kalonzo serve in visiting the IDPs....nothing!! he adds no value to kibaki and he's not even scoring himself any points...people are booing him all over the place and he's just intent on proving he has higher authority than raila....what a foolish man!!

    the worst bit of all is that the people being embarassed by musyoka the looser's antics are kenyans!! but with foolish advisors on his side like mutula kilonzo what do u expect? did someone say mutula was a great lawyer? i wonder!!....if this reasoning is the kind of greatness we are talking about then take me to a river road type lawyer anyday!!

    well, about resettling IDPs mbio mbio i would advise people against it and would implore them to think about it and to think about it well.....otherwise we shall be back here before the end of this year especially if things continue like this! let land issues be addressed first....it is common knowledge kenyatta and friends stole land from kenyans, now guys want to sweep all these under the carpet yet its the root of our problem!

    in any case, if i was an idp...i dont know if i would ever want to go back to the riftvalley to live with people who killed and burnt people, evil people who laughed and chanted when they watched people burning!! i really dont know (sigh).

    DW, that is a really condescending attitude towards people you disagree with. Do you expect people to engage you in meaningful debate if you keep throwing these types of remarks?

    You can learn from Karua's experience after shouting herself hoarse that we should go to court as per the constitution yet the same constitution is the main cause of the problem we found ourselves in. What did she get in return? Outwitted by Annan and denied the coveted seat of DPM by the person she thought she was fighting his corner.

    I support your view that Raila should not in anyway participate in the current IDP saga. It is a no win situation. He should not take the cross from Kibaki and co. He seems to be providing cover and comfort for the dictator.

    Least we forget,the current IDP problem is a political one, so it can not be politicized because it is a political problem in the first place. Just to remind you, it was brought about by a stolen election. In my eyes and the eyes of many, Kibaki is illegally in office. When Kibaki mouthed this statement during his tour ''This is no way to live,'' Kibaki told the IDPs at Eldoret. He should know the moment he stole election he was responsible for what happened. He should not be so hypocritical and aloof at the same time. It is 4 months later, does he think the IDPs have been on a picnic in the park.

    We can forever moralize about IDPs, and they sincerely exist in the most horrible of conditions. But, you can not legislate love, and good neighborliness.
    The current problems started at the moment Kenyatta set up an ethnic based government after uhuru, we have consistently gone off track and now we find ourselves in failed nation state, in the neighborhood of Somalia, yet, we had wanted to become Singapore. We have to go back, look deep into ourselves to solve the current problems.

    It is going to take unique leadership and political artistry to solve the IDP issue. But,as I have advised RAO before on Mungiki, I do the same about IDPs, 'Stay away from that very intractable issue'

    Find a life to lead. It is not all about politics and hero-worship. THere is also God to praise on a Sunday, than writing things that make no sense. It is all about reconciliation and the major players in the government are the top-five. You cannot exclude Kalonzo, the same way Uhuru Kenyatta with his paltry number of Kanu MPs in parliament or Harun Mwau's single slot. They are all Kenyans and we are all in it. Oginga Odinga served in the Ministry in 1963 as kenya's first VP and the calamity that is him still haunts Kenya to this day. Gave away the presidency to kenyatta, endorsed Moi, took Patni bribe, split Ford and many more... Please hide your IGNORANCE. By the way, when are you going to UHURHU PARK FOR THE SWEARING-IN FUNCTION in an ODM kitenge?

    Well, myself I am seeing the red right now on the effect of our very own Kimi Raikkonen. Hats off to you Kimi, the weekend belong to you! But don’t count the lad from Hertfordshire (Lewis Hamilton) out just as yet. See you in Istanbul in two weeks time.

    Back to the issue of VP and PM, why does it matter who is who? Is it not the peace and unified state we want?
    Kalonzo, Judas has he is dubbed now, is as important as the PM and the President.
    My theory is, if Judas did not betray Jesus, we would never had a saviour. ODM must see this betrayal as a blessing in disguise.

    This DECEPTION that selectively crops up with kabita backing won't fool Kenyans. When Masaais and Saboats are evicted they are ignored and title deeds issued in Moi era are mere piece of per. Contrast that with the value attached to deeds issued during Kenyatta's time and see the blood chemistry.

    Kenya will never be same again, NEVER. Fooled once by Jomo and twice by Kibaki, NOT AGAIN. PEACE can only be CULTIVATED and not LEGISLATED.

  18. the powersharing was btwn odm n panu , kibaki is the leader of his panua and raila of odm , so kalonzo is suboirdinate to his boss while raila is his own boss and subordinate only to parliament and the constitution, you dont have to be a genius to see that this is a non issue , kalonzo is not at the same level as raila.

    Independence however did not bring justice for Kenyans - certainly not for the Mau Mau veterans. Kenyatta, even before being sworn as president in1963, had denounced the Mau Mau as terrorists. Contrary to British propaganda, Kenyatta was never a member of the Mau Mau. In an interview, Muthoni Wanyeki, Executive Director of the KHRC, said that:

    "On coming to power, [Kenyatta] proceeded, through the land ownership policies(and practices) of his government (and himself), to betray everything that the Mau Mau had stood for and to entrench the landholding patterns established under the colony"[1]

    It is not a surprise that Kenyatta by the early 1970’s had a few detentions and assassinations under his belt. In the words of politician J.M. Kariuki (assassinated in 1975), Kenyatta created a nation of ten millionaires and ten million beggars. He wanted the Mau Mau platform of Land and Freedom erased from Kenyan memory.

    In 1978 President Moi took over when Kenyatta died and continued with the same dictatorial policies. Irony is such that in 1982, Mau Mau historian Maina Wa Kinyatti was imprisoned by the Moi government in the same Kamiti Prison where the British in 1957 hanged and buried the leader of the Mau Mau, Dedan Kimathi, in an unmarked grave.

    But more important than a hero's acre or a monument is a reckoning with the colonial legacy of torture, dehumanization and pauperization.


    Mau Mau veterans that are still alive, along with their children and grandchildren, live in abject poverty, landless and without formal education (THIS ARE NOW THE IDP'S IN MOST OF THE CAMPS TODAY)

    kibaki, uhuru, moi have enough land to settle the idp's(mau mau veteran's families between them- this is rediculus!!

    the extended kenyatta family alone owns an estimated 500,000 acres — approximately the size of nyanza province — according to estimates by independent surveyors and ministry of lands officials who spoke on condition of anonymity.

    The kibaki and moi families also own large tracts of land though most of the moi family land is held in the names of his sons and daughters and other close family members. Most of the holders of the huge parcels of land are concentrated within the 17.2 per cent part of the country that is arable.

    The remaining 80 per cent is mostly arid and semi arid land. In fact, according to the kenya land alliance, more than a half of the arable land in the country is in the hands of only 20 per cent of the 30 million kenyans.

    That has left up to 13 per cent of the population absolutely landless while another 67 per cent on average own less than an acre per person.

    trouble is, we had a majimbo constitution at independence. The rise of a party-state in kenya: from “harambee!” to “nyayo!” that kanu “urged central control of all regions in an effort to forestall local majimbo legislation restricting land transfer to those born in the area, and to maintain the foothold of the party’s kikuyu supporters in the rift valley land market”.

    Many settlers were returning to britain. Kenyatta and his cronies quickly formed the settlement transfer fund schemes (stfs) and asked the british for a loan to the kenyan government, to buy off land from colonial settlers returning to britain.

    Good idea up to this point. Britain, having been reassured by kenyatta that those settlers still wishing to stay on in kenya would not have their land repossessed, advanced the money. This money was used to buy settler land which was officially sold into the kenyatta initiated settlement transfer fund schemes (stfs).

    next, kenyatta began to give away and sell for peanuts, these government (stfs)-acquired, former colonial land parcels, to himself, his family and cronies around 1964 and 1965. This is the point when the rain started beating kenya. Kenyatta’s then vice president, jaramogi oginga odinga, cried foul and rejected these acts of wanton land grabbing.

    the opportunity to choose nationalism and selflessness over greed and ethnic tendencies was lost. Rather than address this land issue once and for all, kenyatta opted to replace the settler colonialsist in land they had initially grabbed from natives. We have began harvesting the seeds of the mustard sown by kenyatta in the 1960s. It will not be sweet at all.

    the seroneys and other nandi and kipsigis leaders immediately cried foul when kenyatta ensued in his land grabbing tendencies. So were many maasai and miji-kenda leaders like ronald ngala. Their cries were feeble and over run. Today and tomorrow, their descendants will demand justice and restitution in an exercise that threatens to tear apart kenya’s social fabric. who will shoulder the burden of the fruits enjoyed by kenyatta and his cronies, moi and his cronies, and kibaki and his latter day cronies? will it be the poor kenyan taxpayer taking the bill in form of blood, and more taxes?

In the immediate post-independence era, the moment, the seroneys and ogingas started crying foul, and nothing was done, we entered a dangerous phase of our nation’s socio-political path. The political leadership of kenya began carving out into two distinct groups.

    The pro-kenyatta land beneficiaries, sycophants and apologists where daniel moi, paul ngei and others trooped towards,….and another force resisting the greedy post-independence governance by kenyatta which was led by jaramogi oginga odinga, and included several former kadu operatives like ronald ngala, jean marie seroney, masinde muliro, martin shikuku and others

Phil I support your arguments fully but let me be very clear by those who are naive and almost stupid thinking that you can resettle Kikuyus back to Riftvalley by force-by using the security forces..this wont just work unless you will provide security to each kikuyu household for the next 10 years..

    Its ironical that Kibaki and some Kikuyus are preaching peace and reconciliation but at the same time insisting that kalenjin sons and daughters arrested in the electoral violence MUST be prosecuted.Now this is the highest level of stupidity and naivity..You cnat tell Kalenjins to live as brothers and sisters with Kikuyus but at the same time jailing thier sons and daughters on something that was directly influenced by the same stolen election that we want to put behind us.It wont just work..

    This is the way forward:Release all those who were arrested due to electoral violence(remember the mai thief who caused these violence is in office as President),secondly start a dialogue with kalenjin elders on resetlement,third start resettling Kalenjins who were evicted from Mau Forest too..Kibaki must listen to the Kalenjins in this resettlement issue or else there will be bloodshed soon..and the sufferers will be Kikuyus again..

    You dont reconcile people using arrogance..tribal hatred..and still think that you will succeed..It wont work Kikuyus...

    Yaani they have shared the spoils now nobody is talking about the talks for long term solutions. They dont give a dime now that they have gotten themselves what they wanted, and what do we kenyans do? Follow them like mbuzi, forgetting with them. We want an article here about the talks for a long term solution in the country.

    We also want an article about the Dominion saga. All the mainstream media know the names of the politicians who demanded bribes and then are frustrating this group.     Prosecution to post election violence perpetrators is unconditional. They broke the law and thus MUST be dealt with in full force of the law. Stolen election or not, thou shall not kill. As a matter of fact the death penalty should be made applicable.

    This is not the same kenya Martha Karua allowed kibaki to execute people without a day in court!!

  27. Phil, I have to agree with you. IDPs are IDPs, whether they are Kikuyus or not. The other IDPs should be resettled as well. I have no sympath for the Kkuyu IDPs alone, I sympathise with all. And they are no better. Raila should also be careful and resist to be dragged into this saga. Ad for the issue of protocol, everyone now says it is upto the president etc.. I am no surprised coz I know Kibaki is as powerful as he were and the Act didn't change much, but for the sake of peace. It is going to be a rough terrain in front but we hope for the best.

    Anon 9:58am raises a very pertinent point. We are the only nation where evidence is available on video showing crimes such as murder and aggravated assault and we do not make an effort to prosecute those individuals. Yet we want to prosecute others (Ruto) based on rumors and spurious claims!
    The first act of violence was stealing our democracy by the dictator and he is should be the first to be prosecuted.

If Karua and other Kikuyu leaders feel that PRISECUTION goes with Reconciliation then prosecute the MAIN election THIEF who is Mwai Kibaki and Samuel Kivuitu..and Mungiki...see u cant prosecute Kalenjin sons due to an electoral violence that was triggered by Kibaki theft and at the same time ask kalenjins to view kikuyus who will be resettled as BROTHERS AND SISTERS..It wont just work..and soon there will be bloodshed again..

    Secondly you must also resettle Kalenjins displaced from MAU FOREST by Michuki in 2005..everyone is important..Its useless prosecuting ordinary citizens while KIVUITU is earning tax payers money everyday and he is the one to blame for the election fiasco..Kenyans wake Up..wake up...

  33. SECOND UHURU PROJECT DEAD IN THE WATER..Phil I think you should write about this..I wanted to but I cant post in Kumekucha..The Gema are already looking forward to 2012 with Uhuru as their flag bearer but this project is dead even before take off...

    First Uhuru has no base at all that can propel him to the Presidency..haveing lost Rftvalley..he only remains with Central..taking the 2007 elections..we have proved that you cant win the presidency with central alone no matter what..thats why Kibaki lost and mark you he was an incumbent..

    Secondly,Uhuru Kenyatta chances will be hurt by the same Kalonzo Musyoka who will stand anyway..he will not agree to run as Uhurus second in command after being VP for five years..but again he has such a big ego that wont allow to play a second fiddle..

    Thirdly the perception to day in Kenya of uhuru is one who abandoned his role as official opposition leaders for tribally calcilated move..Kenyans have not forgiven him for that..

    Fourthly his association with the vanquished Moi dynasty will play a diadavanged role in 2012..becuase Moi will still cme out in support of the project...

    Uhuru canddacy in 2012 is dead as a dodo..Gema should look elsewhere..if they were bright enough they should have kicked Kalonzo out after the PNU/ODM deal..they had nothing to loose...
