PNU Makes Its First Move In Grand Anti-ODM Dirty Tricks

KACC Asks Mudavadi To Explain Kshs 10 Million Woodley House

The move that PNU masde this morning has been expected for months now. Those who have been regular readers of this blog will know that in the run up to the failed elections of last year and with dwindling support from Western province, this blogger was reliably informed that Musalia Mudavadi’s file was being looked at with blackmail being high on the minds of PNU operatives then.

One thing Kenyans should not forget about the duly elected president is that he has never made a decisive decision in his life. He always moves and hesitates a million times before finally making his move very late when the very effectiveness it may have had has been completely diluted. The Mudvadi issue is no exception because this writer is very much aware that it has been in the works now for a long time. Just the way William Ruto’s is still in the works.

Now after weeks of intimidating Musalia Mudavadi, the Kenya Anti Corruption Commission which is best known for prosecuting traffic policemen for taking Kshs 50 from matatu touts, has this morning moved to the high court to compel Mudavadi to appear before it to disclose how he acquired a Woodley house valued at Kshs 10 million which is in his name.

With that single move PNU have hit right at the heart of ODM in a strategy that is meant to create cracks of disunity within the ODM pentagon top brass of the party. It is yet another classic example of how justice in Kenya is so selective. The game is really very simple. Any ODM Pentagon member who dares to lift a finger will be told; “File yako pia tunangali.” (We are also looking into your file).

Interestingly in all the suspect deals that Mudavadi may have been involved in the past, those involving retired President Moi have been very conveniently ignored and the one chosen is a mere Kshs 10 million house in Woodley. Indeed it is the same reason that has helped William Ruto avoid harassment from KACC because most of his deals during the Kanu days involved Mama na Baba President Moi (now retired). President Moi, a close advisor of the duly elected president is obviously being protected and the idea is to keep his name out of the limelight as much as possible as his assets around the world are moved.

The funny thing about this is that PNU is illegally in the government and has no mandate from the people, moreover the grand coalition agreements passed through must be adhered to, thus how is this questioning being derived at. We have had "billions" stolen by the very PNU & MOI cronies and not one single cent has been recovered and nor justice has been served.

    Hopefully, ODM better have a solid strategy to counter such nuances and ensure that they are united in fighting the cause. PNU strategy in my opinion will backfire because this will open a whole can of worms, and divide the country further into another ethinic eruption.   9. If Musalia 'stole' the Woodley house then he, like pastor Paul, must relinquish. So must all thieves in ODM and PNU. That said, even the most ardent PNU apologist like the ex-Kumekucha blogger M-pesa (who will return to the dump after a few days of cooling down), recognize that the sudden outburst of KACC activities amount to political witch-hunting. In the very least, it's 'rule by intimidation'. Folks, look at the timing. These are desperate PNU moves.

    Such are the political tools of Museveni, Kibaki's new found bosom buddy. Very soon, Kenya's advocates for change will be accused of rape, treason, sabotage, carjacking…. Chris will be charged with subversion while Phil will be charged with infiltrating political houses with intent to steal secret dossiers. Luke and Ritch must prepare to go to Kamiti for writing political poems. In all these, PKW and Daniel Waweru will be held for a few days at central police cells…to make things look fair. Taabu, well, the man is safely out of the country.

    What really is your point? That he did not steal the house? He will then be required to provide necessary ownership docs. Simple. End of case. Or is it that the timing is wrong? When is it the right time to prosecute a corruption case?

    I think also every case should be looked at in its own merit. The fact that they have not succeeded in puting Ruto behind bars does not mean they will fail with Mudavadi. Again, you have failed to acknowledge recent success in repossessing Grand Regency Hotel.

    Let us separate KACC from the political tom and jerry games.

  19. Chris, u r looking at this literally. What u should be doing is looking at the behind the scenes of going after the son of Mudamba.

    Most PNU figures 9(yes even the hardcore ones) would rather deal with Mudavadi than with Raila. Why?

    1. They already know that Mudavadi is being watched by the other pentagon members but inorder to strike a deal without interference from other members, they have to corner him "within" the law.

    2. They know that Mudavadi can work easily with both ODM members and also with hardline PNU members for the simple reason he has no spine. He is just like Kibz.

    3. If (I'll repeat that again, If) elections are held today, he would be readily acceptable as a neutral person if (I used that word again) RAO and Kibz are not acceptable to the rest of the masses. (than Kalooser).

    That is quite correct. Indeed, they don't want justice at all, which is why they have feted Jackson Kibor, argued against the the implementation of the Goldenberg and Ndung'u reports, and are now threatening to ensure that RVP remains permanently Kikuyu-free .

    The argument about selective justice is mildly irrelevant. The argument is whether there is good evidence to prosecute cases of corruption. If there is, then the cases ought to be prosecuted. That other people have been just as corrupt doesn't remove one's liability before the law. And if selective justice is at stake, why can't PNU use that argument and say that none of its members ought to face prosecutiin before ODM's?

    Kiunjuri's wrong, so far as I know: only Saitoti has been cleared, and that in exceptionally dodgy circumstances. I cannot believe that a guy whose signature was all over the relevant documents was acquitted; he must have had extremely good legal advice. But, at least he went to court and defended himself against the charges. He showed some respect for the legal process, and the opinion of Kenyans. So far as I know Kiraitu has not done even that much (or little), and none of the ODMers have either (except Ruto).

    (Just remembered that Biwott went to court to have his name removed from the Akiwumi report, so some - very little, but some - credit is due him and Ruto for respecting the rule of law.)

I too like him and would vote for him for presidency, but if he took that house corruptly let his bottom sit on hot coal. Yes, there maybe an appearance of selective justice in the timing, but the "don't investigate our guy before you investigate your guy" position you endorse has kept this country choked with corruption from Mt.     More importantly, brother, I don't know how rich you are, but what you call allegations of theft of "a mere 10 million house" is a big deal to 99.99% Kenyans. I had sent to Chris (Kumekucha) all the details regarding Thabiti Bank, Molasses etc. - but it was not published because Chris did not think the moment was 'right'. Let me assure zou that I do not like this 'selective' way of communicating - on the contrary, I think that ALL Kenyans have the right to know the truth because I think that they are mature enough to distingigush between right or wrong themselves without any censureship.

    I was even more disappointed because I had sent to Chris all this information upon his expressive request!!!!!!! But then the talks between PNU and ODM collapsed and he decided that it was 'wiser' ´not to publish the information I had sent to him.

    I know, I have been accused of many things in the past - but let me assure you if there was one thing I was always pushing for it was the truth. I have sacrified mz life to tell the truth - and I do expect the same from the people I am dealing with or better, the people I have trusted to be on the same wave length. It seems that you did not see the whole handing over of Grand Regency by Pattni to the government as a political PR exercise. What KACC was doing, of course on behalf of the govt in cahoot with Pattni himself, was to make the guy as the best citizen of the year 2008 albeit the whole fiasco the guy has put the country through. Personally I would have celebrated had the guy been presented to the press in shackles because that is when justice would have have been served on behalf of the Kenyan people.

    The history is slightly dodgy: the Devonshire white paper wasn't a necessary condition for suffrage, and Kenyan Asian agitation wasn't necessary for the issuing of the paper.

    My understanding is that the Devonshire white paper was issued in response to Asian agitation and it listed African interests above Asian ones.

    Keep in mind I have a lay (and dated) understanding of Asian political history. Short of re-opening the D'Souza and Mangat, I am not sure I can respond to your last point.

    As I understood it, Kenyan Asians at the tine wished to see the end of segregation and other disabling facts of colonial life; the Colonial Office basically argued, in bad faith, that the interests of black Kenyans were paramount, so that they trumped Kenyan Asian interests. That was then used to deny Asians most of what they sought (e.g. an end to segregation). Classic example of divide and rule.

    The declaration of the primacy of black interests had some rhetorical force in later invocations, but universal suffrage came so much later that there is no sensible way to see it as a result of Devonshire. More likely, universal suffrage came as result of the desire to disarm the radical nationalists.

    And it's kind of unwise to rely too much on advocacy history for accuracy or careful historical judgment. If you only ever read that stuff, you might never discover, for example, that there were some people out there who actually disliked Kenyatta. One of the reasons for the present mess is that, outside the official school stuff, there is no consensus about the past in Kenya.

    Point taken regarding my comment that 'the real rapists are from central'. I was reacting emotionally to jaramugo's comments.

    What I meant to say was that there are a disproportionately large number of wealthy people from Central Kenya who have benefited from corruption. IMO, where convient, the likes of Pattni, et-
    al are convenient middle-men (as has been the experience of many Asians in Kenya).

    Thanks for shedding light on the genesis of the white paper. I don't know the intricacies as well as you do. Perhaps it's an indication of the absence of absolutely any record of Asian contributions to self-determination in the school curriculum that people such as myself who don't make a living reading history or law have to rely on advocacy history.

    The wife and driver of Mungiki national chairman, Maina Njenga, have been murdered and their bodies dumped in a forest.


    Ms Wambui Flora, sister to the late Virginia Njenga, wife of Mungiki Sect Leader Maina Njenga is consoled by Mr Mwangi Mbugu at the City Mortuary on Friday. Mrs Njenga and her driver were found murdered and thrown in Gakoye Forest,Gatundu, after they went missing in Nairobi, on Tuesday.

    The bodies of Virginia Nyakio, and the driver, George Njoroge, were found dumped in Gakoe Forest in Gatundu on Wednesday, a day after their abduction.

    The mutilated bodies had deep cuts in the head, neck and other parts of the body when they were discovered alongside two other decaying bodies.

    Police brought them to the City Mortuary and booked them as unknown.

    Nyakio’s body had a deep cut in the neck while Njoroge was hit several times in the head. Nyakio contested but lost the Laikipia West parliamentary seat in last year’s General Election. The other bodies that were found at the scene have not been identified. Some people abducted the two along Lang’ata Road on Tuesday afternoon as they drove in a white Toyota RAV 4.

    The car has not been recovered. Police said they were investigating the incident.

    Their mobile phones and other valuables have not been recovered. Nyakio was a mother of three while Njoroge had one child.

    Njenga’s relatives claimed yesterday police were behind the incident. Some of the relatives gathered at the mortuary to view the bodies

    A brother to Njoroge, Mr Charles Ndung’u, said police have been reluctant in investigating the incident.

    "They have not helped us at all. This is the same way people accused of being members of Mungiki have been killed by police," said Ndung’u.

    Njenga’s elder brother, Mr Peter Njoroge, said the two were travelling in a car when they were abducted.

    They denied claims that the killing could have been committed by another faction of the sect over control of power.

    Ndung’u said none of the sect adherents "can dare kill" close relatives of their chairman.

    Njoroge and his cousin, Mr Charles Waithaka, said the deceased mobile phones have been off since they went missing.

    "Their mobile phones have been switched off. We think they were attacked by people who knew them," said Njoroge.

    Njoroge said the driver had called a cousin immediately after they were attacked but did not communicate.

    Said he: "All he heard was the driver pleading with the attackers not to kill them then the phone went off."

    He said police had in the last one month been trailing members of the family.

    Kamunya said that the incident was related to last week’s police raid on Njenga’s rural home in Oroimutia, Nyandarua North District.

    "We believe that police have abducted my brother’s wife and his driver for reasons not known to us. They have been trailing the members of our family but we thought they would not go too far," he said

    Police spokesman Mr Eric Kiraithe denied police involvement, saying they are investigating the incident.

    Njenga is jailed at the Naivasha Maximum Prison for possessing a gun and drugs.
