Parliament Debates Crucial Bills

15h45 Local Time - Historic Day for Kenya

Kenya parliament is currently debating historic bills. The Justice Minister had earlier moved the motion seeking to pass the Constitution of Kenya Amendment Bill 2008. The next motion will be the National Accord and Reconcilliation Bill. Both bills are aimed at legalising the peace agreement that was signed by Raila Odinga and President Kibaki on 28/Feb/2008.

President Mwai Kibaki has just arrived (nearly two hours late) in parliament and is surprisingly occupying the seat of Leader of Government Business, and has asked Raila to join him on the government side. It is significant that Kalonzo was initially forced to move to No.3 on government front benches, but is now sitting next to Mudavadi on the official opposition benches. Both Raila and Kibaki are now contentedly seating on government side and those who were at the end of that bench have now had to move to the back bench. Is he discreetly telling us that Raila is NOW leader of government business? Only time will tell.

Earlier, George Saitoti had raised tension in the house by launching a scathing attacking on some MPs who supported violence in Rift Valley, particularly where innocent people were burnt in a church in Eldoret. (I wonder why he did not mention those who were burnt to death in Naivasha or was it an attempt to campaign for the Deputy PMs seat)

All speakers have supported the Constitution of Kenya Amendment Bill 2008 and it is likely going by the mood of the house, this bills will sail without a hitch. The Kalonzos, Mutulas, Nyongos and Kajwangs of this world are singing the same song.

The speaker reminded members that the last time the Kenya constitution was amended by parliament in 1982 when the then KANU government (outlawed multi-party) and made Kenya a dejure one party state, it took ten long painful and agonising years to undo this amendment.

For the first time in the history of Kenya a sitting president has contributed to debate in parliament. Usually Kenyan presidents just give speeches.

President Kibaki gave his lengthy contribution in his capacity as member for Othaya shortly after that of Prime Minister designate Raila Odinga as member for Langata.

I was touched by the impact this crisis seems to have had on our president's health. I have never heard him repeating himself or rambling on and on which is exactly what happened at one juncture and seemed to cause considerable anxiety on the government front benches but fascination from the rest of the house.

The president emphasized that God must love Kenya a great deal and went on to mention God more times in this speech than in all his previous speeches (since he became president) put together. He went on to insinuate that the place where the country was going before the peace deal was reached, was really scary. His excellency Mwai Kibaki also emphasized the fact that the young people of Kenya (new generation) have no room for tribalism in the way they think or do their things. He noted that this younger generation have settled all over the world and are making a huge impact in many societies, not to mention the fact that they send money back home for development and other activities.

President Kibaki caused laughter and indeed surprise when he pointed out that all that was needed to have a new constitution in Kenya was to give the whole job to Orengo (James). He added that Hon Orengo knows all that they have been discussing in the previous failed attempts to get a new constitution and was bound to come up with a document that would be acceptable to all, the president said.

The mood in parliament was one of unanimous agreement to the bill and cordial behaviour to each other. This was only broken briefly on two occasions. Firstly when in an apparent slip of the tongue Gitobu Imanyara while contributing to debate said that the rest of Africa would always measure the standards of their election against the one that took place in Kenya. There was uproar from the ODM side and even the PNU back benches and it took several minutes for the speaker to restore order. The other time was when the mover of the motion Martha Karua stood to move the motion after debate and warned against the use of insensitive language referring to member Otieno Kajwangs referring to a "stolen election" in his remarks.

Voting is now going on and although the ayes have it, since this is a constitutional amendment bill, numbers have to be verified so that the two thirds majority required to pass the bill is attained.

Parliament has voted to extend sitting beyond the usual 6:30 PM Meanwhile the first bill has been passed unanimously with all 200 members in the house voting for it. There were no nays and no abstentions. The Constitutional amendment bill has been passed and now awaits presidential accent to become law.

The Two Bills; Constitution of Kenya Amendment Bill 2008 and the National Accord and Reconciliation Bill have sailed through parliament both receiving unanimous support from the members. The first one has already been signed into law by the President and the second one is expected to be signed later tonight.

Effectively Kenya has changed forever and it is expected that even tomorrow the president could announce his new cabinet and officially acknowledge Raila Odinga as Prime Minister since the post is now entrenched in the constitution. This is hardly the time to go to sleep. Kenyans need to be as alert as ever. This is just the beginning of the long hard road to true change in Kenya.

P.S. As if to confirm my earlier story on William Ruto, Internal security minister George Saitoti told parliament earlier today that inciters, perpetrators and financiers of post election violence will not be spared. President Kibaki while attending a passing out parade for police cadets at Kiganjo earlier in the day said exactly the same thing. It seems that a major purge is in the offing. Let us now wait and see what happens.

  7. Yes, it is a new dawn for Kenya and her wonderful 42 communities. I have said it here before, Kenyans are not out to for positions politicians share but common mwananchi are crying for good government with a new constitution, equitable destribution of resouces, equal job opportunities on merit, poverty eradition and devolution of power. We are watching everything closely believing that these ladies and gentlement of the 10th parliament will deliver the wishes of Kenyans. Whether Raila is the leader of government bussiness or not does not bother me much what bothers me is the concerns of the mwanchi.

    Standing orders require parliamentary business end at 18h30. It is now about 20 minutes to this deadline and it may require the Speaker to make a ruling to extend today's historic session.

    Thanks for the updates. I am at work just getting my day started, have been very edgy but I can now get back to my stack of contracts. Great day for Kenya! Now next step, regional, gender balance in the entire government and REFORMS!

    Kenya is moving forward and folks are still talking about "putting banana peels in ODM's path". I hate to quote lyrics but from the hit song Jesus Walks "y'all need Jesus"!! If the events of the last 2.5 months aren't glaring affirmation that things have changed than I don't know what is.

    not sure if Marende was to cast a vote likely not so thats 205

    so it would appear 5 MPs were not in the house, or if Marende cast his vote, then we have 6 MPs absconding duty already.

    The President has signed the Constitution of Kenya Amendment Bill 2008 into LAW.

    President Kibaki is reportedly said to be within parliament precincts awaiting completion of debate on the National Accord and reconcilliation bill 2008 which has elicited hot debate from both sides of the house. Kibaki intends to sign this bill into law tonight and possibly name his new cabinet tomorrow.

  36. anonymous 8.54 'luo fashionista' hehehe!!....i think 'nyadhi' means a trend-setter, someone with style, an elegant person-i got the word from some set book i read many years ago for my O-levels but you have to agree with me where baba fidel's wardrobe is concerned, words cannot do him justice!!

    9.06.....can you believe the nerve of those people?.....no shame at all!! even today they couldn't pretend and show up!! there are 222 mps in that chamber and only six constituencies are unrepresented (3 didn't have representatives from the beginning-kilgoris kamukunji and wajir north, then add to this emuhaya, embakasi and ainamoi) where were the rest?

    i have to ask though, kwani nominated mps are not allowed to vote? i was under the impression that they do!.....these ayes dont reflect their presence in parliament....whatever the case, nobody's going to cheat me that 15 mps were all out of the country for official duties!!

    phil and chris please investigate who these delinquents are.......and my member of parliament better not be among the missing!!!

  40. PNU may make threats but they will think twice b4 they act.Let us not forget the admissions by Mungiki that they had meetings in STATE HOUSE with top goverment (GEMA)officials before and after the elections on how they were to unleash terror and mayhem.

    Kibaki himself is implicated in the organisation and funding of mungiki. PNU knows that all their kikuyu kingpins were involved right from the top.

    The story has been hushed.But there is evidence in the pubilc domain that mungiki were absolved into the National Youth Service(where they were to be trained and armed)in their thousands, on instruction from the house on the hill.

    Here is what Mutahi Ngunyi said earlier:
    THIS IS A LETTER TO MPs. AS you begin debating the two ‘‘peace’’ Bills tomorrow, consider some thoughts.

    For starters, the important thing in the peace deal is not the letter of the agreement; it is the spirit. Which is why you should not dismiss the ‘‘Muthaura project’’ and the leaflet circulated in Parliament on Wednesday last week.

    In the spirit of the ‘‘peace deal’’, you must remember that this was never a struggle between a right and a wrong. It was a struggle between two rights. The ‘‘Muthaura forces’’ are right, although they are sheepish about their claims.

    Similarly, and fundamentally too, ODM is right! And this is why you must not be rushed. In fact, you have no choice but to amend the National Accord and Reconciliation Bill. Reasons?

    First I want to address ODM legislators. Good people, you are being cheated. My hunch is that PNU will support the Accord, and botch the amendment entrenching it in the Constitution. Not because the ‘‘Muthaura forces’’ are sneaky, but because the Accord is untenable in its present formulation.

    If you pass the Accord before the constitutional amendment, nothing could stop the President appointing the grand coalition Cabinet the following day. And the country would break into a party.

    IN THIS MOOD OF BLIND CELEBRAtion, the Constitutional Amendment Bill would be put to the vote. At this point, the ‘‘Muthaura forces’’ would ensure it does not garner the two-thirds majority.

    In fact, instead of the 148 MPs required to pass a constitutional amendment, they would raise something like 145 MPs. The other MPs will either be absent or will abstain from voting. And with this, PNU will have won. They will have created the position of Prime Minister through an Act of Parliament as opposed to a constitutional amendment.

    Would you blame President Kibaki for this? The answer is a resounding No! This would be blamed on the renegade MPs from PNU.

    In the meantime, you would be in government with Mr Raila Odinga as Prime Minister. Would you abandon your positions and return the country to violence because the power deal was not constitutionalised? Maybe not. But if you accept the deal through an Act of Parliament, you would be cooked! Let me explain why.

    If you accept the deal using the Act, PNU can decide to withdraw from the coalition at some point. This would annul the Act, disband the position of prime minister, and send all your ministers packing.

    But can PNU do this? Definitely. If the country returns to normalcy and the bandit forces in the Rift Valley and Mt Elgon are neutralised, PNU can gamble on this. More so if the coalition government is problematic. And this is why you must accept nothing short of a constitutional amendment. In fact, you must insist on amending the Constitution first and enacting the National Accord and Reconciliation Bill later. Otherwise, you will be at the mercy of PNU.

    Now I want to flip the argument and argue that a constitutional amendment is fatal for PNU legislators.

    First, I must disagree with you regarding the creation of two centres of power. I submit that you will be the biggest beneficiaries of the position of prime minister in future. When Mr Odinga is president with 50 per cent executive powers, Ms Karua can be premier enjoying 50 per cent powers. And when Ms Karua is president, Mr William Ruto can be premier.

    At any given moment, you can either occupy the position of president or prime minister with 50 per cent powers. Why would you fight such an arrangement unless you are myopic?

    Second, if you plan to sabotage the Constitutional Amendment Bill, you would have a point. PNU has the numbers, but can never control Parliament. This is why, with 4.5 million votes, Mr Kibaki could only manage 45 MPs, plus some 20 or so from the fringe parties.

    With 4.3 million votes, ODM had over 90 straight MPs. What does this tell us? If the prime minister is to be chosen by Parliament, PNU would stand no chance in future. This is so because some of our constituencies have as many as 100,000 voters, while others have as few as 4,000. Yet the two extremes produce one MP. And if it takes more voters to elect a PNU MP, than an ODM MP, ODM would occupy the PM position forever.

    In other words, you must not rush the constitutional amendments. If you entrench this position in the Constitution, you must also go for proportionate representation in which your number of MPs is increased to match your population size. The two must be mutually exclusive and constitutionalised. Short of this, you could lose both the presidency and the premier position to ODM in future.

    NOW, IF A CONSTITUTIONAL AMENDment is bad for PNU and the National Accord and Reconciliation Act is bad for ODM, what must you do?

    This takes me back to my original submission: you have to amend the Accord. You have to introduce Section 9 to the Act or amend Sections 6 or 8. The amendment should state clearly that, in the event one coalition member pulls out and the Act is annulled, we should go for fresh elections.

    This would secure ODM’s 50 per cent power-sharing deal and provide PNU enough time to think through the constitutional implications of a PM position.

    Otherwise if the Accord is passed and the constitutional amendment fails, ODM will be the loser. And if both the Accord and the Constitutional Amendments are passed, PNU will lose big. What do you think?

    Now it seems you were either blind or did not read this piece carefully. If this is what you are referring to then ODM carried the day. Mutahi Ngunyi said ODM should not agree for the Accord to be amended first before the Constitution amendment bill, but actually the reverse happened and the Const. was amended first so.......pumbafu wewe. Washa ushiga.
    My only worry is that in the event that ODM in the future garners more MPs and ofcourse win the presidency then it will keep both the PM post and the presidency. That as sweet as it may sound to me, but not so for peace and stability in Kenya. A clause should be introduced/ought to have been introduced to the contrary.

  44. It’s great news that the bills have been passed, although I must agree with Ms. Karua that they’re not of the highest legal quality. Incidentally, the President has already given his assent.

    Things are thick for Ruto. Too many people have died in front of the cameras for the Rift valley violence to be ignored, as it was in 1992-2002. Second, the investigations this time began even as the violence was in progress. Since the early days, international investigators and the press have been involved – it is clearer now than it was in the past just who did what. Amazingly, militia leaders have been willing to give their names to journalists (e.g. Cheserek, Kibor. Actually, Kibor is a good example of the continuity of the violence, since he was involved in the clashes of the 90’s: he was sixth on the Akiwumi Commission's list of recommended prosecutions). Third, unlike previous rounds of ethnic cleansing in the Rift, the state was not involved in the planning, logistics, execution, or cover-up; that makes it much harder to hide events. The lorries, for example, which were used to transport the assailants and their supplies are well-known, as are their owners. Since the state wasn’t involved, the militias have had to rely directly on locals, which means the violence was intimate, and therefore even more horrific, but it also means that the perpetrators are often known to the victims. This has been enormously helpful for gathering evidence. It is usually a mistake to kill large numbers of people in plain sight without state backing.

    The circumstantial evidence, alone, that Ruto was involved is quite good: his admission of incitement in the HRW report, the admission by HRW's Kalenjin interviewees - both junior and senior - that Ruto had control of the violence on page 42 of the report, that Kibor openly organised the violence in Ruto's constituency; all these point one way. There is direct evidence too - the police have told some foreign journalists that they have enough evidence to arraign him on a murder charge. One way or the other, the days of impunity are definitely over

  45. Each of the lives lost was equally valuable. I have no problem with perpetrators, financiers being charged but it's got to be even handed. If they are going to charge Ruto then they should haul Karume, Uhuru, Saitoti et al into the same Courts. We can't have any of that selective justice that's being promised. Saitoti or Kibaki & Co. cannot be the arbiters of just conduct when they engage in the proscribed activity they seek to punish. Either charge Mungiki members and their warlords as well or let everyone walk.
