Reaping Fruits of Political Dishonesty

The genesis of all head and no light at the PNU-ODM mediation talks can be squared traced to our past that is replete with political dishonesty. No deal will be binding unless it is felt watertight, structured and documented in front of the whole world.

Our Nobel Laureate Wangari Maathai saw it coming long time ago. Politicians all over the world make deals to survive. But trashing all your agreements once in power is the height of costly expediency. Now we are all roped in this ugly journey to political abyss.

Proclaiming sanctity to Kenya’s tattered constitution is to continue the destructive bumpy ride along the deceptive path. You cannot partially acknowledge a crisis and premise your pledge to resolve it on the same empty edifice you abused to cause the crisis in the first place. There are no half measures here and time is of essence too. Human patience is no elastic and Kenyans are threatening to snap soon.

You can't rule unwilling people
You cannot fool a country and the world all the time. Kibaki’s buying of time will be very costly to all Kenyans in the long run. In the minds of his handlers he has succeeded in weathering the global pressure and can now revert to old and time tested Kenyan gimmicks of grandstanding and brinkmanship.

Tomorrow AU boss Jean Ping is coming to town. You see, the world is not giving up on Kenya. Not just yet. Collaterally we must not abuse nor betray their efforts by trivializing their concern as patronage. Our immediate neighbours have left us to stew in our own oil thanks to our cheap brand of capitalism doled in primitive material accumulation.

You CANNOT rule an unwilling population. Not not in the 21st Century, never. Kibaki must move in haste to politically resolve the present crisis. Failing which even him he will not be spared the resulting devastation. Time is running out and Kenyans’ patience is no rubber band. We cannot lose our beautiful country to a bunch of old tribalists. The inhent class war is only secondary.

The embers are menacing glancing at the Kenyan fabric. The inferno is eminent and it is not a matter of IF but WHEN to implode. We want our country back NOW. And that is no just a wish. It is a right for which more than 1000 Kenyans have already lost their lives for. Enough is enough. No more red herrings and splitting of hairs please.

    If the agenda for cessassion is pushed through, who loses most?.Ordinary Kikuyus or these looters.By the way, these ordinary Kikuyus have a claim against the Uhurus who stole their land in central province.They took their land and "threw them away to being in the disaspora.

    Have you seen how Uhuru Kenyatta "mentions" Grand coalition. The Looters will lose more than ordinary Kikuyus.

    It pains me most when I realize how many brainwashed ORDINARY Kikuyus we have.Yet they unknowingly, are furthering the interests of looters-Goldenburg,Land looting,Anglo leasing etc.Interests that they never and will never gain from.

    How can we Educate these Ordinary kikuyus to join the Grand dream of fighting the looters of Kenya?.For the benefit of ALL Kenyans.

    I repeat that it is a class war.Not a tribal war.And if Kibaki is the instrument for the looters, let him face it personally.Save the Ordinary Kikuyus.They did not steal the elections.some, legimately bought bought land outside Central province.But is there time to educate them? Their enemy is Kibaki and co.Who can tell them this?
    As for Kambas. time is proving that Kaloozer is an opportunist. Betrayer.Iscariot as it is.He has no interest of his people at all.
    He was in the plans of Moi/Biwhat agenda.

    With mungiki demanding Mathai's head, Kiai going into hiding, ODM threatening seccesion, Kibaki unmoving as ever.... we are in for a long haul.
    Yes even Moi did repeal section 2(a) when the pressure was high but Kibaki seems immune to pressure, sorry ladies and gentlemen. We are in for rough times indeed.

    Truly speaking, can Kibaki rule a country which has rejected him. Go to Malaba, Kakamega, Kitale, Kisumu, Oyugis, Kisii, Eldo, Kericho, Keroka, Kipkelion, Nbi, Mombasa, Magadi, Malindi, Makindu, etc. Kibaki is not welcome in these towns. How will he rule people who dont like him and his so-called government.

    It would be better for him to say good-bye. Infact this is what the super powers want.

    Kibaki, it's time to say goodbye.

  9. I dont think Kibaki will survive this onslaught but I hope Kenyans will stop fighting and start asking for better leaders. Raila is no better, and stop kidding yourselves that he is, he is far from what Kenyans deserve. Many Kenyans said that the offer of leaders was poor, and I second that, we need leaders that put their country's needs before their own political needs first.

    the cloth (constitution) meant to cover kenyan people, already so tattered after years of use, misuse, abuse and other daily wear and tear (national and global economic and social changes and challenges) is nothing but threads dangling and cannot offer dignity to cover the nakedness or shield from the heat or cold. hanging on to it when there's opportunity for new stuff is mind boggling, but typical of old-timers. As the late whispers would say, this othaya guy and his cronies are well past their sell-by date

  11. Ok Taabu, after countless articles im finally listening to you but what do you propose instead of the current constitution as a temporary measure to protect the nation? As much as PNU are being very stupid right now, they made a valid point in saying how can the PM's office be implemented without a referendum? Shouldnt there be a provision that for now the PM can be appointed without a vote, but in the future we should vote for both a prime minister and a president? I also think the fundamental problem with Kenyan elections is that they are all done at the same time, they should be staggered, because the risk of rigging is reduced

  15. was there a referendum when 2A was repealed from the constitution? was there one when 1A was incorporated? to make kenya a multiparty democracy?

    they are just being stubborn... they dont want to do it....all constitutional amendments have been made by parliament all they need to do is agree.

    alterations can be made by 65% of parliament!!

    Kibaki tells opposition not to dictate solutions

    President Kibaki met the Government Coalition Parliamentary Group and declared that there was no constitutional vacuum.

    The President at the same time warned against inciting Kenyans into acts that could derail the peace talks and told the Opposition not to dictate solutions.

    "This is not the time to dictate solutions, but to reason together so that we can find short and long term sustainable solutions to the challenges we face,’’ said Kibaki at the Kenyatta International Conference Centre.

    The President further said there was no need for a forceful settlement of the issues at hand. He said instead, leaders should support the necessary procedures to amend the Constitution. He spoke against the backdrop of threats of mass action by ODM if their conditions were not met.

    The Government side dismissed the threats as not helpful in the negotiations.

    Foreign Affairs minister, Mr Moses Wetangula, speaking after the Government’s negotiating team, briefed the PNU leadership on the progress of the talks, dismissed ODM’s threats as uncalled for.

    Meanwhile, Annan met retired President Moi at his Kabarnet Gardens residence.

    After the 40-minute talks, they emerged at 6.40pm and shook hands for the cameras.

    In a brief interview, Annan said the mediation talks were progressing well.

    "I’m optimistic and so should all of you," he said.

    Annan expressed hope that peace would be attained soon.

    Creditors storm PNU offices to demand payment

    Creditors stormed PNU offices for the second time demanding more than Sh60 million.

    The creditors jammed the PNU office on Lenana Road and blocked the entrance with their vehicles, demanding audience with Mr Lee Karuri of Kibaki Tena, whom they accused of giving them false promises.

    A businessman, Mr Sammy Mucheru, who supplied 40 vehicles for use in the campaigns, said he was owed Sh6 million and his financiers were now pursuing him.

    Mucheru, who displayed a demand letter from a bank seeking to recover a Sh3.3 million loan, said he was initially owed Sh7 million, but was paid one million after the last protest.

    Mucheru who operates a travel company — Easyride Car Hire and Safaris — said Karuri made promises to pay them, but never did so.

    Another company, Arnet, that printed polling registers for nominations is demanding Sh2.6 million and a female trader who supplied lesos is demanding Sh3.3 million while Badge Masters is demanding Sh600,000.

    Others supplied various items such as T-shirts, posters, banners, fliers and consultancy services but are yet to be paid nearly two months after the General Election.

    Efforts to reach Karuri were unsuccessful, but the PNU deputy Executive Director, Major (rtd) Francis Matu, said efforts were being made to pay the creditors.

    Matu said he had spoken to Karuri who had promised that the creditors would be paid by the end of the week.

    "The matter is being dealt with urgently. They will be paid by the end of the week,’’ Matu said at the PNU offices.

    He said the delay in payments might have been occasioned by the problems the country had faced and asked the traders to be calm as their issue was being sorted out.

    The creditors threatened to camp at the office until Karuri or any other senior PNU official addressed them

    Annan's team in crucial talks over PM's role

    Government and ODM negotiators in the Kofi Annan-led talks were Wednesday evening on the verge of reaching agreement on the creation of a prime minister’s post.

    But they were yet to agree on exactly what powers and responsibilities the holder of the office should have.

    Although the details of the position were yet to be worked out, it heralded the beginning of softening of hard-line positions that the two sides have taken since former UN secretary-general Kofi Annan embarked on the mediation process on January 29.

    Sources close to the National Dialogue and Reconciliation Committee, which Mr Annan chairs, revealed that both Government and ODM sides had agreed on the need to create the premier’s post as part of the political settlement.

    Governance structures

    It is understood that the resolution was made by the four-member working group of the mediation team appointed on Tuesday to explore the options of governance structures that could be acceptable to both sides.

    It is perhaps on the strength of the agreement that the chief mediator issued a statement in the evening assuring Kenyans that the talks to end the political conflict were on track.

    “Despite discouraging reports prompted by statements from one side or the other, the chair (Mr Annan) wishes to assure the public that the talks are going on well and we are on track,” he said in a statement issued by his spokesman, Mr Nasser Ega-Musa, at Serena Hotel Wednesday evening.

    Later Wednesday, however, Mr Annan directed the PNU/Government and ODM negotiating teams to agree on structures of proposed coalition government by Thursday.

    A source at the talks said the negotiators were to work on a formula, giving functions of a proposed prime minister’s position and powers.

    Mr Annan is said to have insisted on the urgency of arriving at short-term solutions to problems facing the country by latest Friday.

    The issues include addressing the crucial solution to the disputed presidential election results which sparked riots across the country.

    Mr Annan had set a deadline of 15 days, from January 29 when the talks started, for the negotiators to strike a deal on short-term solutions.

    Short-term solutions

    It is upon the completion of short-term solutions that the negotiators are to embark on long-term ones which include legal, land and constitutional reforms, within a year.

    Former Tanzanian President Benjamin Mkapa, who is a member of the African Union appointed Eminent Persons of Africa led by Mr Annan and which is spearheading the negotiations, re-joined it at 8pm after taking a short break.

    Mr Annan’s directive followed hardline positions by some of the negotiators that had threatened to derail the discussions as anxiety grew locally and internationally over progress of the talks.

    Members of the mediation team William Ruto and Mutula Kilonzo exuded confidence and determination that the talks were progressing well as they emerged from the meeting at 11am and at 4.57pm.

    “We are progressing well and we intend to burn the midnight oil to reach an agreement,” said Mr Ruto. On his part, Mr Kilonzo commented: “We are doing well.”

    The working group comprising Cabinet minister Martha Karua and Mr Kilonzo from the Government side, and Mr Ruto and Ugenya MP James Orengo on the ODM side, was set up on Tuesday at the direction of Mr Annan.

    The team, which is being assisted by former Swedish Judge Hans Correll, was tasked to transform the political deals struck during its sessions into legal terms that will be accepted by the Government and ODM.

    Wednesday’s agreement on the creation of the Prime Minister’s post came a day after President Kibaki, for the first time, gave an indication on the kind of political deal he will accept.

    Meanwhile, ODM threatened mass action if Parliament is not recalled within a week to debate proposed legal and constitutional changes to entrench the new government structures to be agreed upon at the talks. The statement was issued after an ODM parliamentary group meeting.

    Mr Annan later warned parties against making statements that could jeopardise the talks. Mr Annan said his staff would monitor media reports of utterances by political parties to keep track of what could harm the talks.

    Government MPs were also meeting under President Kibaki’s chairmanship late Wednesday night.

    In a statement issued through the Presidential Press Service, President Kibaki said there is no constitutional vacuum in the country

    Any agreement based on structures outside the constitution will be sending dangerous precedence, he said, but reaffirmed his commitment to the success of the talks.

    He also called on leaders to stop inciting Kenyans to violence at a time mediation talks are under way.

    President Kibaki said he cared for the welfare of Kenyans and was ready to work even with those who competed against him because of this.

    “We all want a peaceful Kenya, so let us all agree on a common agenda for our country. This is the reason I want us to work with even those we competed with in the last general elections,” said the President.

    On Wednesday, it was said the working group had agreed — in principle — on the creation of the PM’s post as part of the governance structure. The working group reported their resolutions to the whole mediation team in the afternoon and later met in the evening to fine-tune some of the issues that had not been specified.

    Among the issues the two sides failed to agree on was whether the PM will have executive powers or not.

    Others touched on its constitutionality and the time within which it will be created.

    We learnt that the Government side pushed for a non-executive PM post to be created through a Statute — an Act of Parliament. This, they said, was provided for under Section 16 of the Constitution, which allows the President to name members of his Cabinet from among MPs.

    The Government said the position should be created in 12 months as there were a raft of adjustments in the governance structure that will come along with the new rank.

    Meanwhile, incoming AU Commission chairperson Jean Ping will make a two-day official visit to Kenya from Thursday.

    He is scheduled to arrive at 10 am. He will meet with mediation team leader Kofi Annan and members of the Panel of African Eminent Persons as well as the negotiating teams to receive briefs on the progress of the talks

    Mathenge: Sorry I do not respond to such greetings they have aspects of colonialism which we fought so hard in the Mau Mau period, look at the richness of greetings such as Thaai, or nyororokete (Spelling may be wrong) they represent a wholesome answer.     AfricaNews.com: When did you join Mungiki?

    Mathenge: Eight years ago, then I was a tax collector, but I rose through the ranks.

    AfricaNews.com: You sound educated. Would you wish to share your academic background?

    Mathenge: After my high school education in Kangaru and Mangu high School, I joined the University of Nairobi where I did a BA in Philosophy with a bias on (Religious) logic, I then did my Masters Degree at St. Paul's Theological College in Limuru and specialized in African Theology.

    AfricaNews.com: So it’s correct to say that you qualify to be an ordained priest?

    Mathenge: Sure, but I refuse to be ordained until African Theology takes over. For example ask yourself why do Churches take alcoholic wine and preach against it? Why are we told of vineyards instead of Maize plantations? Instead of pellets church leaders should have bread made from wholesome wheat, Facing Mt. Kirinyaga is a religious concept even Jesus faced the skies…focus is important and Mungiki has a focus.

    AfricaNews.com: Are you involved in the post-election violence?

    Mathenge: No we are not, those are just people who are using our name.

    AfricaNews.com: What focus does Mungiki have other than killing people to scare others to do what they want?

    Mathenge: First let me warn you that if this interview has to go on you have to ask about facts...

    AfricaNews.com: Sorry to interrupt but it’s a fact that Mungiki has been killing people, just tell us why?

    Mathenge: True we have been killing people but you have to understand us, even God in the Old Testament killed people who did not toe the line of the Law. We have been killing defectors, and those who refuse to pay their dues for our services and that will not stop.

    AfricaNews.com: You are yet to answer why? That is after killing them you lose people who would in future have paid your ‘taxes’.

    Mathenge: Young man! You do not understand. We do not waste our time. We ask you to pay taxes and if you refuse we act on you. No negotiations, Give unto Ceasar what belongs unto Ceasar.

    AfricaNews.com: How many people are in Mungiki countrywide?

    Mathenge: We had our last National Convention in April 2007 in Thogoto and we realized we had recruited 45,000 new members we are now about 2.8 million, of course excluding Women and Children.

    AfricaNews.com: What are the benefits of joining Mungiki?

    Mathenge: When I come to recruit you I will tell you, we don’t recruit through the media so I won’t answer that question.

    AfricaNews.com: Politicians have been mentioned as being part of this movement. What is your reaction?

    Mathenge: Sometimes I laugh when I see them denying and laugh more when the media refuses to read in between the lines.
    AfricaNews.com: So now you have a chance to tell the truth. Tell me about the politicians involved?

    Mathenge: I know you are going to interview 'General' (the underground name for Joe Waiganjo the acting leader of the group) so let him tell you, but let me tell you they are many and we actually sponsored a few of our members and they are now in parliament.

    AfricaNews.com: So is Mungiki a criminal grouping or is it political?

    Mathenge: It is political and religious. Look when Jesus came on earth he said he was the King of the Jews. That is political. Then he said he has come to restore salvation. That is religious and that is our mission. You don’t even need to ask that question. Remember the recent meeting in Michuki’s office. Why were these politicians meeting?

    AfricaNews.com: Mungiki appears to be a group of lazy people who do not value the ethics of hard work what’s your reaction?

    Mathenge: Lazy? You think it’s easy to raise Shs 2 billion a year? Look at our leadership and members do you see any of them begging? Simple because we do not use a microphone like you does not mean we are lazy we are very hard working, we patrol estates and keep security, arrest pick-pockets, settle cases of marital consequences, buy food for those who cannot afford, In Kiambu for example we run 4 children homes. You still call us lazy? It is you who are lazy, your job is solely to follow people.
    AfricaNews.com: If you are so brutal on defectors why have you not killed Waruinge and he has publicly said he has defected or even Maina Njenga who has even been baptized?

    Mathenge: They are alive because we know they have not moved, there are clear structures on how resignations of top leaders are handled, look they were once Muslims remember that conversion? Now they are Christians, maybe tomorrow they will be Hindu but the bottom line is that they are still part of us.

    AfricaNews.com: Final question, if you became the President or the Minister for Internal Security how would you fight Mungiki?

    Mathenge: I would adopt them as a crucial part of the economy.

    Emilio Mwai Kibaki was vice-President in Kenya (1977-88) when Yoweri Museveni's "bandits" like Mr Balaki Kirya were either "kidnapped" and shipped back to face death in Uganda; or like Mr Amama Mbabazi, Ndugu Rudunda and the Lango "Hima" clan leader Adoko Nekyon, were expelled and sent to face uncertain future in the Nordic countries.

    Today, Mr Museveni's lone support for Kibaki's victory, which the opposition Orange Democratic Movement (ODM) has called a civilian "coup", carries a lot of latent weight. Mr Kibaki is set to legitimise and consolidate his coup in a power-sharing deal with his victim, Mr Raila Odinga who is likely to take a junior position in a coalition government.

    The immediate impact of the Kibaki-Odinga deal is that ODM will cease to be a viable opposition, just as the DP found to its cost, when it joined a "coalition" government under Museveni in 1986.
    But if the aftermath of Mr Museveni's support for other leaders in the region provides any clue, his backing for Mr Kibaki could cost Kenya dearly. Consider the following:

    On 1 October 1990, while Mr Museveni was away on a state visit to the USA, Rwandese exiles in the Uganda "stole" large quantities of small and heavy weapons, army uniforms, communication equipment, vehicles, fuel, food and medical supplies; and invaded their country, without Uganda's knowledge!

    That invasion marked the beginning of the home-coming by Rwandese refugees who had been forced out of their country in 1958. Yet, within ten years, Uganda had fought two bloody "Kishangani" wars with Rwanda, the same country he had helped to "liberate". Their sons who had earlier paid with their blood to install Museveni in power in 1986, had become "terrorists" .

    Mr Museveni's August 2001 letter-for-arms to the then British Secretary of State for International Development, Ms Clare Short, is instructive:

    "Right Honourable Minister, we have just defeated the protracted terrorism organised against us by Sudan, both in the West of Uganda and in the North. We can not countenance nor tolerate another round of terrorism this time organised by Mr Kagame whom we sacrificed so much to stand with when the world was either against their cause or indifferent to it."

    He went on, "In order to have a strategic capacity to defeat the aggressor, we need a large number of officers and NCOs trained before hand, adequate numbers of technical staff (pilots, tank and Artillery crews, field engineering, etc); and a large militia who are not part of the regular Army".

    And he concluded, "Given that Mr Kagame is turning the sister state of Rwanda into an enemy state to Uganda, we have to confront him". The rest is history, though many doubt it is!
    Earlier in 1996, Museveni had been instrumental in organising, financing and arming Congolese rebels who toppled Field Marshal Mobutu, before installing Mr Laurent Kabila as president in May 1997.

    Yet, four years later in January 2001 "President" Kabila was assassinated after trying to dismiss his Ugandan bodyguards. Curiously, President Museveni did not attend Kabila's funeral.
    On the contrary, Uganda intensified its occupation of the Congo directly through its own troops, and indirectly by arming and training several militia armies including Mr Thomas Lubanga's L'Union des patriotes congolais (UPC) or Union of Congolese Patriots and Jean-Pierre Bemba's Congolese Liberation Movement (MLC).

    By the time Uganda was forced to leave the DRC in 2003, over 4 million Congolese had lost their lives, according the reports by the UN, Human Rights Watch and the International Crisis Group.
    And, in a landmark ruling, the International Court of Justice (ICJ) ordered Uganda to pay D.R Congo $6-10 billion in compensation for illegal occupation and war crimes including the looting of gold, diamonds, silver and timber; mass killings, torture, rape and the training of child soldiers, committed between 1998 and 2002.

    Given these incontrovertible records of atrocities, committed by Uganda against countries that had initially enjoyed Museveni's support, Mr Kibaki and all Kenyans would be very foolish not to ask themselves these obvious questions:

    Why did President Museveni risk international condemnation by supporting Congolese rebels to topple Marshall Mobuto only to occupy the same country, looting and committing war crimes to the extent that the ICJ found it necessary to impose an "exemplarily" $6-10 billion fine in compensation?

    If Mr Museveni's army could turn against the Rwandese they helped to power, what could he do to Kenya, a country which allegedly abducted and returned to Mr Obote some of Museveni's guerrillas in the 1980?

    Is this the same Museveni who provoked skirmishes along the Uganda- Kenya border in 1987 before turning his attention to the Congo, Rwanda and the Sudan? Could Museveni be the human equivalent of the Upas tree, so poisonous that it destroys all animal and vegetable life for miles round it?

    And Isn't Mr Mwai Kibaki, like Laurent Kabila (RIP) and Gen. Kagame, accepting a ride from a Chinese Tiger from which he will not climb down, safely?

    Kenya's so-called economic miracle under Kibaki is a facade because it has not benefited the majority of Kenyans but a few select people predominantly from Kibaki's Kikuyu people.

    As for Kibaki, he has never been a democrat; he was Vice President during the autocratic rule of Daniel arap Moi, a period when dissenting Kenyans were detained without due process, and prior to that served the autocratic Jomo Kenyatta.

    It is now becoming very clear that Kibaki learned valuable lessons of repressing innocent Kenyans from the authoritarian regimes of Jomo Kenyatta and Daniel Moi.

    Information from Kenya now states that Kibaki and his dreaded former Minister of Internal Security are funding the atavistic murderous Kikuyu group called Mungiki. This fact in and of itself now confirms that Kibaki belongs at the International Criminal Court alongside Charles Taylor of Liberia.

  27. For Kikuyus to oppose Kibaki would be to ask them to endorse the murder of thousands...yes thousands...of their kinsmen in Eldoret. It wont happen, it will never happen.

    you can wish this to be a fight for democracy or even a class war but it ceased to be when your fanatics went on a blood letting spree.

    There are no more Kyuks or Kisiis or Kamabas, or embus/merus left in ODM zones. Ruto's interhamwe thugs were halted in Molo when the populions of their targets became bigger and bigger.

    Now if there will be bloodshed an iI sincerely hope there wont it will be movement west of that beautiful town of Molo.

    ODMers cant see that kibaki cant just quit because if he did, the country will erupt into a civil war as The PNU communities attempt to free themselves from the rule of men they consider mass murderers. ofcourse if he stays , we just slide into the same abyss.

You silly DOM goons, I dont wish you have way because mko na Kiburi sana. I can not stand ODM rule, and so many other Kenyans. The likes of Balala only pain the supporters of PNU and the public in general for threats with infamous Mass Action. And now am wishing that even us the govt supporters come out and demonstrate that the so called Mass Action is not a monopoly of DOMs. Am now willing to take to the street to make these DOMers understand that am also a Kenyan.

    I haven't scoured all the papers but I know not many will report what
    Balala said on TV yesterday. I seemed to get the message that he was
    calling for a secession. You and I know, though, that this has been in
    the minds of many and has been spoken about in hushed tones. It is the
    first time a public utterance has been made of it by a man of stature.
    It is arguable that, by attempting to legitimise an illegitmacy,
    Kibaki himself seceded from the larger Kenya. Except for the visit to
    Eldoret church that was burnt, he has been unable to travel much
    outside State House.

    Here below is a document I came across on the Internet that speaks the
    same language. I think it is an adaptation of the American Declaration
    of Independence.

    The unanimous Declaration of the SIX united Provinces of Kenya

    When in the Course of human events, it becomes necessary for one
    people to dissolve the political bands which have connected them with
    another, and to assume among the powers of the earth, the separate and
    equal station to which the Laws of Nature and of Nature's God entitle
    them, a decent respect to the opinions of mankind requires that they
    should declare the causes which impel them to the separation.

    We hold these truths to be self-evident, that all men are created
    equal, that they are endowed by their Creator with certain unalienable
    Rights, that among these are Life, Liberty and the pursuit of Happiness.

    -That to secure these rights, Governments are instituted among Men,
    deriving their just powers from the consent of the governed,
    -That whenever any Form of Government becomes destructive of these
    ends, it is the Right of the People to alter or to abolish it, and to
    institute new Government, laying its foundation on such principles and
    organizing its powers in such form, as to them shall seem most likely

    To prove this, let Facts be submitted to a candid world.

    1. He has refused his Assent Bomas Constitution, the most
    wholesome and necessary for the public good.
    2. He has forbidden his Members of Parliament to pass Laws of
    immediate and pressing importance, unless suspended in their operation
    till his Assent should be obtained; and when so suspended, he has
    utterly neglected to attend to them.
    3. He has refused to pass other Laws for the accommodation of
    large districts of people, unless those people would relinquish the
    right of Representation in the Legislature, a right inestimable to
    them and formidable to tyrants only.
    4. He has called together legislative bodies at places unusual,
    uncomfortable, and distant from the depository of their public
    Records, for the sole purpose of fatiguing them into compliance with
    his measures.
    5. He has dissolved Representative Houses repeatedly, for
    opposing with manly firmness his invasions on the rights of the people.
    6. He has refused for a long time, after such dissolutions, to
    cause others to be elected; whereby the Legislative powers, incapable
    of Annihilation, have returned to the People at large for their
    exercise; the Province remaining in the mean time exposed to all the

    Jury:

    * For transporting our muslim brothers beyond Seas to be tried
    for pretended offences

    * For abolishing the free System of Assembly in the world,
    establishing therein an Arbitrary police government, and enlarging its
    Boundaries so as to render it at once an example and fit instrument
    for introducing the same absolute rule into these Provinces:

    * For taking away our Charters, abolishing our most valuable
    Laws, and altering fundamentally the Forms of our Governments:

    * For suspending our own Legislatures, and declaring
    themselves invested with power to legislate for us in all cases
    whatsoever.

    14. He has abdicated Government here, by declaring us out of his
    Protection and waging War against us.
    15. He has plundered our seas, ravaged our Coasts, burnt our
    towns, and destroyed the lives of our people.
    16. He is at this time transporting large Armies of foreign
    Mercenaries to compleat the works of death, desolation and tyranny,
    already begun with circumstances of Cruelty & perfidy scarcely
    paralleled in the most barbarous ages, and totally unworthy the Head
    of a civilized nation.
    17. He has constrained our fellow Citizens taken Captive on the
    high Seas to bear Arms against their Country, to become the
    executioners of their friends and Brethren, or to fall themselves by
    their Hands.
    18. He has excited domestic insurrections amongst us, and has
    endeavoured to bring on the inhabitants of our frontiers, the
    merciless Kikuyu Savages (Mungiki), whose known rule of warfare, is an
    undistinguished destruction of all ages, sexes and conditions.

    In every stage of these Oppressions We have Petitioned for Redress in
    the most humble terms: Our repeated Petitions have been answered only
    by repeated injury. A Prince whose character is thus marked by every
    act which may define a Tyrant, is unfit to be the ruler of a free people.
    Nor have We been wanting in attentions to our Mount Kenya brethren. We
    have warned them from time to time of attempts by their leaders to
    extend an unwarrantable jurisdiction over us. We have reminded them of
    the circumstances of our existence here. We have appealed to their
    native justice and magnanimity, and we have conjured them by the ties
    of our common kindred to disavow these usurpations, which, would
    inevitably interrupt our connections and correspondence. They too have
    been deaf to the voice of justice and of consanguinity. We must,
    therefore, acquiesce in the necessity, which denounces our Separation,
    and hold them, as we hold the rest of mankind, Enemies in War, in
    Peace Friends.

    We, therefore, the Representatives of the Orange Republic Of Kenya, in
    General Parliament, Assembled, appealing to the Supreme Judge of the
    world for the rectitude of our intentions, do, in the Name, and by
    Authority of the good People of these Provinces, solemnly publish and
    declare, That these United Provinces are, and of Right ought to be
    Free and Independent Country; that they are Absolved from all
    Allegiance to the Mount Kenya Mafia, and that all political connection
    between them and the Province of Eastern and Central (Banana Republic
    of Kenya), is and ought to be totally dissolved; and that as Free and
    Independent Provinces, they have full Power to levy War, conclude
    Peace, contract Alliances, establish Commerce, and to do all other
    Acts and Things which Independent Countries may of right do. And for
    the support of this Declaration, with a firm reliance on the
    protection of divine Providence, we mutually pledge to each other our
    Lives, our Fortunes and our sacred Honor.

Asking Kibaki to share power is like asking him to share loosy .How do you share a woman , who you painstakingly courted, paid dowery, and finaly moved to your crib?? please try to wear Kibakis Shoes, it is a hard compromise for him , his ego is at stake and it is time he showed Raila who the real Njamba is.
