PNU and ODM Teams Return to Negotiating Table

The heat is on, as Annan says he has suspended many important assignments to be in Kenya (but PNU politicians seem to be taking the country in circles!)

After the government side introduced a new raft of demands that trashed a power-sharing deal reached in the infamous Kilaguni Lodge, it immediately resulted into a collapse of the mediation talks on Monday. But it seems all is not lost, because it now appears Kofi Annan has managed to bring the warring parties back to the negotiation table after meeting both Mwai Kibaki and Raila Odinga last evening.

As at the time of posting this, both parties were back meeting Annan and his group of eminent persons in their usual Serena Hotel rendezvous. It is unclear whether what they were unable to agree on Monday had been sorted out with their respective principals.

In order to achieve normalcy in Kenya, Annan and the international community are in agreement with the ODM in its quest for an immediate political settlement arising out of the disputed December 2007 election before deeper negotiations and agreements can be reached on the issue of constitution review. That immediate political settlement is: POWER SHARING.

Earlier Koffi Annan's aide had told CNN that the Chief Mediator would be leaving Kenya unless the protagonist reached an agreement. Annan himself issued a statement saying:
"After four hours of intense negotiation this morning, the team made almost no progress on reaching an agreement on government, I had to conclude that they were not capable of resolving the outstanding issues."

Annan's diplospeak is hardly revealing any failure, but it is revealing huge frustration and disappointment orchestrated by the Government side led by Martha Karua. Matters were not helped by the fact that the Local government minister - Uhuru Kenyatta - was engaging in blatant abuse of power by trying to influence (read-rig) the Nairobi and Nakuru mayoral polls in favour of PNU. This morning, the ECK Chairman, Samuel Kivuitu has uncharacteristically come out in support of ODM and disowned Uhuru Kenyatta with regard to the nomination of Esther Passaris by ODM.

Back to the Annan led mediation talks, Annan has been in Kenya for more than a month trying to resolve the elections crisis and it is said that it is the longest period he has spent on any conflict resolution. Annan met both Raila and Kibaki Monday evening and released a statement saying: "I believe that the Panel of Eminent African Personalities working with the Kenya National Dialogue and Reconciliation has done its work. I’m now asking the party leaders, Hon Raila Odinga and President Mwai Kibaki to do theirs."

  1. I think that any normal thinking person would agree that after the flawed elections a fair and real 50:50 power-sharing is a great way forward. ODM, the internation community, and actually a large number of local moderates from tribes usually not linked to ODM see this very clearly.

    However, kibaki and friends try to make it look like they are cornered into giving up what is rightfully theirs. They are GREEDY and SELFISH and they don't care whether Kenya goes down with them.

  3. What I don't understand is why pressure on kibaki is not increased. They should revoke visas, state it publically, freeze assets, send home their families, etc. etc.
    There are a lot of ways of hitting them personally. And that is what they need to do now. Otherwise, Annan is just left alone fighting a completely unwilling power hungry government.

  4. Bwana Phil, i believe both factions have already tried this dialogue before;don't get me wrong i am all for negotiations, but dialogue has no use when both parties lack integrity to do what they say, so what is the point of meeting when Annan has already said its now upto Kibaki and Raila?
    pick up the phone kibaki, pick up the phone raila, meet at steers tonight and ask each other why you both want to destroy Kenya.
    Then agree like kenyans to share power between yourselves, and tomorrow morning make a press conference together, first thing to do is apologise unreservedly to kenyans for being terrible leaders and then re-name a new cabinet there and then on the spot
    This is so simple, but what do i know i am just a pumbavu who should be carrying a machete chanting domo!domo!

    why do you put RAILA in the same class as kibaki? What has RAILA done to Kenya? He has never held any real powers in government, has he? So how can you hold him responsible for what is happening in Kenya?

    In fact, by RAILA stepping aside for kibaki in 2002, he has done the greatest service to Kenya's democracy anyone has ever done to it. He has shown Kenyans the power of voting.

  7. i am asking raila odinga and his supporters to take this deal. What are they being offered? the first thing they are being offered is peace and progress. Under kibaki, you can be sure there will be progress.
    All odm needs to do is contribute peace. They are also being offered a prime ministership and two deputies created under an act of parliament. They are also being offered ministries to run and parastatals to manage. Their long-held desire to see the constitution reviewed has also be promised - within a year - with odm being the main actors as they control parliament.
    This arrangement will be temporary until a new constitution is written. Entrenched executive power through an undemocratic process like the serena round of talks is conspiratorial and unrepresentative.
    Why does raila want to wield executive power for less than a year? again, if raila becomes an executive pm, this will weaken the opposition considerably.
    Who will watch over him given that pnu is part of government? if raila becomes a non-executive pm, it will represent quite a climb down for people like martha karua, kiraitu murungi and john michuki, who will have to eat humble pie and serve under raila.
    It also a big achievement for raila and odm- the biggest reorganization of government since independence in 1963. Most importantly, it will save raila's country, and the entire east african region, from chaos that charles onyango-obbo described in the sunday nation.
    I get the feeling, however, that raila and odm will not take it. Why? because they want everything or nothing. That is their idea of compromise. Simply put, raila wants executive power. He want to be president without proving that he won - simply on the basis of allegations and often repeated suspicions that the election was stolen.
    I am worried that kibaki is giving too much space to raila and odm. Although evidence abounds that kibaki won, including declaration to that effect by eck, he has decided to negotiate with odm after they threatened the entire country with violence. I can understand kibaki’s desire to save the country.
    He should realize, however, that violence threatens every single kenyan - and kenya's neighbors. It is not just pnu supporters who will suffer. Odm supporters have blood too. Odm cannot threaten kenya as if only pnu alone would go to the dogs - the whole country goes to the dogs. It is time to call odm's bluff.
    They want to demonstrate? let them demonstrate. But if they break a single car window, break them and never allow them to protest for three years. Kibaki would be a fool to give up executive authority. He is the one 4.4 million kenyans elected, and he the one supported by odm-k' 800,000.
    He the one being supported by thousands more who changed their mind after odm-instigated violence. Already, kibaki is too magnanimous in sharing responsibility for governance. It means if the odm prime minister does not perform, kibaki will be responsible, because the buck stops with the president.
    Why is kibaki taking this risk? raila will likely fail as pm. He was a failure in all the ministries he held. Can anyone remember his achievements in energy during moi's regime, and roads and public works during kibaki first term? i guess part of the reason why two deputy pm are being demanded has something to do with the realization that odinga cannot work. He needs some donkeys to deputize him as he spends his term payukaring and exercizing domo.
    This is the best deal. Raila should take it and work for kenya. The alternative is to refuse and consign the country to the dog. He should he will be on the front seat.

  8. Hey, do you know guys have Railas potraits in their premises from Kericho westwards? My messenger just travelled back to Nairobi from Nyanza over the weekend. His guys were asking him where the hell he thought he was going and yet war is about to erupt in a few days time. Not a very hopeful comment.
    Did you guys watch Leakey's interview with Jeff Koinange? He said guys should not butcher each other like the Mau mau simply because they disagree on issues. But I wonder, had the Mau mau not butchered, would anyone have listened?

  9. I think it is the height of cheek for Kivuitu to come out a day after elections to announce that Uhuru's move was illegal. Where has he been since Friday?!!!!Or was that the plan all along? My dear people, it appears to me that these guys are far from through with our collective Kenyan voice. As someone said earlier, I shudder to think what is in store for us come 2012! I have a feeling 2007 was just testing the waters. Now that they have proved that they can get away with it (make no mistake...They have!, 2012 will be a walk over for them. They wont even bother with pseudo diplomacy then. By the way, i still insist that they have gotten away with it. For as long as the beacons of our nation's moral and conscience values do not categorically and DIRECTLY(!)point to the THIEF and sanction him individually; for as long as the Koffi Annans, the Kaparos, the Bishops et al continue to lump Raila and Kibaki in the same blame basket for Diplomacy's sake(!!!), for as long as nobody of great standing and political voice has the guts to firmly and squarely sanction Kibaki as the election thief,and thereby place the country's sanity at his doorstep and his doorstep alone; for as long as Raila's name keeps being spoken in the same breath as Kibaki's when talking about lack of peace and democracy in order to 'appear neutral' and to 'avoid inflammatory remarks', when all the while we all blame Kibaki in private,(yes, even his fellow Kiuks are embarrassed by the new level of arrogance except they have been threatened by mungiki if they dare speak out of 'turn'with the house of mumbi!); for as long as our leaders do not stand up and collectively say it as it is, for as long these things continue to happen as we 'diplomatically wait', PANUA HAVE WON THE DAY!   10. In 2012, they wont even bother with the farce of counting the votes and topping up... they will march straight to Statehouse and Martha Karua will be sworn in. She runs the show now. Why should she wait and work hard for Kalonzo and Uhuru again after expending so much energy for Kibaki? Kalonzo may even have been dumped by then for all you know! Say it as it is to the culpable one now, or brace yourselves for 2012 fiasco and regret later.

Those of you who think that Raila is the saviour of Kenya, you have got it very wrong, Raila has an agenda, maybe the only difference is that he might do a little bit of resource redistribution to poorer ethnic and class groups but raila is a wolf in sheeps clothing, dont make the mistake of not holding him to account. And dont forget that when he assumes the PM position, he is as liable as the president for the effecient and equitable management of our country.

I thought he promised to do that...We wacha i'd rather take water and leave in a peaceful country rather than eat meat in a house that is burning...Kibaki has failed this country...

    Before i delve in replying Phil's post, I wish to state categorically that most of you, apart from Irene Kondile here are one-sided and hell-bent to smear the PNU Team in the talks for nothing.

    Nobody in his balanced wisdom is looking at it that what ODM are presenting to the team are impractical and cannot happen now or ever.

    The thing is that being one-sided is eating up the basis of the real arguments some of you here might offer.

    PNU agreed to have the PM's post and 2 deputies. All occuopants to the seats were to be drawn from an amalgam of parties in the current parliament. The PM is to be appointed by the sitting president and any other minister to serve shall so be appointed.

    Now, it has turned out that because Kibaki appointed 17 ministers, ODM want to be accorded 17 ministries, they make their own appointment and rifle them to Kibaki to make announcements. IT WILL NEVER HAPPEN.

    That Kibaki cannot sack an errant minister having a court case arising from a piece of land he stole from Kenya Pipeline while he was in the Kanu government. That will not happen.

    That Kibaki cannot sack a recently elected minister since she was, like her newly ecelted former PS involved in the Goldenberg and Anglo Leasing Scam, and an armophous CENTURY ENTERPRISE until Raila Odinga approves, WISHFULL THINKING.

    That for Kibaki to appoint a minister Raila Odinga has to agree with it and consequently endorse a sacking: NDOTO MBAYA.

    Kibaki has agreed and ceded his immense powers to appoint Raila Odinga an inspector of his ministries. Period. If Kibaki names him the PM and not Noah Katana Ngala, then what will happen. It will be good anyway, when Kibaki sends Raila to check on the road construction in Bondo where Michuki cannot step and report back to him within a few days.

    Or, for Raila to monitor to re-settlement of communities in Eldoret driven away by the ODM goons. Or better still, to check on the FISHERIES Ministry in Lwanda Kotieno.

    Anyway, whatever the outcome, there is no way that Kibaki will give away his powers and any machinations being created by ODM to apply pressure on PNU will come a cropper. Even releasing details of the meeting and the unconcluded draft to the Standard for propaganda purposes will serve no purpose. Just the same way THAT agreement that was allegedly drafted and presented to Kibaki for signature by John Kuffor and availed to newspaper organisations, this one is bound to fail.

    Martha Karua is not wrong at all, and just as Kibaki has said before, everything has to be done as per the current constitution.

    Phil, another thing bwana, you mean Nyatanga survived the RACOON that visited Kibera. I thought it survived going by the happenings witnessed here over the last few days, I am deeply concerned that it is still operational.

    Phil, you wrote here that Raila Odinga flew to South Africa (he denied it) then to Nigeria on a charter plane. That is Nyatanga. He never went to SA.

    You said JOBLESS CORNER leader Musalia Mudavadi will head the TRANSITIONAL GOVERNMENT. As who? How does he come into this. Kenya Police are lenient. This is the bloke behind the mayhem that visited the country after he announced Raila as the winner and he is still scot-free. Even after Goldenberg?

    I repeat again, Raila and ODM needs to take the deal offered them. They lost the election and are losers. Losers never ask for power, they are given powers so that the country and the work can go on.
    Work has to go on!.
    Lustly, for the male chauvinists woh have have asked me to be raped, I want to say that how can I be raped and I represent Kenyans? Not all of us voted for ODM. How can ODM ask for me to be raped why the lost the erections?

    ACTION POINTS

    Action Point - Truth Prevalence or Lack thereof
    PNU and Kenya Government need to rise up NOW! If they can’t find any in their midst, hire the worlds top guns in the field of public propaganda and media savvy-ness. Media Perception needs to be TOP of everything. Get the truth out in all the media and those who refuse to carry the story, pay for the adverts! That should be done in ALL the media outlets, with intensity especially in the neutral and ODM areas. The Goal is to inject doubt on the ODM victory in preparation of the TRUTH coming out. Insist on results from the PNU media strategy think-tank. They are being paid for results.


    Action Point – Publicly Challenge ODM
    Rather than just pay for Adverts seeking the truth and challenging Raila and ODM, these are the very exact questions Kibaki; yes the President himself. And he needs personally ask those questions on national TV and Radio. He needs to keep saying the same things over and over in English (Yes, English, his Kiswahili awful). Arrange for well publicized press conferences with question and answer sessions....in English.

    The man is extremely eloquent and needs nobody to write speeches for him, as long as he does them in English. Others around him can do the Kiswahili versions on his behalf. Then let him mention and challenge Raila and Ruto by name. Yes challenge them personally and put them on the defense. Other PNU and PNU friendly officials go after their counterparts in ODM. Kibaki takes the challenging lead role and others follow. Let Kalonzo talk peace and show dictatorial tendencies of the entire ODM leadership and hence his jumping ship with ODM-K. Make public tours and repeat the same challenges over and over.


    Action Point - ODM Rigged Big time
    Get folks in ALL suspicious ODM areas where the vote was stolen in favor of ODM to file petitions in court. Prevail on the courts to move with speed and urgency to nullify the elections if the voters are indeed dead or could not have voted. This is a public safety issue and public security. Give it top priority. Hire more Judges if necessary to handle other cases while the more respected and experienced judges handle the election petitions. This is part of the negotiation ODM is pretending to ask for - speedy resolution of election cases.

    Action Point - Preaching Peace
    Get ALL religious leaders and community leaders preach UNITY like NEVER before. For example, get popular pop stars, local and international to participate in peace rallies.
    So what the government pays for them directly or otherwise. It’s about endearing the masses for the sake of peace. Get the Muslim leaders to condemn violence. Islam is a peaceful and compassionate religion, not the radical fundamentalism painted by the west. The government should embrace and echo that fact over and over. Have interdenominational prayers by all major religions. Condemn ODM style violence and senseless loss of life. Use Burnt Forrest as an example - always.

    Action Point - Demonize Majimbo
    Make MAJIMBO synonymous with VIOLENCE and discrimination and an excuse for wanton destruction of life and property. Mount similar campaigns like those by ODM and condemn violence and insist on peace and amicable resolution of disputes in courts. Get all the top-guns to go for peace and ONE nation, One Country under the rule of law NOT lawless disputes on the streets as rallying points. Always mention Majimbo on the same sentence with Raila, Ruto and Chaos and loss of life.
    Show that it is a hate campaign designed to bring chaos. Repeat the church burning and tossing of the 3yr old as what Majimbo means.
    We are all brothers in one family called Kenya. Show how Kibaki has been all-inclusive president but was railroaded by a disgruntled minority after the referendum to snatch power illegally. Drum it in, over and over.

    Action Point- Act on Corruption
    Get all those corruption cases on the likes of Ruto, Mudavadi and Murungaru on fast track. Show that ODM is a worthy opponent with good points but those good points are being tarnished by corrupted individuals. Name them by pointing to corruption cases. Make them pay for the corruption. Please the West that cries for corruption cases and jail terms.
    Kosgey and Ruto should be first closely followed by other dirty individuals even in Kibaki camp. The country is much more important than a few rotten but friendly eggs. The point is to be seen to be taking action on corruption…remember the perception factor?


    Action Point - Act on Violence Masterminds
    With the Intelligence on hand, prosecute RUTO, Alexanda Sitienei and accomplices on RV clashes. Damage has been done in RV so, no worse could happen with the Kalejin vote. Get others on incitement charges. Make tribal clashes look REALLY BAD AND BARBARIC. Let everyone frown on the primitive nature associated with it in this day and age. Several people must face the law and indeed long jail terms, really long. They should be highly publicized cases.

    Action Point - Public Thoroughfare
    Make blocking public roads look so bad and make bandits blocking such roads as economic saboteurs and potential murderers and robbers. They are basically criminals up to no good. The motive for such closures is always to cause trouble, rob, maim and even kill in the mayhem.

    Execute shoot to kill orders for blocking roads. Move with speed. (Try blocking I-95 in the US with barricades and see what will happen, human rights will be forgotten!)

    Action Point - Increase the Police Force
    It’s a known fact that in Kenya, the police and armed forces in general are seriously outnumbered per capita (to the general public) going by world standards. Hire extensively and fast track police training to maintain peace.
    Have local policing to maintain peace and above all avoid local thuggery. Borrow a leave from the extremely functional Tanzanian policing system: Security is everyone’s concern; national police is a supplement to help the locals as they maintain and manage peace, not the other way round as it is in Kenya.

    Action Point - International Mediation
    Invite International mediators and show the facts and especially as they favor the government side. If for instance President John Kafour was railroaded with un-orthodox documents out of character and disingenuous procedures, let the government have President Kafour talk about it to the world media. Let the Kenya public hear it over and over again. Have public debates on it. Always focus and shape the public debate in PNU favor. Never play catch up to the opposition. Senior government officials participating in such talks should give a public report as much and as often as necessary. You know the opposition will rush with biased information, act to beat them in the press game.

    Action Point - Look to the future
    With VP Kalonzo secure on the government side, let him take the lead in the Peace initiatives with the President taking a commanding role and being publicly visible. Have an internal move to put ODM-Kenya and PNU friendly parties into one. This becomes a HUGE advantage to Kalonzo who should be preparing for the 2012 Presidential elections. Get the Coast and Western Provinces fully behind the new unity party, whatever its name. DO NOT RELENT on the Media and wooing the youth in the new-Kalonzo unity initiative. Always give a forward looking, confident, inspiring and highly optimistic future with the young fully incorporated.

    Action Point – Keep Central Out of the limelight
    Central and GEMA tribes, the so-called Mount Kenya Mafia are Kenya’s favorite punching bags in the political arena. Keep the GEMA group in crucial supportive roles behind the scenes. Kamba and other non-GEMA tribes to be seen leading the imitative but not prominent in its formation. Have GEMA 100% behind Kalonzo with Western Kenya, Coast, N. Eastern and Rift Valley prominent in the new unity outfit. With such Strong unity and a corruption free progressive government, ODM will be struggling. Kalonzo should take that lead with public blessings of the president. With KANU left as a skeleton, a single strong united party, extremely disciplined should be the force required to confront ODM in the coming and inevitable battles in parliament and public Perception.

    Action Point – The Raila Factor
    Get the public talking about loss of life in the abortive 1982-coup attempt and the Dec 27, 2007 election aftermath. Connect the dots with public utterances on Raila to mean disgruntled, willing to kill and circumvent the law for leadership sake. The ODM adherents went with the winning propaganda party that looked like it would win with GEMA as the poster boys of ridicule, and it worked. Never relent on the violence and Raila’s desire to be president whatever the cost, including loss of life. Do whatever it takes to turn tables around for all to embrace each and all, irrespective of tribe. It can be done!

    Action Point – The Youth Factor
    The Youth must be incorporated in this new unity initiative. It needs to be fashioned in such a way to look like it is the Youths initiative, progressive, non-tribal and chic! If a young person has to be progressive and forward looking then one has to be made to be spearheading the new initiative that truly condemns and shuns violence and dismiss it. Strengthen the Women and Youth Development funds. Give credit to the Government.

    Action Point – The Western World Motive
    Insist on the motive for the Western government to ridicule and point a finger at Kibaki. Show publicly with convincing figures and graphs what the West lost in terms of no-bid government contracts with business moving to China. Show how they refused to support Kibaki after the contracts were cancelled. Show high tax collection and how it has been put to excellent use. Show budget supported by 95% local revenue. Show development was across the land before the violence. Show pictures of before and after. Show the West motive is to subjugate and domineer the poor countries and Kibaki managed to break free. Breaking free meant that the rest of the Poor countries were being shown the way forward by Kenya, and that the West can’t afford that. Show the WTO policies and how Eastern facing by Kibaki (Read China) is bad for the West and Great for Kenya and poor nations. Bring the contradictions of Raila courting Muslims by day and the West by night.


    All the actions should be thoughtfully timed with the public debate always insisting on peace and progress. Encourage others to acknowledge the Kibaki splendid record. YOUTH MUST of necessity, be at the core of the all these initiatives. After all, the future of the country (and indeed the kingdom of God) belongs to such as these young… Actually work has been cut for PNU side: just use the now infamous ODM Poll Strategy document only this time for positive outcome. Use similar SWOT analysis and above all, have the outcome ACTED upon. Swing this thing around using their weapon, clearly thought out action plans with specific goals and objectives with action-oriented operatives.

    This is serious business to be executed corporate style. No roadside or broadside statement declarations. No statement to be issued unless approved by the core think-tank. It’s a high stakes game by very senior management professionals.

    How can you judge what I said about Musalia to be leader of a transitional government to be UNTRUE if the real agreement has not been released by Annan? Are you judging me on the basis of whats published in the Nation/Standard website. He never stepped into a college classroom (Read-Makerere and LSE) but was from the school of hardknocks that taught him how to be a "gentleman" compared to this goon, if you ask me.
