Kumekucha Exclusive: Why Has ODM's Salim Lone Fled Kenya?

Kenyans have often been accused of having short political memories. As we and the rest of the world anxiously await the magic word from Kofi Anan, one man that seems to be slowly slipping from our collective memories is Samuel Kivuitu – arguably the chief architect of this whole fiasco. He was on Television recently and he had close to an hour to display his characteristic careless speak and sick humour.

As far as Kivuitu is concerned, Kenyans are spending too much time complaining and yet it was only the presidential tallying that went wrong. His question was, ‘what fraction is presidential tallying compared to the whole electioneering process’? Somebody please answer that. Was Kivuitu implying that Kenyans should applaud the commission for giving them Councilors and MPs? Without a clear president?

He went on to say that he was just as shocked as anyone else when the police stormed KICC and whisked him away from the room. He completely did not see that coming. His best explanation was that there were people so close to his table shouting and haggling and maybe the police feared that something bad would happen to him. We can all guess who those people were. He did not know either that there was only one media house when he was announcing the results. He saw lots of microphones and since he did not carry out a roll call of the media houses, he had no way of knowing that there was only the state broadcaster present. After all all microphones look alike. For all he knew the whole world was watching.

Asked about the commissioners who later emerged to cast doubt on the election results, he replied that they had all agreed to go and announce the results and that one of them actually oversaw the tallying. He invited those calling for the disbandment of the commission to go ahead and do so and replace the commissioners with Bishops and Archbishops since they can do a better job at ECK than him who has no role in the church. Why would anyone want to disband the ECK? They only announced results. They did not kill anyone! He did however feel some personal responsibility for the initial flare up of chaos but when they started taking a more organized shape, he freed himself of any blame.

In conclusion he insisted that the one who was announced as president is the one who won but there could be mistakes, the results were 100% right but they could be wrong and that he will not resign from ECK because of the flawed election. He will only resign after better systems are installed to ensure proper management of future elections. Systems like computerization of the voting process and improved communication of results among others.

NTV: Bottom line; Did Kibaki win the elections?

Kivuitu: That is a very difficult question.

Yes, Wanjiku, I agree with you. We have a very short memory. We are so focussed on Annan, ODM and PNU, that we are slowly starting to forget the other architects of this fiasco. And they need to be dealt with brutally.

Yes, our memory is short indeed. We are busy worshipping Kaburu/Tausi Raila as a democrat after he went around preaching about a certain "kabila adui yetu" and promoting majimbo as a code word for ethnic cleansing. Until Genocidal Raila is brought before a Truth Commission to repent his demonic tribalism there will be no peace in Kenya. Some of his followers are already beginning the talk like Hitler followers of "a final solution" in the Rift Valley. If that cannot make normal Kenyan to distance themselves from this maniac, then I agree with Taabu that Atmageddon is at our door!!!!

You know it doesn't matter what anyone feels. The truth is that Kibaki is the President of kenya wielding the unquestionable executive authority and that will be so for five years. Kofi Anan, George Bush and Condi Rice can say whatever they like but mark my words. If ODM will be in government any time soon, it will be by way of a few ODM members of Parliament serving as ministers in ministries that Kibaki considers simple enough for them to run. William Ruto will not be one of those lucky Mps. Once again Kibaki will use his mercy and generosity to give these guys jobs before fielding the indomitable duo of Kalonzo/Uhuru in 2012. Opposition Daima Milele--ODM. Like Karua said, the elections were not to be won by heckling. Power sharing also, will not be effected just because of endorsements from the US neither will it be because we blog our wishes out here.

Kivuitu did not do anything wrong. He just saved the nation from being auctioned to hawks.

We also forgot that we may be held hostage by a group of super rich men. These men paid US$15,000 to eat lunch with their benefactor.
We also forget that karua may have meant that elections is not won by heckling but by serious rigging... it has been done before anyway.
We forget that an officer was allowed to correct a small anomally of awarding kibaki 115% votes , he scaled it to 85%.
We forget that some sections of our country felt so left out in politics and the economics that goes with it. They have always being the king makers.
Politics is a dirty game, Kenya is big enough to accomodate all of us without exclusion. This winner takes it all thing should stop now.
If Raila were to win with the current constitution his handlers will have been tempted to throw their power around.
Instead of waiting till next election we need to change the constitution now and remove these perceptions.
Let our people not fight. The government should create an enabling environment for people to make a decent living , put food on their tables, pay school fees, travel... this is can be done by protecting the local industries, promote property ownership in shares, buildings, and other places not on land only. We need economic education whatever that is.
A people who are not hungry and angry will have no quarell with politics. That is why we have to address the question of equity and employment seriously. Let the wanachi know fairness is practiced everywhere.
Finally let us have strict laws against favoritism, nepotism, tribalism, and the like- vices. In our minds lets know that such laws are only effective when there is justice and fairness like it was during 2002-2004!
Our kenyan leaders have let us down big time. They have always put their interests first.
Will it change this time??

Wanjiku,u are spot on.These octogenerians who dont care less about where this country is headed used Kivuitu for their own selfish needs.He was part and parcel of all these and for him to come and say he knows nothing is absolute crap.He should not ridicule the intelligence of Kenyans.
Him and his likes should be dealt with without mercy for putting the country in the hell hole we are in.I beg to differ with an opinion posted here that Kivuitu has no blame-He KNEW what he was doing and was part of it.His integrity,so hard earned over the years has just wilted dry.

Kivuitu said he was ready to burn with Kenyans, i am wondering if he is burning right now. People say Kibaki rigged and yes he did rig, and yet some say Raila rigged and yes he might have rigged, but how come ECK allowed it.....Gabriel Mukele in a show on NTV just before elections were announced begged Kivuitu to do one right thing for this nation...He defied and now goes on yapping that he was sick at that time. If he was sick he should have stepped down before...How come his sickness is coming out right now...Let him say he was a pawn......I beg him and his cronies to resign so that we kenyans can start forgetting him

What wrong did Kivuitu commit? People cannot only be right when their decisions favour us. We should stop thinking people exist to entertain us. It is this kind of delusion that will have our hearts broken so many times over again. You guys shouted the loudest during the campaigns, you are evidently shouting the loudest once again but it is amazing how you will NEVER have your away, not with that kind of mentality. I am counting. First it was a weird prediction that Kibaki's reign wont last three days, then due to some unavoidable circumstances the period was extended to seven days. Now i have been told Kibaki has to concede power to raila. Dr. Rice has indeed been imported to come and bargain for raila. well, let's see who the fool is in this game.

We think we can survive on our own, kwani was God a fool when he created the boundaries of nations and made us co-exist with others...Right now we can not just co-exist as different tribes. One who was once your neighbor you see him or her as an enemy..Fidel Castro was able to steer Cuba through tough times though not well but he had the goodwill, mandate and the support of the masses and that is why he survived through it all ..Let we as kenyans try, >>.I am telling you it is hard for a man to rule another man who has not given him consent....Let us brace ourselves for tough times ahead....Unless God and God only intervenes for this country

Kenya govt activates murder gang-activist

NAIROBI, Jan 9 (Reuters) - Kenya's embattled government has activated a murderous criminal gang to protect its supporters during a bloody confrontation over disputed elections, a leading human rights activist said on Wednesday.

Maina Kiai, head of the government-funded National Commission on Human Rights, said the Mungiki, an ethnic Kikuyu gang notorious for beheading its victims, had returned.

"They are coming out again and being used by the state. We have firm evidence of that, some of their people came to us," he said.

Government spokesman Alfred Mutua angrily denied the claim: "If there is evidence of Mungiki, he should either table it -- and he had better make sure that it is the right evidence -- or just shut up."

There have been unconfirmed reports of Mungiki attacks on other ethnic groups in Nairobi's slums since violence erupted after the disputed re-election of President Mwai Kibaki in a Dec. 27 poll. About 500 people have died.

Many Kikuyus were killed in the Rift Valley and Nairobi's slums as other ethnic groups vented their rage over what they say was a rigged result.

Experts have long said the Mungiki were manipulated by Kikuyu politicians. They were first established to counter violence by Kalenjin ethnic gangs during elections in the 1990s, when Daniel arap Moi, himself a Kalenjin, was president.

But last year the human rights commission said police may have executed as many as 500 men during a crackdown on the Mungiki after the gang terrorised central Kenya with a wave of brutal attacks. Police denied the charge.

Kiai said the government had offered the Mungiki protection in the future if they protected Kikuyus against supporters of opposition leader Raila Odinga, who says he won the vote.

"They are now assured of security even afterwards. They said 'Okay we will not touch you again. We will not go for you as we did before'," he said.

Kiai called on Western powers to revoke visas for members of the Kibaki government, senior members of the civil service and their families as well as opposition figures.

He said this was the only way to push politicians into negotiating an end to Kenya's post-election crisis.

"Bring them back to suffer with us. Maybe then they will be forced into talking to each other," he said. "If all visas are revoked you will see movement so fast, you won't believe it. The breathtaking extent of corruption perpetrated by the family of the former Kenyan leader Daniel Arap Moi was exposed last night in a secret report that laid bare a web of shell companies, secret trusts and frontmen that his entourage used to funnel hundreds of millions of pounds into nearly 30 countries including Britain.
The 110-page report by the international risk consultancy Kroll, seen by the Guardian, alleges that relatives and associates of Mr Moi siphoned off more than £1bn of government money. If true, it would put the Mois on a par with Africa's other great kleptocrats, Mobutu Sese Seko of Zaire (now Democratic Republic of Congo) and Nigeria's Sani Abacha.

The assets accumulated included multimillion pound properties in London, New York and South Africa, as well as a 10,000-hectare ranch in Australia and bank accounts containing hundreds of millions of pounds.

The report, commissioned by the Kenyan government, was submitted in 2004, but never acted upon. It details how:

· Mr Moi's sons - Philip and Gideon - were reported to be worth £384m and £550m respectively;

· His associates colluded with Italian drug barons and printed counterfeit money;

· His clique owned a bank in Belgium;

· The threat of losing their wealth prompted threats of violence between Mr Moi's family and his political aides;

· £4m was used to buy a home in Surrey and £2m to buy a flat in Knightsbridge.

Kroll said last night it could not confirm or deny the authenticity of the report.

The Kroll investigation into the former regime was commissioned by President Mwai Kibaki shortly after he came to power on an anti-corruption platform in 2003. It was meant to be the first step towards recovering some of the money stolen during Mr Moi's 24-year rule, which earned Kenya the reputation as one of the most corrupt countries in the world.

But soon after the investigation was launched, Mr Kibaki's government was caught up in its own scandal, known as Anglo Leasing, which involved awarding huge government contracts to bogus companies.

Since then, none of Mr Moi's relatives or close allies has been prosecuted. No money has been recovered. Three of the four ministers who resigned after the Anglo Leasing scandal was exposed have since been reinstated.

Last night, the Kenyan government confirmed that it received the Kroll report in April 2004. But Alfred Mutua, the government spokesman, said it was incomplete and inaccurate, and that Kroll had not been engaged to do any further work.

"We did not find that the report was credible. It was based a lot on hearsay." He said the leaking of the report was politically motivated and insisted Kenya was working with foreign governments to recover the stolen money. "Some of the money is in UK bank accounts. We have asked the British government to help us recover the funds, but so far they have refused."

The report was obtained by the website Wikileaks, which aims to help expose corruption. The document is believed to have been leaked by a senior government official upset about Mr Kibaki's failure to tackle corruption and by his alliance with Mr Moi before the presidential election in December.

On Tuesday Mr Moi said he was backing Mr Kibaki for a second term, saying he was disappointed that "selfish individual interests have been entrenched in our society". Mr Moi remains an influential figure in Kenya and his endorsement is expected to go some way to ensuring his successor's re-election.

In the Kroll report the investigators allege that a Kenyan bank was the key to getting vast sums of money of out of the country via its foreign currency accounts. The same bank had already laundered $200m (£100m) on behalf of the late Mr Abacha, with the assistance of a Swiss-based "financier".

"It is believed that twice as much was laundered through the same system by the Mois," the report said.

Kroll confirmed last night that it had previously done work for the Kenyan government. A company spokesman was given extracts of the report seen by the Guardian. "We cannot confirm or deny that this report is what it purports to be," he said. "Nor can we talk about the scope, content or results of any work we have done for the government of Kenya, which remains confidential."

Records contradict minister

THE Government signed an Anglo Leasing contract for the supply of Sh500 million security telecommunication system in 2003, court documents show.

In a petition and affidavits filed in the Central Registry of the High Court by Midland Finance Securities Limited of Switzerland and Globetel Incorporation of Cambridge, UK, the documents contradict the dates given by Finance minister, Mr Amos Kimunya. Earlier yesterday, Kimunya had claimed, the contracts were signed during the Kanu regime.

A director of the two companies, Mr David Dunkley, says the Government entered into the contract for the installation and commissioning of a Nationwide Digital Multi-channel Security system on May 29, 2003. Globetel Inc was to supply the communication system to the Administration Police. On the same day, the Government entered into a credit-financing contract with Midland for the first phase of the security contract.


The credit was to be repaid within 72 months from the date the agreement became effective. “The credit contract and the security contract were subject to the laws of England,” he says. The contract, Dunkley says, was to last two years from the date of execution. “Indeed a legal opinion was accordingly issued by the Attorney General, Mr Amos Wako, on June 17, 2003,” he claims. The UK-based company immediately embarked shipment of the equipment in the interest of the timely completion of the contract, Dunkley says in his affidavit.

“As a consequence, Globetel Inc purchased the necessary equipment for installation, had it inspected and shipped in accordance with the agreement, to Mombasa,” he adds.
The two companies also filed a case before a constitutional court on April 4, seeking orders quashing the Government’s decision to hire PriceWaterHouse Coopers to investigate the contract. They also want the AG and the Kenya Anti-corruption Commission or their agentsrestrained from arresting or preferring any criminal charges against them, their shareholders, agents, directors or contractors.


The companies want the court to declare illegal and uncontractual attempts by Government to criminalise the commercial dispute between itself and the petitioners.They contend that the agreements were entered into on the strength of AG’s legal opinion and were, therefore, lawful and do not warrant scrutiny by the audit firm contracted by the Ministry of Finance.

Hearing of the case failed to kick off, yesterday, when a Nairobi advocate, Mr Fred Ngatia, told the court he had instructions from the two companies, to join their advocate, Mr Kyalo Mbobu, in arguing the case. Ngatia told Justice Joseph Nyamu that he needs time to prepare his arguments, a request the judge granted.

The judge ordered that the case be heard on February 11, next year.

We have heard and seen all manner of chest thumping and self justification all over the Kenyan blogs, including Kumekucha. Such pride and arrogance, from the so called PNU supporters, is surely based on shortsightedness about what tomorrow might bring. Those folks have put their trust and confidence in an individual and his government, forgetting that there comes a time in life when a falcon cannot bear the falconer. In the words of Chinue Achebe, the center will no longer hold and mere anarchy shall be loosened upon the world.

To the seekers of truth and justice, and all sons and daughters of God, who yearn for justice here is my word from the Holy book. God cannot be mocked and a man shall reap what he sows. Yes, the arrogant may trust in the might of the army and other state oppressive operators to suppress and trample upon the will of the people but Jehovah God is the defender of the powerless.

Let us seek truth and justice, even as we preach peace and reach out to those arrogant folks with love. Zeal without knowledge is a run away horse and those chest thumping folks are just too blind to think clearly for themselves. Their arrogance will be their downfall when Jehovah God shall hear the cry of the oppressed and say enough is enough.

It is a dreadful thing to fall in the hands of God. When God shall arise to punish this iniquity there shall be no more chest thumping. Those arrogant chaps with their mockery words you shall see or hear about no more.

Be comforted my brothers and sisters and take heart. Our God says do not revenge, it is mine to recompense. God is more than able to change the ballgame anytime. In his wisdom, He can allow the arrogant to prevail for a while before He intervenes and displays his might for His own glory. And who knows what God is up to and who among those arrogant guys is wise enough to instruct God? Shall a man play with fire and not be burned?

So be warned and take heed, when the fools display their foolishness in this blog about tomorrow, do not answer them in their foolishness but rather show them mercy. In a little while they shall come to know that tomorrow only belongs in the hands of God. In a little while they shall come to see the futility of putting their trust in their tribal kinsmen instead of reaching out to all people so that we can build a nation where justice, privileges, and opportunity sets are widely distributed. Their pride and arrogance has become their god and instead of sowing seeds of love they are busy sowing hatred and destruction. Busy dividing our nation along tribal and economic lines so that they can continue their domination.

Remember the biblical Ahab? What happened to him when he decided to take away the poor possession of Naboth? Shall a man trample of will of the masses that belong to Jehovah God and expect to escape the consequences? No, Naboth appealed to God because he could not be accorded justice in the land and God’s justice was enough.

They have planted the wind and they shall reap the whirlwind. Jehovah God cannot be mocked and His justice is coming.

Ndura Waruinge and Maina Njenga are still Mungiki
Christian convert and PNU politician Ndura Waruinge and imprisoned mungiki chief Maina Njenga have not "properly deserted mungiki", we can now report.


A leader of the gang in Central Nairobi, a Mathenge (Mnyama) was asked by a reporter why his dreaded gang had not beheaded the duo. His answer was curt, "They are alive because we know they have not moved, there are clear structures on how resignations of top leaders are handled, look they were once Muslims remember that conversion? Now they are Christians, maybe tomorrow they will be Hindu but the bottom line is that they are still part of us".



From the interview, it emerged that some of mungiki's followers are the educated middle-class who contribute a whooping KShs 2 billion a year to sustain the gang. Consequences for defaulting are scary, the gang says.

Asked whether they kill people, Mathenge retorted, "True we have been killing people but you have to understand us, even God in the Old Testament killed people who did not toe the line of the Law. We have been killing defectors, and those who refuse to pay their dues for our services and that will not stop".

Asked how many mungiki members are in Kenya and abroad, "We had our last National Convention in April 2007 in Thogoto and we realized we had recruited 45,000 new members we are now about 2.8 million, of course excluding Women and Children".

The group is currently led by one Joe Waiganjo (General) and draws membership from some of the politicians in parliament.


Meanwhile, a plan by the outlawed Mungiki, a sect which is slowly transforming into an Italian like Mafia, was to blame for most of the crimes committed in early 2007 in the East African nation, a confidential twenty-four page police report indicates. As for Kivuitu even though we are by the good book not to judge- I hope he always has sleepless nights bcoz of the pple burnt in Eldoret and Naivasha.
-I hope where he is he talks to himself.
- Sacking him from ECK is not enough, he should feel in 1000 ways the pain of all the dead Kenyans and in 500,000 ways the suffering of IDP's.
- He is shameless rotten and I did not watch his interview on NTV neither can I watch it anywhere else.

Please get out of this emotional state you are in and think long term. Come 2012, I would hate to hear you cry again that your man is rigged out. While you are busy singing the international community anthem, Kalonzo is busy consolidating and aligning himself with the largest voting block in Kenya. You may think that it is funny calling him Kalooser, but if things continue his way, the election between an ODM candidate and Kalonzo will not be a close call. Kalonzo will win with a landslide and your muzungu friends will laugh at you if you cry a second time for help. If you do not change your attitude, you might as well start getting used to calling him HIS EXCELLENCY IN WAITING KALONZO. For a start, Kalonzo is a humble man who has never embraced violence as a political instrument, or promised revenge to anyone, or rationalised the deaths of fellow Kenyans simply because they are from an "enemy" tribe. Better still he does not have a Kisumu Molasses factory hanging around his neck. The traitor-in-chief has been found red-handed. Kalonzo Musyoka's running-mate and Kenya's first ever female Veep in waiting, Prof Julia Ojiambo has rocked the delicate Kibaki-Kalonzo banditry by suing the party for renegging on its earlier promise to nominate her. ODM Kenya chairman Daniel Maanzo and Julia Ojiambo have moved to court to sue vice president Kalonzo Musyoka, two nominated MPs and ECK for failure to nominate them to the 10th parliament. ODM-Kenya nominated Mr Mohammed Affey from North Eastern and Ms Shakira Omar from Coast.


The two also argue that Kalonzo had turned them down even after promising to nominate them in public.

Now it is Julia's turn to tell us the deal that was sealed to hand over LPK to Kalonzo and enable him escape with odm-k with which he entered into a bandit regime with Kibaki.

This new twist comes as a complete embarassment to Kalonzo who is abroad for prayers. Earlier today Kalonzo met US Senators Feingold and Peyne. While meeting with them, Kalonzo who is in a bandit power arrangement with Kibaki revealed his fears for the success of the mediation efforts by Annan whose efforts "must never fail". When he met New Jersey Congressman, Mr Donald Peyne, who has also sponsored another resolution on Kenya in the Congress, Kalonzo argued that proposals for power sharing were reasonable, but such arrangements could reverse democratic gains made over the years and run contrary to the Constitution, which declares that Kenya is a multi-party democracy.

Kenyatta, Moi and Kibaki land holdings

Kenya's two former First Families and the family of President Mwai Kibaki are among the biggest landowners in the country. The extended Kenyatta family alone owns an estimated 500,000 acres — approximately the size of Nyanza Province — according to estimates by independent surveyors and Ministry of Lands officials. (This report first appeared in the Standard Newspaper report by Mr. Otsieno Namwaya)

The Kibaki and Moi families also own large tracts, most held in the names of sons and daughters and other close family members, all concentrated within the 17.2 % of Kenya that is arable or valued. Remember that 80 per cent of all land in Kenya is mostly arid and semi arid land.

According to the Kenya Land Alliance, more than a 65% of all arable land in Kenya is in the hands of only 20 per cent of the 35 million Kenyans. That has left millions absolutely landless while another 67 per cent on average own less than an acre per person.

The building land crises in the country, experts say, will be difficult to solve because the most powerful people in the country are also among its biggest landowners.The tracts of land under the Kenyatta family are so widely distributed within the numerous members in various parts of the country that it is an almost impossible task to locate all of them and establish their exact sizes.
