PNU Not Interested in Justice or Peace

After rebuffing the mediation mission of OAU Chairman and Ghanaian President, John Kufuor, the so called PNU government now seem hell bent on ensuring that the efforts of his nominated peace-broker Koffi Annan does not see the light of day.

Yesterday as the thriller was going on in parliament, breaking news flashed on TV screens to announce that Koffi Annan has postponed his trip to Kenya after "suffering a serious bout of flu." Other rumours contend that Mr. Annan fainted as he was boarding an aircraft to bring him to Kenya at Kotoka International Airport in Accra and had to be rushed to hospital. None of these two incidents have been reported in mainstream Ghanaian press or elsewhere.

Surprisingly, nothing has been said of the status of his two other eminent persons, Mrs. Graca Machel-Mandela and former Tanzanian President Benjamin Mkapa who were to accompany Annan to the mediation talks.

Mr Annan's sudden illness came only a day after John Michuki, while handing over the internal security docket to incoming minister George Saitoti, arrogantly questioned Annan's visit to Kenya terming it unnecessary.

Ever since Mr. Kivuiti tragically plunged this country into unprecedented chaos by declaring Kibaki president and later adding fuel by confessing that he, as ECK Chairman, did not know who won the presidency, it has become clear that the PNU government is not keen on mediation or negotiations with ODM and it does not value the lives of Kenyan citizens. While everyone else is concerned about violence, needless deaths and flawed elections, PNU seem to be saying - everything is alright. What nonsense I say!

It is also clearly emerging that the PNU is deluding itself that it is a democratically government that is fully in charge of the country and that the ODM should be the official opposition party. The PNU government largely undermined the Kufuor mission from the outset, with prematurely appointed government ministers repeatedly saying no mediation was needed since there was no problem in the country. All the while - live media broadcasting is "banned" and political rallies "outlawed" - Kenyans are not only needlessly dying. Kenyans are undergoing untold suffering in their hundreds of thousands. In addition to this, several former African heads of state have been given a cold-shoulder by the PNU government and nobody knows quite what happened to the efforts of Nobel laureate Desmond Tutu. The concerns of international community have been openly rebuffed leading to threats of imposing economic sanctions by all major donors. Is there any guilt or self-respect in government? Dont these Kenyan lives have any value?

On the other hand, ODM has been seen to be committed to all mediation processes and had even dropped all pre-conditions, including suspension of mass action rallies, in order to facilitate the negotiation with PNU in a peaceful atmosphere. According to ODM, "it is patently obvious that we do not have a partner to negotiate with."

Where does this leave helpless civilians?

  1. I think all the so called Eminent persons are just messing with our heads for nothing.
    Kenyans will have to get a Kenyan solution to those who have stolen our rights.
    There are those who trivial the issues and think Kibaki is sitting pretty bcoz he sneaked and swore himself under heavy guard.
    We have a long stretch to go and people will soon stop talking of biz losses as the figures will be too mind bogling.
    Meanwhile the thief should not 4-get there is a higher authority above all of us who knows what he has planned??

By then bwana Amollo will be 77 the right age for a president, now he is too young and inexperienced, let him get very needed exp. in hte opposicion benches.funny to see how Ndimama was very agitated yesterday!

  6. Anon@6:26, ditto! I have asked that question several times and have not received any answers. Maybe you'll yield some responses;-). I have read posts advocating the media ban and outlaw on rallies. When Moi did all of the above in the late 80s and early 90s, he was a dictator; when Kibaki does the same he is "teaching Kenyans a lesson, showing them who is in charge, restoring order, etc. Thus, it seems it's ok to hijack our fragile democracy and its institutions, violate the civil rights of Kenyans if Kibaki has his foot on the gas peddle but no one else!

    Finally, every single Kenyan life is valuable. No tribe has a monopoly on that....from those burned in the church, those dying as a result of genital mutilation, those dying simply because they look like they belong to a certain tribe, those brutally shot by police (looting nothwithstanding -that's what jails are for)those dying because their neighbors have turned against them, etc.

It is interesting to see how people all of a sudden get hit with a dab of amnesia and forget that a month ago Kenya was one of the most stable and economically productive countries within the sphere....who do we accredit that to???     Parliament yesterday was pathetic...it looked like something out of a tasteless reality show starring Orengo .

    Now after they have yapped and yapped week calling for peaceful demonstrations . They stated last week after police threatened to ban the demonstrations and I quote "let them arrest us, it is not the first time they have done so" then come the big day they are all AWOL. IN ALL HONESTY WHO LOOKS LIKE THE FOOL HERE???

    I am positive that Mr. Annan backed out for the only reason he was not ready to join the circus as all he was coming to do in negotiate with a bunch of ridiculous clowns.

  18. NAIROBI, Kenya - Kenyan police battled hundreds of opposition protesters on Wednesday, killing two, as the opposition defied a ban on rallies against President Mwai Kibaki’s disputed re-election, witnesses said.

    From the western opposition stronghold of Kisumu to the coastal city of Mombasa, in the capital Nairobi and the Rift Valley town of Eldoret, police clashed with gangs of youths, some of whom erected roadblocks and burnt tires.

    Police in Kisumu shot in the air and used teargas and batons to disperse a 1,000-strong crowd. Two men were shot dead, witnesses said. A Reuters cameraman saw a corpse in the street, with bullet wounds in the back and side.

    In Nairobi, police chased a series of protesters through the central business district, firing teargas and live rounds in the air. The gas seeped into nearby offices.

    Three youths were shot in the back of the leg as they tried to run from officers in the sprawling Nairobi slum of Kibera, one of Africa’s biggest, a hospital administrator said.

    'Trying to escape'
    “It was so crowded, a very narrow place. I was trying to escape and I got a bullet in my leg,” one of the three, 18-year-old student Oscar Junior, said from his hospital bed.

    Many Kenyans and expatriates in the capital stayed at home, shopkeepers boarded windows and traffic was light.

    More than 600 people have died and 250,000 have been left homeless in the turmoil since Kibaki was sworn in after a December 27 vote that the leader of the opposition Orange Democratic Movement (ODM), Raila Odinga, says was rigged.

    Police outlawed three days of rallies called by the ODM. Rights groups and Western governments, including the United States, have called on Kenya to lift the ban.

    Gangs threw up roadblocks near Eldoret, in the Rift Valley area worst hit by the violence, while in Mombasa, police dispersed some 150 youths, scattering them briefly before they attempted to regroup, witnesses said.

    “We want Kibaki to resign and pave the way for our rightful President Raila Odinga,” said demonstrator Joel Oduor in Kisumu, coughing and crying from teargas.

    Government challenges critics
    Kenya’s political crisis has jeopardized its democratic credentials, angered donors, driven away tourists and hurt one of Africa’s most promising economies.

    Fuelling doubt over Kibaki’s win — officially by 230,000 of 10 million votes cast — a senior U.S. official said on Wednesday it was impossible to know who won the presidency.

    “We have done our own analysis. What it shows is that the result was extremely close and that whoever won probably won with no more than 100,000 votes at the most,” Washington’s ambassador to Kenya, Michael Ranneberger, told the Daily Nation.

    “It is really not possible to say with certainty who won because the process was not transparent.” But he called for power-sharing rather than a new vote or re-count.

    Kibaki has solidified his position by naming the core of a new cabinet and convening parliament. But the opposition got a boost by winning the post of speaker in the assembly on Tuesday.

    'Turning point'
    “Yesterday marked a turning point,” Odinga told reporters. ”The terrible wrong done Kenyans on 27th of December will not be able to stand. This is an illegitimate presidency.”

    ODM has the most legislators of any party, but does not have enough to win a no-confidence vote unless parties allied to Kibaki join it. Underscoring its narrow edge in parliament, ODM’s choice for speaker won by just four votes.

    The United States and 12 other nations threatened to pull direct aid if the government’s commitment to “good governance, democracy, the rule of law and human rights weakens.”

    But the government challenged critics to show proof.

    “You have publicly claimed that the presidential results were flawed. Can you provide tangible evidence?” said a state advert in local media.

    The opposition also stands accused of rigging and ballot-stuffing in its own heartlands during the polls.

    The part of the constitution that you post made me sit up and think for a minute.

    What if ODM by the miracle of God was able to garner the 2/3 majority in parliament and pass the vote of no confidence in Kibaki’s government, would Kibaki give up power?

    I highly doubt it, given the precedent that was set after December 30th.

    The only way of making Kibaki listen is to launch an armed insurgency then come to the negotiating table as equals both possessing instruments if violence

Raila is the people's president, the people i.e. the majority of Kenyans who voted in the presidential election are with him. There are many innocent Kikuyus who ar ebeing targeted by some frustrated Kenyans and that is wrong. While I cannot as a compassionate human being ever condone such activities I do believe that inciteful comments from silly bitches like Vikii who prior to special surgery once were men, only add to the general frustration. If people are ready to move on why is there still a media ban, why do the police have to prevent people from exercising their rights? The reason is PNU is living a lie. I have read some imbecile has talked about the formidable duo of uhuru and Kalonzo and laughed. This country won't be led by two people who are at their best when they are on their knees awaiting direction from their masters not to mention the fact that neither can muster any kind of support that even resembles a national outlook. i know some of you have come to Vikii defense, but i must remind you all that despite whatever surgery she has undergone, she was once a man and men should stick up for themselves even those men who like to suck dick(kalonzo's albeit)!!

  26. It is amazing the way everything says that Kibaki rigged the elections, but so far no evidence has been brought to the table. As ODM has the country pretty much under arrest, and have recently put their stamp on the parliament, it is time for them to put forward this evidence. If any of you had the ambition to be a president, and you were sworn in in suspicious circumstances, I am sure you would still defend your position until proved otherwise. If Raila and his advisors are thinking on their feet, they should be looking for subtle ways of unseating Kibaki, not trying to pull a Mexico because some Dick Morris person saw what happened in Mexico and advised them to use the same tactic twice. It is not working, time for plan B.

That in addition to the other commisioners that have had the decency to come out say the process was rigged once it was clear Emilio was losing. Furthermore why would ODM waste their time in a court system that has also be ruined by the likes of emilio and co. It would be like a black man trying to prove a hate crime in Mississippi during the 1960s.   32. ODM officials have produced a list of MPs to be nominated. On the other hand, ODM Pentagon (hehehe) has produced a DIFFERENT list of MPs to be nominated amongst them the fellow ODM star that failed to shine in Gachoka--Nyagah--and the friend of the Warlord Ruto called Musa Sirma.
    Raila has emphatically said that the Pentagon list is Final!.
    The ECK has to go with the list produced by the Signed Officials, not the Pentagon's list.
    Maybe its just me but Pentagon will call for mass action to protest their list was the right one and their nominated MPs were rigged out by ODM officials and ECK!. They will then burn houses in Kisumu.

    And now, ladies and gentile men, brace yourself for the splitting of ODM with Raila as a de facto leader of a faction! (ODM-Asili, ODM Saba Saba; ODM Pentagon; ODM "we won but were rigged out" Peoples president?--now accepting names!). When this happens, it will not be the first time that Raila breaks ranks with his own party--NARC, LDP, NDP, FORD-K, KANU--etc.
    When those nominated MPs from ODM officials come to parliament, they will be sucked in by PNU,having been jilted by ODM-Pentagon, then any ODM MP who needs a ministerial position, just needs to get a letter from the legal officials of ODM to be in the GNU.
    History, folks, has a way of repeating itself.

    The constitution does not call for 2/3 majority in parliament to pass a vote of no confidence... just a majority.
    Hence 51% of elected and nominated members or parliament is all the opposition needs to take this action.

    officio members), and of which not less than seven days’ notice has been
    given in accordance with the standing orders of the Assembly, declaring
    that it has no confidence in the Government of Kenya, and the President

    on the fourth day following the day on which that resolution was passed.”

My dear anonymous, I am merely stating the truth, you didnt respond to what I commented, you brought up a whole new topic about the ECK commissioners who said that it has been rigged but havent even mentioned who they think has rigged. On that saturday before they announced the results, ODM had countless doctored form 16's and 16a's in addition to the returning officer whistle blower who has 'fled'.What happened to all those documents? They must still have them somewhere. If they had such an airtight case, they would have won by now, Kibaki would be at least disgraced prompting fresh elections or something of the sort. ODM do not have to use the court system to show their evidence! They can use the media, which in spite of the ban can still record and play their broadcasts,maybe they should consult Greenpeace, who are very good at this sort of thing. They tried to pull a Mexico, you cant even defend that, DIck Morris was the advisor to the Mexican president (The Kibaki) and saw watched the opposition tactics from a front row seat. All I have said is, if ODM want to be political kingpins, they better start using plan B, coz plan A is starting to falter, and it might weaken their battle. This is like a boxing match, theyve tried the punches, now they should try being quicker and more nimble on their feet.

  37. Sweet banana. point well taken. ODM have nothing to show or any proof the PNU rigged the elctions. Although is is abvious that both parties did rig the elections. All ODM constituencies had a voter turnout of near/over 100% the registered votes. How can this be practicable. Mr. Raila's campaign was absolutely successful to the extent that there was a voter turnout in excess of 100% in al constituencies. How can this be practicable? His PR campaigns were even outstanding. He was able to shift election rigging focus to PNU even before the elections started. come on, does anyone see some anomaly here?

  48. Following Kenyan politics has become depressing. I shed tears for those who are struggling to survive (Jua Kali, domestic work, under paid workers, subsistence farmers, etc, etc.)

    Imagine if all the resources spent in battling for the Presidency would have gone into Medicine, Micro loans, and many more worthy causes.

    Yes, you have elites fighting it out, but only elites have the resources to rise and therefore lead. People should be thankful that you have the Railia's and Kibaki who want to lead the Nation.

    BUT, elections are there to usher change if necessary. If ONLY Kibaki had been graceful in defeat.

    I for one am deleting all Kenyan blogs from my Favs. I have had enough.

    We Kikuyus have everything: Banks, Supermarket chains, International Hotels at the Coast and NBI, Dairy processing, Coffee, Tea Estates, Soft Drink Industries, Brewing Industries, etc.

    I am aware that most scientists and best lawyers are from Western Kenya. We need people, who dont earn alot to do scientific thinking and lawyers to protect our interests.

    We need consumers everywhere in the country.

    We have settled anywhere in Kenya from Ukunda to Busia, from Garissa to Homabay, from Eldoret to Taveta. We are everywhere.

    What if the whole Kenya turns against us, shall we be able to survive? How will the presidency help us with? My uncle's thriving buisiness plus villa has been burnt down in Eldoret. He will never go back to the wonderfull town again. How will the 5 yr stolen presidency help him with? Is it worth losing Kenyan customers, and in the big Kikuyu hotels in Mombasa, international tourists because Kibaki wants to keep on playing golf and pretending to be ruling?

    My niece had a kiosk in Mombasa, my cousin had a stall in Kisumu, my sis-in-law had a textile shop in Kakamega. They are all dead! Will the stolen presidency make them live again.

    My fellow Kikuyu men and women, Kenyans have been cheated. Kenyans are not fools. Kibaki has refused to allow democracy to continue in Kenya. We are the only community which will pay dearly for this coup de tat by Kibaki, EVEN IF PEACE prevails.

    Let's open our eyes. Reject injustice in Kenya. I warn that we shall suffer, if we dont join hands with other Kenyan brothers and sisters to codemn this democracy killer named Kibaki.

    Enough is enough. Kenya should remain democratic and UNITED. Join other Kenyans to demontrate against tyranny. Save Kenya, if you love Kikuyuland.

  58. ODM officials have produced a list of MPs to be nominated. On the other hand, ODM Pentagon (hehehe) has produced a DIFFERENT list of MPs to be nominated amongst them the fellow ODM star that failed to shine in Gachoka--Nyagah--and the friend of the Warlord Ruto called Musa Sirma.
    Raila has emphatically said that the Pentagon list is Final!.
    The ECK has to go with the list produced by the Signed Officials, not the Pentagon's list.
    Maybe its just me but Pentagon will call for mass action to protest their list was the right one and their nominated MPs were rigged out by ODM officials and ECK!. They will then burn houses in Kisumu.

    And now, ladies and gentile men, brace yourself for the splitting of ODM with Raila as a de facto leader of a faction! (ODM-Asili, ODM Saba Saba; ODM Pentagon; ODM "we won but were rigged out" Peoples president?--now accepting names!). When this happens, it will not be the first time that Raila breaks ranks with his own party--NARC, LDP, NDP, FORD-K, KANU--etc.
    When those nominated MPs from ODM officials come to parliament, they will be sucked in by PNU,having been jilted by ODM-Pentagon, then any ODM MP who needs a ministerial position, just needs to get a letter from the legal officials of ODM to be in the GNU.

  59. Road to recovery likely to be long and hard for Kisumu after violent protests:

    A town that had established itself as a regional economic and commercial hub self-destructed in an orgy of violence as gangs went on the rampage under the pretext of protesting the outcome of the presidential elections.

    From being the vibrant gateway of the larger Eastern African market, Kisumu has been paralysed by violence, and the aftershocks are being felt in Rwanda, Uganda and other countries which rely on Kenya’s road network for fuel supplies and for cargo from the port of Mombasa.

    It will take years for the town on the shores of Lake Victoria to rise from the debris and regain its lost glory.

    Anglican Bishop Francis Abiero said the town was facing “a slow, painful realisation that it could be condemned to endless stagnation”.

    Death, blood and tears have been haunting the town since December 30, with authorities estimating that about 50 people could have been shot dead by the police.

    Hospitals in the town have over 60 patients nursing gunshot wounds, while 146 others had been treated and discharged, said Dr Julianna Otieno, the medical superintendent of the New Nyanza General Hospital.

    Sought treatment

    The number could be higher because there were patients who sought treatment in private hospitals.

    The debris of the destroyed buildings mirror the tattered hopes of thousands of people who worked in the town but now face joblessness. Supermarkets, bars, churches and industries are no more. They were looted and burned.

    On Oginga Odinga Street, two branches of Ukwala Supermarket and two Bata shoe shops were looted and burned by youths. Port Florence Hospital and the Swan Centre, which hosted several shopping outlets, were not spared either. The same fate befell Tusky’s Supermarket and two branches of Kimwa Hotels on Jomo Kenyatta highway. Kimwa Hotels owner, Mr Miriti Muthara, said he incurred loses estimated at Sh40 million.

    But managers at both Ukwala and Tusky’s said it was difficult to establish the amount lost because vital documents on stocks were destroyed.

    On Obote Road, shells of burnt-out vehicles stand at intervals. Not even new cars that had been on display were spared by the arsonists; Looters also stole spare parts from the Crater Automobiles showroom which had six cars at the time. After stealing, they set the showroom on fire.

    At the Lake Victoria South Water Board, the car park is littered with burnt shells of 17 vehicles which stand near the office block that was also destroyed by arsonists.

    Stalls from where estate residents bought groceries were also reduced to ashes as was the Kibuye open air market, which feeds the town and provides employment to many. The town’s industrial area, where hundreds of casual workers used to line up every morning in search of jobs, now looks like it had been attacked by mortar fire.

    What started as a street protest degenerated into massive looting within hours. Gangs moved from shop to shop, emptying stocks and then burning the premises.

    But unlike post-election violence in the Rift Valley, where marauding gangs were targeting ethnic communities they accused of not voting for ODM, in Kisumu the pattern was more of random looting and burning.

    However, it was also only in Kisumu that looters were felled by police bullets. Still, local businessmen have accused the police of not doing enough to secure the central business district from destruction as happened in Nairobi.

    Gunshot wounds

    A senior medical officer at the provincial hospital, who spoke on condition of anonymity, said almost all the deaths recorded in Kisumu were from gunshot wounds.

    “From a medical perspective, we think there was a shoot to kill order from the fact that most of those admitted either had bullets lodged in their abdomens or chests,” said the doctor.

    Mr Aggrey Mwamu, the Law Society of Kenya West Kenya branch chairman, said over 80 per cent of the deaths recorded in the town occurred in residential areas, which in his view, were free of the looting reported in the Central Business District.

    But Kisumu police boss Simon Kiragu denied accusations of high handedness and dismissed claims by the lawyer and the doctor as subjective.

    “The police reacted depending on the magnitude of the violence, but even then, we tried our level best to restrain from shooting more people,” he said.

    At the height of the chaos, there were rumours that the shootings were the work of military officers from Uganda, an allegation that police spokesman Eric Kiraithe later disputed.

    Before the violence broke out, Kisumu was an attractive town for businesspeople because they enjoyed good returns from their investments. But now, many of them are lamenting after suffering huge losses at the hands of looters and arsonists. The business community, led by the local chapter of the Kenya National Chamber of Commerce and Industry, has asked the Government to exempt them from paying taxes. They said that they had incurred huge losses and their books of accounts had been destroyed by fire.

    The chairman of the Kisumu chamber branch, Mr Jerry Ochanda, expressed doubts that some businesses could be revived. According to him, grants would be needed to help them restock but even then the question of investor confidence still remains because many had fled and had vowed never to return.

    Mr Ochanda said the losses incurred could run into billions of shillings. According to him, many of the burnt buildings will have to be brought down because they were damaged extensively.

    Besides this, Kisumu has been struggling to get its routine supplies of vital commodities because major roads leading to the town still had illegal roadblocks manned by gangs of youths especially in Rift Valley.

    Many businessmen and professionals doubt that Kisumu can recover soon without massive injection of external help.

    “Donor support to micro-finance institutions and other affected groups can help alleviate these problems and save us from collapse,” said Mr Samuel Deya, the executive director of Adok Timo, a micro-finance institution. Mr Deya estimated that small and medium-sized businesses lost Sh50 million due to missed business opportunities and destruction of property. Close to 80 per cent of the such businesses were affected by the violence. These include 184 shops which were looted and burnt leading to a loss of 5,000 jobs. This will adversely affect micro-finance institutions which are unlikely to recover outstanding loans.

    Some business premises that have started operations have to incur the extra cost paying for armed security to keep away hungry looters.

    Business losses

    Besides the business losses, Anglican Bishop Francis Abiero said healing could be hard to come by because politics shattered the harmony communities enjoyed in the past.

    “The country is bleeding and the confidence and trust communities had in each other were eroded by the aftermath of the elections. It will take a long time to restore the glory of the town and heal the inter-tribal relations,” he said.

    The Kisumu police boss has also expressed fears that the once secure town could become crime-prone because major shops and business activities had been grounded and the town had experienced a high exodus of investors. These could lead to further job losses.

    In the estates, it has become difficult for shoppers to carry home their supplies because of hungry criminal gangs who steal from passersby.

Raila Odinga walipoingia kwenye ukumbi wa Bunge huku kila mmoja akiwa ametazama upande wake kana kwamba ni paka na panya. Inasemekana wawili hao hata kupeana mkono walishindwa.

    Alipoingia Bw. Odinga katika ukumbi huo wa Bunge mishale ya saa 8:40 mchana, msindikizaji wake ambaye alikuwa ni mbunge wa Mvita Bw. Najib Balala, alipaza sauti yake na kusema ``Mheshima Rais`` ikiwa ni ishara ya kuwataka wabunge wa upinzani kunyanyuka ili kutoa heshima kwa Bw. Odinga.

    Sakata lingine lilitokea pale mbunge mmoja aliposimama na kutoa hoja akitaka maelezo ni kwanini Rais Kibaki aanze kwa kupiga kura yake wakati wanafuata mpangilio wa kiherufi.

    Hata hivyo msimamizi wa uchaguzi huo, Bw. Samuel Ndindiri, alikataa hoja hiyo na kusema kuwa Rais Kibaki ndiye atakayeanza kupiga kura.

    Baadaye alifuata mbunge wa Budalang\'i wa ODM Bw. Ababu Namwamba, ambaye aligoma kupiga kura yake hiyo na kumweleza msimamizi huyo kuwa ``Huyu ni rais wa watu anahitaji heshima yake pia,`` akiwa anamaanisha Bw. Odinga.

    Baada ya kusema maneno hayo, alimwita Bw. Odinga kwenda kupiga kura yake, wakati huo, Rais Kibaki alibaki kwenye kiti chake mara baada ya kupiga kura yake huku akibadilishana mawazo na baadhi ya mawaziri wake.

    Aidha mara baada ya uchaguzi huo uliompa ushindi Bw. Marende wa ODM Rais Kibaki, ambaye katika kipindi chote cha mkutano huo hakuzungusha jicho lake wala kusemeshana na Bw. Odinga alinyanyuka na kwenda kumpongeza spika mpya wa Bunge hilo.

    Nafasi ya uspika ilikwenda kwa mgombea wa chama cha ODM, Kenneth Otiato.

    Mgombea huyo wa ODM alinyakua kura 105 dhidi ya mpinzani wake, Francis Ole Kaparo ambaye anatoka chama cha PNU cha Rais Mwai Kibaki, aliyepata kura 101.

    Kwa mujibu wa magazeti mbalimbali ya nchini humo, Rais Kibaki na hasimu wake mkuu Bw. Raila, licha ya kukaa katika viti vilivyokuwa umbali kama wa mita tatu, hawakuangaliana usoni.

    Kibaki alikuwa amekalia kiti cha urais wakati Odinga alikuwa ameketi katika kiti cha Kiongozi wa Upinzani.

    Awali wabunge wa PNU iliwalazimu kuingia ndani ya ukumbi huo saa 7:30 mchana ikiwa ni saa moja kabla ya kuanza kwa kikao hicho cha kumi cha bunge, kutokana na kuwepo kwa fununu kuwa wabunge wa ODM walikuwa wamepanga kukaa upande wa Serikali.

    Wabunge wa ODM waliingia ukumbini hapo kwa pamoja mishale ya saa 8:10 na walipotinga tu ndani, wakaenda moja kwa moja kuketi upande wao wa mkono wa kushoto wa Spika.

    Mbunge wa Muhoroni wa ODM, Prof Olweny Ayiecho, aliwakejeli wabunge wa PNU kwa kuwaambia ``Inaonyesha hata hamkwenda kupata chakula cha mchana leo``.

Our tough lady,the daughter of the toilet cleaners was interviewed by bbc and she stressed that they never expected ethnical retaliation but just a small street protest over the flawed result.I take this to mean just a few luos throwing stones.Kenyans are not all luos.The Rift valley guys are not rioters but warriors.Yesterdyay there were sixty thousand protesters in eldy and what scares me is what they did in the streets,they cursed a traditional spell of war.Another very sad thing is that the there is no tribe in this country called the discipline forces.Those are our son being missused and they are slowly getting tied.Am told there are now split on politically and they are just waiting for something to trigger the major split.Be prepared of worse things to come.The govt is taking us there.

    from what i have seen on this blog (someone quoted the constitution on motion of no confidence) an election is possible soon (ok, assuming all ODM MPs and those who support them are willing to seek a fresh mandate).

    that possibility logically led me to wonder aloud as i did.

    Kibaki obviously will not step down unless (as someone suggested) there is voilent leverage. which right-thinking kenyan is ready to go into a guerilla war?

    a vote of no confidence is to me a more attractive option. this will only happen if ODM is genuine about quest for democracy because it raises two important strategy issues:
    a) is a majority of parliament willing to seek a fresh mandate?
    b) if the answer to above is yes, would a re-run hand Raila the presidency?

    if the answer to (b) is no then you can kiss the vote of no confidence goodbye.

    jan, are you telling me such discourse is purely academic?

    can someone shed some light regarding the constitutional position regarding a re-run - will kibaki be eligible?

  95. If there was a re-run and Raila lost, do you think it will change? This guy and his fellow ODM'ers have not contemplated defeat as option. They will only take a 'win' and that is what 'democracy' means when you look at it in ODM PERSPECTIVE.
    They have completely misinterpreted the whole idea of democracy, justice and peace. They see themselves as total Kenyans above all Kenyans . ODM should not really go ahead of itself. It has proved not to be good for them for example; the election of Mr Marende is to the benefit of the government as it is to them. ODM’ers have proved to us they have no respectable leadership nor character.

Jambs, from my interpretation of the constitution, Kibaki would still be eligible to run constitutionally unless the High court rules that his appointment was invalid and even so, until they hold fresh elections in his constituency he still has the powers and privileges of an MP and if he wins again, they cant convict him of rigging the elections until the seat of president is declared vacant. After this then they have to hold fresh elections anyway.

    '(3) Where at any time the High Court determines under section 44 that the President has not been validly elected as a member of the National Assembly, or that the seat in the Assembly of the President has become vacant, the High Court shall declare the seat in the Assembly of the President to be vacant, and:-

    (a) an election shall be commenced forthwith and shall be held in the constituency for which the President stood for election as a member of the Assembly; and

    (b) if the President is not elected as a member of the Assembly at that election, he shall cease to hold office as President upon the expiration of the time allowed by law for the making of an application to the High Court under section 44 in respect of that election, or, where such an application is made by him or by the Attorney-General, upon the High Court determining that the person declared to be elected at that election has been validly elected:

    Provided that:-

    (i) if the High Court determines, in relation to an election held pursuant to paragraph (a) at which a person other than the President has been declared to be elected, that that person has not been validly elected, the High Court shall declare the seat to be vacant and a further election shall be held pursuant to paragraph (b) and this proviso shall apply accordingly;

    (ii) notwithstanding that his seat in the Assembly has been declared to be vacant, the President shall be entitled to sit as a member of the Assembly and to exercise all the powers and privileges of an elected member of the Assembly until he ceases to hold office as President.

    (3) Where the High Court determines under section 44 that the President has not been validly elected as President for any reason other than that he has not been validly elected as a member of the National Assembly or that the seat in the Assembly of the President has become vacant, he shall cease to hold office as President.
