ODM Refuses to Endorse Kibaki's Presidency

Kenya's leading opposition candidate, ODM's Raila Odinga, has this evening declared that he will not recognise the purported re-election of President Kibaki.

Instead, Raila has announced that his party has called a public rally scheduled for Uhuru Park at 2pm tomorrow 31st December 2007. This was annouced in a press conference at the ODM Presidential Campaign Centre in Upper Hill Nairobi where Raila also indicated that the rally was meant to show the world "who really was elected as Kenya's president" in the concluded polls.

It is instructive to note that Raila has on several occasions warned Kibaki and the PNU that the ODM shall not accept any poll rigging and should the PNU resort to manipulating the electoral process, it shall be met with greater and sustained resistance.

EU and AU observers, who were earlier manhandled and thrown out of KICC by armed paramilitary personnel, have already cast serious aspersions on the Kenyan electoral process, moreso because of Kivuitu's suspicious mode of declaring Kibaki as president and Kibaki's hurriedly arranged swearing-in ceremony. The election observer team, reputed to be the largest to be dispatched anywhere around the globe, fell short of endorsing the Raila presidency and it is suspected some of them may find their way to Uhuru Park tomorrow afternoon.

Without a (sworn) cabinet in place, Kibaki may be tempted to declare a state of emergency in order to bring the country to manageable level but this will paralyze social, economic and political activities. This will certainly not argur well for government parliamentary business for his fragile and battered coalition.

  3. A statement from the US embassy said: “We ask all candidates to accept the Commission’s final results and to urge their supporters to reject violence and respect the rule of law. Regardless of the eventual winners of this election, we call on Kenyans across the political spectrum to work together to advance democracy and national development.’’

    It praised Kenyans for conducting peaceful elections and condemned the cases of violence.
    According to the statement, the ECK did a perfect job and will give Kenyans the president they want.

    A US Embassy official, Mr Thomas J. Dowling, called for patience until the commission announces the results and said any concerns about the elections should be addressed to the Electoral Commission.

    The US government released another statement from New York, urging Kenyans to accept the final election results calmly, saying it had “great confidence” in the ECK and its chairman, Samuel Kivuitu.
    State Department spokesman Tom Casey hailed Kenyans for the “largely peaceful and orderly voting.”

    “But,” he added, “we share the Commission’s concerns about reporting delays that have slowed tabulation of final election results.”

    A statement by British Foreign Secretary Mr David Milliban and Secretary of State for International Development Mr Douglas Alexander said: “We are disturbed at the violence surrounding the elections. The British government calls for an end to the violence, respect for the democratic process and for all Kenya’s political leaders to act responsibly.

    “This is a pivotal moment for Kenya. It is vital that the entire election process meets the expectations of the Kenyan electorate.”

    Meanwhile, the National Convention Executive Council, NCEC expressed shock over the incidents of violence and looting that took place in Kisumu, Eldoret, Kericho, Mombasa and Nairobi.

    NCEC admonished ECK for incompetence and being sources of delay in releasing elections results.
    “NCEC finds it irresponsible, reckless and tantamount to incitement for the top leadership of both ODM and PNU to purport to announce their individual results.

    “It is an unfortunate and embarrassing for this country that leaders can be that greedy and hungry for political power to the extent of gambling with people’s lives.

    It said that all electoral irregularities and complaints lodged with the ECK by the aggrieved parties must be thoroughly investigated within the shortest time possible and justice done satisfactorily.

    “Since the electoral laws do not give a defined limit for the hearing of petitions, there should not be a situation where a case goes on in court for years before it is determined.”

  4. One thing was clear before the results were published. Both sides indicated that if the other was pronounced the winner by the ECK, they would concede, but it seems to be quite the contrary. If ODM disapproves the ECK results, they should contest them through the judicial system. Inciting violence is not the way forward!

  6. I'm a Kikuyu and i voted for Raila because I wanted change. It's just unfortunate that we shall not be able to watch the swearing in of Raila's parallel government tomorrow because I doubt whether Michuki will have lifted the Ban on the media.

    Clinton once wanted to meet the new president of kenya who abolished school fees? maybe he should come and see the same president steal power so shamelessly and ban media broadcasts.

    Guys out there reading please tell me what the swearing in of Raila will mean? There's something i don't understand. How does a parallel government run?

  15. For those of you who say that Raila should respect the result and contest it in courts, do you think the Judicial system will be fair in these kinds of hearings? If Kibaki was willing to rig the elections at such great expense of throwing Kenya into a police state/state of chaos, do you think he will allow the courts to overturn the elections results in an amicable way? Think again. The only way out is civil unrest. It might result in casualties but sometimes that is the price a nation will have to pay to ensure democracy and fairness!

    I have always respected you as an important kenyan figure. I was also thinking about sending my book, which is an anthropological study of the street children in kenya, to you so that you may consider it for publishing. But now I guess I will let my university publish it as was planned.
    You have totally dissapointed me by condoning violence.
    In as much as i hate this rigging and its perpetrators, I would like to condemn violence in all its forms, especially based on ethnic chauvinism.

Kibaki ammased 25% in five provinces, so was raila, the only thing that one required was a win. even a single vote could have saddled him to State House.   51. Kivuitu said there was suspicious activity coming From both ODM and PNU. Why are people only talking about PNU rigging. In Alego the winning MP got 99.3%, in another Western constituency one candidate got 0 votes ( didn't even vote For himselF? Unlikely!)
    both PNU and ODM are all recycled crooks, hooligans and thieves. they all with very Few exceptions have been corrupt. IF one crook steals From another one I don't care because belive me those ODM holier than thou twerps were not going to to nada diFFerent. Many oF them are where they are because they had a connection with another crook.
    There is no change these people would have brought do not be deceived!
    I am also concerned at what would have happened to kikuyus when the Luo/Kalengin rich ODM takes over. these are two tribes that HATE kikuyus bitterly. No one has addressed that concern. Already the casualties who are standing out as reported in this blog are....Kikuyus.
    Imagine a situation where ODM Formed a govt with only kikuyus in the opposition. SCARY!

    1. Credible observers are casting doubts,
    2. Tallied results are not Tallying,
    3. Loser is not conceding,
    4. Recall the colorful mid-morning swearing ceremonies?

    I insist that a a free-and-fair election must not only be free-and fair, but must also be see to be so.

    So, let's all quit the bickering and address the facts that are blazingly glaring at us. Let's try to objective.

  64. There is a lot of to-and-fro bickering here that does not help the very serios situation on the ground. Each of us has an opinion of what happened with the just concluded electoral process in Kenya. Any non-partisan view would agree that the process was not seen to be concluded fairly. This especially in a situaton where the difference in votes between RAO and MK was very small. While the letter of law states that the winner by whatever margin should be declared, the ECK failed to recognize that by hastily announcing the results, over 4.5m Kenyans felt cheated. It is the delicateness of this process that required that all concerned parties bend over backwards to ensure that the process is seen to be fair. This did not happen.

    Now to the future, yes, MK may rule Kenya for the next five years. It should be remembered that in the next 5 years more millions of kenyas will be of votting age. These past few days they witnessed what happened and will remember this next time. While it is possible to massage results where the difference is small, it will not be possible to do so where the difference is in the millions. Kenya will get its hero whether Derek, Vikii, Deroo or anyone in this blog likes it or not. I dare say that there are even more people of Gema who today decided that they will not again vote the way they did, on tribal basis. They will not want to align themselves to a party known to grab power through un-democratic means. As one blogger here said, let us all take a deep breath and think. We must all arise from tribal politics that some peopole here preach.

Guns cannot pacify a people who think that votes were topped up to ensure legitimacy of a prefered canditate!

  67. Although I am no longer proud to be a Kenyan, I totally agree with the standard statement.

    That Kibaki stole the elections is obvious. That Kibaki will find it hard to be welcomed anywhere except Central and Eastern is another fact. That Raila is the legitimate president of Kenyan is also a fact.

    But now what? Burn the country? No. Please pray for peace. Look at Somalia, Rwanda, Ivory coast and the likes. We don't want to be like that. Lets protest but only peacefully. Let peace prevail. Kenya is bigger than any individual.

    Britain has appealed to Kenyan politicians to avoid further bloodshed after its president was re-elected in a poll marred by violence over accusations of vote rigging on both sides.

    Foreign Secretary David Miliband said he had "real concerns" about reported irregularities which have sparked violent protests that have left at least 15 people dead.

    Mwai Kibaki was sworn in after being declared the victor over rival Raila Odinga who immediately rejected the result, leading to further clashes.

    In a joint statement with International Development Secretary Douglas Alexander, Mr Miliband said: "This is a pivotal moment for Kenya, a time when the democratic process and election outcome has to be seen to be fair in the eyes of the Kenyan people.

    "We congratulate Kenyan voters for conducting their vote in an orderly and dignified manner. But we have real concerns at the irregularities reported by the EU observers and others.

    "We call on all Kenya's political leaders and democratic institutions to work together to address those concerns, seriously, in a spirit of unity, and in a way which will bring the respect and support of the Kenyan people.

    "Those leaders must also ensure the safety of Kenya's people - the tragic deaths this weekend have marred an otherwise peaceful election.

    "That violence must not be repeated. We urge all sides to pursue their disputes peacefully through dialogue and the appeals process."

    They went on: "Britain looks forward to working with a legitimately elected government of Kenya, which commands the support of the Kenyan people and which wants to advance the economic, social and democratic interests of the people of Kenya.

    "We will be discussing ways forward with our European and other partners in the coming weeks."

  71. The day Kenyan people will wake up one morning and think they are Kenyans, will be the day they will start thinking what neo-colonialsm is doing in Kenya at the moment.
    As my friend from the Caribbean told me, black people suffers from the effects of slavery, colonialism and it high time "21st century" that we address this issues and stop thinking Jaluo, Kikuyu, Kalenjin, Kamba, Kisii the list goes on to Ibo`s and Zulus etc.
    Election only took a day, and the stupidness of uneducated in Kenya sorry to say and Intelectuals abroad have been compromised by two people. Kibaki and Raila "millionaires" They are now spilling poor peoples blood for their own selfihness, greed and power hunger. What do you think they want to accomplish? Protect their ill gotten wealth some of which have been stashed in foreign banks (safe deposits) while poor Kibera voters slaughter one another and others in Eldoret and nyanza burn their loved neighbours houses because they are from different tribes. And as we speak, kibaki and Raila are tossing champagne and shouting loud "cheers". They all go to bed together. These guys are crooks, i quote John Kerry when Bush was declared the USA President the second time. After rigging Florida votes where his brother was Governor.

    KENYANS, I PLEAD WITH YOU. LET US WORK, STUDY AND GO BACK TO KENYA AND DEVELOP OUR NATION. KIBAKI IS 76 YRS come on, RAILA 62 YEARS hihi getting there, PLEASE GIVE ME A BREAK. These people have never experienced poverty and the people dying are hardly 30 years old. ARE WE BUILDING OR DESTROYING OUR FUTURE?
    These guys are senile, and the reason i`m saying that is because of the lifestyle they have. Ordinary Kenyans should come together as brothers and sisters and oust these guys out of office and out of our way and take charge of our country.

    They have so much money; they can live wherever they want without in this world without working until they die.

    It’s right to keep each one of us in Diaspora who has access to our beloved web “”jaluo.com’’.As you know we are all astonished with the self declaration of Jaraboun’s win.What I can say is that some of the reliable source back from home says that, the peoples President is not locked in and his fellows like Ruto and Orengo Jimy is also not in,they are all expected to hold THE PEOPLE’S PRESIDENDT INAGURATION at the venue that have not been mentioned at 2pm, so far it is that the deaths fom Dagoreti.Mathare, Kariobangi, Kayole and some other estates in Nairobi may be 50 in number’s there have been fights through out the night since Kibaki imposed him self yesterday .The forces are also devide and this is said to couse more havoc scince the majority of the foces are wakale and this are pro Aguambo. Otherwiase this is the time when force should be implemented to achieve the demand of the people as it is said when diplomacy fails Force should be implied, the reasone why am saying this is for the reason that the Court will not solve this situation and if some body is thinking of international community this still will fail couse Okuche as you know they are nincompups who do not look at this as a national concern but away of making more “”Mbesha”” .this is way I say lets find a way of making use of our forces THIS IS THE ONLY WAY OUT.
